‘No Amendment is Absolute’: Chuck Schumer Complains About the First Amendment on Senate Floor

Chuck Schumer is the last person in the United States Senate who you would expect to denounce the first amendment, especially considering the length his speeches usually get to. However, that’s exactly what Mr. Schumer did today, taking to the Senate floor to support the draconian campaign finance law known as the DISCLOSE Act with a speech that included the following very odd statement:

Here‘s the transcript of Schumer’s remarks, from RealClearPolitics:

 SEN. Chuck Schumer (D-NY) on the DISCLOSE Act: “I believe there ought to be limits because the First Amendment is not absolute. No amendment is absolute. You can’t scream ‘fire’ falsely in a crowded theater. We have libel laws. We have anti-pornography laws. All of those are limits on the First Amendment. Well, what could be more important than the wellspring of our democracy? And certain limits on First Amendment rights that if left unfettered, destroy the equality — any semblance of equality in our democracy — of course would be allowed by the Constitution.”

“And the new theorists on the Supreme Court who don’t believe that, I am not sure where their motivation comes from, but they are just so wrong. They are just so wrong.”

Now, let’s parse some of this, because Schumer is disguising a non sequitur as an argument. And as it happens, he gets only one thing right in this speech – namely, that there are limits on the First Amendment. Justices from Antonin Scalia on backwards have all accepted that the Founders never meant for that concept to be applied with absolute force, though there is also the matter that the Founders expected states to decide what forms of speech were and weren’t acceptable, not the Federal government. However, it is still technically true that the exceptions Schumer describes exist.

But are they actually part of the Constitution, or were they intended? Debatable. Anti-obscenity laws (the “anti-pornography laws” to which Schumer refers) have yet to be litigated before the Supreme Court at the Federal level,  and the same goes for defamation (“libel”) laws, which are also enforced on a state-by-state basis. So those two exceptions don‘t particularly help Schumer’s case for campaign finance, because they would have been irrelevant to the Founders’ concept of Federal power, and don’t implicate questions of Federal power even today.

But what about the “fire in a crowded theater” exception? Technically, that does refer to a question of Federal power, but once you hear what that Federal power is, you‘ll wish it didn’t. The example of yelling fire in a crowded theater was first invoked by Supreme Court justice Oliver Wendell Holmes in the 1917 case Schenck v. U.S., in a case questioning whether the Federal government could enforce a piece of legislation called the “Anti-Espionage Act” against a socialist agitator named Charles Schenck.

However, Schenck wasn‘t today’s variety of socialist. In fact, he was arguing for something rather akin to what Tea Partiers might be seen as doing by the extreme Left today – that is, asserting one’s rights against an oppressive Federal mandate. That mandate, in this case, was the wartime draft of World War I, instituted by (who else) President Woodrow Wilson. Naturally enough, Wilson‘s government didn’t take kindly to Schenck distributing pamphlets urging citizens to resist the draft, and so they had him arrested. Schenck cried foul and appealed to the Court. This was where Holmes, one of the Court’s noted progressives, came in, writing:

 The most stringent protection of free speech would not protect a man in falsely shouting fire in a theatre and causing a panic. [...] The question in every case is whether the words used are used in such circumstances and are of such a nature as to create a clear and present danger that they will bring about the substantive evils that Congress has a right to prevent.

Now, not only was this standard nowhere in the Constitution, but Holmes didn’t do a particularly strong job of tying the idea of yelling fire in a crowded theater as a First Amendment exception to the idea that speaking against the government in wartime is equivalent. Nevertheless, Holmes was joined in this opinion by the rest of the Court, and so far, this remains the only exception ever granted to the Federal Government regarding when it can step on the First Amendment.

So does Schumer have a leg to stand on comparing this to campaign finance? Definitely not. Not only is he reaching to an insane degree when complaining that “equality” and “democracy” are destroyed by corporate money, but he’s bringing up concerns that never motivated the Founders when they drafted the document. There was no concern on the part of the Founders that people exercise their First Amendment Rights to an equal degree, nor that everyone should even have equal political rights. In fact, this last part is especially true since, as we have repeated ad nauseam, America was never intended to be a democracy, and property owners were originally the only people who could vote.

Which, come to think of it, sounds rather like Schumer’s nightmare dystopia where those with the most property have the loudest voice. Some might consider it highly revealing when a leader of a major political party does not wish to abide by the political system originally envisioned by his country’s Founding Fathers, but as for us, we couldn’t possibly comment.

      Regardless of what you think of Schumer, corporate financing of elections and politics has destroyed any power a person has in those realms. And its not just corporations, just extremely large donations in general, from anyone. Once it hits you that votes are simply bought you realize that the amount of time and energy you spend on politics is a waste of time. May the more funded candidate win.

      @ANOM : Unfortunately you are right. So it is not best to give up. Now we elect people who will fight to break that link between the high donors and the candidates. The way it should be is that NO donations to candidates are legal and the candidate has to win on his merit and what he promises to the people.
      No financial gain should be involved in holding a public office.

      To begin this wave .. I like Rand Paul so far. Others like him will arrive on the scene. Hero’s will be made.

