Obama Stumbles Through Answer When Confronted on Health Care Law’s Future

If you ask Obama his thoughts on the future of his controversial health care bill, he‘ll tell you that he’s confident it will be upheld. But it might take him a while to give you that answer.

Obama stumbled while trying to give a cogent response when asked why it would be unprecedented for the Court to overturn his health law when that’s exactly what the court does, and what he would do for individuals who would miss out on care if the law was overturned.

“First of all, let me be very specific,” Obama said before launching into a nearly six-minute response filled with pauses and blank stares. “We have not seen a court overturn a law that was passed by Congress on an economic issue like health care, that I think most people would clearly consider commerce, a law like that has not been overturned at least since Lochner, so we’re going back to the thirties, pre New Deal.”

“The point I was making was that the Supreme Court is the final say on our Constitution and our laws and all of us have to respect it, but it’s precisely because of that extraordinary power that the Court has traditionally exercised significant restraint and deference to our duly-elected legislature, our congress. And so the burden is on those who would overturn a law like this.

“Now, as I said, I expect the Supreme Court to actually recognize that and to abide by well-established precedents out there.”

While struggling to connect his thoughts, he went on to say he is not getting contingency plans ready because he expects the law to be upheld:

But Obama’s assertion that such a law dealing with the Commerce Clause has not been overturned is a curious one. For example, in 1994 the court struck down school-zone gun legislation that was based on that part of the Constitution.

He WAS accepted into the plan at A 100% higher rate. Obamacare says you cannot be denied. It says nothing about what you willl have to PAY. Stupid moron!

    CATB. Before Obama’s healtht reform many people could be denied health insurance, and health services. Since the Affordable Care Act was passed that has changed. Not all of the reform has kicked in yet . It is gradually rolling out over several yeas. The mandate, which is to take effect in 2014, just required the 1% people who could afford to buy health insurance , but instead free load off of those who do, to buy insurance. The Affordable Care a Act has opened up benefits to many peopled who were perviouly coverage in the past.
    Benefits in effect today: If you have PRIVATE INSURANCE
    - No more lifetime caps on coverage.
    - Access to free preventive care.
    - Insurance companies can’t deny coverage to kids with pre-existing conditions.
    - Young adults can stay on the family insurance plan until age 26.
    - Insurance companies have to spend 80% of premiums on care
    - Independent experts review rate increases of 10% or more.
    Benefits in 2014:
    - No more charging women more than men.
    - Insurance companies can’t deny coverage or charge more for anyone with a pre-existing condition.
    - Everyone has access to affordable insurance – so if you lose your job or want to change jobs or start a business, you’ll know your family can get affordable care.

      Coercive contracts are not binding. If two parties are forced into a contract then the contract is null and void. The other point is the Congress has no authority to force anyone to purchase anything as a condition of citizenship. This is an issue of fundamental liberty!

      Bernbart has obviously drawn long and deep from the kool-aid well. There are so many things wrong with your points to support Obama’s healthcare scheme I am not sure where to start.
      1…Let us not forget first and foremost that everything the federal gov’t touches turns to excrement.
      ..Social Security, Medicare, Wall street, Fed Reserve, modern warfare, foreign relations, etc. The list goes on.
      2…While wonderful to look at on the surface, the fact is that this utopian version of health care reform simply cannot be paid for and will not ever be paid for. Deficit city guaranteed.
      3…When has anyone been “entitled” to health care? or anything for that matter? Where does it end? Our entitlement culture today is enslaving us to the entitlers.
      4… Our forefathers understood that the only entitlements worth dying for and relying on (Life, Liberty and pursuit of happiness) are those set in place since the creation of the world we live in. Placed there by an infallible, omipotent, omniscient, perfect God. Gov’t of ANY kind is not even close. The constitution is the closest we‘ve ever come and is still far from God’s level of perfection.
      5… All of modern politics is purely about personal gain of power. There are no public servants anymore. Obama’s health care is just to gain power.       The average person will contribute 150k to medicare and take 400k out. This is an unsustainable model. Anytime you add a link to the supply chain, the cost increases. This is why the socialized healthcare model has no alternative except rationing to lower costs. Women in England do not have access to easily obtainable breast cancer drugs because of the cost of the drugs. So, wealthy Brits get those drugs outside of the country and poor Brits die of breast cancer. If my health insurance attempted to tell me I couldn’t have those drugs, I could complain to the government. Who do I complain to when the government is involved? The simple answer is no one. Healthcare for women is demonstrably more expensive. That is why insurance costs more for women. We can run around with our fingers in our ears singing “la la la”, but it doesn’t change the fact that adding government to the supply chain will kill more poor women in the US. I get that you are sold on the central med idea, but don‘t try to play it off like you’re some champion of the poor or women. This is simply about continuing a broken model for the benefit of childish egos.

