Obama Warns ‘Unelected’ Supremes: Overturning My Law Would be ‘Judicial Activism’

President Obama has waded into the legal battle surrounding his landmark health care law with a stern warning to the Supreme Court not to overturn it. Specifically, Obama argues that the Supreme Court deciding in such a way would be an “unprecedented” example of “judicial activism” undertaken by “unelected” judges. The relevant excerpts of the President’s speech, as reported by Reuters, are as follows:

“Ultimately, I am confident that the Supreme Court will not take what would be an unprecedented, extraordinary step of overturning a law that was passed by a strong majority of a democratically elected Congress.”[...]

“And I’d just remind conservative commentators that, for years, what we have heard is, the biggest problem on the bench was judicial activism, or a lack of judicial restraint, that an unelected group of people would somehow overturn a duly constituted and passed law,” Obama said.

“Well, this is a good example, and I’m pretty confident that this court will recognize that and not take that step,” he said.

The remarks have prompted a flurry of speculation about how much of an effect, if any, the President‘s remarks will have on the Court’s eventual decision. The Drudge Report has openly speculated that President Obama knows something about the eventual outcome of the case, possibly through a leak from the high court itself. The Huffington Post, meanwhile, has drummed up the President’s confidence with the headline “It Will Stand.”

How accurate is Obama’s charge of “judicial activism,” though? While it’s true that the Supreme Court has at times deferred to the will of Congress, or of state legislatures, a decision blocking laws that are passed by “strong majorities” is not so “unprecedented” as he might think. In fact, the Court struck down an act of Congress as recently as 1996 – specifically, the Line Item Veto Act, which passed the Senate by 69-29, and passed the House by unanimous consent. This is a much stronger majority than existed in the case of Obamacare, and ironically, the judges who struck the law down were (with the exception of Clarence Thomas) all from the liberal wing of the court. Another case where the Court struck down a law passed by the Federal Congress concerned the Religious Freedom Restoration Act.

In fact, very recently, the Court arguably took on both the President and the Congress in the case of Hamdan v. Rumsfeld, which not only ruled that the Bush administration could not try detainees under military commissions without express authorization from Congress, but explicitly set aside an existing act of Congress which arguably removed the Court’s jurisdiction over the case. Again, the majority in this case consisted of liberal justices, and Justice Anthony Kennedy.

So does Obama know something we don’t, or is the charge of judicial activism unwarranted? Weigh in below.

      Does this socialist dictator in waiting even have a clue as to why we HAVE a Supreme Court? They are there Comrade Obama to stop leaders (and I use that term “leaders” very lightly) like you from dictating law which is exactly what you did in this case. You, Nancy Pelosi and Harry Reid colluded to rape the private sector and take over health care when 60% of Americans don’t want your intervention in the matter.

      No Barry, you can just friggin show up on the scene and do what you damn well please, it doesn’t work like that in this country, although you are trying to change it.

      Hopefully, you and your ilk will be thrown out in November in the biggest landslide since that waste of a President, Jimmy Carter. If you don’t get the boot in November, history will remember you as we remember Stalin and Mao, nothing but dictators who thought they could control the spirit of their own countrymen. Shame on you Barry! You are becoming a scary monster.

      While waiting in line to vote in the past primary, I was asked rather loudly who I supported. I replied, “If the ballot had a button for secession, I’d be for that. ”

      The whole crowd erupted in a cheer – Republicans and Democrats alike. I didn’t expect that kind of response. While I was exclaming in jest, I thought I would never get back out of there due to people wanting to discuss how we’d be better off working on our own issues “closer to home”. This was in Tennessee.

      All I have to say to Texans is, if you do exert your Constitutional right – you might find some familiar company. The outrage against DC is really bigger than I thought and may be crossing some party lines outside the inner-city limits.

      All these statements are serious veiled threats. If his Obamacare is shot down will he resort to force?

      That might sound extreme, but keep in mind this is the same guy who has supported the radicaliasm of Rev. Wright, Black Liberation Theology and Critical Race theory. Too, he announced that he would institute a “civilian defense” force that would be as strong, as well-funded and powerful as the US military.

      He supported Harvard’s Henry Gates against a legitimate police arrest simply because he was black. He announced his support for Trayvon Martin who was what is now revealed as a black thug and burglar, along with other criminal pursuits.

      He spent twenty years in the church of a racist, hate-mongering preacher with a like-minded congregation. Almost his entire adult life he has been a community organizer consumed with one goal, which is to advance the black populaton and black causes by any means necessary.

      I’m warning people now who have the ears to hear. This man is extremely dangerous to the country. If he sees his health bill destroyed before his eyes I’m betting it will unhinge him to the point of going into a severe ballistic mode wherein he would be capable of causing chaos on a grand scale.

      No health care bill, little chance of re-election…all spell mental meltdown for this extreme man who has held extremist ideas all his life. BEWARE!

      Obuma knows exactly what he is doing. He was a law professor. Not a smart one. Passable. But the game he is playing now is politics, and he is manipulating public sentiment. In the process, by undermining the legal process this nation has in place (judicial review), he is cheapening the legal foundation of this nation.

      It is his intent.

      This is a man intent on bringing this nation down. The white man’s laws must go. Instead, a zulu warrior will rule. That is BHO’s vision. He is a clown, but I hope he takes the facade off so we can all can see it clearly. Blacks in particular need to see it. They need to see the evil manipulators of their race.

      And then we can get back to the business of making this a nation of laws, with blind justice, for all. No benefits based on race. No double or triple standards. One legal standard for all.

