Obama Administration Dumps Major Provision of Health Care Law

WASHINGTON (AP) — The Obama administration’s signature health overhaul law, under relentless assault by Republicans, has suffered its first major casualty – a long-term care insurance plan.

The program, expected to launch in 2012, had been dogged from the beginning by doubts over its financial solvency.

Proponents, including many groups that fought to pass the health care law, have vowed a vigorous effort to rescue the program, insisting that Congress gave the administration broad authority to make changes. Long-term care includes not only nursing homes, but such services as home health aides for disabled people.

“This is a victory for the American taxpayer and future generations,” said Sen. John Thune, R-S.D., spearheading opposition in the Senate. “The administration is finally admitting (the long-term care plan) is unsustainable and cannot be implemented.”

Known as CLASS, the Community Living Assistance Services and Supports program was a long-standing priority of the late Sen. Edward M. Kennedy, D-Mass.

Although sponsored by the government, it was supposed to function as a self-sustaining voluntary insurance plan, open to working adults regardless of age or health. Workers would pay an affordable monthly premium during their careers and could collect a modest daily cash benefit of at least $50 if they became disabled later in life. The money could go for services at home or to help with nursing home bills.

But a central design flaw dogged CLASS. Unless large numbers of healthy people willingly sign up during their working years, soaring premiums driven by the needs of disabled beneficiaries would destabilize it, eventually requiring a taxpayer bailout.

After months insisting that could be fixed, Health and Human Services Secretary Kathleen Sebelius finally acknowledged Friday she doesn’t see how.

“Despite our best analytical efforts, I do not see a viable path forward for CLASS implementation at this time,” Sebelius said in a letter to congressional leaders.

The law required the administration to certify that CLASS would remain financially solvent for 75 years before it could be put into place.

But officials said they discovered they could not make CLASS both affordable and financially solvent while keeping it a voluntary program open to virtually all workers, as the law also required.

Monthly premiums would have ranged from $235 to $391, even as high as $3,000 under some scenarios, the administration said. At those prices, healthy people were unlikely to sign up. Suggested changes aimed at discouraging enrollment by people in poor health could have opened the program to court challenges, officials said.

“If healthy purchasers are not attracted … then premiums will increase, which will make it even more unattractive to purchasers who could also obtain policies in the private market,” Kathy Greenlee, the lead official on CLASS, said in a memo to Sebelius. That “would cause the program to quickly collapse.”

That’s the same conclusion a top government expert reached in 2009. Nearly a year before the health care law passed, Richard Foster, head of long-range economic forecasts for Medicare, warned administration and congressional officials that CLASS would be unworkable. His warnings were disregarded, as President Barack Obama declared his support for adding the long-term care plan to his health care bill.

The demise of CLASS immediately touched off speculation about its impact on the federal budget. Although no premiums are likely to be collected, the program still counts as reducing the federal deficit by about $80 billion over the next 10 years. That’s because of a rule that would have required workers to pay in for at least five years before they could collect any benefits.

“The CLASS Act was a budget gimmick that might enhance the numbers on a Washington bureaucrat’s spreadsheet but was destined to fail in the real world,” said Senate Republican leader Mitch McConnell of Kentucky.

Administration officials said Obama’s next budget would reflect the decision not to go forward. Even without CLASS premiums, they said the health care law will still reduce the deficit by more than $120 billion over 10 years.

Kennedy’s original idea was to give families some financial breathing room. Most families cannot afford to hire a home health aide for a frail elder, let alone pay nursing home bills. Care is usually provided by family members, often a spouse who may also have health problems.

“We’re disappointed that (Sebelius) has prematurely stated she does not see a path forward,” AARP, the seniors lobby, said in a statement. “The need for long-term care will only continue to grow.”

Sebelius said the administration wants to work with Congress and supporters of the program to find a solution. But in a polarized political climate, it appears unlikely that CLASS can be salvaged. Congressional Republicans remain committed to its repeal.

    They don’t see a way forward. Translation: Too many people have now READ the Bill and they can’t fool them anymore about what this BAD LAW is going to cost them. In my Humble yet outspoken Opinion, there is NOTHING in this Bill that is worth saving. I just don‘t understand why it hasn’t already been fast-tracked to the Supreme Court and put out of our misery already.