      Having everyone insured does zero to address any of the real issues. The reason we have insurance is because health care costs so much but instead of trying to find ways to make health care itself cheaper Obama’s solution is just to make everyone pay for it so no one person is paying “too much”. Why not fund research that seeks to find cheaper ways of treating people or producing our medicine? Why not pass legislation that protects doctors from frivolous lawsuits (which makes them charge more so they can cover the court fees)? Obamacare doesn’t solve the problem, he just kicked the can down the road along with all the debt he’s put us under.

Maybe it is the fact that a man cannot get pregnant and we have a shorter life span meaning that in general, we have less money spent on us for our healthcare over our lifetime. Also, if a woman is planning on getting pregnant, she is either a Nadya Suleman or she is a normal woman in a committed relationship with a man and she and he are already paying for their bills in unison making the increased cost a null and void issue.

      The only people this bill helps are the people who want to control your life and the single idiots out there pumping out kids so they can get a gov‘t paycheck because we as a society think that no child should have to suffer for their ignorant parent’s decisions or ignorance.       @ Tzion, because the things that would make healthcare cost less are not what the gov’t or the AMA want. They don’t want you to forgo the expensive and radiation bombarding x-rays and various other scans when you break a finger or get a fracture. They don’t want to just make you better, they want an excuse to have all of their machines and the only way they can afford the expense of leasing or buying those machines is to use them on patients and bill them for it. Also, alot of recommendations on how to make healthcare cost less would involve such novel ideas as stopping the fluoridation of water and the ending the now needless vaccines that people are getting. But the American economy is now largely based in the healthcare profession. If we actually had doctors who wanted to help patients by providing just the services they needed and when they needed them, the healthcare field would take a stumble economically. The gov’t and AMA are trying to treat us all like members of an HOA when all we want to do is build a tree house for our kid and they call it a public eyesore and condemn our home as blighted. They have far too much control over our health as it is and they are reaching so far that soon their wrist will be within striking distance of my meat cleaver. CHOP!!!

      Whenever Obama starts with “let me be clear”(in this case…“let me be specific”)….it is ALWAYS followed by a stream of rambling, incoherent, nebulous banalities that are anything but clear.
      Let‘s talk about Obama’s “well established precendents”. That’s Obama double talk. There ARE NO precendents for this law. NONE! And the supreme has already made that clear. This is the biggest overreach and mangling of the commerce clause ever attempted by an administration. Then what Obama‘s saying when he’s saying “I expect the supreme court to actually recognize that”..is “I expect the supreme to base their decision on the political ramifications of this bill rather than the constitutional ones”. All this from what’s supposed to be a senior lecturer on constitutional law.
      Obama has no contingency plan because he outsourced the bill to Pelos, Reid and the unions. He also knows it’s no point putting a new bill together it will not pass this house this time around.

      I’m sorry BERNBART….but when my employer decides he’d rather pay the fine (or is it a tax?) than pay for my benefits…do I just go ahead and pay the fines (or are they taxes?) each year until I get seriously ill and then I won’t be denied coverage when I am seriously ill? And what will that do to my premiums? Oh and tell me why Physician Owned Hospitals are no longer permitted to build new centers or expand current ones under Obamacare. So much for choice right? I’ll be waiting for your response.
      Oh and one more thing BERNBART….the CBO just priced Obamacare. It’s now going to cost $1.76 trillion. So when Obama crowed about bringing it under $1 trillion he was wrong. He as wrong because the budget tricks and rosier than rosy budget predictions he, Pelosi and Reid used were laughably inadequate for such an expensive venture. When critics said there’s no way you can expand Medicaid to cover an additional 30 million people (formerly 47 million when Obama was including illegals) without incurring HUGE costs…they were right. In just over 2 years..Obamacare’s cost has nearly doubled and as you pointed out earlier…the “treats” haven’t even kicked in yet.

