Rep. Sheila Jackson Lee: Repealing ObamaCare Would Be ‘Unconstitutional’

Congresswoman Sheila Jackson Lee, D-Texas, said Tuesday that repealing Democrats’ national health care overhaul law would violate the U.S. Constitution — a claim strikingly contrary to many Republicans’ claim that the law itself is unconstitutional.

During a meeting of the House Democratic Steering and Policy Committee Tuesday, Jackson Lee and her Democratic colleagues discussed Republicans’ efforts to repeal the law. According to Jackson Lee, passing the GOP’s repeal bill — H.R. 2 — would violate the Fourteenth Amendment’s equal protection clause because it would leave some Americans uninsured:

Later, on the floor of the House of Representatives, Jackson Lee expanded her case, claiming a repeal of the health care law would also violate the Constitution’s Fifth Amendment guarantees of due process.

“The Fifth Amendment speaks specifically to denying someone their life and liberty without due process,” the Texas Democrat said. “That is what H.R. 2 does and I rise in opposition to it. And I rise in opposition because it is important that we preserve lives and we recognize that 40 million-plus are uninsured,” she said.

“Can you tell me what’s more unconstitutional than taking away from the people of America their Fifth Amendment rights, their Fourteenth Amendment rights, and the right to equal protection under the law?”

“This bill has been vetted. This bill is constitutional and it protects the Constitutional rights of those who ask the question: ‘Must I die? Must my child die, because I am now disallowed from getting insurance?’” (h/t AmSpectator)

As we all know, just because she is a lawyer doesn’t mean you have to know too much about the Constittion.       @TOMMY.. It’s because they have the market cornered.. You can’t buy insurance over state lines like you can with car insurance.. That’s why it keeps going up…Thanks to the dems, If there are 2 insurance companies in a state they can pretty much demand how much money they want from you, but if you can shop around though other states, then YOU can pick the cheapest that you find and the others will have to comply.. Otherwise they will go under in no time.. THAT’S THE FREE MARKET AT WORK !!! Get it? hmm. capitalism sounds pretty good now, huh ?

      @ TOMMY..he above numbers show that the United States spends far more on healthcare than the other countries do. What do the other countries have in common that the U.S. does not? GOVERNMENT RUN HEALTH INSURANCE.
      Not only are the other countries spending less on healthcare than we are, EVERYONE is covered. Go figure. Yeah and look at their healthcare system and the type of care that they give..
      It’s funny, that most in the countries that you’ve listed people come to the U.S for BETTER care…lol
      You know the old saying right ? you get what you pay for, but in your case, you get what you don’t pay for.. Some patients in Cuba were forced drink water from the plants vases in their rooms. Now that’s the kind of care the U.S should strive for… Can I ask ? Do you like standing in line at motor vehicles ? because that’s what your going to get ,maybe not in the beginning, but soon enough the money is going to run dry… You should do yourself a favor, move to Canada or Cuba, those countries are right next door and they have that lovely healthcare system that you’re praising ..

      Check out the numbers for a 2007 comparison of the infant death rate per 1000 births and average the average life span of the citizens in the following countries:

      United States 6.4 78
      France 4.2 79.9
      Switzerland 4.3 80.6
      Germany 4.1 79
      Canada 4.6 80.3
      New Zealand 5.7 79
      United Kingdom 5 78.7

      Where’s the American exceptionalism in our healthcare? We spend more per capita than countries with universal health insurance spend, and we get less in return. Go figure.

      Foreign citizens coming to the US every year for medical treatment: ~50,000

      US citizens going to other countries (Mostly Mexico/Canada) for medical treatment every year: ~1,500,000

      I believe the right to Life means the right to exist, not the right to be kept alive at the expense of others by forcing them to pay your medical bills.

      Citing the Fifth Amendment doesn’t even make sense.
      “The Fifth Amendment to the Constitution, ratified in 1791, represents five distinct liberties the that Framers attempted to safeguard from majoritarian impulses: (1) the right to be indicted by an impartial Grand Jury before being tried for a federal criminal offense,(2) the right to be free from multiple prosecutions or punishments for a single criminal offense, (3) the right to remain silent when prosecuted for a criminal offense, (4) the right to have personal liberties protected by Due Process of Law, and (5) the right to receive just compensation when the government takes private property for public use.” (Legal Dictionary)

      Citing the Fourteenth Amendment doesn’t make sense, either. It was passed to deal with reconstruction to ensure that laws were equally applied to newly freed slaves, from what I gather.

      “Its Equal Protection Clause requires each state to provide equal protection under the law to all people within its jurisdiction.” (Legal Dictionary)

      It is not the job of government to provide for people. Until liberals/progressives/lawmakers figure that out and act on it, things will never be fixed.

      Umm. Sheila. I think you forgot some of the context of those amendments. And the very sentences you quote condemn you too: not being deprived of PROPERTY being the case in point. This is Sheila pretending the Constitution matters to her. It does in the sense that there are words in it. She can use words. Words can be put together into sentences. And sentences can make her socialistic point. The fact that those words have to be completely divorced from their context to make her point is immaterial to her.

