‘Real News From The Blaze:’ Marine Detainment Stirs First Amendment Debate

A 26-year-old former marine named Brandon Raub has been involuntarily detained by the police and ordered to undergo a psychiatric evaluation after making alleged threats in a series of anti-government proclamations that the Iraq and Afghanistan veteran posted on Facebook. Police were acting under a state law when detaining Raub, that allows emergency, temporary psychiatric commitments upon the recommendation of a mental health professional. Raub has since been questioned by both the FBI and Secret Service.

One particular posting by Raub that is believed to have raised the alarm to authorities is; “Sharpen my axe; I’m here to sever heads,” that ABC News reports appears to be a lyric from the band Swollen Members and its song “Bring Me Down.”

Many Raub supporters and critics of the arrest have emerged, arguing that the former marine’s First Amendment rights have been violated. The head of the Rutherford institute, a Virginia civil liberties group that is represent Raub, told ABC;  ”For government officials to not only arrest Brandon Raub for doing nothing more than exercising his First Amendment rights but to actually force him to undergo psychological evaluations and detain him against his will goes against every constitutional principle this country was founded upon.”

      It could be worse.He could have had his hearing within the hospital and shuffled around like fred astaire on stage.Least ways we know about it.Virginia allows courts to operate in the hospital.Called special magistrates.Technically you actually have to be in the hospital.But alas there are a number of ways around that as I a member of the human canvas club have long since discovered.He is to have a hearing to determine if he will be transfered to Salem VA Hospital.Its also the regional office of the VA.

      My problem came from something far more sinister and always out of state.I just discovered the holes in there system while investigating my own plight.It too can be used by the EOS.

      I‘ll tell you how I feel about shaving a man’s beard: He is a Major in the U.S. Army that is currently receiving $72,000/year as his contract states, which also states that he won’t have facial hair that extends past the edges of his lips. So, in the case of the beard, religious freedom isn’t something that is protected for Soldiers, Marines, Airmen or Sailors. We knew what freedoms we gave up when we joined. I personally think the traitor would look good dancing at the end of a rope with his facial coif intact.

      As for a man being forcefully detained by the government for not agreeing with that government, well, wars have been fought for less, but the coming war will be fought to protect ourselves from this overreaching and illegitimate government. Why aren’t Rev. Wright, Quanell X, andy Louis Farrakhan in custody for saying much worse? Why isn’t Eric holder in custody for supplying the cartels with weapons to be used against Americans? Why isn’t Obama in jail for the admitted murder of Anwar Al-Awlaki (also an American who had no trial or even charges). See, when everyone stood by and cheered the death of a man we all disliked, we forgot that it set the stage for this tyrant to detain, interrogate, and even murder anyone that says anything this government considers wrong.

    I‘m a Virginian and I’m infuriated that Governor McDonnell, AG Ken Cuccinelli, our US Congressmen and US Senators have not been on this like white on rice; but, not one of those lifeless bastards have come to this boy’s defense.

    Don’t take this as anything but factual. What is more terrifying: Brandon Raub’s comments or the rhetoric from the leader of the New Black Panthers urging black folks to invade hospitals and kill white babies? Uh oh! Better get some graduates of Harvard Law School to debate this one. It’s way over the heads of us lowly public school grads.

    Wait, I guess one Harvard grad already gave his opinion on the matter since Eric Holder’s FBI participated in the raid and arrest. Then again, Holder, called the NBP “my people” when testifying before Congress. Do the NBP have a chapter at Harvard? Who knew?

    Brandon Raub must be released and those responsible for the arrest brought to trial.

      Well said, I don’t know much about your Gov., AG, or congress if you claim them still. But I whole heartedly agree. They left this marine, US citizen, and Virginian out flapping alone. Well done for those fellow statesmen and women who spoke up on his behalf. If he was not threatning homicidal or suicidal acts then they violated his rights. Also in my opinion by tapping his personal cpu conversation it would appear that his rights were violated more than once. Maybe I am ignorant to this but do we not have the right to privacy. In the land of the free inside your own home.
      I suppose if you are an illegal alien, you would be entitled to these benifits. As long as you get the,(major issue) drivers license 3 months before election. Forcing me to buy something from a company hand picked by the government in order to avoid incarceration sorta crosses a line.

