Obama Uses Executive Authority to Make Recess Appointment — While Senate Is Still in Session

In a defiant display of executive power, President Barack Obama on Wednesday will “stick his thumb in the eye” of GOP opposition and name Richard Cordray as the nation’s chief consumer watchdog. Outraged Republican leaders in Congress suggested that courts would determine the appointment was illegal.

But why are Republican leaders outraged at this recess appointment? Well, mostly because the Senate is still in session.

Although President Obama has constitutional power to make appointments during a congressional recess, Republicans have moved to keep that from happening by having the Senate running in “pro forma” sessions, meaning open for business in name with no actual business planned.

The Senate held such a session on Tuesday and planned another one on Friday. Republicans contend Obama cannot make a recess appointment during a break of less than three days, based on years of precedent.

The Obama White House contends such an approach is a gimmick. For all practical purposes, the Senate is in recess and Obama is free to make the appointment on his own.

McConnell said that Obama’s move “lands this appointee in uncertain legal territory, threatens the confirmation process and fundamentally endangers the Congress’ role in providing a check on the excesses of the executive branch.

The president plans to argue that the appointment was necessary because, with a new director in place, the new Consumer Financial Protection Bureau can start overseeing the mortgage companies, payday lenders, debt collectors and other financial companies.

It seems certain to raise the level of confrontational politics for a president seeking re-election by championing the middle class. Acting right after Tuesday’s GOP presidential caucuses in Iowa, Obama is seeking to grab attention with his most brazen leap-frog over Congress and show that criticism won’t slow him.

Republicans have stalled Cordray’s nomination because they think the consumer agency is too powerful and unaccountable.

The Senate’s top Republican, Sen. Mitch McConnell of Kentucky, accused Obama of an unprecedented power grab that “arrogantly circumvented the American people.”

Added House Speaker John Boehner, R-Ohio: “It’s clear the president would rather trample our system of separation of powers than work with Republicans to move the country forward. This action goes beyond the president’s authority, and I expect the courts will find the appointment to be illegitimate.”

By his move, Obama essentially is declaring the Senate’s short off-and-on legislative sessions a sham intended to block his appointments.

Furthermore, it was the president’s own party that set this precedent. Democrats started the practice when George W. Bush was president to halt him from making recess appointments.

The White House braced for fallout, but said Obama was left with little choice to get the consumer agency fully running after months of stalemate.

White House communications director Dan Pfeiffer announced Obama’s move on Twitter after senior administration officials first confirmed it to The Associated Press.

Obama planned to talk about his decision at an economic event in Cordray’s home state of Ohio, accompanied by Cordray.

Cordray would take over the job later in the week and stands to serve for at least the next two years, covering the length of the Senate’s session.

Obama planned to say that every day Cordray waited for confirmation, millions of people remained unprotected from dishonest financial practices, according to prepared remarks obtained by the AP.

“That’s inexcusable,” Obama says in the remarks. “And I refuse to take `No’ for an answer. I’ve said before that I will continue to look for every opportunity to work with Congress to move this country forward. But when Congress refuses to act in a way that hurts our economy and puts people at risk, I have an obligation as president to do what I can without them.”

More than a standoff over one significant appointment, the fight speaks to the heart of a presidential campaign under way. Presiding over a troubled economy, Obama’s is trying to persuade a weary middle class that he is their advocate, while fending off criticism from Republicans challengers and lawmakers.

Republicans have had little opposition if any to the qualifications of Cordray, a former Ohio attorney general. Their objection is with the consumer agency itself.

Obama and his team say lawmakers should try to revise the Wall Street oversight law if they don’t like it, not keep the agency from performing its job.

What should one expect to see happen next? Ed Morrissey of Hotair offers some insight:

Don’t be surprised if Obama turns to the [National Labor Relations Board] NLRB next.  The board can’t operate without a quorum, which it now lacks, and the GOP won’t budge after the activism of the NLRB under the influence of his previous recess appointment, Craig Becker. Cordray won’t cost him much political damage, but Obama will come under fire regardless of which way he goes on this.  Business leaders will erupt in outrage if he forces more activists onto the NLRB, and unions will be just as outraged if he doesn’t.  Obama needs the former for funding and the latter for organization in the coming election, but setting this precedent will make it almost impossible for Obama to resist more recess appointments.

Update: It looks as if Morrissey’s prediction was spot-on accurate. A recent report claims that the president has lost no time in appointing new members to the NLRB.

“…President Barack Obama said in a statement Wednesday he will recess-appoint three people to the National Labor Relations Board,” writes Steve Goldstein of Marketwatch.

“The three, Sharon Block, Terence Flynn and Richard Griffin, would allow the controversial board to continue to operate, since at the moment it only has two members and quorum rules require that at least three be present,” Goldstein adds. ” Senate Republicans had sought to block the appointments.”

