Obama Justice Department Threatens University With Lawsuit Because Transgendered Man Can‘t Use Women’s Bathrooms

In a bizarre case that, depending on your point of view, either highlights the complete lack of common sense in the Justice Department’s Civil Rights Division, or demonstrates how truly radical certain segments of the gay rights movement are, Arkansas University has been sued over its refusal to allow an almost 40 year old, still biologically male student to use women’s bathrooms.

A little background on the issue before we plunge into the specifics of the case: Most college campuses make some sort of provision for transgendered students – IE students who believe they were born the wrong gender and are in the process of transitioning to physically resemble the other (presumptively correct) gender using surgery and/or hormone therapy.

These provisions typically include the creation of spaces such as “gender neutral bathrooms” (IE bathrooms that can be used by both sexes), or even in some cases the allowance of completely gender neutral housing which would permit men and women to live in the same dorms. In some cases, students are even taught to use substitute pronouns for gender-nonconforming individuals such as “ze” or “hir,” and often this includes being told that there are more than just two genders. In extreme cases, students are told that there is no such thing as gender at all.

Full disclosure: The author of this article actually went through such an orientation, and has written a firsthand description of the process:

For evidence of this, one has only to look at what is actually argued in these sessions. Among the more interesting facts I gleaned from my session of BiLeGaTa were the following:

1. Gender is a social construct.

2. There are at least five genders (what the other three are is not explained), not two, and that’s a conservative estimate.

3. The proper pronoun to use to describe transgendered people is not “he” or “she” but rather “ze.” The possessive form of this word is “hir.” The word to use in formal address (as in “Sir” or “Madame”) is “Ziram.”

And…

4. Anyone who disagrees with any of this, or even questions it, is automatically “heteronormative” or worse, “heterosexist.”

Why bring all of this up? Because many of these measures (for instance, the creation of gender neutral bathrooms) were implemented by the University of Arkansas at Fort Smith (UAFS), which is the school being sued. Unfortunately for them, that was apparently not enough for our tormented would-be woman, who wanted the right to use not just gender neutral bathrooms, but any and all bathrooms intended for women, despite the presence of decidedly non-female reproductive organs. Meet Jennifer Braly, the plaintiff in this case:

For the sake of simplicitly, we’ll be referring to Ms. Braly by her preferred pronoun throughout this article, if only because we don’t know what her original male name was, and hearing someone named Jennifer referred to as “he” is headache inducing. Campus Reform brings us further details on the story:

A letter from the Department of Justice (DOJ) caused the University of Arkansas at Ft. Smith (UAFS) early this month to reverse policy and allow a 38-year old anatomically male-student permant use of women’s bathrooms on campus despite opposition from female students.

The university made the reversal on “advice of counsel” after receiving a letter the DOJ sent in response to a complaint that a single, self proclaimed “transgender” student filed with the DOJ’s Civil Rights Division.

“Because of the stance we took, the individual filed a complaint with the Office of Civil Rights in the Department of Justice,” Mark Horn who is the vice president of university relations explained in an interview with Campus Reform on Tuesday.

Jennifer Braly, the student who filed the complaint, calls [herself] “transgender” with a “gender identity disorder.” Braly, however, remains anatomically a man and is currently raising money online for Sex Reassignment Surgery (SRS).

Braly filed the complaint with the DOJ after the university initially told [her] to use the campus’s several gender-neutral bathrooms instead of the women’s restrooms.

Got that? The university tried to settle this problem by telling Ms. Braly to just use the gender neutral bathrooms in order to avoid making female students who wanted privacy in female bathrooms uncomfortable. She claims on her website that this was inconvenient because gender neutral bathrooms did not exist in all buildings on-campus:

So the University called me into a meeting and told me I had to use unisex bathrooms and that was it. I can’t use any male or female public bathrooms. One problem to this is there are not unisex bathrooms in every building. Especially the two main buildings where most of my classes are, so I have to go to a completely different building to use the restroom.