      We fought a war over the intolerable acts. The transgressions now make the intolerable acts look like a bad elevator conversation. The difference is they were men and our generation wants to lick the boots of the oppressors in hopes that they’ll give them an easier lot of serfdom.

      So they hold him and declare him sane and release him,he then commits mass murder is the state liable? No because the state used an unconstitutional law to pick him up and detain him for breaking no laws.The state is also immunized from any potential civil action brought by the victims families,it’s good to be the king,you get to make all the laws and it’s weird how it always works in favor of the government.

      None of this ads up.
      How does someone with no criminal background get access to the type of body armor, tear gas, and SWAT gear that he had on? How does a PhD become a functional expert in these wapons as well as explosives/traps? Why would he go to those lengths to set up the appartment traps, and then warn the police about them? How does an unemployed student get the money for this equipment (at least $10,000)?
      I hope Glenn searches for these answers over the next few days. I have heard that a big UN small arms treaty is expected next week….Seems very suspicious to me

      THEREALCONSERVATIVE. You are on the right track here. The “watch out Bubba’, they’ll be coming for you next” crowd would be making entirely different noises if a former Marine… armed to the teeth… walked into a government office and began shooting and killing people at random.

      That being said… Uncle Sam may have overeacted this time but it is quite likely someone tipped off the authorities about Raub and they decided to err on the side of caution. I personally think there is more to this story than meets the eye…

      RESME. As far as I know he made statements stating “an imminent revolution against the U.S. governmant“ that ”he would be leading“and ”the cavalry is coming”… blah-blah-blah.

      Like I wrote, I think there may be more to this than meets the eye and some other threatening statements he made that we are not yet privy to.

      @real, Mass shooting statistics are about 0.5% (Maybe even less) of all homicides(involving 5 or more victims). I guess every time someone post lyrics to a song on Facebook should be detained and receive a psych exam.

      No matter who’s elected Patriot Act, NDAA, SOPA, PIPA, Fed Unaccountability, deficits, debt, regulation, growth of government….it all keeps going. Do you really think Romney would roll back NDAA? How about reeling in the Fed? The only difference you’ll see is tax policy (just a little bit) and foreign policy (big ol wars vs. many small wars). That’s it.

      I don’t know how to bridge the gap with this argument. Until people take a stand, nothing is going to change. We can’t compromise on liberty. People that believe they’re allowed to take away our rights (Romney and Obama) are traitors. Arguing which traitor is worse is an argument that doesn’t even register with me. The country is dying because the two party system where progressives dominate both parties and the media. Until we reject it our future is bleak.

    Living in a free society implies by its very nature that bad things will happen before we can stop them. It is one thing to be on guard for such bad things, it is quite another to take away one’s freedom and rights because of a potential bad thing. Our armed forces have the fortitude to go overseas to protect our rights, at least the civilians “back home” can have the balls to protect rights too.

    NDAA, Patriot Act, all of the executive orders. Where are the few Patriot law enforcement who obey their oath to the US Constitution? many are oath breakers blindly following illegal unconstitutional orders ignoring individual liberties. They need to remember their oath’s and keep in mind that they to will be subject to this treatment if they get fired, quit, retire etc. No longer wearing a badge they can have their Constitutional rights abused as well. oathkeepers.org

    One more precident of intimidation and unlawful detention via the courts for the Obama admin; recall that they will use any and all means availible to maintain their control and power. To lose one is a nightmare for them of the left, to lose both is an armagheddon event.

    Anyone want to figure that there is a connection under the ‘unlimited detention of Americans’ that can be used to justify the administrations actions; something we missed?

      I see the Sentence in the Bill of Right‘s that say First Amendment with it’s description, but the reality doesn‘t match the Bill of Right’s. As much as the words in the Holy Bible doesn’t match the reality of what the Holy Bible means. Because as with the Bible – Heaven and earth has faded away, and only the ‘The Word of God’ remains – likewise with the U.S Constitution – Liberty has faded away and only ‘The Word’ of the Constitution remains.
