Obama Admin Rejects Indianas Ban on Planned Parenthood WASHINGTON (AP) — The Health and Human Services Department rejected changes in Indiana’s Medicaid plan Wednesday, saying it illegally bans funding for Planned Parenthood, and sought to make clear that a similar fate awaits other states that pass legislation barring any qualified health care provider.

State officials signaled they would not accept HHS’ decision.

In a letter sent to Indiana’s Medicaid director, Medicaid Administrator Donald M. Berwick said Indiana’s plan will improperly bar beneficiaries from receiving services. Federal law requires Medicaid beneficiaries to be able to obtain services from any qualified provider.

“Medicaid programs may not exclude qualified health care providers from providing services that are funded under the program because of a provider’s scope of practice,” Berwick wrote in a letter to Patricia Cassanova, the director of Indiana’s office of Medicaid Policy and Planning. “Such a restriction would have a particular effect on beneficiaries’ ability to access family planning providers.”

Indiana’s law bars Planned Parenthood offices in the state from receiving federal money because it provides abortions, among other services.

Marcus Barlow, a spokesman for Indiana’s Family and Social Services Administration, said the state’s attorneys have told his department that it must continue to comply with the law passed by the Indiana General Assembly.

“We will seek guidance from the Indiana attorney general on how to proceed forward,” he said.

Bryan Corbin, a spokesman for Indiana Attorney General Greg Zoeller, said the letter was being reviewed to determine the state’s options but that “we will continue to defend the statute.”

Berwick writes in his letter that Indiana should change its plan to conform with federal law, noting that the state has 60 days to appeal. The letter does not state it explicitly, but Indiana could face penalties if it does not comply. In the past, state Medicaid plans that did not conform with federal law have been changed by states before HHS enforced any penalties.

In addition to Berwick’s letter, HHS also posted a notice on Wednesday to other interested parties that sought to make clear that the department would take a dim view of similar efforts to ban specific providers from federal funds.

Indiana Republicans who worked to pass the ban were quick to denounce HHS’ decision.

“Indiana’s on solid legal ground,” said state Sen. Scott Schneider, an Indianapolis Republican who sponsored the measure to strip Planned Parenthood’s funding. “There’s no reason for us to change course at this time. It’s up to them to prove that this is not legal.”

Schneider added, “I’m extremely disappointed. I would take issue at their interpretation of the law.”

Indiana officials should have expected the proposed changes to the state’s Medicaid plan would be rejected, Berwick wrote.

“We assume this decision is not unexpected,” Berwick wrote. “As the Indiana Legislative Services Agency indicated in its April 19, 2011, fiscal impact statement, `While states are permitted to waive a recipient’s freedom of choice of a provider to implement managed care, restricting freedom of choice with respect to providers of family planning services is prohibited.’”

The HHS notice, written by Cindy Mann, the director of the Center for Medicaid, CHIP and Survey & Certification, emphasizes that states may bar providers from participating in Medicaid in certain circumstances, such as if a provider is committing fraud or criminal acts.

“States are not, however, permitted to exclude providers from the program solely on the basis of the range of medical services they provide,” Mann wrote.

Medicaid is a federal-state partnership that nationwide now covers more than 60 million low-income children and parents, seniors, including most nursing home residents, and disabled people of any age.

Federal law prohibits using any federal funds, including Medicaid funding, to provide abortions. While Planned Parenthood provides abortion services, it also provides other services such as preventative care, cancer screenings, and family planning and is eligible to receive Medicaid funding for its other services.

Planned Parenthood operates 28 clinics in Indiana, four of which perform abortions. The state chapter has said federal funding makes up about 20 percent of its annual budget.

Betty Cockrum, Planned Parenthood of Indiana’s president and CEO, said HHS’ letter was “gratifying.”

“It is right that the federal government take action against Indiana and set an example for other states seeking to adopt this type of harmful legislation,” she said. “This new law is already preventing Planned Parenthood of Indiana Medicaid patients from receiving some services.”

In recent days, HHS has come under lobbying from both Democrats and Republicans on the issue. Last week, a group of Democratic senators called on HHS Secretary Kathleen Sebelius to inform Indiana that its ban didn’t comply with federal law.

In response, eight Republican members of Indiana‘s congressional delegation sent Sebelius a letter calling on her to support the state’s law.

Indiana should just tell Obama admin where to go and implement their law as planned. If they cut funding, stop medicaid altogether. We just need to say no, and not comply, across the board.

    Medicaid needs to get eliminated all together! I’m all for helping the elderly and the handicapped, but I‘m sick of hearing how poor people need help because they can’t afford it.     Texas passed a bill in the house saying Tsa could not touch you in private parts unless there was some reasonable cause, etc. It went to the senate and they received a letter for the Obama adm. saying if it passed Texas would be a no fly zone. Planes could not land or take off from Texas. So the spineless sentors pulled the bill and did not vote for now. All the states need to pull together and leave the union as one country and leave DC and Cal. all to themselves.

      The problem is money…..

      There is not constitutional Ground to stand on here, as Medicare itself is Unconstitutional via any real reading of the constitution, and since the federal government PAYS for part of the program there is no 10th amendment argument unless the program will move from the Fed/State partnership to a State Run Program, which all of these social programs should be anyway.