      Once that is understood, the Sharpton’s, the Jackson’s, the Jone’s, the Spike Lee’s fade away into irrelevance. And finally we can get back on track.

      Democratically elected seems to be the code word for the actual phrase—”we either duped you or cheated your vote, we are in, so now that we are here, we do as we wish.“ As for calling the SCOTUS an ”unelected” group of people, he is not only issuing a veiled threat, he is trying to wage a poliitcal war against them. Even the left leaning judges are having a problem with the individual mandate. And yes, Obama, without that mandate you cannot steal from those you demand by law pay to fund for those you gave waivers to. Also, he keeps equating pre-existing conditions with the individual mandate. Total b.s.
      Furthermore, what do you all think of his conference with the leaders of Canada and Mexico? I feel a North American Union coming on quicker than we thought.

Besides the piece of crap being totally unconstitutional you lied about the cost to get it passed and it will be the demise of this country if it actually gets fully enacted.       Even if 60% wanted Obamacare it doesn’t make it Constitutional. 60% could just as easy want all blacks sent back to Africa however the constitution give people rights. That‘s why we live in REPUBLIC where simple majority rules can’t pass Unconstitutional legislation. To protect the minority as well as the majority the establishment of inalienable rights .

      Obama is right. If the Supreme court overturns this law it will be a textbook case of judicial activism. This situation presents one of those interesting cases where the hypocrisy of both sides comes into focus: Obama has been happy to support judicial activism that overturns laws he opposes. On the other hand, the right has been decrying judicial activism for years, but now there’s broad conservative support for it in this case (even though the individual mandate was originally a conservative idea!)

      Obama knows that the arguments at the Supreme Court went poorly for his lawyers and I imagine this is an attempt to appeal to Chief Justice Roberts and Justice Kennedy. Roberts is likely concerned about the long-term stability of the court and might be susceptible to this argument because he does not want to set such a bold precedent so early in his tenure and at a time of serious political antagonism. Kennedy might be persuaded on the grounds that he should not support hypocrisy from Scalia, Alito, and Thomas.

      There’s a chance it will backfire, however. Obama‘s unprecedented direct attack on the court’s ruling in Citizens United infuriated Roberts and this appeal might do the same. Obama is playing a desperate game in the wake of his side’s weak showing last week. This Hail Mary pass demonstrates how worried his administration is about the court’s eventual ruling.

      These are no more than games. Political theater. Obango drama. Manufactured disinformation. He has nothing else to do because he has backed out of his agenda due to the “election year” ‘sensitivity’ of the electorate.

      This P O S law “IS” unconstitutional on its face. The ONLY real affect of keeping this law “IS” the affect it will have on destroying the constitution. Which was the goal from the outset of his candidacy.

      You don’t have to be a savant to divine that truth from his actions.

      The SCOTUS holds America, literally, in the grasp of this one decision. If they uphold it, history will record the SCOTUS as the final blow to justice, contrary to it’s own “name”, and liberty in the last free nation on earth.

There are different charges for each child on this plan. Younger children you pay $100 per month per child, teenagers $150 per teenager per month, Adults $200 per person a month They will set up a committee and they will either deny or accept your treatments for all kinds of procedures. There is so much more you need to read the Bill. You will be shocked!

They know if this radical, corporate owned Court overturns this law, then every state will go to a single payer health care SYSTEM.       Bad BO’s “warning” was not a warning at all but simply a rally cry to his base, Progressives. It’s an election year and his Progressive base has been disappointed, in their view, of his lack of pushing the Progressive agenda even further down the throats of Americans. They see bad BO as too passive and timid and was expecting more of an FDR. In order to be the image they want, he issued this so called “warning” so as to seem more forceful and to excite them so if the ruling is overturned they will not blame him for being a sissy progressive but will blame and targets the courts and to try and erode the few balances of powers we still have left. 

      His citing of Lochner v New York, wrongfully cited I might add, is quite clear this rally cry was meant for the ears of Progressives, the very core of Lochner v New York case.

This SCOTUS ruling won’t come down until June and they will try and make everyone happy. Justice is gone. The Consitution will remain behind glass and will be just a piece of paper.       If the courts want to declare something “unConstitutional”, they should declare the Democratic Party unconstitutional, because they have willingly gone along with this LYING POS POTUS in his attempts to dismantle the Constitution, destroy and “fundamentally change” this country into another Russia, Cuba, etc. The Democratic party has shown themselves to be the enemy of this country, of freedom, and the enemy of the people.       It wouldn’t surprise me if he did not try something like that, since he seems to think his every whim should be the law of the land–no matter HOW Unamerican, anti-freedom, etc. But the Justices are “appointed for life” PRECISELY so that sme POS like ODUMBER cannot use political pressure to sway their decisions, and I don’t think the SCOTUS justices would go quietly into retirement, if he tried that. At least we can certainly pray that is the case.

      Since our gutless Congress has chosen to cede their powers to the executive branch and allow this POS to do whatever he wants, no matter HOW unconstitutional, our liberties and the life of our Republic are currently in the hands of those nine justices — or at least the six this POS of a POTUS did NOT appoint. I don’t think we can trust his appointees to do the right thing–look how Elena Kagan refused to recuse herself, even though she was intimately involved in writing this monstrosity of a law they are now attempting to overturn.

    I believe the Supreme Court voted last Friday. NoBama must have received a leak that things did not go well. If they had gone his way he would have remained mum. But because he has come out so strongly, even referring to the Court as “unelected” individuals, he must be trying to get someone to change his vote or face his wrath.
    Plus, this is just what his base wants to hear. Stand by. If there is more of this from him it will show further acts of desperation.
