NH Homeowner Arrested for Firing Warning Shot During Burglary

A New Hampshire man stumbled upon the terrifying sight of a burglary in process in his home, and took decisive action with a firearm, but now he could face years in jail for foiling the robbery.
Foxnews.com has the details of the incident which already has 2nd Amendment advocates up in arms:
“Dennis Fleming, 61, of Farmington, was arrested for reckless conduct after the Saturday incident at his 19th century farmhouse. The single grandfather had returned home to find that his home had been burglarized and spotted Joseph Hebert, 27, climbing out of a window at a neighbor’s home. Fleming said he yelled “Freeze!” before firing his gun into the ground, then held Hebert at gunpoint until police arrived.”
Sounds like a good outcome to most, doesn’t it? Apparently not to New Hampshire police.
Despite the fact that no one was injured in the incident– and the fact that the New Hampshire legislature is considering passage of a version of the “castle doctrine”– two arrests were made at the scene.
Fleming has a logical explanation for his actions, as he told Foxnews.com that ”I didn’t think I could handle this guy physically, so I fired into the ground. He stopped. He knew I was serious. I was angry … and I was worried that this guy was going to come after me.”
For foiling the robbery of his home, and defending himself from possibly imminent harm if the burglar was armed, Fleming faces a similar prison sentence to the person who he claims was invading his home.
While state authorities consider whether Fleming acted within New Hampshire statutes for the protection of life and property, Fleming remains very worried about the possible outcome.
“I have 14 grandchildren, I don’t want to be a felon and go to jail,” he told Fox. “I’m kind of wound up about it.”
Fleming’s seven rifles and his .38 caliber handgun have already been seized by police.
Some New Hampshire locals are already letting it be known that charges against Fleming would be a total affront to the right to bear arms and basic common sense.
Penny Dean, a spokeswoman for the Gun Owners of New Hampshire, has claimed her organization is “absolutely outraged.”

Except in tyrannical/authoritarian regimes around the world (and in some parts of the supposed United States of America), a person defending their own lives with a firearm by shooting their attacker is safe from the law, even if the defended against attacker dies, because the motives of the defender were not the attacker’s death, but just the attackers cessation of attacks. You shoot to stop. You do not shoot to kill. If you shoot to kill, the law generally does get a hardon for prosecuting you.
In a few of those regimes where it is okay for a person to shoot to stop an attack on themselves, they are also legally immune for shooting to stop an attack on someone else. Some restrict this defense of others to close family members, others allow friends and acquaintances, others allow lethal force in defense of complete strangers. The legal right to defend the lives of others, regardless of familiarity should be assumed as the default, and any jurisdiction which disagrees with that is in error.
In fewer still, a defender is legally immune from consequences for using lethal force to defend property, with a similar “your own/someone else’s” dichotomy. I think specificly of the Texas burglary after dark statutes.

This makes the situation much less legally ambiguous for the mental midgets in the prosecutor’s office and the police officers on the scene. And makes there job of making the life of the defender harder than the criminal class already had.
If the political ruling classes don’t like the scenario I just outlined above, they have only themselves to blame. Adopt a comprehensive castle doctrine and people defending themselves from or preventing criminality against themselves have less incentive to “take the law into their own hands”. If the law would do its job at dealing with criminals, then fewer regular folk would find it necessary to deal with criminals themselves.
I’ve even personally witnessed hypothetical discussions between gun owning homeowners and area police about when it is legally permissible to fire on a home invader where the “authority” admonished that if they shoot the criminal outside of their home’s walls, to drag the skel back inside. That is the best way for the authorities to not have to arrest the homeowner, which, frankly, the good cops never want to do in the first place.

There is a book store on Amazon I buy books from that now will not get any business from me – same goes for e-bay. You would do time for this in California for sure. Its a shame that criminals can run rampant and right through your home. But you can‘t chase them down after they’ve left and then fire at them or fire into the ground because thats the same. I’m not for what happened to this guy but you gotta know the local gun laws before you pull that thing out. This is one of those instances. If the criminal is in your home you have every right to stop him, but climbing out of the window of a neighboring home…eh? Call the cops! Get a good description, shadow him at a distance and stay on the phone to give details. No sense in going to jail with the guy!

Report Post »The gun owner in this story did everything right. He alerted authoritys approached the criminal shot into the ground where the projectile had no chance of falling and hitting an innocent person. Making the burgler fully aware that he meant business without shooting the burgler.
The government problem is they don’t want people to be self suffienent they want a society helplessly dependent on them.
The man should demand a Jury trial and I can guarantee the jury will nullify this statute and set a case law for future citizens proptection from the Government.