Inconvenient? Sure. But the reasonability (or not) of Braly’s complaint suffers rather a lot when you realize that this “woman” considered having to walk five minutes to go to a bathroom she could use to be an infringement worthy of asking the Federal Department of Justice to sue the school. It’s also ruined by the fact that, according to Campus Reform:

The university offered to convert more current bathrooms into gender-neutral restrooms, but still Braly was unsatisfied and decided to sue.

“We tried to make reasonable accommodation and to find a common ground, converting the number of bathrooms on campus to gender-neutral,” Horn from UA said on Tuesday.

Finally, however, it was the letter from DOJ that convinced the legal department and administrators at UA to yield to Braly’s demands.

So the school not only set up gender neutral bathrooms rather than expecting Braly to use the men’s room and possibly risk feeling really uncomfortable, but they also offered to convert existing bathrooms to being unisex. But no, apparently Ms. Braly believes that being able to walk through a door with this sign on it is a civil right as sacrosanct as the right to vote:

Now, to be fair, it’s not clear what the letter from the Justice Department said (they’ve refused to release it to the press), so for all we know, there could be an airtight legal case in the letter. Certainly something spooked the university.

To be doubly fair, some might argue that so long as Braly acts like a woman, doesn’t behave in a meaningfully threatening way towards women and shows no signs of being attracted to women (and thus has no ulterior motives for wanting to enter a women’s bathroom), then this really is a rather silly, old-fashioned move on the university’s part.

Fair enough. Except it’s not true. Despite her supposedly false gender, Braly evidently is attracted to women – so much so that she’s been married to other women twice and even got one of them pregnant with a daughter. From Braly’s website (emphasis added):

I have lived with this condition for the first 36 years of my life and I am now 38. During the first 36 years of my life I tried everything to conform to the male standard but nothing ever seemed to work. I had two marriages and both ended in divorce. My second marriage ended with my ex wife being pregnant with my daughter. A three year visitation battle ensued because of my decsion to transition into the woman I am today, and it drained all my funds. In the end for lack of representation in court I ended up having to sign my rights away.

Now, say what you like about “conforming to the male standard,” but getting someone pregnant takes more than just being a good actor. Either the attraction is there or it isn’t. If Braly is capable of knocking girls up, then those girls have every reason to want her away from them in the bathroom so long as she retains the organ that would permit her to do so. This is just basic common sense.

And not that you needed another reason to think this all sounds like a bad joke gone wrong, but it turns out that Braly actually was able to use women’s bathrooms for a good portion of her time at UAFS. So why isn’t she allowed to use them anymore? Because apparently she thought it was a good idea to do a campus lecture tour talking all about how she’s secretly a man and accusing anyone uncomfortable with that fact of being transphobes. Again, from her website:

When I started living full-time as female at the University I was fine. I was living in stealth mode, quiet, and kept to myself. It just semed safe. I would use womens public bathrooms with out any complaints. Then I took General Psychology and had asked the professor if I could give a lecture on Gender Identity Disorders for some extra credit. She not only allowed me to speak to my class but her other 2 classes as well. She also referred me to another professor and I spoke in his class too. I was excited I was educating people about being a transsexual and the other types of Gender Identity Disorders. Those lectures would be the beginning of all my problems. As I did get many great responses from students how my lectures greatly changed their perspective of what transsexuals are, some students were not so accepting. Some saw me using the womens public restrooms and complained to the University that they didn’t think I should be using the restroom with them.

Shocking. And the truly ironic thing? Braly’s been banned from giving these lectures because apparently she’s not a qualified expert on the disorder, except by virtue of having it. This is not considered a credential. For instance, medical schools don’t invite amputees to lecture on the finer points of when to cut off limbs, even though they themselves might have had their limbs removed. Similarly, while Braly might suffer from the disorder she’s lecturing about, that doesn’t mean she knows how it ought to be treated, or its neuroscientific origins, or the history of its inclusion in the DSM-IV. Her opinion is only slightly more informed than a layman because of her experience. This doesn’t merit a status as a guest lecturer.

However, psychologists may still want to take note of this case for a very specific reason: given the response of the Justice Department, not being in your right mind may be contagious.

      The argument you’re trying to make, that someone with a gender identity issue is automatically a rapist or pedophile, is insulting at best and the sign of mental instability at worst.