      Dont get me wrong, I agree with the law passed, and I think Congress should pass one like it nationally, but This is a Federally run program, if you want the cash you have to follow the fed rules, dont like it, dont take the cash…

      Excuse me–did you read the part about how there’s a (albeit stupid) FEDERAL LAW BANNING THE USE OF FEDERAL FUNDS FOR ABORTIONS. You ALREADY have what you want–now you’re just advocating preventing Medicare (which is already a legal entitlement program that helps old people, a constituency you ought to care about at the very least politically even if you have no humanity) from spending money on important routine services that would be identical if any one else provided them simply because you happen to have a beef with the provider because some (a percentage less than 10) of their other services (which can’t even be paid for by Medicare anyway, even though if sane rational people who weren’t governed by their emotions were in charge it would be) you find objectionable. While we are at this, should we also just shoot everyone who doesn’t declare the Jesus Christ is Lord–it’d save a lot of time and trouble I feel like, if that’s the end goal here anyway.

      This should be a real wake up to everyone who believes, or better yet knows, the federal government is becoming way to intrusive, overbearing, and too big. The federal government has trampled all over the states in every aspect of our lives all because they believe they hold all the purse strings. If I were the governor of a state and some Secretary of whatever section of the federal government made these types of threats, I’d answer with, say good bye to all your federal taxes coming from my state.

Their deceptive dereliction of duty was deftly codified by rhetorically requesting guidance from the CRS on just the birth certificate issue. The expected reply was the infamous Maskell memorandum.[2]

      I have read many of the comments in reply none of them seems to understand the power of the Federal Government in this issue. Yes, Indiana has states rights under the tenth Amendment. However, when they except Federal Money for a program they give up a certain amount of those rights for the money. The Federal Government has bought the power over the state with the Medicade money. This has been the problem with the Federal Government and how they have gained power over the states in most areas. Every dollar that they recieve from the Federal Government gives the Federal Goverment power over the states that is not consitutional power. This is how the Federal Government has become as big as it is and powerful and dominate in our very lives. The only way to stop this power and reclaim the 10th Amendment rights is to refuse Federal money and do with out it. The real Question is are you and I ready and willing to do that, live without Federal Money comeing to our states. That would mean no food stamp program, No Medcaide, (I am not sure how Medicare works between the states and the Federal Goverment), It would mean no money for streets and road projects that are not Federal Goverment, Interstate Highways I believe are the only roads that are Federal property. The list goes on and on. For states to be independant as our founding fathers wanted them to be would be a totally different ball game here. I say give up the money and become independant states again as we were meant to be.

      ….Continued: I have heard a lot of talk about a civil war coming to the United States and a revolution…etc. For the citizens to revolt, start and civil war, or a revolution. There is only one way that would work. That is through the State Governments to revolt to reject the power of the the Federal Goverment in their States. That would be to reject the Money first, and then stand up to the Federal Goverment. We are seeing this start to happen I think as People realize that the Federal Goverment is not doing what it is suppose to do according to the Consitution and imposing and suing the states over powers that the states hold in the Consitution. If you want to abolish the Federal Goverment it must be done through the State Goverments, the general population cannot and will not do it. Revolution must come from the people through the States. So people now is the time for you to make up your minds and what you are going to stand for. For us to make an effective Change in the Federal Goverment our State Goverments must be willing to stand up for us, we can do this if we organize and like Indiana say not this, not in our state, Federal Goverment get out of our State. This is the discussion we all need to start having amoung ourselves and then bring the changes to our state goverments, then to the Federal Goverment!

      I‘m glad I’m old and ready to die… Obama is so worthless that I don’t think America will survive his leadership for long!

      I have made sure that my Son and Grandson have active passports and Duel Citizenship. Most of our investments for the last 5 years have been in Gold and Commodities. The smart money is planning to for the worst and, hoping for the best!

      The answer to your question is that there are many possible reasons but here are two BIG ones:
      1) He doesn‘t think the government should be interfering in someone else’s private medical decision that doesn’t effect him whatsoever (conservatives, of all people, should supposedly be able to appreciate this)
      2) He doesn’t think that having a womb should mean that you are a slave to your body, something men will never have to deal with.

      Just two possibilities–get off your high horse. Abortion is what gets you mad? How about the Lord’s Resistance Army which uses child soldiers to slaughter non-Christians in Uganda and central Africa, and chops of the hands of the disobedient and cowardly to make an example, and intentionally orphans entire communities to bring in fresh conscripts–all this is done in the name of the God to which so many conservatives sleep at night, and you are worried about a little abortion? You conservatives disgust me.

      Federal law requires Medicaid beneficiaries to be able to obtain services from any qualified provider. Sounds to me like the State is rejecting PP’s status as a “qualified” provider. Abortion is an optional, not necessary medical procedure. Maybe HHS should demand that Rep. Weiner be offered the enhancement his picture indicates he needs while they’re justifying why funding for another optional procedure should be required.

      HHS doesn’t have the Constitutional authority to force states to fund organizations.

      “State officials signaled they would not accept HHS’ decision.”

      The states are well within their Constitutional rights to ban funding to ANY organization that resides within their borders. Read the Tenth Amendment!

      The feds are just plain wrong on this (and a great many other things, too). And don’t give me that garbage about federal law trumping state law. The Supremacy Clause only applies to those powers specifically enumerated in the Constitution. Nowhere does it say states aren’t allowed to do this.
