Return of ‘Death Panels’? Obama to Enact End-of-Life Planning for Medicare

After public outcry over “death panels” forced Democrats to drop their proposed end-of-life planning from the health care overhaul legislation, the Obama administration is pressing forward to enact the same measures by bureaucratic regulations. The new regulations are set take effect starting Jan. 1, the New York Times reports.
Under the new policy, outlined in a Medicare regulation, the government will pay doctors who advise patients on options for end-of-life care, which may include advance directives to forgo aggressive life-sustaining treatment.
Congressional supporters of the new policy, though pleased, have kept quiet. They fear provoking another furor like the one in 2009 when Republicans seized on the idea of end-of-life counseling to argue that the Democrats’ bill would allow the government to cut off care for the critically ill.
The final version of the health care legislation, signed into law by President Obama in March, authorized Medicare coverage of yearly physical examinations, or wellness visits. The new rule says Medicare will cover “voluntary advance care planning,” to discuss end-of-life treatment, as part of the annual visit.
Under the rule, doctors can provide information to patients on how to prepare an “advance directive,” stating how aggressively they wish to be treated if they are so sick that they cannot make health care decisions for themselves.
While the new law does not mention advance care planning, the Obama administration has been able to achieve its policy goal through the regulation-writing process, a strategy that could become more prevalent in the next two years as the president deals with a strengthened Republican opposition in Congress.
Despite the political firestorm of controversy surrounding such end-of-life planning, the Obama administration insists that research supports its decision to move forward with the controversial measure. “Advance care planning improves end-of-life care and patient and family satisfaction and reduces stress, anxiety and depression in surviving relatives,” the administration’s preamble to the Medicare regulation reads, quoting research from the British Medical Journal.
Several Democratic members of Congress, led by Representative Earl Blumenauer of Oregon and Senator John D. Rockefeller IV of West Virginia, had urged the administration to cover end-of-life planning as a service offered under the Medicare wellness benefit. A national organization of hospice care providers made the same recommendation.
Mr. Blumenauer, the author of the original end-of-life proposal, praised the rule as “a step in the right direction.”
“It will give people more control over the care they receive,” Mr. Blumenauer said in an interview. “It means that doctors and patients can have these conversations in the normal course of business, as part of our health care routine, not as something put off until we are forced to do it.”
After learning of the administration’s decision, Mr. Blumenauer’s office celebrated “a quiet victory,” but urged supporters not to crow about it.
Meanwhile, opponents of the measure, including Elizabeth D. Wickham, executive director of a pro-life Christian advocacy group told the Times she was concerned the so-called “end-of-life counseling” would actually encourage patients to forgo or curtail life-saving care.
“The infamous Section 1233 is still alive and kicking,” Wickham said. “Patients will lose the ability to control treatments at the end of life.”

First of all, doctors and patients have conversations for free, so why pay the doctors with federal funds? Secondly, will doctors benefit from the nudge to forgo health care (while they get paid for the nudge) in order for the federal government to steal money from those who die? There seems like a quid pro quo going on somewhere in the future. Creepy.

Report Post »All of my “conversations” with my physicians occur during my office visits. As I pay for the visits, I know that MY interests are protected.
When THE STATE begins to pay doctors an “extra” 50-100 bucks/patient for end-of-life “counseling”, when does the scale begin to slide towards THE STATES interests instead of my own? How long before we start seeing end-of-life “counseling” as part of a 6 year olds annual physical? (and before you pooh pooh that, have you seen anything restricting when this “advice” is given besides “annnually”?) With all of the medicare fraud out there, I’m sure that this little “loophole” will be fully exploited.

Her cancer med costs $600 month through medicare, the FDA took away her pain killer (darvocet) which is less likely to kill anybody then Chantix. Now she has to read that she has to plan her own demise???? Does anyone commenting here realize how heartless and cruel this is for her and me??? It’s obvious – if he can’t get congress to pass something, he’ll have his toadies in the various departments take care of it. Someone commented he should be impeached. Ok then the people spoke out loud…very loud…about the end of life clause in the Health Bill , so loud in fact that it was pulled out. Now why is it they are putting it back in the mix a few months later, through another way…even though the people have spoken? I keep seeing this though it be Amnesty, EPA, Taxes…you name it. Is this administration rogue? Or have I been sleeping the past several years and just am now noticing that is has almost gotten to the point that they need to be physically taken out of the places of power by the people.