      This is an exceptional example of a red herring. The fact that the act created those things does not justify its constitutionality. The constitutionality of the law is purely determined by the exact wording of the Constitution. The federal government may regulate commerce. It is not allowed to force commerce through coercion in order to then have the power to regulate.

      To say that this allowing people more affordable access is an absolute falsehood. Premiums have already risen because the insurers cannot price risk into individual premiums so we all end up paying more regardless of how well we take care of our own health.

      Additionally this law has created shortages in lifesaving medicine to include drugs used to treat cancer or to aide in recovery after a heart attack (namely sodium bicarbonate) because the FDA is used as a Pit Bull against the drug companies if they won’t agree to sell pharmaceuticals at below market prices to the government. In order to avoid that they choose not to make those drugs that the government demands, in order to prevent be regulated.

      We have effectively given ourselves the same issues the Soviet Union faced from its early days to its final days. The fact is that free market economics work when we refuse to allow politicians to choose winner and losers, and rather let individuals choose with the dollars they spend.

At some point, the liberal idiots will moan and cry that the unforunate need it provided at no cost to them, which means cost to everyone else.

      Under this new swell deal that is being forced upon us, if a person can‘t afford to buy insurance and forgets or can’t afford to pay the “penalty” they will suddenly become a criminal for breaking a Federal Law. Their driver’s license will be suspended and that lovely collection company called the IRS will be harassing the hell out of them.

      this is just another step the progressives HAVE to take before they take it to a single payer level. Do not be fooled. The working few CANNOT pay for all the medical needs of the rest. they have done nothing to cut down on waste and fraud. I am waiting for someone anyone to point out that health insurance is NOT healthcare. I live in rural community and maybe some people do not have easy access to care but having insurance will not change that one bit. I suggest people try to read what they are so blindly supporting. A gov take over of everything is not the answer for freedom loving people.

      I really don‘t give a rat’s ass what it covers.
      My problem and more than half of America’s problem is:
      creating another government agency out of it
      forcing people to buy it whether they want to or not
      forcing people to pay for others -(spreading the wealth in healthcare)
      Allowing the irs and local police to access our medical records -(yes it is in there, how do you think they are going to enforce it)
      and the list goes on.
      Sorry but the government has no right to dicate a person must buy healthcare insurance.
      If it stands what is next:
      forcing people to give up on drinking, smoking, eating only certain foods, not allowing you to have suger or salt -(oh wait, take a look at NY, some of those rules are already in effect),
      mandating you must work out a certain number of hours every week, all in the guise of better health for you.
      Once we go down that slope it will be harder to come back up

      I’m a nurse and all those machines you are talking about really do save lives. I also agree that much can be done to lower health care costs. Most are common sense, if there were tort reform doctors could avoid a lot of expensive tests by ruling IN the most common disorder associated with a symptom and not search for the test that proves conclusively that it is not a one in 3 million differential diagnosis. Defensive medicine (fear of being sued) has afflicted our society. Should there be damages for negligence? Of course but most of this is BS. Take obstetrics, now at the first sign of any change in the monitor the GYN will opt for a C-section, because IF something goes wrong, even congenitally, the Doc might get sued. Shortening patents on drugs or at least standardization would make generics more prevalent. Eliminating tax loopholes for drug company advertising would reduce drug costs dramatically, really how many times do we need to see the “Viagra Man” solve a problem or the “Cialis couple” take a bath? Also remember that many patients see a doctor for a severe cold or cough what they need is an excuse for work, not antibiotics, but they are prescribed SOMETHING because the patient expects it. I could go on and on and on.

      @ Bernbart—- My 48 year old son lost his job. When he finally found employment he was denied health coverage from his new employers provider due to a pre existing condition (sleep apnea) at the prevailing rates. He was informed (I saw the letter) that he could pay the additional fee if he wanted the coverage. The amount was 100% more than the rate for the rest of the employees. He cannot afford the insurance. He appealed the decision and lost the appeal. He has no insurance. If this law is upheld he will be FORCED to purchase something he cannot afford, BTW this job pays less than half of what he made at the job he lost. Obamacare sucks. Stop spreading lies. Educate your stupid self!

