‘Real News From The Blaze’ SCOTUS Splits On AZ Immigration Law

The Supreme Court announced their ruling on Arizona’s controversial SB 1070 Monday morning. Striking down and upholding different portions of the law, supporters and opponents have both declared victory. Upon further review of the ruling, the “Real News” panel suggested Monday that the Court‘s decision may lean in the direction of defeat for the law’s supporters and any hope that it could serve as a keystone for comprehensive border security and immigration enforcement moving forward.

While striking down the first three provisions, the Supreme Court upheld 5-3 arguably the most controversial portion of the law which allows enforcement to check the immigration status paperwork of individuals when they are stopped for other lawful reasons, but suspected of lacking authorization to be in the U.S. The Supreme Court’s decision implies that this provision will stand as long as it is used with caution, careful not to infringe on the rights of law-abiding citizens.

The opinion, which did not include Justice Kagan who recused herself from the case, largely holds that Congress envisioned an enforcement role for states but did not want to uphold those parts of this particular law that they see as going beyond Congress’s original scope.

On “Real News” Monday the panel dissected the mechanics of what was decided Monday, and how the key surviving provision can be implemented. While SB 1070 supporter and Republican Arizona Governor Jan Brewer claimed victory after the court’s announcement, Will Cain and the panel did not necessarily see Monday’s outcome fall predominantly in her favor.     The SCOTUS is a great disappointment and has too much power. It also has a bad case of ‘not getting out of their office’. They know nothing of the border problems the states have. They don’t care. The whole government is out of step with the people. The whole government in Washington d.c. should be forced to stay in Laredo.

    Does anyone know if the trespassers can be detained indefinitely under NDAA if they are held under the “papers” provision of NDAA?

      Under the Patriot Act, I believe anyone can be detained indefinitely.

      So if someone gets pulled over for a burned out taillight, I guess they shouldn’t have to worry about being an illegal alien, drunk, the ten bundles of weed on the front seat or two underage hookers in the back seat right?

      I understand that Simple, but a burned out tail light isn’t a felony, and from what I gather, it the other obvious crimes I laid out wouldn’t be the “reason” for being pulled over, so according to the ruling, theoretically, the officer shouldn’t bust him, or at least like I said, thats what I’m understanding from the SCOTUS ruling. But then again, I’m just a dumb American citizen.

      The burned out tail light would be the reason for pulling him over. Usually considered an investigatory stop. Once pulled over the dope and the hookers should suffice for the felony part. That’s not to guarantee deportation or even criminal charges; point being that would be the only way they could get the DoHS to even have a listen, having a belong act attached in some way. Chances are good he would be deported instead of charged IMO.

    obama dosen’t have a clue what separation of powers means he is trampling on state rights and ignoring the Constitution if you voted for him before you better wake up,because sooner or later he will take your rights away too We arer in clear and present danger from this adminstration

    It matters not what SCOTUS said about SB 1070. The fact remains the sovereignty of that state and our country is being willfully and knowingly neglected by our federal govt. SCOTUS should have been forced to rule on whether or not the Federal laws are being justly followed by those that are SWORN to protect them….Napalitanos phone call and decision to ignore call from Az is a disgrace….total disgrace.

    The Obama Administration is voting “present” on the immigration issue. They are NOT concerned with the safety and the rights of the American taxpaying citizens. The Obama Administration is more concerned with “ changing ” America into a dysfunctional anti-capitalist society and with buying votes ( legal / illegal – they don’t care ) for the 2012 election. NoBama and No Democrats 2012.

    So the Supreme Law of the Land stated that whilst in the midsts of a LAWFUL stop, if the status of Citizenship is called into question, the State has the LEGAL RIGHT to call ICE and have NOTHING HAPPEN? Do I have this right?

      I believe correct. Napolitano actually send out a dictate to ignore calls coming from AZ that relate to immigration…your statement would be a likely end result.

      Correct. Only the state is “OBLIGATED” to call on reasonable suspicion of illegal immigration status. (Profiling at it’s best) Conversely, the DoHS is telling AZ to pound sand on any detainees that do not have a felony on their record. They need a felony to be deported or charged.

      Americans that are of Mexican descent have been thrown under the bus. Don’t even try getting a job. You are now suspect. It’s like a person seeing a snake. Only a few are poisonous, however, ALL are treated that way. Better safe than sorry!

      Exactly. Just like everything about the Smoke and Mirrors Obama Administration . So the state taxpayers can pay to have police detain but the federal people won’t do anything . Screw the taxpayers . AGAIN. Undermine the rule of order. AGAIN. This stinks. Like most of the Obama policies. These people deserve to be run out of Washington on a rail. The utter contempt for American values and protection just stinks.

    Not that this matters much. The Dept of Homeland has already advised they will be denying all calls on citizenship from officers and/or ICE that do not involve a felony. In other words. If an officer has a person of illegal status in this country and do not have a felony or are not committing one, the DoHS will advise to release said person or will flat out deny the call.

      Robbing a bank is a Federal offense, so when the call comes in, they should notify the FBI to respond. Don’t enforce Federal law. If a mailbox gets knocked down, that’s a Federal problem also.

      SB 1070 is an attempt to duplicate a federal law with a few extras thrown in. Checking for proof of citizenship is already a Federal Law enforced by our border patrol agents (and any other federal level law enforcement official).
      AZ‘s problem is that the Fed wouldn’t acknowledge locals exercising the same practice (Which is why there are so many illegals detained “waiting” to be deported in AZ). Thats why you keep hearing it’s a “Federal” problem.
      So, in turn, they‘ve created the law at the state level so local law enforcement can exercise what the federal gov’t has been allowed to do all along.

      Plainly put, it extends the same power used by border patrol agents to state/local law enforcement.
      SB 1070 is nothing new, just a jurisdiction extension.

    Let me see if I understand recent events correctly. President Obama gives a speech today disparaging Mitt Romney for outsourcing jobs. Last week President Obama issued an executive order to allow 1.2 million illegal immigrants to get work permits for jobs here in America. What is that, INSOURCING?
