Update: Here is a more recent video that lays out the shooting incident in northern Philadelphia. It confirms all initial reporting in the incident from yesterday, and gives some additional details. Eells is currently in the hospital and is expected to make a full recovery

A Philadelphia college student put his firearm carry permit to good use Monday, as he shot it out with a would-be robber, hitting him twice.Philadelphia Student Carrying Legal Firearm Shoots It Out With Armed Robber

Robert Eells, 21-year-old Temple University student, was in front of his off-campus house smoking a cigarette at 1:30Am Monday when a group of teenagers approached him and asked for money. The main suspect- who is 15-years old- allegedly then attempted to rob Eells, who refused the demand for cash.

At that point, police say the suspect started shooting, and hit Eels in the stomach.

But Eels was able to fight back. He drew his own legal pistol and fired, hitting the attacker in the chest and leg.

School officials say Eells is recovering at Temple University Hospital.  He had a license to carry the weapon he used and faces no charges in the incident.

The suspect is also in the hospital, and will face aggravated assault and attempted robbery charges. Police are searching for two accomplices.

      15 year old criminal SHOULD be tried in 1st Degree murder attempt and charged as an adult. His two accomplices should be tried as adults in accessory! Throw it all together WHY were 15 year olds out on the streets packing guns at 130 am?? Prosecute the parents too!!!

      Pennsylvania is a legal “carry state” ….. for adults and those who are not felons.
      Felons may not possess or even live in a home where firearms are present.
      Therefore, I my kid is convicted of a felony offense, I have to choose whether he stays or the guns.
      Guess which one I choose.

      I don’t understand the premise of the question? Why would either leave? If your son was convicted of a felony and PAID HIS DEBT then he is a free man. You don’t lose your 1st amendment right or 3rd, 4th, 5th, etc., when convicted of a felon and have served your sentence –why your 2nd? Let me reword that … YOU DO NOT LOSE A RIGHT AS A FREE MAN!       Do we sacrifice the legal system so felons can carry guns.
      Issue of CHOICE is a huge topic today.
      Patriots do the right thing within the premise of societal law and a uniform code of conduct.
      Would Washington have accepted members who would be a detriment to his cause.

      Remember the kid in Arizona saw the Gifford group but went to the drug store first to get smokes. The smokes was the problem also – he had a 45 cal. gun and a carry permit. He would have been a real hero if he had not been out of smokes.

If you have you are square with the house and a FREE man with ALL your RIGHTS(inalienable). If you have not paid your debt you should be in prison. What part of “shall not be infringed” do you not get? There should be NO gun laws on ANY level of ANY kind.(plus they don’t work, look at N.Y., Philly and D.C.) I also believe you should have the right to yell “fire” in a movie theatre per your 1st amendment right. You get to deal with the angry people you just p***ed off if it was a “joke”.

      Your son is this scenario made a mistake, PAID HIS DEBT as determined by his peers or a judge. Gets a second chance. If it is a right… YOU CANNOT LOSE IT. If you think you can lose it, then you don’t have any rights.

      As for Washington… the premise of your question? Washington and all of the colonials committed treason to fend off an oppressive government; trampling rights. Hmm, were any founders ever imprisoned? That’s your point?

      Be careful, in PA you “lose your right” for much less than a felony. “… that is why I can keep my guns”. Really? Keep them no matter what –it is an INALIENABLE right and a duty as an actual patriot(not just an avatar monicker).

      NY has the strictest gun laws. In-fact if you have a weapon with out a permit it is mandatory jail for 3 years.

      I have a few friends on the job in the City of NY and here is what they tell me about that law.

      One friend brought in an armed robber and went to the DA with it here is how it went.

      DA: so he had a weapon
      PO: Yes

      DA: was it loaded??
      PO: Yes

      DA: was there one in the camber??
      PO: No

      DA: well we will throw out the gun charge.
      PO: ?????

      Now if bloomy wants to do something perhaps he should talk to his DA’s and tell them the law is to be enforced before he goes around to other states and tells us how to handle our weapons.

      I left NY several years ago to a much friendly state and I enjoy having my second amendment rights.

      Welcome to Philadelphia. I know this area VERY well.

      Students come here from all over the world, are shown this beautiful campus for Temple(and LaSalle, Drexel, University of Pennsylvania, and many many others) but are NEVER told that just ONE block off campus is one of the most dangerous neighborhoods in the country. These schools are given their own police forces, NOT to keep the students safe, but to keep the lie.

      Students have the right to see police reports from the campus their going to attend, so the very specialized police districts let them NOT count anything that happens even across the street from the school. THIS incident is a great example, it’s two blocks off school grounds, which means they won’t have to report it, and can keep attracting students who have no idea that it’s smack in the middle of gangland.

      Me like Florida law. I think if the laws against illegal firearm use were toughened, it would do better than making it harder for people to get guns. Criminals will always find a way on the black market to get a gun. Do you really (or I should say, does anyone really) think that those criminals got that gun legally? One was 15 for Pete’s sake. I don’t know of an honest gun dealer who would sell a gun to a 15 year old.

      Loriann12; We don’t need more laws. What we need is that the ones already on the books are enforced.

      There are to many plea deals being made so that prosecutors have more tee time. Some courts “work” 2 or 3 hours a day.