      Hey sandra bernhart or bernbart, since your beloved dictator has been in office, pay raises at my place of work were frozen( as of feb. 09) 2 months ago they unfroze them but lowered the pay scale 15% which means I’m overpaid and they are looking for a reason to get rid of me. My health care for a family went from $45 a week to $110 a week, within 2 years for me and my 2 daughters. Gas is back at 4 a gallon, and as I look to find work else where in field that I’ve never had a problem getting a job in my field now I find nothing, and can see the vultures at the door waiting for me to quit, I am stuck, for once in my life. My life in the last 3 and half years has become a nightmare, yet one many would love to have, I’m still lucky to have work. Oh yea my house went under water 2 years ago too, that damn Bush must have done all this, funny though I was doin pretty damn good when he was in.       Lets set aside BumFart’s very weak arguments and consider this: If the nine justices of the court are supposed to rule on cases brought before them based on the merits of the plaintiff vs the defendant and in that capacity set aside personal political beliefs, uphold the letter of the law and the constitution as it has been written then the case brought before the Justices by the states suing the Feds over the mandate should have produced a 9-0 feel to it. The fact that the AG could not provide any real compelling reasons why the law should be upheld should have had even the 4 liberal justices (if they were truly judging by the case merits) a more robust questioning from them. It looks as though the 4 SCOTUS liberals are willing to “make precedent” even though the AG lost the argument on every single point,and lost badly. What it boils down to is this. The POTUS and the Democrats are all for the SCOTUS when they rule in thier favor but when that ruling goes against them the Court and it’s judges are “legislating from the bench” in lock step with the Republicans. What has been lost is the prestige of the court and the role it plays, another necessary step in the Marxist playbook deviously unfolding.       Let people buy CATASTROPHIC health insurance across state lines. Catastrophic insurance is used ONLY for LARGE INJURIES and ILLNESSES. If you smoke, race cars, are fat – etc – you pay MORE in premiums because you are a greater risk.

      People should have a large health care savings account (not taxed) to be used for not large injuries like a broken leg or for aspirin or eyeglasses. And, if they are too stupid to save for a health care savings account or feel saver – just buy regular health insurance which covers preventive and catastrophic medical issues IN THEIR OWN NAMES across state lines. If you buy regular health insurance – you don’t need catastrophic insurance.

      To solve the problem of people not paying for their health care because they didn’t have insurance – THEY CAN NEVER – EVER – REMOVE that debt from their credit report and it will always be due until they pay it off. No penalty costs added – just the true cost (not inflated crap) but no skating out of not paying it either.

      If you are an illegal alien – you will be treated for the medical emergency – but you also will be finger printed, photographed, DNA taken and then DEPORTED. NEVER TO BE ALLOWED BACK INTO THE USA. All employers should be forced to use E-Verify so illegals won’t have a way of making a living. The USA will also BILL the country the illgal came from for the cost of their care and if they don’t pay – we will deduct any charity we give that country to pay for it.

      I’m not a wealthy man, but my family has always had health insurance. I made it a priority and put it before many other things. At one point, when my employer went bankrupt, I cashed in my 401K to pay for it. In other words, I made health care affordable when others wouldn’t.

      I’m not a wealthy man, but my premiums went up almost 25 percent last year in part to pay for all those goodies for others that you’re so excited about. While there‘s a certain attractiveness to a mandate that forces those who don’t share my priorities to ante up, such a thing is an infringement on another’s God given right to be a fool.

      I guess therein lies the point. Those of your ilk simply need to leave the rest of us alone. Period. Continued infringements could get ugly. Things are getting to the point where a law biding citizen like myself could almost be convinced that we’ve reached an ideological impasse and that an organized armed defense is the only option.

      There is so much more to this 2,700 page taxation and government control bill you are leaving out. For example, the HHS secretary can mandate anything she wants without scrutiny, death panels that ration care and can deny care, price control board to limit payment, etc. in this bill you can pay the fine and call to get insurance while waiting in the emergency room and they have to take you. Private insurance will go out quickly. There are also a slew of new taxes like 3.8% on capital gains among others. I pray for SCOTUS to do the right thing

Guess how many people actually went without insurance last year excluding those who opted out voluntarily, were temporarily without, in the country illegally? approximately 10-15 million people… who could have been covered by Medicare… Also what part of the bill actually guarantees better healthcare overall?

