Not Sweet: Candy Store Owner Fights Mayor to Keep Bars on Her Shop Windows

A Wisconsin business owner is fighting for the right to keep bars on her shop windows.

Pamela Bogen is set to open her new candy store, The Mini Sweet Shop, in the city of Racine, about 30 miles south of Milwaukee. Right now, the street level-store has bars on the windows — and that‘s where she’s run afoul of Racine Mayor John Dickert.

Dickert said having bars up sends the wrong message about the city, and he wants them removed.

“It‘s about where we’re going in Racine and if we’re going to go back to bars on window, I think we’re going in the wrong direction,” he told WITI Fox 6.

Other stores in the area have bars on their windows, but zoning rules prohibit new businesses from putting them up. The shop already had the bars before Bogen arrived, and for cost reasons the building’s owner convinced city authorities to keep them up as an exception.

And the mayor is not happy about that.

“It‘s a very inconsistent message and we’re all about consistency,” he said.

Bogen said it’s not about rules, it’s about safety.

“Just let me keep the bars up,” she said.

But Dickert said the city is turning around, and bars on the windows will suggest otherwise.

“We just put a community policing station in that area,” he said.

One resident disagreed with the mayor’s estimation of the city.

“This is crackhead city, this is drug-infested,” she said.

Bogen also wondered if the fact that she’s a black business owner had something to do with the mayor fighting her, a claim Dickert said was “absolutely ridiculous.”

The city council is due to make the final call Tuesday on whether Bogen can keep the bars.

For now, Bogen said she just wants to open her shop.

“Let me run my business and try to be successful,” she said.

    Dear Mrs.Bogen.Tell the so called Mayor that you will gladly remove the bars as soon as he signs a contract agreement stating the He takes full personal responsibility for any loss or damage someone might cause to the store and that he personally will be liable for any robbery’s or injuries due to a crime being committed in her store after the said bars are removed. if not then he has No say in how you protect your business.just remember election time who NOT to vote for!!!!!!!

      Have other ‘new’ businesses had to remove their already existing security bars?
      If not, “the shop already had the bars before Bogen arrived”. If they want the bars removed, perhaps the new ordinance should mandate that they be removed when there is a transfer of business (new renter) or done when a building is sold.

      >Better yet, the bars should remain until they rust.

      This is happening so often now its almost common place. Why cant government officials/authority PLEASE just let us live our lives without intruding into EVERYTHING we choose to do? Bars on the windows are a choice the business owner makes to protect their business, they dont hurt anyone else, break any laws, or cost anything to anyone else. Im getting sick and tired of government intrusion! They obvioulsy cant get their act together so what makes them authorities on everyone elses business?

      @Ookspay, nothing personal, but you’re absolutely wrong about that. Every state that has decided to allow concealed carry experienced an almost immediate decrease in person-on-person crime and an //increase// in impersonal crime. I.e, robbery decreased because the bad guys don’t know whether the person they are robbing might be packing. But burglary //increased// because the bad guys remain bad guys … they just decide to break into places rather than confront potentially armed victims face-to-face.

      Consequently, a high-crime area that starts allowing citizens to carry weapons will just remain a high-crime area with somewhat lower person-on-person crime rates and somewhat higher impersonal crime rates. Maybe it will make a difference long term, but that requires a change in the type of people who live in the area.

      Stegal TX- also one can’t shoot to protect property, only persons. Accurately assessing your life in danger or just your cash register is tricky especially if you only work for the owner.
      Candy stores do close.
      it’s a good idea to keep it difficult to get in the store in the first place.

      Remember that article awhile back where a woman commanded the burglar to leave “in the name of Jesus”? ….and he did.

      LibertyLuvnMomma, you can use deadly force to protect property in Texas. Texas Penal Code 9:42 spells it out, though I would not shoot over a television.

      A person is justified in using deadly force against another to protect land or tangible, movable property:
      (1) if he would be justified in using force against the other under Section 9.41; and

      Because a criminal does not learn.
      Once he has your property and has gotten away with it, he becomes emboldened. Next you will have to not shoot over your wife or daughter getting raped, your car getting stolen, etc etc.

      I sent the mayor an e-mail as well, but i would caution anyone who feels like sharing their views to be respectable and not resort to throwing any “clown” references around. It is a little disconcerting to hear the race-card reference thrown in there. There’s WAY too much of that and for no good reason, most times. Nonetheless, how could a legitimate new business be a negative influence on any Main Street USA?

    Crackheads have the right to break into any store they please when they run out of dope money. It is against thier civil rights to limit thier choices to stores that are not allowed to protect themselves.

    She needs to be sweet as the candy she sells, talk to the city council and tell them how if she is broken into, she will be forced to sue the city for targeting her business to be one of the unprotected vulnerable targets for theives. If it’s no bars, it’s no bars for everyone. She should have the right to protect her business, and her livelihood and if that means bars, then bars it is. I think she should go on record to the city council and make it clear that not only the city will be sued but each of them individually if they decide to single her out and have her remove the bars and there is a break in.

    It really is time for government at all levels to recognize the rights of the people. Freedom, should be more than a slogan. It’s not up to government to decide what is acceptable risk and what is not. It’s not up to government to protect us from life. Laws should be simple and just protect society from those who willfully try to injure another person. Having bars on her shop injures no one. Government needs to let her run her own business. Government over-regulation is destroying the freedoms we once enjoyed, not to mention our jobs and our economic future.

      My guess is that Governor Walker did not go far enough. Just because there is a police office down the street does not prevent a break-in at her shop. Until city hall and ALL of the other businesses remove their bars and hardened security, she should be allowed equal protection under the law! Or, is this the Mayor’s way of spreading the wealth around.

    NO ONE should be prohibited from barring up their businesses in any way they please, especially in crime-prone areas. We put hinged steel plates over our small businesses windows and door to prevent them from being shot out or vandalized. It’s been very effective as no one has even bothered to try anything. At a glance, you instantly know that you’d be hard-pressed to put a pistol or carbine caliber bullet through the plates.

    Mr. Mayor, no matter what you do in your city, YOU CANNOT totally eliminate crime. If you force this entrepreneur to take her bars down, you should be forced to pay her restitution from your own wallet if she is broken into.

    Crap like this is why small businesses like ours are failing in America.

The 89 cent light bulb is being pushed out and I still can get a reason why… If THAT isn‘t control then i don’t know what is..       What city are you from Jamestownrd? The thousands of cities who work hand-in-glove with agencies of the U.S. government, and with ICLEI and Agenda 21 function on the ideology that everything on your property and inside your house and your body is their business. Most citizens would probably be shocked to read all the requirements posted on their cities’ websites dictating all these requirements. They‘ll even find their cities’ dictates for mulching whether the property owners want to mulch, or not. And even requiring rental property owners to reduce the amount of parking spaces to force people to have to walk to work or school or store. Isn’t it wonderful to have people like Al Gore dictating our lives, and making speeches at schools telling students not to ask their parents environmental questions because adults (except for him and George Soros) are stupid. And now, he’s preaching about “Mother Earth” and her “civil rights.”

      Lord, come quickly.
