NLRB Under Fire for Leaking Confidential Info

NLRB Under Fire for Leaking Confidential InfoTerence Flynn, a Republican member of the National Labor Relations Board (NLRB), has been accused of leaking internal information to two former NLRB board members, according to an Inspector General report released Friday.

Flynn began working at the NLRB in 2004, was nominated to the board by President Obama in Jan. 2011, and was given a recess appointment in Jan. 2012, according to Ryan J. Reilly of Talking Points Memo.

Flynn allegedly gave the former NLRB members information regarding the status of pending cases and information pertaining to how NLRB members were expected to vote, according to the report authored by NLRB Inspector General David Berry and released by Rep. George Miller (D-CA), the ranking member of the House Education and the Workforce Committee.

The report claims Flynn “knew, or should have know, that he had a duty to maintain the confidence of the information that he received in the performance of his official duties.”

Flynn allegedly gave information to Peter Kirsanow, outside counsel for the National Association of Manufacturers and Peter Schaumber, who serves as co-chairman for Mitt Romney’s labor advisory team, Ryan J. Reilly of Talking Points Memo reports.

Kirsanow denies the charges, telling the Wall Street Journal that he “received no inside information whatsoever.”

Schaumber has given no comment.

Rep. John Kline (R-MN), chairman of the U.S. House Committee on Education and the Workforce, said in a statement that this is just another reason why President Obama shouldn’t have made recess appointments to the board.

“Three individuals now sit on the National Labor Relations Board, despite never participating in a public hearing, and in some cases, sidestepping the traditional confirmation process altogether,” Kline said.

“The Senate’s vetting process provides an important forum to raise and address allegations of misconduct before someone is elevated to a position of public trust. Both President Obama and Senate Democrats allowed partisan politics to obstruct the public’s right to examine the backgrounds of these individuals. This report illustrates the vital importance of the constitutional confirmation process,” he added.

AFL-CIO President Richard Trumka has weighed in on the matter and is calling for Flynn’s resignation.

“Even for an agency that has at times been highly politicized, these unethical practices are unprecedented and indefensible. NLRB member Flynn should resign immediately. The Department of Justice should quickly investigate and bring criminal charges if violations are found,” Trumka said in a statement.

    when these positions were filled
    not following the proper protocols
    why are they(Congress) not challenging this and other decisions made by obama
    taking the potus to task on sidestepping the rules and regs concerning these appointments…
    should we then by example sidestep rules and regs
    that are not convenient to us as well
    seems to me the potus leads by example and
    we should all follow his lead and
    fail to follow the rules and regs we feel are not in our best interest as well
    sorta situational ethical rationalization on mass scale
    at the lead of the potus
    If we all do as the potus does
    this would instill the very anarchy he and his co-anarchists so believe in …RIGHT?
    So where is the leadership in the House and the Senate concerning these illegal appointments?
    Do your jobs for once and stand up to this dictator in chief…or step down! You are an embarrassment to the country!

      Unfortunately, it appears there is not a single person in our government that will stand up to this muslim dictator-wanna-be in OUR White House. He should have been arrested long ago when he began going around The Constitution and virtually breaking the law, but no one seems to have the kajones to do so. Why do you think he’s so smug? He knows he controls the country and pretty much everything in it. He knows that he is either going to win the next election, or suspend it so he can remain in office. And he knows no one will do a thing about it!

      God help us if we don’t put a stop to this crap pretty soon.

      Good post! All the crazy news going on and then…..just a few minutes ago….a “ray of common sense/sensibility”…..Fox News had a conversation with…Amb. John Bolton. There are very few “powerful”, past/present/future individuals that I admire but Amb. John Bolton is “very genuine”. When he speaks, it is from his heart and “no-smoke-screens” and he has such a calming voice of reason. God broke the mold when he made Amb.John Bolton!

      Reuters search engine sucks. I could search for Putin or Soros but not both.

      I would like to see it in the Daily Mail, Telegraph or some other large newspaper.

    Struck me as if someone was leaking intelligence from the NSA when I first started to read this. Trumka, and cronies really want to maintain as much cover as possible. Frankly, we need more and more info to come out regarding the NLRB and this is one of those committees that should be as transparent as glass when it comes to the public’s concern.

    Flynn might be a RHINO but no way could he be a true Republican and barry put him on the Board. Guess they have someone new they want to give the job to so they will ‘leak’ and ‘toss’ Flynn and annoint someone else ! Flynn was ‘nominated’ in 2011 but was only APPOINTED to the job in Jan.2012…..I guess 2 months was enough for him…..throw him out and give that chair to someone who can bundle campaign money !!!!

      Obama put him in January 2012, now in March he’s being accused of leaking information….hmmm…seems to me to be a set-up. Really, what the ……, were they wirer taping him or what? Talking to 2 previous members…was the guy asking advice on how this are suppose to go?

      I was watching “The Good wife” this week where she had to sit on a board….the board was just rubber stamping.

      I think this guy didn’t realize he was a token Republican. He was probably trying to do his job and fulfill his oath of service. He must have slipped on an “Obamana-peel” (fruit, similiar to a banana), while trying to investigate something against the gangster, “Trumpka”.

    Isn’t Flynn the only Rebuplican on the NLRB? As stated before, EPA needs to go first, then second would be the NLRB. Are they calling for an investigation due to Flynn’s background or just to stir the waters and make sure that Boeing and other companies hesitate to try to open business in right to work states? Sadly, nothing this administration does anymore surprises me. I hope that everyone who voted Obama and his regime into office finally realize what they have done to our once great country.

    This is reason enough for me to think that Terence Flynn is innocent. A sad reflection of the times we live in. If a Union mobster wants Terence Flynn taken out of the way Flynn must be doing something right.