      You’re missing a few brain cells! First, dumping millions into Medicaid does what? It doesn’t provide them healthcare…. Right now only about 5% of physicians accept it. Most physicians are limiting new Medicare patients. You might have a card but that won’t help you when sick. Also in this area we have had a bunch of new hospitals all out in the ‘burgs that are PRIVATE. No Medicaid! And No Medicare unless you also have additional insurance. So, since a small area of Florida will be allowed to have these plans after 2014 that means seniors won’t get their care there. So the poor will be forced to get their care in old inner-city hospitals that will be over-crowded and under-staffed. This is exactly why Canada outlawed Private Care. Second, Who is going treat you? Physicians are retiring in record numbers. You going to force them at gunpoint?

Are there some good things in the bill yes I am sure that out of 2500 pages you could find a handful of things that are positive, but be warned there are probably 2400 pages of that bill that are nothing but a big government power grab, whittling away your freedom to choose. The individual mandate is unconstitutional from the word go, government can’t force anyone to purchase a good or service.       There was also NO tort reform, ability to sell insurance across state lines or ANYTHING else that would have affected cost. A simple solution would have been to give the uninsured the ability to BUY into federal blue cross like government employees. People would have had the OPPORTUNITY to become insured, of course it does cost money. So the real goal is more of a National Health System one payer option where the entire country goes broke. Or there must be rationing.

    I doubt very much the SC will repeal the entire bill as to many people are benefiting from it. It they repeal the mandate, which is a very small part of health care reform then the reform it will be funded with taxes, instead of the mandate which called for personal responsibility. In fact liberals did not want the mandate, so it gives them a chance to use this issue to win the 2012 elections and get a single payer system.

      If the SCOTUS exercises judicial restraint, then the only decision they could make is to strike down Obamascare in its’ entirety. Once they look at the legislative history and find that a sever-ability clause, at one time existed, but is absent from the final bill signed into law, the clear intent of congress will be undeniable – If any part is found unconstitutional then none of it is to survive.

      (I would really like to know the details of how it came to NOT have a sever-ability clause. Divine Providence? …I love it when a plan comes together!)

      Problem is the right has politicized the Supreme Court. You used to be able to count on conservative judges to be balanced and make decision based on law, and and not ideology, but not since the radical right took over the republican party. Now the conservative judges on the SC have become judicial activist for right wing politics.

      Please read the constitution. The government cannot force anyone to buy anything. In fact, the solicitor general did not, at least in the reportage available, make the case for the commerce clause, as Obama does in this article. He made an argument relating to, then President Washington (1791), prior to the Supreme Court, mandating the arming of a militia. Lest we forget, even the champions of the Obamacare bill did not read it, “We’ll have to pass the bill, to find out what is in it” (snicker, snicker). I bring that up because at one point there was a “severability clause” which would have allowed the rest of the bill to stand.

    What a line of Blaze bull. Obama gave a very good answer. and he is right. Obama and Democrats were elected in 2008 becausse the public wanted health care reform and they got it. Ironically the Supreme Court is hearing a case on the mandate which was NOT a liberal idea, but based on the republican idea of personal responsibility…if you can afford to buy insurance you should instead of begin a free loader and putting the burden on those who so buy insurance. The Mandate ideas was first suggested during the Clinton administration by the conservative Heritage Foundation, and is sued successfully in MA. The Democrats wanted a single payers system, but negotiated with republican during the healht care debate and settled on the republican idea of the mandate.

    Then the radical right Tea party started their lies that Health Care Reform, that it was a government take over which it is not. Al insurance except Medicare and Medicaid is still private and you still choose your own doctors.

      In the end you WILL NOT choose your own doctor. Employer provided health care is a benefit in order for the company to attract talented employees. If everyone has health care then it is no longer a benefit and employers will drop it in order to pay the less expensive penalty. The government will end up supplying helth care for EVERYONE and no good doctor will want to be a part of what will essentially be Medicare. Stop lying to everyone telling them they can keep their doctor. If they have a good doctor then he will not be part of a medicare type system that pays them peanuts.

      And just for your record, even if the republicans had brought up this draconnian mandate I would still be against it. There is noting personally responsible about the government forcing you to enter into a contract with another person/company just because you were born.

