NY Releases Doomsday Manual for Possible Apocalyptic Event

It seems like something out of a Hollywood movie such as “I am Legend” or “2012.”

How should judges, lawyers, and public health officials respond to a chemical weapon attack? What happens if a mass terrorist attack forces a quarantine, large-scale evacuations, or the slaughter of private animals? Those are the questions that a new doomsday manual put out by the New York state court system and the state bar association hopes to answer.

The manual’s title, “New York State Public Health Legal Manual,” may be boring but the subject matter is not. The book doesn’t mandate new law but encourages officials to think through the application of current rules and regulations when it comes to apocalyptic situations.

How should judges, lawyers, and publich health officials respond to an apocalyptic terrorist attack?

“It is a very grim read,” Ronald P. Younkins, the chief of operations for the state court system, told the New York Times. “This is for potentially very grim situations in which difficult decisions have to be made.”

The Times explains:

The manual provides a catalog of potential terrorism nightmares, like smallpox, anthrax or botulism episodes. It notes that courts have recognized far more rights over the past century or so than existed at the time of Typhoid Mary’s troubles. It details procedures for assuring that people affected by emergency rules get hearings and lawyers. It mentions that in the event of an attack, officials can control traffic, communications and utilities. If they expect an attack, it says, they can compel mass evacuations.

But the guide also presents a sober rendition of what the realities might be in dire times. The suspension of laws, it says, is subject to constitutional rights. But then it adds, “This should not prove to be an obstacle, because federal and state constitutional restraints permit expeditious actions in emergency situations.”

When there is not enough medicine for everyone in an emergency, it notes, there is no clear legal guidepost. It suggests legal decisions would most likely involve an analysis that “balances the obligation to save the greatest number of lives against the obligation to care for each single patient,” perhaps giving preference to those with the best chance to survive. It points out, though, that elderly and disabled people might have a legal claim if they are discriminated against at such moments of crisis.

“In its matter-of-fact way, it conjures an image of the courts muddling through in an apocalyptic city,” the Times goes on to say, before mentioning the manual’s instructions that in the event of a chemical attack court officials might need to use respirators in the courtroom.

“In today’s world, we face many natural and man-made catastrophic threats, including the very real possibility of a global influenza outbreak or other public health emergency that could infect millions of people,” New York Chief Judge Jonathan Lippman writes in the manual’s forward.

“While it is impossible to predict the timing or severity of the next public health emergency, our government has a responsibility to anticipate and prepare for such events.”

The manual is available for download, or can be purchased as a hard copy for $18.

      I’ve heard you make that claim before, with all of its machismo rhetoric. Oddly though you never seem to take any position but that of the Left when one examines your posts.

      Granted, I’m not left nor right, but I am libertarian and I generally do not parrot the Left line as a result (nor the Right when they get all Social Convservative on me). Yours seems to be a different story though. Maybe you should consider coming to peace with the notion that you’re a Leftist?

      worst part is when you get to the larger cities, many folks rely solely on public transportation. I don’t know how true that is for NYC, but I know quite a few people from Chicago who don‘t even own driver’s licenses. what would they do in an evacuation scenario? I‘m sure the cab drivers and bus drivers won’t be staying at work.

      During the 9/11 attacks, Pretty much all transportation came to a halt and the bridges and tunnels off the island were closed. In that case Manhattanites walked across the bridges into Brooklyn. I think the ferries were running into Staten Island. Anyway, that is probably what would happen.

      This stuff is creepy. All the best plans kind of go out the window when tragedy actually happens. I remember the chaos of 9/11. There is no way to accurately plan how people will react to a real emergency. Everyone is different, and we all handle panic in our own way.

      On the one side is the fact the government of NY has plans for the probability of a doomsday style of scenario happening; yet I still find this thing disturbing in the way that any and all plans have the way of going to ‘hell in a handbasket’ when the crisis actually begins, due to the fact of humanity being humanity.

      In short, humanity may have a plan, yet throws it out the window due to the fact it could not cover even the most basic contingencies when the unexpected starts to occur.

      Case in point, Hurricane Katrina.

      Try this on for a wake up call. Back in 2000 or it may have been 1999, I was returning home from my last trip to a trade show in Las Vegas the first week of November and was seated next to a young gentleman that was the classic off duty military guy in civilian clothes. I turned and asked if he was indeed military and his immediate reply was “how did I know?” Well, I said “My son was a C-5 Commander and he looked very similar to him in stature and appearance.” He then warmed up enough to talk a little; since we had my son in common it made me a military Dad. He told me he was at a military conference on domestic terror at a base near Las Vegas. We eventually ran out of things to say so we both settled in to enjoy the flight. After a few minutes of staring straight ahead in silence, he turned to me and asked out of the blue, “Where do you live?” To which I replied “Daytona Beach”. He then asked “how far was it from Orlando or the Cape?” I told him it was about 40 each. He thought carefully for a minute and then said, “Well you may be safe there”. I was in shock. “Why are you asking me this?” I said. His response was, “ Well, at the conference I just attended, they are expecting a nuke to be set off by radicals in a major US city or military installation within the next 10 to 12 years. So I advise you not to move any closer to a major city or military installation in the future.” He further said, “ It would probably be someplace like NY or Chicago, DC or LA, so I was probably safe where I was.” Well, needless to say I was in shock for a long time after that little bit of advice. At this point I was speechless, we didn’t speak again until we parted and I wished him well as we exited the plane in Atlanta, I am not even sure he told me his name. This is Absolutely the truth, I couldn’t make this stuff up, not me, the conversation took place. So now does this put everything in prospective? If the government has had this theory all along, don’t you think we should have been securing our borders from the get go? What the hell are they doing? Was that a WTF moment or what? For me, Absolutely.

