Protesters Rally for Former Marine and 9/11 Truther Detained Over Anti-Gov Facebook Posts (With Video of Arrest)

RICHMOND, Va. (TheBlaze/AP) — A former Marine involuntarily detained for psychiatric evaluation for posting strident anti-government messages on Facebook has received an outpouring of support from people who say authorities are trampling on his First Amendment rights.

Brandon J. Raub, 26, has been in custody since FBI, Secret Service agents and police in Virginia’s Chesterfield County questioned him Thursday evening about what they said were ominous posts talking about a coming revolution. In one message earlier this month according to authorities, Raub wrote: “Sharpen my axe; I’m here to sever heads.”

Brandon Raub Detained for Psychiatric Evaluation Over Ominous Facebook Posts, Some Cite Violation of Free Speech

Police – acting under a state law that allows emergency, temporary psychiatric commitments upon the recommendation of a mental health professional – took Raub to the John Randolph Medical Center in Hopewell. He was not charged with any crime.

This video was filmed of Raub being taken in by authorities and posted on YouTube:

As the YouTube user IamKirstenMeghan writes in the description for the video posted above, one of the Facebook posts called into question is song lyrics. The song being reference is “Bring Me Down” by Swollen Members with the rapper Saigon.

A Virginia-based civil liberties group, The Rutherford Institute, dispatched one of its attorneys to the hospital to represent Raub at a hearing Monday. A judge ordered Raub detained for another month, Rutherford executive director John Whitehead said.

“For government officials to not only arrest Brandon Raub for doing nothing more than exercising his First Amendment rights but to actually force him to undergo psychological evaluations and detain him against his will goes against every constitutional principle this country was founded upon,” Whitehead said.

Raub’s mother, Cathleen Thomas, said by telephone that the government had overstepped its bounds.

“The bottom line is his freedom of speech has been violated,” she said.

Thomas said her son, who served tours as a combat engineer in Iraq and Afghanistan, is “concerned about all the wars we’ve experienced” and believes the U.S. government was complicit in the Sept. 11 terrorist attacks. One of his Facebook posts, she said, pictured the gaping hole in the Pentagon and asked “where’s the plane?”

Whitehead said he found nothing alarming in Raub’s social media commentaries. “The posts I read that supposedly were of concern were libertarian-type posts I see all the time,” he said.

The big concern, Whitehead said, is whether government officials are monitoring citizens’ private Facebook pages and detaining people with whom they disagree.

Dee Rybiski, an FBI spokeswoman in Richmond, said there was no Facebook snooping by her agency.

“We received quite a few complaints about what were perceived as threatening posts,” she said. “Given the circumstances with the things that have gone on in the country with some of these mass shootings, it would be horrible for law enforcement not to pay attention to complaints.”

Whitehead said some of the posts in question were made on a closed Facebook page that Raub had recently created so he questioned whether anyone from the public would have complained about them.

“Support Brandon Raub” Facebook pages have drawn significant interest, and other Internet sites had numerous comments from people outraged by the veteran’s detention.

Raub’s supporters characterized the detention as an arrest, complaining he was handcuffed and whisked away in a police cruiser without being served a warrant or read his rights. But authorities say it wasn‘t an arrest because Raub doesn’t face criminal charges.

Col. Thierry Dupuis, the county police chief, said Raub was taken into custody upon the recommendation of mental health crisis intervention workers. He said the action was taken under the state’s emergency custody statute, which allows a magistrate to order the civil detention and psychiatric evaluation of a person who is considered potentially dangerous.

He said Raub was handcuffed because he resisted officers’ attempts to take him into custody.

      These are straight up communist tactics. This is an exact picture of where this country is at this moment. Freedom of speech is dead. My first thoughts when I heard of this was of the blind Chinese dissident Chen Guangcheng who was imprisoned for years in a Chinese hospital. Is this why they are building the internment prisons in Utah and elsewhere? How many of you think the police and military won’t turn against the American populace now? They will at the drop of the hat just as they did in this case.

      UM, yes, you CAN go into a theater and yell FIRE! if you want to. If there’s no fire, and no one gets hurt, there will be no more consequence than if some Occupy Wall Street goon shows up to a rally and yells over the speaker. They will face consequences, like getting escorted out, but they will not be arrested because they broke no laws.

      If they were concerned they could have got a warrant and followed him around a bit, rather than sweeping him up without a warrant, no charges or lawyers, and putting him in a mental ward. There are thousands of similar post on this site even that could end in the same result. Words do not equal actions. Freedom is lost in America because of people such as yourself.       It’s not so much as to what he said as to the fact that the Feds are choosing sides in the issue. The left is being left untouched despite issuing more dramatic and violent threats.       Give me a break. He didn’t do anything wrong and needs to be released or charged immediately. Putting him in the psych ward is bogus.     Can we quit beating around the bush here and just acknowledge we are now rounding people up for thoughtcrimes?

