Obamacare Gets Its Day in Court: Supremes to Hand Down Historic Ruling Thursday

WASHINGTON (The Blaze/AP) — They’ve known the outcome for three months. Now it’s time for the nine Supreme Court justices to share it with the world.
Barring some incredibly strange twist, shortly after 10 o’clock in the morning Thursday, Chief Justice John Roberts is expected to reveal the high court‘s verdict on President Barack Obama’s health care overhaul.
Between 400 and 500 people will crowd into the marble courtroom, the only witnesses to a historic moment that will not be broadcast live on television or radio. Some of those hoping for seats already were in line early Wednesday afternoon.
The court is not just passing judgment on a major expansion of the social safety net, designed to cover an additional 30 million Americans with health insurance. It is doing so on the president’s signature domestic legislative achievement and in the heat of his closely fought campaign for re-election.
Four major issues await resolution, the most important of which is whether the law’s centerpiece requirement that most people have health insurance or pay a penalty is constitutional. The justices also are weighing whether other parts or indeed the entire 2010 law should fall if they strike down the insurance requirement.
Apart from the insurance mandate, the court also is considering the validity of the health care law’s significant expansion of Medicaid, the joint federal-state health care program for the poor.
One wrinkle could prevent the court from deciding the fate of the insurance requirement. A mid-19th century law prohibits challenges to taxes until they have been paid. The insurance requirement does not kick in until 2014 and people who pay the penalty won’t do so until they file their 2014 income tax forms by April 15, 2015.
The court devoted more than six hours to arguments about these issues over three days in late March. The justices met March 30 to take a vote on the case and sort out who would take the lead in writing the opinions. In a case of this magnitude, the chief justice probably is writing the majority opinion, assuming he is in the majority.
The 26 states and the small business group challenging the law seemed to have the better of the courtroom arguments in March. Conservative justices peppered Solicitor General Donald Verrilli Jr. with hostile questions about both the insurance requirement and the Medicaid expansion.
But the lively arguments, the only time the justices discuss pending cases in public, are a relatively small part of a rather large record – in this case, a mountain of more than 140 legal briefs.
Whatever the outcome, it seems certain to become part of the campaign between Obama and his Republican rival, Mitt Romney.
Obama could try to make the court itself, or more particularly its conservative majority, an issue if the insurance requirement or the whole law is struck down. For his part, Romney already has said he will try to take advantage of either outcome. If the law falls, Romney said it will show that “the first 3 1/2 years of this president’s term will have been wasted on something that has not helped the American people.” If the law is upheld, “we’re going to have to have a president – and I’m that one – that’s going to get rid of Obamacare. We’re going to stop it on Day One,” Romney said.
The case began almost as soon as Obama signed the law on March 23, 2010. Even before the day was out, Florida and 12 states filed the lawsuit that ended up at the Supreme Court. Another 13 states later joined in later.
The heart of the challenge was the claim that Congress could not force people to buy a product – health insurance.
The administration advanced several arguments in defense of Congress’ authority to require health insurance, including that it falls under the power to regulate interstate commerce.
The government also argued that the insurance requirement was necessary to make effective two other undoubtedly constitutional provisions: the requirements that insurers accept people regardless of existing health problems and limit what they charge older, sicker people.
The administration also said that even if the court rejected the first two arguments, the insurance requirement and penalty are constitutional as an exercise of Congress’ power to enact taxes. The penalty assessed for not buying insurance functions like a tax, the government said.
That argument, however, has been largely viewed by Conservatives as an after-the-fact argument. Still, the document does contain plenty of other taxes. If the government can’t force me to buy a product (healthcare), then how can they force me to buy a government product (social security). Afterall, we know that social security is not a good deal.
Of course, this may be a reason why they uphold obamacare….

However, if the SCOTUS looks at precident – they might not strike it down. The government already requires people to buy products. For instance, the government requires companies to have minimum disability insurance for their employees as well as other coverages. The government requires hospitals to treat people who do not have insurance….. Companies are just groups of individuals – so the precident has already been established.

Report Post »once again, I think you are getting this wrong. The FEDERAL government does not require any INDIVIDUAL to buy ANYTHING. It is the STATE govermnments that require certain public safety type purchases–car insurance, etc. The FEDERAL government does, however, REGULATE certain aspects of commerce, etc, that does affect the daily life of the individual.