If that event didn’t lower the confidence level in NYC government, I would hate to think of a real catastrophe, especially with the current mayor. Unfortunately, I am afraid it is coming to a city near you, just when and where, are the questions.

      Yeah, I remember, back in the Cold War days, how the government had plans to send out appropriately radiation protected IRS thugs to confiscate any remaining wealth/foodstuffs from the remaining American population who was, last check, to be left to deal with the hell of a nuclear holocaust while “essential government operatives” aka Congress/POTUS/Their Friends were sequestered safely below ground in a radiation proof mini-city until it became safe to emerge and live above ground again.

      As it turns out the contingency plans were real, and the shelters were as real as could be, as most of us remember from news reports in the late 1990′s.

      In essence, their plans were to loot anybody who managed to survive for their own personal gain and leave us starving and dying while they lived in relative comfort and guarded by men with machine guns.

      Needless to say, you should keep all of this in mind when making *your* plans on what you will do and how you will respond, in the event of any future national/world tragedy. These narcissistic parasites will give you no quarter, and will starve or kill your family so that *they* can go on, so give them no quarter back, I say.

      When OB was elected, I told all my friends and family that if this man was not stopped I would not put it past his administration to do something drastic to get re elected, because the people would finally realize just what he was up to “destroying America”. I even said I believe this man would allow a WMD on our soil to go off.. And that 2012 elections would and could be the very last elections this country will see for a long time. He will declare a national emergency and suspend our constitution. He will call out the military and of course all local and state police to quill and control the people. As in Kritana. But i did not think about calling into action the Judges and lawyers. That is interesting.

      @ Absolutley. When I was on active duty I was stationed at Camp Lejeune, NC. In 1993 or it may have ben 1994, Our unit, 2ND LAR(Light Armored Recon), was involved in an exrecise. I didn’t think much about it at the time, nothing new for the Marines to do manuevers both on and off the base. This really didn’t hit me until about a year ago and now with this story and yours, I really do wonder. The premise of our exercise was a terrorist attack/invasion from the East coast originating out of New York. Now, I don’t remember the exact name of the exrecise, I was younger and still gullible, therefor didn’t pay too much attention to it. We went Northeast then enacted a “fighting” withdrawl all the way back to Fort Benning. I don’t think it was just an exercise anymore considering what happened in 2001.

I even wondered if the oil spill wasn’t orchestrated to stop off shore drilling, therefore making us more dependent on foreign oil; followed by our helping orchestrate riots in Egypt, leading to more unrest.       You didn’t need a military guy to tell you something like that. It’s plain old common sense. Just pick what you would consider a target, big city=maximum kills, or power plant=take out power, and try not to live too close to one. I have been wondering why people stilll want to live in those cities, when they know it will happen some day. I predict LA will be the next target and it will be a nuke.
      I live in a small town far enough away from a city to be safe, but close enough to be convenient.
      My only problem is that I live close to a couple of power plants on the Ohio river.

      It brings back memories af the ADA laws and how they have been pushed so hard on us. Of the little handicaped dictators who go sue crazy over little or nothing. You know real life isn’t so full of gurantees and a lot of people could be very surprised how life would be if they were not leaching off others. I don’t say these things from a cold heart as I recognize the truely needy and my heart goes out to them. But sometimes I laugh when I think of the takers in life and how much I would like the authorities off my back and robbing me to give to such. Sorry but I am not a child and I see things in my own way. God I love America!

      YOU KNOW WHAT REALLY ANGERS ME !!!! When I read and watch what took place down south after Katrina hit the blatant violations of constitutional rights. I know there were many problems but Isaw people kicked out of their home against their will. Guns confiscated even though the owners were legal and had committed no crime (most of them never got the guns back either). It makes me so angry I could spit nails…….OK I’m calm now. That is exactly what will happen nation wide if something really big ever hits. Katrina is the practice for the real game.

      Scarey stuff. Notice how it states that the government (I mean doctors) will make the decision on who will get the live-saving medicine. And then in the next sentence it states that if the elderly or disabled find they are discriminated against they will have a right to a legal claim…AHHHHHHHH I don’t think having a legal claim for discrimination will do any good for the elderly or disabled since they will be dead after not receiving the life-saving medicine. Kinda like Obamacare. Grandma doesn’t get heart surgery, she dies and can’t make a legal claim that she was discriminated against BECAUSE SHE IS DEAD! Progressives – they think of everything.

      Actually, there have been hundreds of court cases stating that the government has no requirement or responsibility to provide “emergency care” or response by police etc. – You pay your taxes and take your chances. In reality, it has to be this way, since there is no way to guarantee there will be resource/people to respond to any particular emergency.

      “While it is impossible to predict the timing or severity of the next public health emergency, our government has a responsibility to anticipate and prepare for such events.”