There is no SANE reason why charges should be brought. If charges are brought I agree HANG THE PROSECUTOR. We cannot continue to play with these idiots who refuse to listen to reason and feel that they know better than we do in such a situation or that they know better than the Declaration and Constitution guaranteed us. Just as I believe it is time to stop playing with murderers, rapists and child abductors/abusers we need to stop playing with these government lackies that feel their idea of law is better that our guaranteed rights. Constantly the rights of citizens get trampled into the dirt and the recourse we have is limited at best. Look at Eric Holder’s actions and the actions of his team. They won’t receive any sort of punishment for fast and furious. The whole thing will just be a dog and pony show so everyone can cater to their parties of interest on both sides, then it will just fade away.
At some point trampling on the people should result in a broken leg. After all they have set the precedent of “over-the-top” penalties upon us not being aligned with perceived crime. For the victim at his age to be arrested and stewing over serving years in jail for defending himself and property. The system is broke; financially, intellectually, and morally. At some point something will have to give. It did in 1776.

Would have been better off having the man cough up the stuff he stoled and told him never to come back, only to burglurize someone else and who know what else could happen if he thinks he can steal with inpunity. I don’t want to jump the gun on the cops who arrested the man, although, you would hope they could have sided with the owner of this place. If it comes down to it we need to vote the bums out of office that are preventing law abiding citizens from protecting themselves. With crime going up it’s no wonder why people are staying closer to their guns. It’s getting scarry and dangerous. Do you know how many gangs there are out there and drugs are rampant. The drug war is lost and gangs are gaining in numbers as our economy continues to tank.

Posted on February 22, 2012 at 5:57amA few of you guys allege that New Hampshire is a liberal state with whacky gun laws. I live here – the truth is that it’s not. Open carry requires no permit. My concealed permit is a small piece of paper. I went down to my local police station and paid $10, and they filled out the carbon copy paper, tore it off, and said, “here you go.” We’re a “shall issue” state, too. There’s virtually no limit to what you can have or carry here. No state statutes specify any limits to weapon types, capacity, etc. When you buy a firearm, you only have to fill out the federal paperwork. What’s more, you can carry just about anywhere.
This state is traditionally very conservative (in a unique, New England way), but there’s an increasingly liberal influx from the Commonwealth to the south. Maine and Vermont are suffering the same plight. (Maine below the “Volvo Belt” that is)
I’m trying to find the statute and quote it, but I’m pressed for time. Basically, our state law says that deadly force is justifiable when the criminal is invading your home or on the area immediately around your home attempting to enter illegally. (Very loose paraphrase. Sorry) It gets kind of dicey when you’re outside your home and the guy is coming out of your home, because then I suppose he legally poses no immediate threat. Even though I read the laws myself, my local cop explained this technicality to me when I applied for a permit.
Could the laws be better? Yeah, sure.

Only problem is civil litigation with burglar sueing home owner, not much chance of collecting in most courts.

Posted on February 21, 2012 at 7:03pmIf you produce a firearm do so to use it. Do NOT try to intimidate, do not try to warn, If you pull a gun use it to stop the threat PERIOD! To do any thing else other than using it to stop the threat is going to get you in more trouble. The threat can take the weapon and turn it against you, they could use their own weapon on you then there are the local authorities who look down on throwing lead in the air to scare someone.
Make sure of your local laws and especially any “Castle Doctrine” laws first, Better still get out of the Communist dominated North East. Texas is nice any time of year.

Talk to any lawyer who handles gun cases, though, and he’ll tell you never fire a warning shot. That’s Hollywood ****. You either shoot the guy or you don’t. In this case if he was outside the guy’s house he had to legal cause to shoot him. Castle Doctrines protect you in your home, car or business, not outside in most cases.
Draw down on the guy and if he comes at you, plant a couple rounds center mass.

Not that I am defending the criminal, but laws are laws. It is kind of like illegals coming into our Country but we have laws that say they cannot enter illegally but we let them get away with breaking the law. You must know local and state laws before using a firearm to thwart a perceived crime. Many states/localities do not permit citizens to intervene with deadly force. For example, here in the People’s Republik of New Jersey citizens are obliged to retreat until there is no more escape available before they consider deadly force. You can‘t simply dispatch a burglar just because they’re in your house. And you damned sure can’t fire your gun (ANY discharge of a firearm is illegal in my township) just because you wanted to impress an imagined burglar exiting a neighbor’s house. I feel for this fella but he made a couple of real big mistakes here. I hope sane heads prevail but I’d be willing to bet that his firearm owning days are behind him now.
Is any of this right? He!! no, but it is reality. Instead of tilting against windmills we need to work to change the damage the lib/progs have done over the last 60 years. Know your local laws!
