Public School Defends Posting Nativity Scene Despite Potential Church-State Challenges

A superintendent at Green County Tech Primary School in Paragould, Arkansas, is taking a strong stance in support of a Nativity scene at an elementary school in his district — a scene that has been posted for 20 years without incident.

After ordering the bulletin board be taken down, Superintendent Jerry Noble has decided to allow it once again.

The traditional Nativity scene includes the words, “Happy Birthday, Jesus,” which Noble, a Christian, is adamantly defending. After receiving two complaints this year, the superintendent initially consulted with lawyers and decided to remove the Nativity. But — the community’s reaction led to a change of heart.

“Enough is enough,” Noble explains. “It’s His birthday. We celebrate Jesus’ birthday. One person should not be offended by that. We don’t leave it up all year. We’re not promoting religion. It’s not an effort to convert anybody.”

He explains that he initially removed the Nativity, because he didn’t want to put the school district at risk. “I could not take it upon myself to get the school in a legal entanglement over separation of church and state because we would have to use tax dollars to fight it and that’s not my job to do that,” he explained. But once he removed the display, the community criticized the decision.

Then, a group came forward to support the school if and when a legal challenge against the display was waged. So, Noble decided to put the board up again. “To be honest with you, we offended a lot more people by taking it down than leaving it up,” he said.

The Paragould Daily Press has more about the legal issues potentially facing the district:

…the school district’s attorney, Donn Mixon, who advised him to have the decoration removed. Mixon admitted he was not given all of the details surrounding the controversy and was simply asked whether a nativity scene displayed in a public school was a violation of the Establishment Clause of the First Amendment to the U.S. Constitution. [...]

“I gave the opinion that yes I believe, based upon what I was told about it, that if challenged, it could well violate the First Amendment,” Mixon said. “Prayer at graduation, the posting of the Ten Commandments, those are all issues that have been litigated under that establishment clause. The courts have generally held that if public schools do those types of things… that can violate the Establishment Clause.”

The district’s pro-Nativity stance is already frustrating those opposed to Noble’s actions. The American Civil Liberties Union Arkansas (ACLU) has already said that the school must abide by the Constitution. Rita Sklar, the state’s ACLU director, has come out strong, saying that it’s sad to see Noble and others not respecting the First Amendment. Fox News Radio has more about the controversy:

The Nativity scene was erected by Kay Williams, a counselor at the primary school. She’s been doing it for more than 20 years without any hint of controversy.

“We do live in the Bible Belt,” Williams told the Paragould Daily Press. “One thing that really disturbed most of [the supporters] was we hear about things like this all the time in other parts of the country. But, this is kind of a first for the Bible Belt, here in Arkansas.”

Noble says that Christians have been silent for too long.

      The decision should be left up to the community. But then again so should state elections and state referendums. You can’t have it both ways merely based on your preference as to do so is the epitome of ignorance. Outside groups should be barred from coming in to influence decisions no more than outside groups should be barred from coming in and influencing state elections.

      I had to put up with Kwanza decorations, gay agendas and movies, tolerance classes and anti-Christian BS from the school system for years. I am fed up with the brainwashed ilk… I am so fed up with people stating the 1/10 of 1% example every time. The 1A says we have “freedom OF religion…” and are free to post a nativity scene. If the principal wants to put up a NATIVITY scene because it is CHRISTMAS, then what is wrong with that? If you are so against this, then the kids should go to school on Christmas day because we don’t want to offend anyone. Do you take off that day? The teachings of Christ are Love,patience, peace, kindness, etc…how is that a bad thing? Stop with the brainwashed PC BS, this country was founded on Christs’ principals…this is the fabric of our society. Just like Islam is the fabric of the middle east and you have to accept their traditions if you want to live there. Well, this is the USA traditions…don’t like it? Bye bye… I’m done changing and conforming to PCism (aka Marxism)

      It is not about religion, it is about politics and fundamental transformation. To remove Christianity is one of the steps to implement communism. The actual government doesn’t want citizens to be born with a liberty endowed by the creator. If you remove Christianity and the creator you remove the liberty of the people. This is why Obama always omits saying this specific sentence about liberty and the creator when he refers to the Declaration of Independence.       State by state simple laws can be passed for every instance of Community ys one or a few people in matters like this who have objections. Set a one or two day referendum for voices on the matter. Either community or others prevail. So easy to show where the real sentiments lie.
      It could become an over whelming tidal wave.

