NH School Confiscates Autistic Boy’s American Flag: ‘Considered a Weapon’

DOVER, N.H. (The Blaze/AP) — A New Hampshire woman is upset that middle school officials confiscated her autistic son’s American flag because the rod it was attached to was deemed a safety hazard and, the mother claims, a possible “weapon.”
Theresa Stevens, of Dover, says her 12-year-old son, Shawn, brought the small flag to school to show friends. He had received it as a gift from a family friend whose son is in Afghanistan.
“When he saw how upset the mother of this boy is that’s going to Afghanistan, he wanted to do everything in his power to show support for her son,” Mrs. Stevens told WMUR-TV:
“He wants to bring patriotism back one person at a time, starting with his peer group and adults that have lost their way,” she added.
Stevens says a school official called Wednesday to say that school workers were concerned that the rod’s pointed end could have been dangerous.
“I got the phone call at 8:30 [Wednesday] morning,” she said. “‘This flag needs to be immediately removed from school because it can be considered a weapon.‘ I don’t understand how an American flag can be considered a weapon.”
Dover Middle school Co-Principal Kimberly Lyndes told Fosters Daily Democrat it wasn’t about discipline or patriotism, but about safety.
“A student came to school yesterday with a flag that was rather large and didn’t fit inside the backpack,” she added to WMUR. “A staff member felt that it could potentially be dangerous because of the pointy end and took the item and let the student know and the parent know that they took the item and could pick it up.”
The boy was not disciplined in the matter.
Stevens says she wants her son to know he did nothing wrong. She says students routinely carry around sharp-tipped items, such as compasses and pencils.
“So can pencils, so can protractors, so can any of the school supplies that they give to these children, and their stance is, ‘Well, we don’t let them wave them around in class, and your son has autism,’” Stevens told the station. “Really? That’s your stance?”
“When somebody shows up with an American flag on American soil at an American school, that’s his First Amendment right to do so,” she added. “Just because he‘s 12 doesn’t mean he doesn’t have constitutional rights.”

children should be raised in foam padded buildings, never be allowed to be near hard or sharp objects, wear helmets 24/7 and have all there food pureed in a blender to prevent choking…. sure they may end up fat and soft like veal but at least they will be safe….

A middle school takes away a long pointy stick from an autistic kid because they are afraid he will hurt someone. Look at how the kid is holding the flag in the video! At eye level like a lance! Take a look at 1:20, when he’s pointing the thing right at the camera lens!
Now, if your kid was in that school and got poked in the eye and even half-blinded by this kid, accident or otherwise, would you think “gee, I would be upset, but since it was an American flag, I guess he had every right….” really folks, don’t be so stupid. Venting your pointless outrage at what was a very reasonable safety decision just demonstrates how completely empty and reactionary your understanding of patriotism is.

They took prayer out of the public schools and look whats happen to public school systems, public schools are inferior for a reason. And besides, we don‘t know how this kid’s autism manifests itself–taking someone from the child and then putting it up on a wall where he can see it but it would be out of his reach might just be cruel. Posted on September 16, 2011 at 2:50pmLook folks, we’re getting most of the story of what happened from the mother who is relating what the autistic kid said he was doing with the flag on the bus. Does anyone think this is a completely reliable account of the situation? Kid’s lie all the time, and parents lie about their kids all the time. It’s entirely possible that the kid was poking or hitting someone with it, or otherwise waving it around in a way that it could hurt someone. We don’t know–the nurse made a judgment call to stop kids from getting hurt.
And it’s NOT the responsibility of the school officials to MacGuyver up some way to make the flag non-threatening like The-Monk stupidly suggested. In fact, given the supposed story behind this particular flag, taking it off its original rod would seem like wanton distruction of an item with a lot of sentimental value.
Frankly, this Mom is incompetent and apparently has no regard for the safety of anyone else’s kids. If someone was going to make the flag “safe,” she should have done it, rather than sending her autistic son off on the bus with a foot-long pointy spear. The fact that she thinks its a first amendment issue rather than a very clear safety issue just reinforces the point that she is an unfit parent.
I notice none of you chest-thumpers have responded to Kindling’s post about his/her own autistic child–I love how you Blazers just ignore informed arguments when you have no way to counter them.

Posted on September 16, 2011 at 3:01pmOkay, I’ll respond to the lady with the autistic child. I have two autistic children. I would trust them not to poke anyone’s eye out with them. I would worry that they might disrespect the flag. There is a saying in autism circles. If you have met one person with autism, you have met one person with autism. They are all different and unique. Your experience with one does not correlate with how another person with autism will react. If this child has been mainstreamed, he is probably very high functioning. His autism should not be a cause for alarm unless he has previously presented issues. If he had, I doubt he would be mainstreamed.