      Exactly how did the Obama Administration kill this part of Obama’s Health Care Bill (that already passed in Congress and was signed into Law by Obama) without a Congressional Amendment to the Bill? Is this a new precedent being set by the White House? We don’t like “this part of a law” so now it’s gone? I’m confused.

    A couple of things that I have not seen discussed here in regards to the entire bill or any bill fot that matter.
    When she was Speaker of the House, Nancy Pelosi promised that any bill would be posted online three days before it would be voted on. She also promised a complete and open debate on any bill.
    These were promised so that we could see what was going on for ourselves.
    If you recall-in the runup to this nightmare being passed, she was asked if it was Constitutional. She didn’t answer either tas or no. She just said ” Are you kidding?” and the stuck her arrogant snotty nose in the air and stalked out of the room.
    When it came to the House floor for a vote, they didn’t even have the text available and no debate was allowed.Just an up or down vote. Great way to be open and honest. Time to get rid of the lot of them and start from scratch.
    Remember, if you want policy changes, you need people changes. No Demonrats, No Republicraps.
    But that’s just my opinion. What’s yours?

      Completely agree. The label on the candidate simply does not matter. What are the values, where is the focus, and does the candidate actually stand firm on the clear reading and intent of the United States Constitution. I don’t care if the candidate is a frigging Martian, as long as he or she passes the legitimate test to BE a candidate without hiding his or her history under presidential seals of anonymity, and that he or she fulfills the oath of office which is to SUPPORT AND DEFEND THE CONSTITUTION OF THE UNITED STATES.

      This health care law offends the Constitution in every part of it. People should be heralding this dumping of just one of its elements. If the Congress had any balls period, the thing would be today, DEAD.

      That it isn’t tells me all I need to know about those who have been elected. They are the same useless swill that replaced the former useless swill.

      We did start from scratch 2010. That is why Fanatic Nancy no longer holds the gavel. However it is extremely important to do it again. Need to check your state for Reps and Senate coming up.
      @Commonsenseguy Not trying to correct you but there is no way Fanatic Nancy fell in line for any SS. She was espousing this health care as early as 2006 if not earlier prepping the way for a Dem Pres to replace GWBush. (remember their hate Bush campaign). I know because as soon as she got that gavel I was writing her complaining.(you do know you can write the heads of both parties). And everything she and Dems did was behind closed doors with fixes in. This was a solid Democratic Congress and President stuck it to us. However we need to rid ourselves of Rinos and replace them as well. Sorry-not correcting just Nancy Pelosi and D. Wasserman Schultz talked down to the elderly (in Florida 2006) as if they were stupid and these two elitist rich women KNOW what is best.

      The thing is though, I have wondered for some time about the Obama-care legislation, if it is in reality some kind of bigger smoke screen being used to create a health care crisis and more destruction in the economy…

      Think on this though, even in the face of the Supreme Court challenges they must have known would come against it, they still seem to be in supreme confidence of its success; especially if they can get one conservative justice to recuse themselves.

      And yet, given the continuous opposition to the wishes of the people and the authority soley invested in Congress, Obama has gone around them just as with the job bill defeat now going to his czars for implementation.

      Could they have been expecting the defeat of the Obama-care anyhow? And already have a second system being put into place to have a “solution” for the dictatorship Obama will most likely soon declare?

      I have felt for some time now that this Obama-care, aside from the bald face power grab it was; is also a foil, and a feint to try and keep something else waiting in the wings concealled.

      Every day, more regulations are piled higher and higher here, but nothing is being done with overregulation in Europe, they’re simply tossing money at the issues and fighting to join Europe into one unit.

      There are WAY too many closed door meetings here and in Europe.

    Now they need to realize that the rest of the plan cannot be implemented and dump it. I`m betting on it that they will dump parts of the plan gradually before it gets to the Supreme Court. This way the Supremes will judge what is left of the plan and rule it constitutional. Especially if they drop the individual mandate, which they have`nt yet.
    Do you know there are a lot of other damning parts in the bill that have nothing to do with health care?
    Health care must be taken completely out of government control.

      I am pretty sure that on pages 58 and 59 it states that the goverment will have the authority to take our HC payments directly from our bank accounts, checking, savings and investments? So I am guessing that does not include those on welfare but only on those of us that work or have retired from working?

    By using the search powers of Adobe Reader-search the entire health bill at one time for key words.

