Obama Administration Suspends Immigration Enforcement Program 287g Following Supreme Court Ruling

Just hours after the U.S. Supreme Court rendered its ruling and upheld the controversial so-called “show me your papers” provision in Arizona’s immigration law, the Obama administration announced Monday they are suspending a vital program that lets state and local law enforcement agencies enforce federal immigration law, Fox News reports.

Obama administration officials said program 287(g) would be suspended indefinitely. Under the program, local authorities were permitted by the federal government to make immigration-related arrests.

Officials also said Immigration and Customs Enforcement (ICE) will not respond to calls from Arizona and other police agencies regarding the immigration status of people they pull over unless they meet a specified criteria. For example, they will respond if the person is wanted for a felony.

The latest move will certainly weaken Arizona’s ability to secure its own borders and appears to be yet another unilateral action taken by President Obama to dictate policy.

The program suspension comes after ICE called the program a “top” initiative and agreed it strengthened “public safety.”

“The 287(g) program, one of ICE’s top partnership initiatives, allows a state and local law enforcement entity to enter into a partnership with ICE, under a joint Memorandum of Agreement (MOA), in order to receive delegated authority for immigration enforcement within their jurisdictions,” ICE’s website reads.

“In 2009, ICE fundamentally reformed the 287(g) delegated authority program, strengthening public safety and ensuring consistency in immigration enforcement across the country by prioritizing the arrest and detention of criminal aliens.”

President Obama released the following statement after the SCOTUS ruling on Monday:

I am pleased that the Supreme Court has struck down key provisions of Arizona’s immigration law. What this decision makes unmistakably clear is that Congress must act on comprehensive immigration reform. A patchwork  of state laws is not a solution to our broken immigration system – it’s part of the problem.

At the same time, I remain concerned about the practical impact of the remaining provision of the Arizona law that requires local law enforcement officials to check the immigration status of anyone they even suspect to be here illegally. I agree with the Court that individuals cannot be detained solely to verify their immigration status. No American should ever live under a cloud of suspicion just because of what they look like. Going forward, we must ensure that Arizona law enforcement officials do not enforce this law in a manner that undermines the civil rights of Americans, as the Court’s decision recognizes.  Furthermore, we will continue to enforce our immigration laws by focusing on our most important priorities like border security and criminals who endanger our communities.

The high court struck down the three other parts of SB 1070, including the provisions that made it a crime for immigrants to seek work without work permits, to not carry their immigration papers and permitted law enforcement to arrest individuals they suspect committed crimes that would require their deportation.

The “show me your papers provision” is expected to face further legal challenges as the immigration debate still remains largely undecided and highly contentious.

      Obama hates all freedom loving, small government Americans, just not those of us in Arizona. No doubt the Latino vote is secure in his pocket for the Nov election. Seems like one step closer to the people of America deciding that it is time to leave the union. After all, would Arizona have become the 48th state if they knew the Federal government would strip them of their powers, yet deny calls for enforcement of existing laws? The Supreme Court is allowing the Federal level to keep power that belongs to the state. Hopefully they will not vote with Obama on the Affordable Healthcare Act. If they rule the government can force any citizen to buy a product, I think that will be the last straw.

      Enforcement Agencies, If you read the Constitution, I believe it is the job of the Government
      to PROTECT its people.. But Obama has proven over and over that He could care less about

      so… the President can decide which part of the Constitution to defend, and ignore the parts where he doesn’t agree.. (and demand that the police not enforce the law as well.)…. evoke executive privledge…. executive orders.. hire czars to get around congress..hire a DOJ to enforce only the laws that are politically beneficial to him… the unbelievable is not so unbelievable anymore because it has happened.. we have literally lost our ability to be shocked anymore…nothing from this admiistration really suprises us, We blogg and we comment on pages like this… all the while we let the President use creative writing and language to justify his breaking his oath of office..and I am jst naming the few things off the top of my head…

      Ummm guys….

      We have a Republican congress and the constitution grants congress in Article 1 Section 8 Clause 4 “To establish an uniform Rule of Naturalization, and uniform Laws on the subject of Bankruptcies throughout the United States;” This comes after the commerce clause; which is significant because its premise was to protect our Nation from states engaging in inappropriate commerce with each other, with Indian tribes or other nations. They did not want Vermont starting an economic war with Virginia, they did not want Virginia causing a war with Indian Nations and/or Kentucky starting a war with France. An act of one state could lead the United States to war.