      My aunt (not by blood) in Massachusetts has a friend; a couple actually. The woman dresses like a man and the man is a transsexual male who dresses like a woman. It’s confusing and distrubring to me as a catholic. The bible said Adam and Eve, not Adam and Steve.

      There is a simple solution to this, men stand up for your women. If someone like this decides to walk into the bathroom behind my wife / daughter / sister / mom he can bet there will be problems. He can sit and hold it until my wife / daughter / sister /mom comes out. Then I will broadcast to the women’s restroom a man is about to come inside, I recommend all women leave until he is done.

      Make such a scene and so much noise that he will be to embarrassed to go inside and if he does he is alone. You people that feel the need to constantly throw your sexual preference in peoples faces do it for no other reason than getting attention. Well you want it, you got it. Ill make you wish you could crawl under a rock and disappear because of the embarrassment you will endure. OR OR you could shut up and go on in life as a woman and most people wont notice and use the women’s restroom in peace. Your choice!

      So this is really a case of Braly demanding that the whole world treat the basket case as a woman whether he is one or not. The basket case has been married to women, is clearly attracted to women even though he believes he’s a woman himself and demands to be in proximity to the intimate hygeine practices of women. Oh and apparently there are more than two genders in the human species..the previous genetic and psychological distortions of the two genders are considered their own genders now. Enough already….

      Gender IS a social construct. But it’s also a cognitive construct and, I believe, part of one’s spiritual essence–and there’s only two of them (the other three mentioned can be easily explained as variations on confusion between two genders). Sex on the other hand is biologically binary, and the triple chromosome cases are exceptions, not proof that the rule isn’t valid (which is Judith Butler’s big mistake).
      But even if all it were was a social construct, it’s a good one! It allows for two complementary halves to humanity. It allows for two different kinds of strengths to be made one when joined in marriage (which means joined in purpose). And there’s no single stereotypical role either gender is forced to conform to, since all gender roles are negotiable, heteronormativity is only oppressive in the feelings of those outside the norm.
      We should affirm good norms, and avoid the potential dangers of allowing the chemistry between biologically different sexes to mix in public restrooms.

We cannot look into his claim. Maybe he was a 90 lb weakling & it was easier to become female than to stand up.

      The universities have queer departments. They write volumes on queer theory. And so it cannot be impertinent to ask what everything was that he tried. And after we learn to pass judgement on it.
      After all the DOJ passed judgement & they have police officers (force) to back it up.

      They gave the complaintant a mile not an inch. Then they were going to give another mile (They were going convert more bathrooms. But that was not good enough. We have to live by his stupid timetable.

      This is not tolerance. This is overreach.

      Yup. they put in gender neutral bathrooms. Then they agree to put in more. But it wasn’tt fast enough.

      How fast was it suppose to be? The next day the next week, the next month? With a big organization planning & execution might take 6 to 12 months. If they would have made the change in 3 months they still would have been sued.

      We are being put thru this because they are mental unsound!

I don’t have the statistics to back that up, but just on the basis of life experience and knowledge of human nature, I’d say it’s pretty much a sure thing.       You know what? You’re right about that. Sorry. Sometimes I get wrapped up in theory language when thinking in theoretical terms, but the concepts don’t require jargon. Can I have a mulligan?
      There’s no question that social norms influence gender roles. There’s no NATURAL reason little boys should wear pants not skirts–it’s their parents that teach them that, their school peers who reinforce the markers that distinguish gender, etc. The problem is liberal theorists STOP there. They CAN’T admit that even though the MARKS are arbitrary, the FACT of MARKING IS natural. IT doesn’t ALL belong in the realm of SOCIAL norm either–society is composed of INDIVIDUALS and their ideas about gender are housed inside their BRAINS NOT JUST in the rules society “forces” on them. Put little Suzy and little Lulu in a room with nothing but GI Joes and toy cars, and they STILL will play “house” with them–they won’t become BOYS.
      One theorist in general, Judith Butler, tries to make the case for more than two SEXes (because in super rare cases some people are born with an XXY instead of an XY, for example), and therefore more than 2 genders, but this is faulty logic because a biological oddity shouldn’t be included in the sample.
      Finally, there’s lots of models of maleness that people see in society from which they can choose their OWN masculinity (are you more a Rocky or more a Father Knows Best kind of man?…) so norms don’t impose.
      Better?