      Health care is not a right, nor is insurance, but services for profit. Doctors and health insurers both incur the costs of labor, and since it is their labor, no one may demand it of them – that would make them slaves.

      First, the Fifth Amendment was written to keep GOVERNMENT from taking someone’s life, liberty, or property without due process.

      Second, we are CREATED with certain unalienable rights, among which are life, liberty, and the pursuit of happiness (to include the pursuit of property); That is to say, what life, liberty, and property we possess, the government may not take without due process – and like I said before, health care is done by doctors, whose labor belongs to them, and it is their liberty which is taken if they adhere to Obamacare (which they shouldn’t).

      “This bill has been vetted. This bill is constitutional and it protects the Constitutional rights of those who ask the question: ‘Must I die? Must my child die, because I am now disallowed from getting insurance?’”

      The Obamacare bill has not been vetted – it was voted on by those who didn’t know what was in it, which is certainly less than DUE process.

      Nobody has a Constitutional right to someone else’s labor or goods, including health care and health insurance.

      Look, health insurance doesn’t work unless they can deny coverage sometime – it’s a [private sector] pool of money that’s supposed to be there, for those who pay into it, should they happen to need it. Insurance is NOT SUPPOSED to cover everything at all times – that’s not how insurance works. The money would run out pretty quickly, otherwise.

      But everyone seems to be covered (by and large, I imagine) when they can afford it.

      Health care and health insurance are expensive because of all the regulations and the frivolous lawsuits, not because doctors and insurers are greedy. But even if they wanted to charge an arm and a leg to provide you either, that’s their right, because it‘s their labor or their business that they’re running, and they can charge however much they like; And a free market brings prices down.

She has also urged better relations between the U.S. and Venezuela, which she describes as a friendly nation.       What Ms. Jackson Lee clearly misses in this debate is the part of the dialogue where you don‘t blow smoke up my ass and the other part where you don’t piss on my head and tell me its raining. Don’t they, the progressive liberal left know we have their number and see through all their slight of hand. Someone should tell them that despite what their elite think…most conservatives are educated, well spoken, and well written; we keep up with all the sides of an issue and make objective determinations. On the other hand; Progressives call whatever they want; whatever they want when ever it suits their way of thinking.       Look more closely at your history. What exactly is it that has made health care go up? It is not the “free market system”. Health care has been anything but a free market system since the government stuck it’s nose into it. Health care costs began to sky rocket with the advance of HMO’s. The advance of the HMO was thru the The Health Maintenance Organization Act of 1973. It was the HMO that radically transformed medicine in the United States. That and an incredible amount of red tape and reporting requirements by the government. You folks may not realize it but every time a visiting nurse comes into your home (or a physical therapist) they are required to fill out an “oasis” form and that form goes to the government. You would be shocked to learn what information is collected on that form. As a result of the information collecting requirements the government has imposed on the medical system, home health care visits are no longer driven by patient need, but by government documentation requirements. WAKE UP AMERICA… IT WILL ONLY GET WORSE![

She is trying to bend and twist it around in order to give credibility to her outlandish and incredible remarks. She’s a very good exemple of those who were elected to represent us but are completely unqualified for the task.       Our insurance system and the cost thereof does need to be reformed but giving it away for free at the cost of the taxpayer is not the solution. Is there ways to lower the cost to be insured, yup, there sure it. Is there ways to lower the actual cost of procedures, yup, there sure is. They just don’t want to hear any other option but to give it away for free. Someone actually has to work to provide someone healthcare, it’s not like air or water, something that naturally flows around you that you can access for free (lakes, rivers, etc for water)

      OECD AVERAGE – 8.9%

      The above numbers show that the United States spends far more on healthcare than the other countries do. What do the other countries have in common that the U.S. does not? GOVERNMENT RUN HEALTH INSURANCE.

      Not only are the other countries spending less on healthcare than we are, EVERYONE is covered. Go figure.

      First, she doesn‘t care if she’s right or wrong in regards to the constitution. The constitution means nothing to her despite some oath she blabbered. She could care less about the constitution.
      Second, someone mentioned in an earlier post, I think walkwithme, that her heart was in the right place. She doesn’t give a s**t about the “citizens of Harris county”. Nothing has changed since this woman has been their rep. They’re still in the same socio-economic mess they have always been and will always be if the rely on government for answers.
      It’s all about streaming the wealth of America through Washington where this woman and 99.9% of all the other politicians are standing at that stream grabbing that wealth for themselves and their cronies.
      We have got to dry up that stream by cutting the size of the fed back to it’s constitutional limits.
      The states can decide if they want wasteful entitlements and they alone will be responsible for the consequences.

      Here are some questions I have:
      How many currently uninsured Americans are eligible for Obamacare? How many millions will remain uninsured in the next decade? Is that equal protection under the law?

      Does health care reform really reduce the deficit, as Oh-lying Obama promised? Where will the BILLIONS of dollars needed to cover legalized illegals come from, once immigration reform kicks in?