Hello Mr. Smith you are xx old and you have a terminal disease. You have also used up your allotted “public health care dollars” You know everyone has a maximum amount of money for the care that the government pays for.
Good news for you Mr. Smith you still own your house and a savings account, if you were sign over the house to ACORN and you savings to the public health care agency, we would try to keep you alive for a longer time period. If you have no money we show you have a life insurance policy, you could just list ACORN as the beneficiary.
Now you do realize no one lives forever, but with the money and your home we will help you live as long as we possibly can. If you do not wish to make these gifts, we have had some success with pain killers to help you transition into the great beyond. Here is the number for hospice.
ACORN will place the poor in your house to help the diversity of the neighborhood after you are gone. Any left over money will be used to help others to make good end of life decisions just like you.

Hyperinflation hits, the government stops giving money to Welfare Recipients and Union Pension Funds because they can’t. There will be a mass revolt, burning down all the major cities in the East. After they get tired of burning and they get shot and killed then there will either be a Military coup or some sort of reckoning where we can restore the Republic from the ashes.

Also, nothing is stopping patients and doctors from having this conversation about health care options including the decision for forgo care. The problem with this is that the government will pay doctors for leading patients into this decision. It is the payment that is the problem. A converstation could be had for free, why bribe and pay doctors to nudge patients off of medical care? That is creepy. More money from the government for lessening your patient base.

Not some panel that may decide that my age, 64, makes me non productive anymore. I put it in writing and my family undertands. At 64, I am not ready to sit in a corner [hospice] and just die. But it is MY decision to make, not any one elses.

Will the government stop giving Good healthcare to the elderly? How much of thier benefits will be denied because of age? I believe obama thinks after a certain age if you don’t have money your life is not worth saving, and medicare should not be responsible for you anymore. How many people will die because thier benefits stopped paying for the healthcare they require?
I think you will see an age limit on transplants, bi-passes and other heart surgeries, rehab for stroke patient. Many, many healthcare options we see as normal care taken away because of age,even down to heart, blood pressure, diabetes, and other daily prescriptions.
Mr obama is only beginning, he is warming up, setting the stage. He has no soul, he is ruthless.
The bible says the Anti Christ will reign for 6 years. If obama is the Anti Christ he will get re-elected. Has anyone thought about him being the Anti Christ? I haven’t seen any chat about that…

It was talked about by Glenn about a year ago, and the scary thing about it is ANY of the amendments can be repealed, including the second, and is a last-ditch effort to saving the Republic.

Indeed the calling is at the same time one of the greatest and scariest of means for the changing of the Constitution; I would not put Obama to try some kind of shenanigans past the level of Congress now being made irrelevant in order to do the old roman style of ‘bread and circuses’ in letting us feel we still have a saying in matters when we are long past that stage.

Providing information on preparing a living will is a bit less harsh than dumping peole from transplant lists who will die as a result like they do here in Az. How many of you want to end your life drooling and wearing a diaper when you are old and demented because the state is forcing your heart to keep beating using all measures available even though you no longer have any thoughts or memories but your nerves still communicate pain signals to the brain. It’s one thing to be pro life but to delay the natural process of death with technology is different than killing a child in the womb. People should be allowed to die with dignity not forced onto ventilators, tube feedings and pumped with drugs because the state or a selfish family member will not let them to die peacefully.

Example one, Junior wrecks his car and is brain dead and the family wishes him removed from life support. Example two, Dad has a major stroke and there is no brain activity and the family decides to take him off the vent. On the other hand Junior’s mom is riddled with guilt and denial. She wants everything done to keep her boy alive. He is eventually weaned from the vent and spends the next thirty years in a nursing home in a coma comepletely brain dead, think Terri Schiavo. Over those thirty years of Junior’s comatose existence Medicaid pays $60,000 a year for nursing home care and another million or two for juniors frequent hospitalizations when he starts to go into respiratory failure because for all intents and purposes he really did die the day of the accident. Oh and all you twits who say the family and Dr should decide, that is exactly what end of life planning is with the huge difference being the one who’s life is being discussed is actually present and of sound mind and body. Of course this is The Blaze and all of you grade school educated hillbillies just don’t get it. Oh and I am a health care worker and have had plenty of experience in life and death situations. When there is a thread of hope we must do all we can but some situations are irreversible. All of you who complain that the government shouldn’t be funding this socialist program or that just remember 99% of these brain dead people gets Medicaid to pay their bills and each one runs into the millions. The House and the Senate are basically one body elected by the people but representing special interests. Why can they do this? Because they no longer have to answer to any one but a few stupid voters. If the 17th Amendment was repealed and the Senators had to answwer to their states instead of dumb voters all the progressive bills since 1913 would never have passed. There would be no kickbacks. trading votes, selling votes and buying votes because the Senators would have to answer directly to their state legislature. This is exactly what Madison said would happen without the states having a voice and vote in Gov’t. The Gov’t would just get bigger and bigger until it consumed every thing. Any changes must center around the 17th Amendment so the states can stop the Gov’t from placing unconstitutional demands on their resources. REPEAL THE 17th.