      The First Amendment: “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”

      What part of the First Amendment does the ACLU think they get the power to take down anything religious or not from any place whether public of private? This “separation” thing has gotten way out of line! There is NO separation of anything so quit trying to separate us!

      If WE can’t put up Christmas displays for a religious reason, then how about a freedom of speech reason? Don’t “they” use it against “us” all the time as the ultimate reason “they” can spew their crap?

      The “Black Friday” shoppers went more nuts this year than in past years. Maybe it has to do with more cell phone videos, maybe not.

      Now it seems like every time you turn around there is some ONE person complaining about some ONE setting that they disagree with and want EVERYBODY to knuckle under to their will.

      It’s time WE say loud and clear, “SCREW YOU! This is our country and our traditions! If you don’t like them then go to some other country where your whims and wishes will be tolerated, if you can find one.”

    Once again, there is nothing in the Constitution that says anything about seperation of church and state. It says that the state cannot establish a religion nor can they impeed our right to worship as we please. I please to have a nativity in the town square. It is public property which means that I pay for it too and it is as much mine as anyone elses. These lefties and athiests are impeeding christians rights to worship as we see fit. That my friend IS against the constitution.

      So your saying its ok to spend my tax money on your believes, but my believes don’t matter? As for education… An educational institution that is a public school isn’t suppose to favor one religion over another. Thats the only thing thats going on here. Celebrate your believes all you want. If there isn‘t a single tax payer that isn’t Christian than then there should be no problem… but it is highly unlikely thats the case. Can’t we keep our believes to ourselves or must we always force our believes upon our neighbors…? I dont live in this community so my opinion doesn’t hold much weight there. But if one of the public schools where I live starts putting up Christmas decoration on the school property **with money from the school budget,** then ofcourse I’m gonna be upset about that! That money should be spent on EDUCATING young minds about the REAL world, not the IMAGINARY world! Kids don’t have books, pens or paper and you wanna spend tax payer money (mine and yours) on Christmas descorations…? Go ahead believe what you want to believe, but don’t force it upon my children.

      I agree .. .and this year I have put a nativity in my yard … just to take a stand on PRIVATE property .. the government tells us what our toilets can be .. what light bulbs we can purchase .. I am taking a preemptive strike before they TRY to tell me I can’t have a nativity in my own yard! It will be up every December from now on …

      1) Nothing in the article indicated the school was favoring one religion over another. There was no mention of denying any other displays. – You are making a biased assumption.

      2) Then money should not be spent on teaching Evolution. To date it has never been conclusively proved, thus it falls in that imaginary world you refer to.

      3) Same applies to you. Demanding the bulletin board be taken down because you believe religion is a “fairy tale” is forcing your beliefs on someone else’s children.

      Tell me something. If the government should remain neutral from any religious activity then why is it that Christmas is a federal Holiday ? Christmas is the birthday of Jesus Christ. That is a Christian celebration. Easter is a Christian holiday. If you are right then the government should remain open during those holidays to remain neutral as you suggest.     Simple solution. Toss up another bulletin board about Hanukkah, and another about Kwanzaa, and you’re all set. No legal challenges, stays true to Supreme Court rulings, and still maintains the traditional Nativity scene just fine.

      Could you please point out where it says anything about barring a government entity, branch or facility from displaying a religious scene? A display does not “establish a religion”.

      Are you aware that the United States House of Representatives and the United States Senate both have an official Office of the Chaplain? Since 1789 Christian chaplains have opened sessions in both the House and the Senate with prayer.

      If it’s ok for Congress to have official Christian prayers…then it is certainly ok for a school (or any other government entitiy) to display a nativity.

The US Supreme Court has been clear about religious displays on government property, such displays are violations of the Establishment Clause as they show governmental favortism to one religion or another. The navitiy itself is offense to Christian groups that find Christmas a papal holiday or that the statues violate the 10 commandments and graven images.

      The offense of Chaplain is on shakey Constitutional grounds it just hasn;t been challenged yet.