      Think about this for one fraction of a second. If this is the case, why don’t all rapists just dress up as women? If they can pass themselves off as women, what does it matter if the bathroom is male, female, or gender neutral? @Rebelwuf’s implication is clear: he (or she) thinks that gender identity disorder is used for rape and pedophilia.       False, and false. @Rebelwuf said that rapists will use the “gender identity excuse” to use women’s bathrooms and rape women and young girls, and asked what we should do. I responded that if a rapist does so, they should face the same punishment as any rapist: prison. There’s no strawman there.

      As for an ad hominem attack, I’m really not sure how you can explain away someone linking gender identity disorder and rape. What would your explanation be? Ignorance? Hatred? It’s like linking beetles and volleyballs. Completely unrelated.

      My problem is that the idea of creating specific GENDER bathrooms is based on what someone feels they are. Separate them by sex.       This transgendered woman just needs to accept that her (or his) parts should dictate where she (or he) can go to the bathroom. But it still doesn’t make her a rapist, nor does it make sense that rapists were waiting for this opportunity to act. It’s crazy.

      Here is a question for all you against this woman using the bathroom.

      What bathroom whould you have her use?

      The article points out there is no gender neutral bathroom in the building or buildings near by, this is the issue. When nature calls she is required by the college to seek these out. Do you go to work and when nature calls go down the block to use the restroom, when there is one around the hall. No.

      As I pointed out there are countless cases of abuse and rape to trans people using the bathroom of their birth gender, if this happened at the college the college would face a sever law suit for not up-keeping the safety of a minority person they are aware of. Its the same case if someone ran up and beat up a handicapped person in a bathroom. They also don’t allow her in the women s bathroom because as many have pointed out she still has the equipment of a man and if something would happen in there the school has the potential of another lawsuit, and if said thing happened then she should face the penalty of the crime to the full extent. But who will pay to have bathrooms installed? will you. Colleges charge ridicules rates as is, so will they. Will the government? Its about the rights a person has to do something we all do in a reasonable manner with the least amount of risk to people.

      You should know for one to be diagnosed and treated like her and myself we go through years of therapy. You don’t just walk in a doctors office and get medicine to convert genders. It takes years of therapy and to meet a small window to be allowed to go through the process. Personally it was 3 years for therapy before I was approved for medicines. And I still have to be regularly seen by a therapist. So your argument is faulted in that you haven’t looked into what someone has to go through for this. There is no cure only ways to lessen the feelings by creating a form the person can deal with in their day to day lives. Those Suffering from GID (looks to be changed later next year medically in books) do suffer from other mental disorders at times, those disorders tend to be self destructive ones and depression and suicidal thought and actions are leading triggers to discovering a case of GID in the first place. The therapy is to help people not carry though with doing worse things to themselves.

      If you did not know that Jeniffer Braly was a transsexual would there even be a discussion about this. I applaud the University for making gender neutral bathrooms available. However, Brittany said it very well when she stated that if you need to go to the restroom are you going to walk down the block to use one? There are many transwomen in society and you do not even know who we are. I have seen natural born women who look more manly than some men. You cannot tell from looking at someone…unless of course they are in a dress and sporting a full moustache.

      We all go to the bathroom to relieve our bladders, not to rape or molest women or children. Those rapist and molesters would be spotted very quickly because they will not know how to act in public and pass as women nor can one loiter in a public restroom for a length of time without arousing suspiction.

      For those who say that pre-operative transsexuals use the bathroom of their birth gender, how do you think that a woman in a mens room will be treated. Conversely, if a female to male TS went into women’s restroom dressed like a man what would the reaction from women be. I would guess that Security personnel would be called. It is much easier for all concerned to use the restroom for which they are dressed, and to keep their mouths shut and their hands to themselves.