And who decides which situations are irreversible? The Obama tyranny? Doctors who must either ration or be penalized? This is a cut and dry issue for libs because they are godless. Not so for a believer. People’s wishes can and often do change once they become seriously/terminally ill. There are many kinds of end of life scenarios, and the key issue (although not the sole consideration) in my view is whether a person is ready to meet his/her Creator. I wouldn’t want non-believers to propel themselves into hell (well, a few exceptions do come to mind), because they are too stupid to realize human beings never cease to exist, and there is a reckoning on the other side. Most Americans believe in God, so why should we be, yet again, forced to accept your putrid value system?
I find it ironic that we keep the most heinous criminals sitting on death row for YEARS on tax-payer dole, before they are “cleared” for execution. However, the lib crowd wants law-abiding, God-fearing citizens to make up their minds — with a little help from our enemies disguised as friends — and die expeditiously. But to Kryptonite I’ll suggest you look at the VA, “universal” healthcare for vets. That medical care is 100% socialism: the government owns the hospitals and pays the doctors. End-of-life counseling is paid for and that’s good: ask your own doctor.
And guess what. Veterans have better healthcare than all but the richest Americans. No death panels, no pulling the plug on GI Joe.
The real death panel is in Arizona, where the plug is being pulled on individuals who need transplants. The real death panel is your insurance companies, who could drop your insurance or raise your premiums to unaffordable levels simply because you developed a condition expensive to treat (although, thanks to Obamacare that’s now illegal). The insurance companies exist solely to make a profit, and every dollar they pay to your doctor is a dollar off of their bottom line. You may think they love your, but wait until you or your child gets really sick, then see how much love there is.

And that is why their economies are doing so wonderful that a few of them are collapsing, implementing austerity measures because the money is running out…. Even if the socialized (universal) medicine alone was not enough to bankrupt them this sort of thinking often comes with a few (lots) of other expenses in other areas.
Personally, do I think someone has the right to a living will or to making end of life choices? Yes. Do I think government should be making that choice? No.
I read an example of Medicaid being used to keep the brain dead alive as reasoning for supporting “death panels” of some sort. I had to laugh. Was I the only one who got the irony of that? Government spends too much to keep a few alive so we are going to take away the right for EVERYONE to choose their end of life choices. And it was government making that choice in the first place? We are so happy to spend other peoples money? Make other peoples choices? And the cycle goes on and on. This is why I am OPPOSED to “Obamacare” and “death panels.” The more you do, the more you must do. Eventually that health care worker who thinks this is great will have to someday find that despite their beliefs that government is making all their own choices for them and letting them have no control over their own future because little by little they told the government take away their neighbors’ choices.

This 2,700-page monstrosity of a Health Care/Redistribution of Wealth scheme has been a complete disaster since Day One… The overhaul itself is absolutely flawed and has nothing to do with “affordable health care for all” but everything to do with stealing from the middle class to give to the poor whether they’re in this country legally or not.
The process of completing this overhaul was flawed with all of the shady backdoor deals, corrupt twisting of arms, and the utter arrogance and lack of regard for the vast majority of the American people who clearly opposed this bill; and now the more we learn about this monstrosity, the worse it gets! Why else would so many companies and unions be “exempt” from having to follow certain portions of this law?
And whatever happened to transparency? May this absolute MESS of a bill crumble of its own weight…

Now he’s off next week to kick off his re-election campaign in Chicago. Who is running this Country? He likes flying our 747 around the world I do get that. Campaigner in Chief. His teleprompter speaks a well thought out plan to about 30% of Amercia but, what about the rest of the 70% who wish he would jusy go back to Kenya? Do you support repeal of Medicare, letting seniors fend for themselves in the private market and if they don’t have resources they get no health care? Medicare is the epitome of government run and socially financed health care. The government sets the rates and chooses which procedures are covered. If you want Medicare when you are old then you get what the government chooses to give. Otherwise opt out and try to make it on your own and if you can‘t at least you’ll know you died with your principles intact.