      Look at what is happening at the Federal level. Imperial decrees NOT to enforce laws. Letters of declination issued by AUSA’s because $500,000 in fraud isn’t worth their time to prosecute.

      Enforce what we have on the books.

      Your words could not ring more true. I have family that have attended Philadelphia schools (Temple University) and it is a battle ground for thieves and punks. My nephew’s apartment was ransacked numerous times, his car broken into 5 or 6 times, and his bicycle literally stolen from him as he rode to work at a downtown hotel. I was aware that he had a gun at school, however I advised him to leave it with me because I did not want to see it stolen from his apartment. Underage straw buyers are not looked at fondly in PA. St.Joe’s University has the same reputation and is located on the prestigious “Main Line”. Members and friends of my family have attended there and have been ripped off, and apartments raided while the students were sleeping. It may be titled the city of brotherly love, but it is anything but brotherly, and lacks a true representation of love. It is also true that Philly felons (students) are attending PSU in State College and violent crime is on the rise BIG TIME!

      Unfortunately, you can not do that. Once the threat is no longer there (you have neutralized the situation) you must cease fire. If you don’t, it is called an execution and you will be tried for murder.

      Although I live in a rural area of Pennsylvania, like my American Express, I don’t leave home without my sidearm. At home it is locked and cocked, as the nearest police help is most likely a half hour away.

      Thank god this young man had the foresight and courage he had. I wish him a speedy recovery. As for his assailant, I hope he gets sepsis while in the hospital.

    This student made a very important impact on North Philly:

    As a student, this gentleman is there to study and make the most of his money spent.

    North Philly is not a safe place and SOME great prof’s take jobs to teach great kids, like this young man, to learn street skills (he’s adept) and his classes.

    Middle school kids are the worst as they have to prove their worth to the dealers. Sad.

    This young man who wants a better life for himself and his family will now have to explain himself for the rest of his life because he wanted to live and go back to class.

    Move Temple as that is the only way for a great University to survive as you are 2 miles north open space and no kill zones.

    Not sure what the photo at the top of the story is supposed to signify — frankly it looks like a cheap water pistol — but in a story about a student defending himself with a “legally owned” firearm (the term “license to carry” implies concealed carry, but that is not made explicitly clear), a photo like that is rather perjorative. The clearly defined classroom setting in particular illustrates all the worst criticisms against allowing weapons in universities — a deadly weapon carelessly hanging out of a kid’s belt, gangsta-style, both visible and easily accessible to anyone. The whole point of concealed carry is that your weapon stays CONCEALED. Bravo to anyone using their 2nd Amendment rights to defend their life (while in compliance with the law themselves) but please, don’t give the anti-gunners any unnecessary excuses to come after our guns. Photos have immense emotional impact and this one does us no favors.

      It’s called a photo ILLUSTRATION folks! How do you show a photo of a young man who looks totally average and have the viewer instantly think, “he’s concealing a weapon inside his waistband.” You don’t. People don’t think that way! So you have to SHOW the gun so people will THINK about the gun. The criticism in this thread is absolutely stupid. There is no way to have an authentic photo of a concealed gun that communicates the desired message.

      You are right ‘concealed carry’ means concealed BUT I really DOUBT the Law in Pennsylvania requires, people who are licensed to carry a firearm, to carry it concealed. It seems most states issue a “Permit to Carry a Pistol” with no stipulation as to concealing it. Sure someone carrying like that looks like a dumb a$$ but being a dumb a$$ isn’t against the law. Hell, you can even be president of the US of A.

      In TN, my permit just say “Handgun Carry Permit” and I was told, during the fire arms class to obtain the permit, that I can carry concealed or open, depending on my choice. It also depends on the establishment.

      Walmart has a policy where they allow people to bring their pistols in concealed but if you go in open, you can but if an employee asks you to leave, you must leave. Other stores have different policies but most respect the state laws.

      @SFSUPER49ER…If the victim had been a member of congress it would have been attempted murder, the news would be reporting it for months, Obama would have shown up to blah, blah, blah, and the taxpayers would be picking up the bill for his medical bills.

      @MIKE – Neither Black nor African American is descriptive. The perp was a gangbanger from a single parent family who sponges off the system and looks for victims to suppliment his income. It is a social issue not a racial one. Even if all minorities were removed from society we would still have the same problems with social sponging poor white kids (think Westside Story). The solution is no welfare for healthy poor. Get them to work so they can have the dignity of earning their way in the world.

    Hope the student heals quickly and well. I would like to hear of more statistics on the crimes that have been prevented or stopped by LEGAL gun owners. It seems to me that this goes unreported to often.

      I’m not sure I would have wanted to empty the clip, since there was a group. Not having the knowledge of spare ammo I couldn’t judge his choices harshly. Personally I would have had at least one extra clip, but reloading in a tense situation can be less than perfect. If the threat was removed it would appear prudent.

      ender… Good point. When shot, the immediate loss of blood and shock
      will sometimes cause the victim to lose control and drop the weapon. A victim gets weak fast with a bullet in them. He probably got as many rounds off as he could. And since the shooter was down,
      he did as he was trained. And stopped.

    Hard to say, not being there, but there was definitely a disparity of force (3 vs 1) and I probably would have fired after the attempt to take my money and I felt my life was in danger. I wouldn’t have waited to be shot first. Other than that, good job in exercising your 2nd amendment rights dude. I hope you heal up quickly.