      So Congress was only to have mere oversight, make trade “regular” among the states, indian tribes and nations. As such the same rules were to apply to naturalization into the United States.

      So why the hell does our Republican congress sit idle?

      You guys can blame Obama, but the truth of the matter is that a state cannot make ANY laws pertaining to naturalization above and beyond the current law.

      As conservatives we cannot selectively abide by the Constitution, we have to take a stand on integrity and fight the right fight. The right fight is with congress, taking a STRICT stand on immigration and allowing states to IDENTIFY, ARREST and TRANSPORT illegals back to their appropriate country.

      We must always abide by the constitution. Always, or we become like them (the liberals).

      I can‘t even call it right wing spin because it’s nothing but a flat out lie. The SCOTUS didn’t uphold anything. If they had upheld it that would mean that they found it constitutional. THEY DID NOT. The SCOTUS declined to rule on it until it is tested in the lower courts, and to be sure, when that happens it will be found to be UNCONSTITUTIONAL!!!

Last time I looked one of the DUTIES of the President of the United States is to enforce laws passed by the Congress, I don’t remember anywhere in the Constitution where it gives a President the power to decide what Laws to enforce. It should be an Impeachable offense if the Congress would just do their jobs.

      Yes, extremely illegal. There’s a lot of us that feel that way because of the disgust for what not only this president but so many in Congress and the bureaucracy has done to the country while most of us slept. I’ve even spouted off comments like yours but much worse…still do.

      Yet, if we’re to be “real” patriots we must use our Constitution to indict and clean house. Admittedly, lining up Congress on the steps of the capitol and shooting one, then tell the rest to go do the job they are supposed to until members finally do the right job is at first a pleasant thought. However, I don‘t want mob rule and don’t want dictatorship.

      It’s so difficult to be calm when a storm is all around us.

      Even the Army National Guard has been co-opted to do the bidding of the EPA as their primary function. That’s evil…in my opinion. As soon as I saw Michelle Obama’s hideously evil deformed face on the page I knew there is serious trouble there.

      Great points all…..I think you speak for the majority of us Arizonans. This is insane….since when did the potus become the dictator? Doesn’t he work for us? He‘s so pissed at gov Brewer that he can’t see straight. I stand with Jan. She is doing exactly what we elected her to do. PROTECT OUR RIGHTS !!!!!. I pray the rest of the country sees this and understands what it all means, because if he isn’t stopped here…it’s going to get really bad everywhere else.

      I agree 100% with you, I want to see justice, not in 10 or 20 years, I want to see it before I’m old. These politicians that use our government for their own glory are treasonous and should be arrested and tried quickly to quell the people and make other politicians think twice about breaking our laws and not abiding by our constitution. This guy is sitting in there thinking he can never be touched by justice, it’s time for that to change. God, these people make me see red!

      Normalmom-Clintonwas impeached but refused to step down Richard Nixon was a more honorable man that stepped down for lesser crimes than those commited by Clinton and Obama both men have no honor and do not deserve respect.     President Obama acts like a spoiled child as if he can’t have his way why not make others suffer…

    Legal immigration is what this country has been about and God Bless the immigrants who has followed the laws of the United States. My prayers goes out to all the states that try to be law abiding and keeps up safe. Anyone who does not have that goal is not a leader. Laws don’t make injustice right.

      This great country was formed by immigrants. The population during WWII was about 140 million and it is about 2.5 times that now. We now have way to many people especially non producers. The more Mexican immigrants we have, the more voting Democrats we we will have. This will eventually transform us into a Socialistic Sh#t-Hole like France, Greece or Italy.

      I would stop all immigration immediately legal and illegal. We should do this and leave the U.N. tomorrow.

    I don’t look Hispanic. But every time that I have been stopped by law enforcement, I have had to provide photo ID. This is not a big concern for Hispanics who are here legally.

      I don’t think they will get any help. None of the politicians in office will touch this. (Democrats or Republicans) It interferes with their nice lifestyle. Our representatives want to stay in their comfort zone, live like kings, and make all the rules. They won’t lift a finger. Just watch and see. It’s going to be business as usual no matter who wins the election. You can take that to the bank.

      Look at all the treasonous activity occurring on the hill every year and nothing is ever done…..nothing. Think about it.

      Nothing will change until we all take to the streets and exercise our rights. Throw them all out. They’re all traitors.
