‘Real News From The Blaze:’ Law of the Sea Treaty

Known in Washington as the Law of the Sea Treaty, Democrats are moving to ratify the United Nations Convention on the Law of the Sea, which looks to set global regulations for international waters. Foreign Policy reports:
The Obama administration and Senate Foreign Relations Committee Chairman John Kerry (D-MA) are beginning a new push to seek ratification of the United Nations Convention on the Law of the Sea, known around Washington simply as the Law of the Sea Treaty.
The treaty, which came into force in 1994, established rules of the road for operating in international waters and set forth a regime for determining mineral and other rights beneath the ocean floor. Since then, 161 countries have signed on, as well as the European Union, but the U.S. Senate has not ratified it.
First proposed in 1982, the treaty has never come up for a full vote in Congress. Ronald Reagan refused to sign it for fears of what it might do to American sovereignty. In 1994, President Clinton signed a revised version of the bill but the Senate has never ratified it. In 2007, President George W. Bush endorsed the treaty, prompting objections from Senate Republicans. While seemingly reasonable at face value, CNS News reports on some of the treaty’s fine print that has led to strong opposition on the matter:
Article 82 would require certain members to transfer a portion of royalties from use of the sea’s natural resources to the International Seabed Authority in Kingston, Jamaica. For the United States, resources located on the U.S. continental shelf – defined as 200 nautical miles or more from the shore – reportedly could be worth billions. So, if the U.S. Senate ratified the treaty, the country would be required to transfer part of royalties from drilling for oil and other activities to the ISA.
Massachusetts Sen. John Kerry leads proponents of the treaty who say it “will allow the United States to secure mineral rights in a larger geographical area, would ensure freedom of navigation for U.S. ships, and would give the country better leverage for claims in the Arctic.” Opponents led by Sen. Jim DeMint argue like President Reagan that the United States sovereignty would be subjugated and that the wealth of developed nations would be redistributed to less developed nations.
The treaty was the focus of Monday’s opening discussion on “Real News”

Posted on May 15, 2012 at 7:34amI think that you guys need to get a little more real …… I don’t like the UN generally but I am now coming to pray that the UN will tell the US to get lost in terms of the FATCA legislation that was passed as part of the “Jobs” bill last year. There are no international sovereignty grabs worse than those initiated by the US. The FATCA legislation seeks to impose massive costs and/or penalty taxes (in violation of existing Tax Treaties that the US has in place with a number of countries around the world) on ALL people in ALL countries world wide. The FATCA rules are GOING to severely reduce the US economy over the coming 5 / 10 years or so as the rest of the world wakes up and redirects their economic activity (tourism, investment and purchasing of goods and services) away from the US. The US tried isolationism in the early 1900s and found that it does not work – it still will not work today. The FATCA rules are alienating America’s FRIENDS.
BTW why should the Law of the Sea HQ not be in Jamaica or Cayman or anywhere else in the world? Why should these international institutions all be in the US or Europe thus causing severe redistribution of members’ dues and Ambassadorial expenses FROM poorer countries TO the US and Europe. What arrogance.

Posted on May 14, 2012 at 11:58pmThe video is better than the written story on the LOS Convention because it explains a few of the reasons that the United States has supported it under both the Bush and Obama administrations. It could have gone further to note that every living chief of naval operations, every living commandant of the coast guard and the Chairman and Deputy Chairman of the Joint Chiefs support it as do the commanders of Pacific Command, NorthCom and European Command. The Convention has bi-partisan support and support from the most respected security think tanks. That doesn’t mean people should accept it just on those endorsements, but it does mean that simple arguments against the convention don’t give a fair presentation of the convention.
In 1982, President Reagan sent his negotiators to the final negotiating session of the convention and sated publicly that if changes were made to meet 6 criteria, all related to the deep seabed mining provisions, he would sign the convention and ask the senate for advice and consent to join. We weren’t able to get those changes in 1982, but with patience we got everything Reagan wanted in a a second agreement that we signed in 1994. Together, the 1982 Convention and the 1994 Agreement are the package is what Reagan sent us to the negotiations to get and the one he said he would sign.

Remember what I have warned of in the past; he will control all or destroy all, this is one working of his scorched earth preparation; once he accepts it is end game, there will be nothing that can stop him short of God himself.

This treaty would not solve the problems the world already has over sovereignty rights on territorial waters e.g. China, Vietnam, Philippines dispute over oil rights.
If we extend our mineral rights to the seabed, that is completely different than territorial rights. The U.S. and only a few other nations have the ability to mine the seabed. If we spend our efforts and capital – why should we share with other nations that have no risk of losing capital/money in the off-shore mining adventure?
This is just a thinly disguised world tax by the U.N.

If we gave all the money that we normally give to the U.N. troublemakers, to our millitary instead, I would feel better.