Don’t plan on any help coming from the Federal Goverment, as they were the ones who sold the weapons to the enemy across the border. Governors of the souther states need to consider large scale deputizing of the public in order to form their own militia to combat the border war brewing in Mexico. A show of force along the border would be the ticket to defeating the Marxist plans action against the southern USA (mostly republican). Shut down the drug traffic and detain the illegals, should be the primary focus of Southerners until after the election.
Report Post »The law does not allow the States to intercede in legal immigration and they should not. However the law does allow the states to protect themselves if need be, even mustering a militia if needed. That is what needs to occur.
Capture and Detain these illegals in camps. Detain them but don’t hurt them. Any that wish to return to Mexico allow them to return. Advise ICE of the others and keep them detained until ICE handles their deportation our homeland security approves their application for entry. The states can not decide their immigration status, but they can detain them until that status is clear.

There will be a whole list of executive orders passed immediately.

The health care bill alone, provides control to the government over everyones health. Most people don’t understand that comment. Its means that ALL decisions concerning your health, no longer belong to the individual but to the government. The government can therefore dictate to you what you will and will not do based upon the power given them by this legislation.
The interesting issue is, this is the same, exact action which Hitler and the 3rd Reich took when they gained control of Germany just before WWII. It was under their health care system that the Jews and the elderly and the mentally handicapped and political dissidents against the 3rd Reich were euthanized.
This is how communism works boys and girls. The plan was to have anyone who dared stand agains the Democratic-Marxists declared by their health care doctors to be mentally incompetent…. Starting to understand. Anyone who dared speak a word agains the Democratic-Marxists would be held by the health system for evaluation and treatment… Starting to get it?
Now understand that this part of the legislation remains, even though the individual mandate is eliminated.

This is a plan that was drawn up in the late 60s and was scheduled to be implemented “about 50 years later.”. It was set into action in 2008. It is a separate thing from what had already been going on.

The justices said at that point, they were the judicial and not the legislative branch. Their intention was to send the law back to congress for rework of the components which were not supported according to the opinion of the supreme court.
The supreme court wil not strike down the entire law, sending it all to the trash can as some suppose. They will throw the ball back in congress court, and make them digest the 2700 bill and sort out the details. This will create a limbo situation for those federal departments gearing up for this legislation as well as the medical industry. Legally anyone who is forced according to this law could contest its validity based upon the courts opinion and win their case. The federal departments who choose to act under the legislation will do so understanding that any regulatory activity taken under the legislation could be contested in an court of law and most likely defeated, leaving the government agency powerless to enforce the law. Further, congress will not be compelled to fund activities of the US government where the basis of the legislation is deemed by judicial opinion to be unconstitutional.

However the remainder will be very confusing to Americans as they will not understand what happens to the remainder of the 2700 page bill. The Supreme Court is not going to read the entire bill, they are simply going to kick it back to congress for rework. This means all of the other activities in the bill will be in limbo. Congress does not have to fund them if they do not want to and the Executive branch can press foreword with their implementation.
The best explanation would be That the remainder of the bill remains law, however it remains questionable as to its ability to be enforced due to the courts opinion on the individual mandate.
Nothing will happen with it until after the election. Its important the all Americans who do not want government control of their health, pay attention and vote for those people who will stand for the elimination of this very Marxist based legislation. Americans must load both houses and the presidency with those people who have sworn to uphold the elimination by vote of this legislation. That is the only way this nightmare goes away. The Democrats brought us this Marxist legislation, voters need to remember that at the polls in November and vote each and everyone of them out in each and every election through out the entire of the United States both federal and local.

You will not see the current administration back off of building its vast Marxist based health machine. If the vote is against the individual mandate, then Congress can refuse to fund the legislation and any federal activities which take place as part of the legislation (such as the 13000 treasury agents).
What ever occurs today, the repercussions are going to be a mess until we send enough people to congress to vote against the legislation based on the courts opinion. Its most important that people do not get caught up in the presidential issue this November and concentrate on the Congress. Everyone in congress who voted for this legislation, needs to be replaced. We need a solid 2/3 majority in both houses and we can eliminate this legislation and more, regardless of who is president. Its better for Americans to have a congress who is aligned with We the people, and not the Marxists. A strong congress can move a single entity such as a president. The republican congress under Clinton proved that to be true. We need to replace the Democratic -Marxists with Libertarians and Republicans, and continue to do so until all Democrats are completely gone. The Democratic party is infected by Soviet Marxists and can not be fixed.

A house without its foundation won’t stand long — and to gut this law by removing the individual mandate would have the same metaphoric effect.

I hope that the justices recalled that the ‘tax’ of Obamacare was at first not declared a tax until it started to go to the SCOTUS, and then Obamas admin changed tactics and direction.