      Why are Obama’s darling unions allowed to opt out of Obamacare (222 waivers by Dec. 2010)? Is that equal or preferential protection under the law?

      Muslims (calculated at 6-8 million) are not required to buy health insurance or pay the fine. Is that equal or preferential protection under the law? More importantly, unlike the Amish and Native Americans, Islam is categorized by s ome as the fastest growing religion in the US. Together with ILLEGALS and UNIONS, Islam will be another group that will CONTINUE TO BLEED THE HEALTH CARE SYSTEM (BTW, I predict conversions galore).

      One stat you “forgot” to mention: “The Health and Human Services Department expects that the health share of GDP will continue its historical upward trend, reaching 19.5% of GDP by 2017.” (Wikipedia) Thus Obamacare will not fix cost, only coverage of some of the uninsured.

      Here’s the bottom line, Tommee: Obamacare is about govt. control of one six of our economy, not about fixing costs. So SCR*W your Obamalies and irrelevant quote of OECD stats.

      A regulated economy (central planning) is not a free market economy, and insofar as our economy has been regulated, the prices have gone up.

      Competition REQUIRES prices to go down, and the manufacuring of goods and the provision of services to be streamlined. Therefore, a free market, by definition, lowers prices.

      But the primary goal of a free market isn’t to lower prices, anyway. The goal of a free market economy is to secure individual rights. So if, in a free market economy, people wanted to charge a lot for their goods and services, that’s their right to charge for their goods and labor whatever they want.

      Let me speak of Canada – a country with universal health insurance – because I live near the border, and have many friends as well as a few relatives who are Canadian. I have first hand experience with their health care/insurance system.

      Canada does not have a closed border as you assert, quite the contrary. It is much harder to get into the United States then it is to enter Canada. My wait time to cross the border into Canada is much less than returning to the United States.

      Canada DOES NOT HAVE rationed government health insurance/care. Canadians take offense to any suggestion that there is rationing in their health system. If you’re a Canadian citizen you have health insurance period, no if, ands, or buts. If you are in need of treatment, medical care is readily available. Elective procedures may have a longer wait time, but more pressing problems are dealt with promptly.

      The charge of “lower quality government run insurance” in Canada is absurd. In Canada, no one is without health insurance and you can’t be cut off or refused health insurance like in the U.S.. In Canada is a right to have health insurance, not a privilege for those who can afford it, as in the United States. The cost of health care in Canada is much lower than in the United States, and the results are better, with lower infant mortality rates and a longer average life span.

      Your claim of “unsustainable debt because of health care spending” is also factually wrong. The Canadian Institute for Health Information – an outfit similar to our CBO – recently published a report that health care spending in Canada for 2010 is projected to grow 1.4% – the slowest annual rate of growth in 13 years. Contrast that to the ballooning annual growth of health care spending in the U.S…. we can only wish. Economically, Canada’s national health insurance is helping Canadians eat our lunch because business does not have to include healthcare spending in the cost of producing their goods and services.

      Perhaps you don’t know any better, or maybe you just feel more comfortable stretching the facts to fit your stubborn dogma of how things should be. But your spreading of misinformation only hurts our country. We should see the facts for what they are. If there is verified success in other countries we should learn from them instead of blindly find fault with them or misrepresenting them.

However, since we are basing this discussion on anecdotal evidence, why did Danny Williams, Premier of Newfoundland and Labrador, come to the US for heart surgery?       I gave you the overall trend according to the OECD, since you cited seven countries and the OECD was your source. I don’t know about Canada specifically, but like I said, the Swiss are also doing fine. The OECD may confirm the above projection. However, the overall trend is one of unsustainability.

      Hey tommee, It is not the federal governments buisness to provide health care, period. Don’t give me that “general welfare” b.s. If it were, why didn’t the founders of this government create federal hospitals?
      If what ever state you live in wants to provide health care to their citizens, then by all means do it. But if and when it costs more than that states income is through taxes the other states aren’t obligated to be bail you out.
      There needs to be reform but asking the corrupt greedy s.o.b.’s in political office to do it is a total waste of time and money. Please understand this, THEY DON”T CARE ABOUT YOUR HEALTH CARE! It’s about funneling money through their hands.

      Benjamin Franklin and some friends founded the first hospital in 1751 which admitted everyone – those who could pay and those who could not. That’s right, SOCIALISM in America’s first hospital! It wasn’t until the late 19th century that hospitals became a significant part of medicine. Prior to that patients were mostly treated in their homes, even for surgery.

      Hey tommee, as A Doctors Right… say’s, it was the state that did that. That’s where it should be. That’s fine. I have no problem with that. It’s constitutional. I’m all for it.
      We need to get over this idea that the federal govrnment is where we turn to for solutions to all of our problems. They are too far removed from you and I and it’s hard to keep them accountable. Giving them this much power is just asking for corruption. And I think we can mostly agree, D.C. is corrupt to the core. Both parties. They are ruining our future with their out of control spending.