    As for all the cops in that video, you rounded up a citizen for a thoughtcrime! Where does that end? You go home to your wives and kids and your neighborhoods and your grocery stores and churches and walk your dogs and wave at your neighbors like you have nothing to hide. You probably are even proud of what you do. People need to be educated and informed. They need to shun you and your family like the Stasi that you are. You can‘t round up people for thoughtcrimes and then walk among us like you’re part of the community. Same goes for the DA’s and courts that allow this to happen.

    WE THE PEOPLE can police ourselves. This starts by demanding that the Stasi stop hiding behind their rules and code and procedure and training, etc. and start being accountable to the constitution above all else.

    Now you know why DHS (and other acronyms) are buying enough hollow points to put five rounds into every man woman and child in this country.

      There was conjecture, but not specific threats. In fact, it looked mostly like he was talking about the response he was going to provide to provocation.

      Furthermore, by your logic, “threatening” a government agency is grounds for dismissal of constitutional rights and therefore you can be held indefinitely. However, any agency has the justification to do unto you as they see fit without review or oversight. Gotcha.

    We have a serious mental health problem in our country. Shooters in both AZ and CO both showed signs of mental problems that were noticed, but never followed up on. It is actually very difficult in most places to force mental evaluation on people.

    If there was a process to legal detain people for review, it might have helped in those two cases and others.

    Maybe this guy needs to be checked out. I pray that is what is really happening here. Simply picking someone up off the street is no good, though. There needs to be an order by a judge, which may be missing from this instance.

    One of the reasons we dismantled our mental health system making it so hard to detain people like this is because it is rife for abuse. If you don’t like someone, just get them committed. I pray this is not what is happening here.

      I don’t agree with what this guy has to say. But he has a right to say it.

      And it’s call “Due process of the Law” Someone has to actually do something wrong like break the law, before you can be arrested, or picked-up by Law Enforcement. Even with Mental Health, it’s someones actions that must be a danger to themself or others.

      The Government can’t arrest someone because they think they may do something. If the Government can do this, to this man, they can do it to you, when ever they want……….

    Though I think ‘truthers’ are a bit ‘coo-coo’ for believing the government had a hand in the 9-11 attacks, this man made NO DIRECT THREAT to anyone in particular. And for the government to forcibly detain him for psychiatric evaluation for nothing more than venting his rage, smacks of tactics used in the former Soviet Union.       Some of his posts are a bit out there, but I think they should have questioned him, at least and maybe read him his rights if they were going to ARREST him? What else would it be called, when you handcuff someone, take them away, and detain them? He should be able to have a lawyer present at all times, since they MIGHT try to charge him with some kind of crime in the end. This is all seems backwards and they have the RIGHT to just grab him from his home like that.

      I don’t agree with the truther stuff especially after Popular Mechanics got a bunch of academics & other professionals & debunked it. But that is not a reason to lock him up.

      Obama has created this atmosphere with his strategy of not releasing his transcripts & his Executive Orders going around Congress. He had a Democrat majority congress his 1st 2 years & he did not pass a bill for amnesty (for example). I can find the grade points of Al Gore, John Kerry & George Bush. But somehow Obama’s GPA is sealed, hidden. If we saw his GPA would the Potemkin facade of his supposed genius fall. Would we see him as a figurehead for the left who was an affirmative action student & a spoiled rich brat form a wealthy family who had a grandma who was a President or Visce President of a major bank. his granny was a bankster.

    The judge issued a warrent of detention; therefore it is a court ordered arrest and detainment, w/o any representation and reading of his rights, and no charges placed upon him, this is a clear and present and blatant move of intimidation by the administration and Homeland Insecurity for the sake of gaining more control and power.

    Our government detains people like this but let A Muslim spout his hate while in the military and did nothing until he killed 15 on a Army Base. This is the Obama Democrats way folks.       I want to make a point here (in case anyone cares). I don’t think they should round up the OWS people unless they destroy property or injure someone, etc. Same for NBPP. Thoughtcrimes are not a basis for incarceration. I bring up those two examples to point out the fallacy of the argument in rounding up Raub. Because we are no longer a country of laws we are now a country of political whims. One man‘s thoughtcrime is another’s anthem.

      The messages are not the problem. In fact, they should be dragged out into public and debated vigorously and defeated if they are garbage. The problem is the Stasi defining thoughtcrimes to begin with.

    Let’s see, a Patriot (and fellow Marine) is now a victim of the Pariot Act which was enacted right after the 9/11 (inside job) fiasco. Convenient!

    We lost three high-rise towers (WTC-7 was never hit but came down anyway), too many innocent Americans, and then our individual rights.

    By the way, the damage to the Pentagon has the very signature of a cruise missile. There was no plane there as some of us had “boots on the ground” post-strike witnesses and there were no bodies except for the ones killed in the building. The people of the U.S. have been given FALSE information regarding the whole matter. No plane hit the Pentagon – a missile did.
