Rahm Emanuel Ruled Eligible for Chicago Mayoral Race

Former congressman and White House chief of staff Rahm Emanuel can run for Chicago Mayor, the Illinois Supreme Court unanimously ruled Thursday.  The Chicago Sun-Times reports:

In a 7 to 0 decision, the court Thursday said an appellate court erred in taking Emanuel off the ballot earlier in the week.

The decision means Emanuel holds onto his position as the first name on the ballot in the Feb. 22 election. Emanuel has been leading in both the polls and fund-raising in the race that includes candidates Carol Moseley Braun, Gery Chico, and Miguel del Valle. Patricia Van Pelt Watkins and William “Dock” Walls are also on the ballot.

“So there will be no mistake, let us be entirely clear,” the Supreme Court wrote in its ruling. “This court’s decision is based on the following and only on the following: (1) what it means to be a resident for election purposes was clearly established long ago, and Illinois law has been consistent on the matter since at least the 19th Century; (2) the novel standard adopted by the appellate court majority is without any foundation in Illinois law; (3) the Board’s factual findings were not against the manifest weight of the evidence; and (4) the Board’s decision was not clearly erroneous.”

In response, the Emanuel campaign said their candidate was “very pleased that this issue is finally behind us.”  The Supreme Court’s ruling makes it clear, Emanuel attorney Kevin Forde told the Chicago Tribune, “the law has been settled for 150 years.”

The Supreme Court’s ruling overturns a Monday appeals court decision that prohibited Emanuel from running due to residency concerns.  In that decision, Judge Thomas Hoffman ruled that “the candidate’s name be excluded [or if, necessary, be removed] from the ballot” because Emanuel lived in Washington D.C. and had not “resided’’ in Chicago for a full year prior to Election day.

But the state Supreme Court ultimately agreed with Judge Bertina Lampkin who wrote Monday‘s dissenting opinion which criticized Hoffman’s residency requirement as “not based on established law.”

Emanuel’s attorneys argued that the Illinois state election code should also apply to local elections and that leaving the Chicago area to serve as chief of staff counted as “business of the United States” for which he should not have to forfeit his residency status.

    Uh huh – Regardless of how many votes Rahm receives, he will be ordained as Mayor. Chicagoans know that this whole “election” is just for show and that they have no say in the predetermined outcome; it is quite sporting of them to play along. Let’s face it; everyone knows that Barry will be returning to Chicago in January 2013 to resume his “community organizing” activities and to begin building his kingdom – so it essential that he control the city government. The “outcome” of this election was decided long ago.

    Well, of course, he can run for Mayor !!! Was there any doubt about that and he will win (is there any doubt about that?) Rahm is part of “the group”. Happy I don’t live in Chicago !!!! And to top it all off, I heard Rahm was renting out his home in Chicago while living in Washington “serving his country”—so he was not a resident of Chicago–he is a resident of Washington. Sad situation that this country has to put up with all this crap !!!

      I understand your point, but I feel that every paid working American is both serving their country and following a career choice. He chose the path he did, and was well paid for it. I don’t think he made any sacrifice that any other American would not have made in the pursuit of his career – and he should have maintained his residence if he wanted to serve as mayor, so that he would be within the law.

      I think it is funny that choosing a high paid, high powered career that will keep on paying him for years to come as a known political figure, should be lummped in as “serving the country” the same as a relatively low paid, life on the line soldier – the latter indeed should be exempted.

      Most elected officials, as well as appointees, maintain their legal residence in their home state. Not sure what Illinois law says, but the Supreme Court obviously agrees with Rahmbo. Glad I am in Texas and not in ILLinois!

      No, Illinois politics is as crooked as it gets. Fortunately for most of us Chicago is just a giant pimple on the butt of Lake Michigan. So for 200 years Chicago used one standard, but in 2 seconds, the state overturned that and ruled state requirements supersede Chicago’s.       Folks on this blog have to familiarize themselves with home rule. State law is not supreme here, research preemption. Just saying “state law” doesn’t necessarily mean anything at all.

      For instance, ammunition you cannot purchase in Chicago, you can elsewhere in the state. Same with some rifles.

      Chicago has a residency requirement of its own and it should control. Illinois SC just mucked up preemption more than it already is and all for Rahm. The people of Chicago should reject Rahm, but then, dead people tell no tales.

Also believable about the WH staffer who burned to death in her DC townhouse garage…when that happened, it did seem very strange…he ties things together well! Wonder if he has done any investigation into John Wheeler’s death (was found dead in the landfill about a month ago)…Thanks for the link!

      I never had a doubt that Rham Emanuel would prevail in his quest to run for the office of Mayor of Chicago. He was not a “resident” of Chicago for the 12 months prior to his name being placed on the ballot but the Illinois Supreme Court seems to have over looked that “detail” in their ruling of 7-0 in favor of Emanuel. I guess it’s a ,” You scratch our back and we’ll scratch yours ” kinda thing. Politics in Chicago has it’s own rules, made up as they go along. Rham Emauel is highly favored to win the election for Mayor of Chicago. After Blogovich, I guess Emanuel can’t be ll that bad, or can he ?

      LTB…It is not that Chicago deserves or doesn’t deserve this. Look at the population of Chicago, the control and influence that falls into Rahm’s hands in terms of helping in the 2012 election. If you take the population base of the largest cities in the U.S. and have people in control to help fundraise and campaign on your behalf, how many points can you swing in a national election? Let alone if there is corruption, of course Chicago is exempt from that:).

      No doubt.. the same state that could not get the ballots out to our US Servicemen to vote on Nov 2?

      Yet they can walk them into the jail cells and hand deliver the ballots to felons?… Yea no doubt!
      wow the court systems moved fast for Obama and Rahm didn’t they … but not so much for our fighting men and women?

      Chicago … the state of the art in corruption and Rahm wears it well!