      Congress passed the Consumer Protection Bureau into law. It wasn’t Obama on his own, it passed BOTH the senate and the house. The senate then decided that they would use the ability of the MINORITY to overrule THE MAJORITY and filibuster the nomination of anybody just to stop the already approved board from being of any use. A record number of filibusters have been used to stop any progress at all and Obama is just using the SAME constitutional powers presidents of both parties have used for decades to bypass congressional stalling tactics. This may be a grey area that needs to be sorted out by the courts but it is nothing new.
      Just out of curiosity, why would you not want a board to oversee the financial institutions that brought our economy to its knees with illegal schemes and trades? Under our weak regulations now, nobody was prosecuted for the damage they did to the economy and bonuses and trading schemes are bigger than ever. Only a matter of time before it all crashes again without some oversight and control. Do you really think stock traders, and bankers are looking out for you? Do you really think they won‘t stop crushing the economy if we don’t stop them. Nothing wrong with profit and making money off your success, but the banks and financial institutions are making money off of FAILURE. Every bank and financial institution stock has lost significant market value in the last 2 years and pay and bonuses are higher than ever. How is that success?

      McCain and others remain silent. If the US Constitution is no longer valid, then the Government no longer is valid and no one in the Government has the legitimate right to rule over us. We no longer have the obligation to follow their laws. Only the Government’s guns force us what the demand.

Healthcare, private businesses, banks, and yet they let him keep going and going. The 2012 election cannot come fast enough. Hopefully, we will still have enough country to recover by then. It becomes more doubtful everyday though. Wow, now I hear the other socialist, John McCain, has endorsed Romney. This is a shining endorsement along with Jimmy Carter, and George H. Bush.       President Obama currently has a total of 217 nominees pending before the Senate. These nominees have been pending for an average of 101 days, including 34 nominees pending for more than 6 months.
      The 15 nominees President Obama intends to recess appoint have been pending for an average of 214 days or 7 months for a total of 3204 days or almost 9 years.
      President Bush had made 15 recess appointments by this point in his presidency, but he was not facing the same level of obstruction. At this time in 2002, President Bush had only 5 nominees pending on the floor. By contrast, President Obama has 77 nominees currently pending on the floor, 58 of whom have been waiting for over two weeks and 44 of those have been waiting more than a month.

      Jay ‘Carnival’ Carney earlier today in his daily briefing confirms Obama will continue to go around Congress using the blame republicans and GOP excuse to help the American people.       I am still waiting for the House to impeach the NLRB and Obama for racketeering, and nullifying the union contract that Boeing was forced to sign under blackmail. They are no different than gang members forcing businesses to pay for protection or suffer dire consequences. Not only that, but the union contract is not legal and can be challenged because one of the points of a contract is that it must be made without being under duress or coercion.

      Word on the streets is that the GOP isn’t actually willing to take him to the SCotUS for it because they could side with the executive branch by ruling Congress is not allowed to keep pro-forma sessions open just to obstruct executive appointments.

      Sickening on all sides. Obstructionism from the GOP is due to the law itself, not the appointee; the time to fight it would have been prior to it being signed. Obama power-grabs, and all odds are he’ll get away with it. Seems like the expiration of the tax cuts all over again; media will spin it and the public will overlook Obama’s powerplay while poo-pooing the GOP. Sigh.

      Okay….good to know…..but is anyone going to do anything about it, or just point their finger at him and say “you are doing wrong”?

      Here is the problem with not doing anything…..they see that there is no repercussion for their actions, so they will just dismantle our system while people just point fingers and say “they are dismantling our system”

I agreed that Republican obstructionism is the reason that the American public has such a low opinion of Congress, 7% favorable rating last I checked, and that Republicans are blocking every appointment President Obama has made simply to shut the government down.       You guys don‘t read enough to understand what’s going on here. The creation of the Consumer Financial Protection Bureau was passed into law by Congress. Like it or not, it’s the law of the land. Republicans don’t like it because the agency is set up to monitor businesses who would increase their profits with deceptive and fraudulent practices, which reduces the profits of the businesses who pay for their reelection campaigns.

      Republicans are trying to prevent the CFPB from operating by using their “advice and consent” responsibility. But even Bohner admits he doesn’t have an objection to the nominee. This has nothing to do with the qualification of the nominee. Republicans just using a parliamentary procedure to prevent the President from enacting a law that passed in accordance with the Constitution.

      The House isn’t in session. Some guy walks into the chamber once a day, bangs the gavel to open the session, empty of legislators, and then bangs it again a minute later to close it. The legislators are all at home, hundreds or thousands of miles from DC. Sorry, the Congress has been in recess and will remain in recess despite the intern gavel guy. Maybe it’ll go to court, but in the meantime, the Government has to function.