      The right seems missing in more ways than just this. At times it seems the DNC is writing the playbook and the Republicans aren’t kicking the ball but THEY are the ball. Look how they’re treating Romney and letting Obama leave shoe prints all over his face the same way they did McCain. Romney is the RNC pick the same way McCain was the RNC pick. The Republican party old time farts living in the last century need total replacement and need it now. Sorry if you like your Rep. but if you want change for the better, then new blood is needed and not blood from ball less corpses.

      “draconian campaign finance law” Ah yes the intelligent sounding argument that of course seeks to change both the question and context. There is nothing Draconian about having big money interests disclose what political donations they are making. And better yet what lobbyists they are paying to get self serving laws and regulations passed. For all the free thinking individuals who are not being paid to post absurd comments in favor of the US becoming a Commercial State. Its bad enough that our politicians are bought and paid for by the wealthy and large corporations. At least they should have the integrity, honor and guts to disclose who they are buying and what BS propaganda they are spreading. Again, on both sides of the isle. To argue against this is to proclaim yourself as ignorant. There is no rational argument against full disclosure in our government and political process.

      Yes, you could should fire in a crowded theatre, however since the Constitution also endorses property rights, you’ll be held responsible for any damage that occurs. However, if you scream and nobody gets up or panics, then there is nothing that should be done about that, free speech wise. Of course the Statists know that but used this little wedge to create the emotion necessary to get it in the door as the first infringement on free speech in these united States.

      They never let a bad situation go to waste. They are evil and with unlimited ambition. We need to stop speaking to them, even to refute them, while simultaneously cranking up our own understanding of freedom with like minded people. The time for debate has ended, it’s time to draw lines and declare “No further” to these zombies.

      Everything our first Congress tried to avoid has happened – thats why they set term limits. These men knew that power corrupts and attracts the corrupt. I read where Obama will end up with a $$$ billion bucks in his war chest – thats a lot of favors he will owe.When Hillery Clinton ran for the NY Senate seat she spent 100 million $$ – that means she owed a lot of favors. We need laws that would put $$$ limits on those that run for office. How about $10 million to run for president since they are running for the whole country. How about a $ million bucks to run for Congress since they are just running for their district. Right now money come in from across the country and they owe a lot of favors to lobbyest. With limits on how much they spend they could actually work for the people back home. With the current system they have to start running for reelection a month after getting elected. I would like to some kind of limits and only have 3 moinths to run for office before their term expires.

      Okay, I don’t know how many times I have to EXPLAIN this to people…You cannot say corporations cannot contribute to campaigns but it is legal for everyone else to (unions, non-profits, environmental groups, bundlers). This not only violates the first ammendment but the equal protection clause. So either EVERYONE can contribute, or NO ONE can. So we either go to public finance of elections or the system we have now. The freedom supporting way to get money out of politics, is to LIMIT GOVERNMENT POWER! If government cannot over-regulate industries and pick winners and losers through tax breaks and subsidies, there would be no reason for corporations to donate to canidates. It is a matter of personal survival, you donate to the canidate that you believe will not put you out of business. And for those of you who support this STUPID legislation…I will just help my corporate clients to set up non-profits to continue to donate to friendly politicians. There is ALWAYS a way around campaign finance laws (hasn’t history shown you that – hello 501c3′s).

      Obama has a record we can all see 80% of stimulus spending going to democratic backers of his campaign. Placing regulations to make sure his political backers get their money back before tax payers get their money back. 1.4 billion given to fisker to support their plants in Finland. 1.8 BILLION GIVEN TO SUN ONE WHO IMEDIATELY STOPPED PRODUCTION IN THE u.s. and is building a plant in mexico,50 billion given to G.M.     I ran into a neighbor today who use to tout Obama & the Democrats in Congress. Now that she lost her job, & she just found out, per Obama, her husband will be getting less in medical & Social Security next year, she now complains about what is going on. She then wanted me to sympathize with her situation. So I said, “What we have in government today, is just the mentality, commonsense & morality that is a reflection of those that voted for them.”
    The funny thing is, she agreed. So I said, “Who would vote for anyone who is pro-abortion, pro-entitlement, pro-taxes, pro-regulation, pro-anticolonialism, anti-second amendment, anti-Ten Commandments, pro-homosexuality, pro-premarital sex, pro-man/boy love per appoinment to offices (including childcare and education). Mocked the Bible, from the pulpit, and tout’s a Bible, dependant on teleprompters to the point having to stop what they are saying…has outsourced more jobs from this country…but spins created more jobs here, I would have to agree, is an idiot.” I could see the wheel turning as the words began to take hold of what she helped cause. I then said, “So, who are you voting for.” She said she had to go and left, in her ‘Global Warming’ tee-shirt…Oh, and Schumer is a apathetic windbag, that would sell his soul, for a sound bite…and many in Congress probably have.

    Schumer has displayed his belief that the entire Constitution is not an absolute since he was in the House of Representatives. Obviously, before that too. There is a deeper root to these claims now knowing the way this character thinks.

      Indeed, the group of people he is refering to who believe the first amendment must be true and free of any government restraint (i.e. the libel laws the Senator mentioned/or penalty for shouting fire in a crowded building/outright threats/etc.) are known as Absolutists, and in many regards are of the same theme as anarchists.

      To me, the reason Sen Schumer is rialed up over this legislation proposal is simple; he and others have too much dirty laundry and secrets to hide from the public and from the light of day. Always with political figures who act out of the ordinary from their normal habits, look to the bottom line of what they seek to either protect, or to gain for themselves.
