No to Nanny? Kentucky County Repeals Indoor Smoking Ban

Just as New York City extended its smoking ban to include public parks, a county in Kentucky has completely repealed its own ban. It’s a move some are calling a win for individual liberty.
The Campbell County Fiscal Court in Newport, KY voted 3-1 Wednesday night to repeal the city’s indoor smoking ban just two months after it voted to put the ban in place. Opponents of the ban said the decision should be left up to individual, while supporters say repealing the ban will affect the county’s health:
Nky.com reports the meeting was raucous, with one ban opponent even playing dress-up to make his point:
Dr. Robert Tracy told county officials that to strike down the ban would make Campbell County “a backward-looking community.” He added: “We’ll become the butt – and I mean that honestly – the butt of jokes.”
But the majority in the room – some of them offering a standing ovation – won the battle. Many said they didn’t believe studies that showed the harms of secondhand smoke, noting some of them are sponsored by foundations that oppose smoking.
Some criticized doctors and the medical community for taking a position on the issue. Ban critic Charlie Coleman, a county resident for more than 60 years, drew raucous applause when he compared anti-smoking efforts to tactics used by dictators such as Hitler.
Other opponents couched the debate as one between hard-working, blue-collar people and an elitist medical community that seeks to remove liberties of the common workers.
Tim Nolan of Grants Lick wore a white lab coat and called himself “a doctor of liberty.” He told county officials that a vote against the ban would show people: “Campbell County is the true springboard of liberty for the rest of the state.
“I’ve taken the pulse of liberty … it is very, very strong in Campbell County.”

I got tired of having to go outside, standing 15 feet away from the doorand still getting dirty looks. if an owner of a business wants to allow smoking that is their right. I don’t think this will happen here because we have inherited so many Californians and their mission in life is to make my state another CA by tell everyone how to live. thank God for TABOR.

Posted on February 17, 2011 at 1:55pmI graduated undergrad from University of Kentucky in Lexington and they had the STRICTEST smoking bans I’ve ever seen (outside of major cities like NYC)! As a smoker I did not enjoy the laws one iota. It should be the decision of local businesses. At least allow smoking in bars! I’m glad Campbell is liberating themselves. Let’s hope Lexington follows suit!

A little consideration goes a long way on both sides. I choose to smoke and pay the cig tax. Which IMO is unfair at what it costs today.

Report Post »Unfortunately that is not who we are dealing with when talking about smoking bans, or bans in general. For them it is not about consideration or smoking or health, it is about control. You can be considerate, they complain about butts being thrown out of cars…..ugh. If Lantern and Foolsgold manage to get all smoking everywhere banned, it will not be good enough. Soon they will want to ban something else, then something else ad infinitum. Liberty is a mysterious concept to these types….and an anathema.

I’m not for bannng smoking. It doesn’t bother me in one way or the other. See above comments. I don’t smoke, but someone else smoking doesn’t bother me, because I was raised and live in an area that grows tobacco. It DOES, however bother me that some people choose to litter. That is a different topic entirely from smoking. I do not like to live with trash all around, maybe you do.

However a bar or restaraunt can choose to provide no smoking areas properly ventilated. There is a no smoking bar here that was doing well before it was a state wide ban and I say more power to them. The customers will decide what type of business you are and if you fail to listen to them you will be out of business soon.

The business owners had to pay for all this then a year or so later they banned it completely costing the business owners a ton of money. It should be up to the business owner if he/she allows the use of a legal product on his property. I may have to look at moving to Kentucky. Maryland is quickly becoming a nanny state. They are passing an increased tax for alcohol as I speak saying it will deter underage drinking……They are also passing a law that you may not read a txt or email while at a red light. I’m wondering if I can still eat a hotdog or drink a soda when driving. You gotta love the liberals, and they voted Steny back in nov….

However, I could not take living among the trash in Baltimore and surrounding areas. I gave it all up for a job making about half as much and no where near the benefits to move to back to WV. I have to tell you, it was worth it to be back among civilized folks, no regrets here.

They will do it based on projected high demand for smokeless bars and be driven by the profit motive. As long as the action is taken as a free decision by a private business owner(s) in response to free market forces then it’s great. It’s when the government pushes the market in an artificial direction that things start getting mucked up. Freedom, in large part, means freedom from government intervention into our lives and businesses.

Counties don’t have health. Groups don’t have health. Collectives don’t have health. Individuals have health.
Individuals can choose whether to go into a place that allows smoking and avoid the risk, or they can assume the risk as a free person. Employees can choose to work at a place that allows smoking, or they can choose not to.
I’m tired of the collectivization of our beautiful English language.

I’m not so anal that I am going to throw a hissy-fit if I see someone smoking, especially in Kentucky. I live in tobacco country, here in the tri-state of OH-KY-IN. It’s how the folks around here made/make a living and it would be hypocritical of me to be for a ban. Heck, I only live 7 miles from where white burley was discovered.

The owner of the property, which is private property, will have alerted you to the status he/she allows on his/her private property, and you can decide before you ever sit down whether to “risk it” and have somebody sit down next to you who smokes. Hope this clears things up for you a bit.

Your logic shows you’re happy with many aspects of the nanny state, just not those that may affect you. Hence in your world the nanny state is OK to regulate drinking, drugs, no lead in paint and fuel, but not anything else that may offend you sense of entitlement and freedom? Makes complete sense…

Posted on February 17, 2011 at 4:09pm@ FOOLSGOLD…..Why stop at smoking, there are plenty of things we could ban, MSG, Harsh perfumes that cause headaches, empty calorie foods that lead to obesity (studies show this ain’t good), really really hot coffee (cuz that just plain hurts), people wearing pants that reveal their cracks (my kids most definitely should not be subjected to that,,,whew). Wait a minute………. are you for legalizing marijuana? I bet you are, aren’t you? C’mon be honest …….you are right?

Anyway, smelling smoke while eating dinner is pretty unappetizing in my opinion. I believe that each establishment should decide to allow or not allow. Kinda like gay bars! I am free to go to one, but probably wouldn’t have much fun……“insert joke here”

WHO knows people may start REVISING the bans on the rest of the stuff.. we can only PRAY.. here in IL there are places that just ignore the ban on smoking and IF they get fined they have a fund that everyone puts into every time they go in just to pay it..Other places just ignore it all togeather.. have smoking rooms in the back.. etc.. They lost FAR to much business to push the issue..

If someone wants to inhale that toxic stuff because they have no self control…let them do it in their cars or their homes. It is not right to allow selfish people to cause harm to another. Second hand smoke causes cancer! All us non-smokers are asking is that we be allowed to breath clean air…is that too much to ask?