      This president must be made to fear/respect the force – the consequence – of his abuse of power; however, I have no confidence the republicans have the balls to bring the Obastard to heel. Had they the stomach for a real fight we’d have seen it long before now.
      We’re dealing with a foaming-at-the-mouth mad-dog, who is ripping the heart out of The Consititution. There is only one way to deal with a ravening beast and it doesn’t involve rolling over and showing it your belly! At the very least you deal with it by capturing it, isolating it, and waiting for it to expire.
      The obamination has taken far too much power- unopposed. Given the efforts made by the congress thus far, he will remain free for the next year mauling then devouring what remains of the America we love and admire like so much red-meat!

I worked for Citi in the mortgage group in the 90′s and FNMA and FHLMC came within a hairs breadth of shutting us down for playing fast and loose with credit quality on our loans. Note the time — early 90′s. I was there. I lived it. What changed? FNMA and FHLMC decided to stop enforcing credit quality.

      Has no one caught on to the fact, if it is true, that the CLRB is funded by the Federal Reserve, an agency that is not subject to congressional oversight or any other regulatory regimen and which can print its own money? Is this a trend by the “progressives” to undermine our constitution? More and more, I realize that the Federal Reseve needs to be eliminated and the authority for our fiscal house restored to the constitutional bodies as originally intended. If the CLRB is not subject to congressional funding, then how many other agencies, in the future, can be cloaked under the same funding scheme to take away our liberties?

      When they go along with what you want, you take credit for working with congress. When they don‘t you go around them whether it’s constitutional or not. And if the courts don’t strike down these appointments, then it simply sets a new precedent for future presidents (republican or democrat) and further retards one of the checks and balances put forth in the constitution. Furthermore, instead of pulling americans together he’s deepening the chasm.

      Unfortunately, our legislative branch has no ground to stand on when they talk about “constitutionality”. They just passed the NDAA, so an appointment (#33 or #34?) is just a constitutional burp compared to what congress has done.

    Georgia judge denies president’s motion to dismiss eligibility challenge. Obama must meet constitutional qualifications to be on 2012 ballot!

    Even assuming Obama was born in HI despite allegations by numerous experts that his birth certificate and social security number are fraudulent, his Kenyan father precludes Obama’s eligibility as a natural born citizen in violation of Article 2, Section 1.

      @Tea — a child of an illegal alien born here has the right to be President. His father was a legal alien at the time. His mother was a citizen. Born in Hawaii gives him the right to be President. That the newspapers had birth announcements says he was born in Hawaii. Not even Soros plans that far ahead.

      Spend your time on working toward impeachment and dismissal rather than this dead subject. Spend your time on getting a person elected who will support and defend our Constitution rather than making end runs around it. Spend time getting senators & reps elected who will follow the Constitution first and party second.

      Elena you are right. All this focus is on the Presidential race, but we must not lose sight of the Congressional seats. We need true conservatives in both houses that can not only reign in Obama if God forbid, he is re elected, but to keep in check the RINOS of the Republican Party if they happen to win the election

      Looks like the birthers are at it again, FIrst if you are born on US Soil you are a Natural Born Citizen. There are only two types of US ctizens, Natural Born and Naturalized. Immergrants are Naturalized, Obama and every other citizen is Natural Born.

      As for the Georgia ruling it is nothing more than a ruling on proceedure not the merits of the case. Ths waste of judical resources will also go away.

      Many have flagrantly dismissed the usurpation of the Presidency by focusing on a trivial aspect of the diversionary birth location issue, under the false impression that a citizen is the same as a natural born citizen.

      The overly touted birth announcement in the local HI paper is completely insignificant. It simply means the birth information reported to the state by a resident parent to qualify for a COLB, was also provided to the newspaper by the family or the State for routine casual inclusion. Because HI law at the time permitted a COLB to be issued in this fashion for children born elsewhere and later brought to HI, the newspaper announcement is immaterial to the issue of Obama’s birth location.

      It is interesting to note that the reported dwelling was vacated by another family only four days prior to Obama’s alleged HI birth and that his parents never lived there together, if at all. As enticing as this may be to some, given that Obama’s birth certificate and social security number are alleged to be fraudulent by numerous experts, even if one simply assumes Obama is an American citizen born in HI, he is still not Constitutionally eligible.

      Our Constitution, Article 2, Section 1, requires the President be a natural born citizen i.e., one born in the U.S. to U.S. citizen parents. Obama is ineligible for failing to have TWO U.S. citizen parents!

      Well Tea, the blog is has lied. This was a motion on proceedure, not law and not the merits of the case. The law is settled, has been settled since the 1800′s with hte Wong case. Obama is a Natural Born Citizen, this administrative court judge is lookng for his 15 minutes and wasting state resources.

      14th Amendment, If you can’t prove, beyond a reasonable doubt, that he wasn’t born in HI, he is Natural a Born Citizen, ie: anchor baby/prez.

      Failure to qualify as a natural born citizen is not a birther issue, it’s about supporting and defending the Constitution. You two should try reading it sometime.