And if someone looked like they were in danger of stabbing someone in the eye with a pencil, and you were the authority figure supposed to look after the kids, wouldn’t you take it away? And Wolf, I’m sure some of them do wear belts–now if one of the students were to take off his belt and swing it around at the risk of hitting someone, what would you do as an authority figure?

Fair enough that we can’t necessarily generalize about autistic children, which is why we should probably trust the judgement of the nurse ON THE SCENE and who probably knows the kid. My mother worked in special ed. for years as an aide for autistic children in regular classrooms.
But OK–I have a story too. One day, the kid she was helping started flailing around with a pencil in his hand, and accidently stabbed her in the eye. Of course, the kid needs to use pencils, you know, for learning; so there was no reason why he shouldn’t have pencils. I am glad, however, that he was not holding a pointy stick three times as long when he jabbed her in the eye.
If the kid brought a different two foot long pointy stick to class, and was in danger of poking someone with it, it would be a non-issue if the nurse took it away. Putting a flag on something does not mean all rules are suspended.

Unlike this boy my daughter doesn’t talk or communicate so we have no idea what is wrong or why. DO you think we should punish them and take everything away from them all the time. The teacher could have told the boy that the tip is very sharp and could hurt someone and to put it in the backpack just to be safe. And you could have left the backpack partly open. They understand My daughter does even if she can’t communicate. IF it was a safety issue there are many more ways to handle this than to not allow the American Flag. I have seen kids and teachers at schools wearing Che Guevara t-shirts saying he was a freedom fighter when infact he was a terrorist and murderer. So were is the freedom for this boy…oh everyone else can have their 1st amendment rights but not special needs children. I don’t care what your beliefs are Everyone has the constitutional right to free speech and expression.

Posted on September 17, 2011 at 8:54amI have a high functioning autistic child, and I would not be afraid of him taking a flag to school. I wouldn’t be afraid of him having sharp objects. He’s now 21 and helps me cook. Autism is not always rain man, or severe. Autism is an inability to process one’s senses correctly, or a rigid adherance to routines. It doesn‘t mean he’s violent or going to try and see what will happen if he pushes a stick through the principal or another student. If they had a rule that NO FLAGS ON STICKS were allowed, possibly, but if it’s just because it could be considered a weapon, better take all the pencils away. When I was in the 6th grade, we had a boy that looking back was probably autistic, and he tried to stab the principal with a protractor, kicked him him the cajones and ran away.

Since it that case it could no longer cause a safety hazard, if the school confiscates the flag again, you would then have a clear-cut 1st amendment issue. As simple as that.

Unless we got a special tutor/teacher who specializes in autism and we paid for their salary then we could home school our daughter. While we are comfortable and able to afford our children (we have 4) we could not afford to hire a special ed teacher to “home” school our daughter. By the way if we could have she would still have to be taught exactly as if she were in public school which in my opinion wouldn’t have been any better at least she gets the social aspects in public school.

The school is just using this as an excuse for what’s most likely the real reason:
They don’t like the kid with Autism and (fair or not) think he’s going to do something stupid or violent with it. They most likely see him with the typical condescending Liberal sympathy and didn’t want him having anything he could wave around at school.
I don’t know if the kid has any history of this type of behavior, but they are definitely giving him the typical ‘protect you from yourself’ liberal treatment. The whole reason why this school‘s story doesn’t pass the smell test is because its bull. Unwilling to admit their predisposition to a student, they hide behind a weapons excuse.

Yes they can be a danger to themselves and others, but to take away their freedom of expression is wrong. I can see if he was running around the classroom and using it as a sword the teacher then has a right but from what I got from the report he was waving it showing PRIDE IN AMERICA not using it in a threatening fashion. By the way with an autistic child if they are going to hurt themselves or others you have warning signs trust me I have an autistic daughter I know as do her teachers, siblings and our friends. And she listens to other adults perfectly fine. They understand you just have to explain it to them.

Safety starts when people want to be part of society; Not by proscribing objects.
Safety comes from within. If a person wants to be a part of society he can be by any number of objects and he won;t use them to harm anyone.
I think that teachers need as high of college entrance scores as science majors to get into college. It would go a long way to getting rid of stupid teachers and raising their salary levels.

Posted on September 16, 2011 at 10:45amBased on the school’s twisted reasoning, all pencils and pens should be confiscated. Give every child a miniature chalkboard and a box of chalk. You really have to go out of your way to be this stupid, or so fearful of a lawsuit that you act irrationally, by confiscating a child’s flag.