      The Supreme Court has degenerated into a corrupt “buy a vote” institution. Congressional hearings regarding the appointment of judges have proved that. The Supreme Court has misinterpreted or entirely ignored the Constitution many, many times.

      There are religious displays on several government buildings in Washington DC including the Supreme Court. A depiction of Moses holding the tablets is prominently displayed over one of the entrances to the building. Because they are unable to deny it IS Moses and the tablets, those screaming their incorrect statements about Church & State justify the display by saying it is only a reference to a “lawmaker” (which is incorrect, Moses did not write the commandment laws, God did).

      Funny, the Congressional Chaplain posts have not been challenged since they were first instituted well over a hundred years ago. Hardly on “shaky” ground

      Considering both the House of Representatives and the Senate have an official Office of the Chaplain and that said chaplain is a PAID employee….are you saying that Congress is violating the Constitution?

      Yes, the office of Chaplin is Unconstitutional and a holdback from a different era. The Supreme Court is clear on this issue, public school must remain neutral when it comes to religion. This display is a violation of the US Constitution and the Principal should be fired for willfully violating it.

      And I notice you did not address the fact that every session in both houses is opened with a Christian prayer. Nor did you address the fact that every President has led a Christian prayer, prayed with other Christians and said God Bless America in their official capacity of president. I certainly don’t see the Supreme Court challenging either of those displays. No, they’d rather pick on things like a school bulletin board or a nativity scene or someone calling a Christmas tree a Christmas tree.

The Bible tells us that Jesus said in the book of Matthew that, he came not EXCEPT to the LOST HOUSE OF ISRAEL, which refers to the LOST TRIBES OF ISRAEL…which would include the United States of America. We are intricately connected to Jesus Christ, who is the HEAD OF THE TRUE CHURCH; therefore, WE CANNOT BE SEPARATED from our State/Country and the Church. It is impossible to separate the two. The whole argument then of Church and State falls flat on its face!
    The ones among us that are contrary to everything that we stand for are the Assyrian/Goths that traveled through the pages of history with us; the descendants of our ancient enemies that took us captive. They hate our roots and race. They hate our God, The God of Israel, and they mean to destroy our race and everything that we stand for. We no longer can tell them apart from us except for their characteristics in their behavior towards us. They melted into our race and look much the same as we do. They hate our Constitution, they despise our laws, and they fight against everything that we hold sacred and dear.

See the clause says congress shall make no law respecting the establishment of religion or PROHIBIT THE FREE EXERCISE THERE OF.     Somebody explain to my how an “attorney” who supposedly has studied the Constitution in law school (yeah, right!) does NOT know what the First Amendment ACTUALLY says, and what Jefferson REALLY said (and WHY) about “separation of church and state.” If I as a lay person can educate myself on this issue, why the h*ll are attorneys so stupid?? My God, do these people not have ANY sense at all???????

    I used to live in Paragould growing up and Congrats to the school district for telling these people to “pound sand.” As Spock would say, “the needs of the many outweigh the needs of the one.”

    Maybe all these atheists who are so “disturbed” (pun intended) by Nativity scenes, signs across a road, crosses on top of water towers, etc. should start their own friggin‘ town where they can all be unhappy together and not bother the rest of us who DO believe in celebrating Jesus’ birthday!!!

    Maybe George Soros can buy some land for them and donate it, or maybe the thousands of dollars that OWS has in the bank can go toward starting their own town. Then they can all “work together” (ha!) in harmony….Don’t worry, we all know that town would fail just like the first “communist-style” colonies in the U.S….Idiots, surrounded by idiots!

      It‘s not freedom from religion it’s freedom of religion. Just because a school gets money form the government doesn’t make it part of the goevrnment. If that’s the case they should stop people on welfare(government money) from wearing crosses,having Jesus fish symbols on their cars,or even going to church.If seperation of church and state is an absolute then all government workers should be barred from attending church or donating money(tax dollars) to religious charities as well.
      I say do it all build up suh a hatred in this country for atheist that they’ll crawl back under what ever rock they crawled from and shut the he77 up. Not only that but you can also set so many court presidenses that can be used to stop atheist leeches in their tracks.