      Obama was elected in 2008 because McCaine wasn’t persuasive enough to bring out the conservative vote. Conservatives are generally disgusted with the electoral process because of the thick layer of corruption and blatant deceit it carries, and they require a truly stimulating candidate they can believe in to motivate them to get their hands dirty in the political process. (This isn’t good, but it’s the way it works. It is what it is.) Combine that with the full-on disinformation campaign waged by the media on behalf of their candidate, which further motivated those who actually believed the campaign lies, and you have the Obama presidency.

      @BERNBART: Good try! Socialized health care is NOT a Republican idea. You speak of this law making everyone buy insurance of their own. How naive do you have to be to think that everyone in America has the money to afford health care. They don’t, so guess what, all of those people will still be paid by the taxpayers, only now the cost will go up, because once they get free healthcare, they will be running to the doctor for every little sniffle, just like so many that do have insurance do now and then the costs will rise even higher. This thing about Insurance companies having to take new people with already existing conditon, instead of the one year or whatever conditions that now apply, will put the private insurance companies out of business (they are not non-profit, you realize don’t you?) and then comes the full government takeover. I am sorry to say this but in my opinion ( and I will be polite with my choice of words) you are at the very least naive.

      Obama-care IS (whether the SCOTUS says so or not) UN-constitutional. Sure, there may be some nice things hidden in it somewhere (which only god must know, since no-one has read the entire thing) but all of the big selling points are garbage.

      Kids don’t need to be on their parents insurance until they are 26… I was booted off of my parents insurance at the age of 20 when I got my Bachelors degree and graduated college… And I have been quite alright without it…. I am sure some of the youth from today will be okay as well, as long as they can get mommies breast out of their mouth long enough to grow up…

      You and your Fuhrer-and-Chief, are lacking something in the critical thinking department, and as long as people like you and the Fuhrer exist only to push forward your agenda, then the country will keep sliding down this path of destruction.

      The government DOES NOT need to do things the individual can do for themselves… BOTTOM LINE.

    Great! He set himself a beautiful trap by getting himself on record for not having a back up plan. This is so good for the GOP if they will think to use it! The left is already criticizing the GOP for not having a plan, and using that as their fall-back plan of attack for the campaign. They want to say “hey, we tried, but an activist court overturned it. You have to get us back in power so that we can try again because the GOP doesn’t have a plan.”

    Now that Obama has said “we have no back up plan,” there goes that argument against the GOP for not having one! Too sweet.

    In fact, the GOP does have a plan, which includes Tort Reform, opening up the insurance markets to cross state lines, fixing the pre-existing conditions problems, and as for federal spending, reducing fraud, waste and abuse. More than anything, they must cut the red tape, reduce the regulations, reign in the lobbyists (who are paid handily, thus driving up our insurance rates), and promote wellness programs to prevent illness and disease (like diabetes and other conditions that are created or worsened by irresponsible lifestyle choices. We should not all have to pay for people to eat, drink, laze, and smoke themselves into sickness. Personal responsibility.)

    Finally, we MUST reveal who wrote the 2000 page health care plan in the first place. Very very telling. GOP get on this. You have to hammer this every chance you get. Reveal the radical origins of such bills.

      Too true. I hope the TEA parties have awakened them and returned some limited government principles. I just know socialized medicine is not the answer, and too much federal regulation and control will lead to that. We need some fresh folks in there, not yet tainted by lobbies – including trial lawyers – and other DC ills. Maybe it’s a simplistic dream. Every time states try tort reform (Texas) it is met with reductions in cost and improvement in care. Then you have Illinois with terrible malpractice laws (unions and trial lawyers have alot of power) and good doctors left in droves, only hurting patients and driving up costs. I don’t think we need a comprehensive controlling bill, we just need some common sense principles and then let the free markets actually operate. What can we do to have them hear us?

      The problem for the democrats relating to a plan is that they perfunctorily dismissed Republican ideas of opening the insurance industry across the country and tort reform. So, the Republicans CAN rightly say, we had a plan all along, which you were not willing to discuss. So after the failure of the Obama bill. They can pass the Republican ideas. If Bart really has his panties wadded up over the people “freeloading” we could include some language to attach their possessions, tax returns or garnish wages to pay for their medical bills. If they are not here legally, they can be deported.