    By using this method I determined that HHS Secretary has unusual and nearly unlimited discretionary powers. I’m happy to know she has common sense to know the failures of the bill – and integrity enough to admit it. With all that power comes triumph or failure.

    Besides – the many fingers would be pointing at her eventually if she herself did not exercise that decision.

    As I understand it, Obamacare should be dissolved, because they said it was “All, or Nothing”!!!!
    The “Law” was enacted intact, now is the time for it to be brought back before Congress, and voted on again, because it no longer is as passed!!!!
    Repeal the whole thing, then Pelosi will have time to read the rest of it, and “See what is in it”!!!!!

    Did you know that the health care plan clearly states that all “long term facilities” (nursing homes) would be government run? they also want to take over homes for the handicapped. I can’t site the line number, but I read about half the bill, enough to scare the bejesus out of me. That’s what got me into politics. I read about 2/3rds of the first one (that didn’t pass) and maybe a little less of the 2nd one (that didn’t pass) also. There was a plan that I don’t think made the final cut called something like take back your health act of 2009. It would have required all medicare recipients with chronic diseases to show marked improvement (by stats in 2 categories, which included waist measurements, quitting smoking, cholestoral levels, etc) of 10% in order to get paid for their treatment (or rather their doctors to get paid). They also had to attend something like 72 1-hour sessions (which could be given in groups) on how to eat healthy, etc. At the bottom it said it’s for Mecicare recipients, but they wanted all Americans to be subject to it. the chronic disorders? breast cancer, prostate cancer, diebeties, metabolic disorder, etc.

      The Take Back Your Health act of 2009 is what got me into this. If you don’t lower your numbers by 10% in 2 categories, your doctor doesn’t get paid. My uncle is a doctor, and I knew it would hurt him. Funny thing about that? My cousin (a staunch Obama supporter) got mad at me and said they would NEVER do such a thing as not pay her dad, and her dad wouldn‘t refuse help to medicare patients because the government didn’t pay him. Yea, right.

      This reminds me of the zero population growth crowd. And If I recall correctly, Kissinger called those who could not “produce” anything (work) “useless eaters.”
      This is what a health care system looks like when run by a socialist/fascist/communist type of government. If a person is handicapped or chronically ill, or elderly and cannot work, they are like useless eaters of resources for the rest of society.
      This mindset has been around for a very long time. It is just recycled with new words. The underlying thought is the same though and pure evil.

      My dad, now 79.5, had prostate cancer about a year and a half ago. He was always Democrat until this administration, and now he’s an independent. But, his doctor just wanted to “watch” his cancer for 10 years. My mom (a licensed practical nurse) had to fight for treatment. When she was telling me about it, I could hear my dad in the background yelling, “There ARE death panels!” All Obama is doing is alienating the older population.

      I think to some degree that’s true.

      But his health care plan has always had major support from organizations like AARP (their members are a huge voting block). Have you seen some of their latest commercials? They can dress it up but it’s nothing more than scare tactics.

      And I think the Republicans have used scare tactics as well. The phrase “death panels” for example. What they should have done & should still be doing is presenting rational, easy to understand information about how ObamaCare works and specifically how it impacts senior citizens.

      Senior citizens aren‘t stupid and it’s insulting that both sides seem to think they are. And it’s reprehensible for either side to use fear in an attempt to get their votes .

      I sympathize with you and will pray starting now for you and your family, especially your dad.

      The problem I have is that if people are awake and fulfilling their duty to be observant citizens, men of character and principle will be elected, and not the dunghill we have sent to Washington to represent them because they “seem” to be cool people, or because I didn’t recognize the names or the platform of the candidates so I just checked ones name.

      There was a reason the Founders envisioned an elective process where only those who owned property would vote. That was because it was those people who had the most to responsibility to protect their equal rights against tyranny.

    It’s part of the plan to drop this part, don’t you see it? Dropping long term care for the elderly and disabled will be necessary to carry out the Complete Lives System. It’s an orchestrated false victory for the right.

      Its like Goerge Bernard Shaw said…..we all should have to go in front of a board every so often to prove are worthiness for being kept alive…..The theory is if we don’t produce as much or more than we consume we would be put to death….in a compassionate way of course….The Fabian Socialists are starting to emerge their ugly heads once again.