      Here‘s what I don’t get. They insist that gender is only a social construct (which in my opinion would mean it has next to zero relevance and isn’t connected to sex in any way) and yet try to argue that someone who by sex is a man but by “gender” (which, once again shouldn’t be relevant at all) should be allowed to use the bathroom reserved for members of the female sex (not gender). Moreover, if gender is a social construct, and therefore in no way connected to sex, why is it that so many “transgendered” people feel the need to pass themselves off as the opposite sex?

      While we’re asking questions, how is it that gender, a social construct, can exist in 5 different varieties if society has never recognized more than two? These people have contradicted themselves left and right so many times that it’s not even possible for a critically minded person to take them seriously. The way these people talk about gender, it sounds as though “gender” is derived from interests and behavior, in which case calling it gender is misleading.

      I would like to see some facts backing up all of these global co gender washrooms you speak of. In fact, if you believed that you could say that sexual assault crimes are higher in countries other then America and then argue that co gender public bathrooms are the reason why. Also in most countries around the world, especially the middle east, LGBT’s are stoned to death if found out. So to think that American’s are too sensitive on the issue is ridiculous, most people I know don’t even blink when introduced to an LGBT person . The point is that she/he still has a penis, just because you put a dress on doesn’t mean the penis disappears, I say if you want to use the ladies washroom, loose the penis, until then you are a male who just happens to like dressing up like a female and peeing in ladies washrooms.       Yes, there is a hell for this malady. It’s called living a life of total personal conflict and being uncomfortable in your own skin. Many eventually commit suicide because they cannot handle the conflict of wanting to live the life you feel is right for you versus living a life that society expects you to live…just so you live according to someone else’s view of societal norms.

      Try walking in their shoes and understand the pain of it instead of talking like uneducated idiots. I am a mechanical engineer, a conservative, A TEA party member and a follower and believer in od the Father, Jesus His son and The Holy Spirit.

      I do not believe that God makes mistakes. He made this way for a reason…why He did I do not know. Honestly, I wish this hardship upon NO ONE, not even my worst enemy. When someone loses their temper, do you say, “You know, I feel bad that God created that person to smash windows and furniture when his wife burns dinner”? Although, people may have tendencies as a result of genetics (to lose one’s temper or to have attraction to the same gender), we must never discount the power of agency. God gave us the ability to choose our own course, to conquer weaknesses, and to turn them into strengths. When we see people give in to the world’s culture and to their own base desires, the wrong attitude is to question why God did this to some poor, confused soul. Henry Ford once said, “Whether we think we can or we think we can’t, we are right.” This person chose to be the person he is. From all evidence, he has an accountable mental state and the ability to choose his course without restriction from mental handicap, etc. Being weak does not make someone not responsible for actions.

      I understand your lack of understanding of us. Is GID a disorder? Some doctors refer to this as a medical issue even though GID is still listed in the DSM IV, section 302.85.

      I was diagnosed as a girl when I was 10 y/o. I lived the life of a man until I was 53. I supressed every feeling in me for my entire life to be someone that I never was. I prayed to God for relief from this since I was 8 or 9; asking Him to make me a girl or to take it away from me. I realized when I transitioned that He had answered my prayer. It took me over 40 years to discern the answer.

      Your reply to me is based upon your personal feelings that every aspect of our lives is a choice. A birth defect is not a choice! If this was a choice do you think that I would be willing to give up everything dear in my life? I lost my 23 year marriage, my wife-who was also my best friend, my family, my home, my church and many friends. I did not wake up one morning and decide to “screw up” my life on a whim and just CHOOSE to become a woman! Before you speak so authoritatively, please investigate what you comment upon. I am not angry with you nor do I wish to insult you but there is so much here that you are not aware of. This forum does not allow me to share everything. That would require that I write a book.

      the had gender neutral bathrooms. They were creating more. the problem is that the university did not wish them into existence or did not embark an expensive rush job to build them.

      I think the tranny is on a power trip. they lost 2 marriage 7 then a bitter custody case. then they see an university bending over backwards for them. they must have loved to see a big organization to do their beck & call. Only it was not fast enough

      I am sick of this crap. the gays do not know what to think of trannies. They have no clue as to causation. Not one. They are going with it because it is just more ammo for their cause. There is no science behind it (or morality).

      This is going to be reversed at some point but it is going be horrible until then.
