Robber Claiming To Be Deaf and Dumb Was Faking It To Avoid Trial

The New York Daily News:
An accused robber who claims he can’t speak or hear lost a bid to represent himself at trial after a psychologist accused him of fakery.
Wendy Gabriel, who communicates with judges and prosecutors through handwritten notes, has apparently feigned the disability since his May 2008 arrest, psychologist Barry Winkler says.
“There is no dysfunction,” said Winkler. “He‘s not speaking because he doesn’t want to.”
Prosecutors said Gabriel used the ploy to secure 64 adjournments and to delay trial for nearly three years.
“He is attempting to put one over on this court and this system,” said prosecutor Stephanie Catros. “It has to stop.”

Posted on April 28, 2011 at 11:50pmWOW! They must feel like fools to have been fooled like that. Judges are supposed to be wiser than this and have better discernment. What happened to all the good judges that wouldn’t have bought that nonsense for one minute. That should have been the first words out of that Judge‘s mouth when he first heard he could not speak or hear is I want this investigated and this man evaluated to see if he isn’t just pulling a fast one. I had a great Uncle who was a very famous judge, he retired many years ago and is dead now but he was very skeptical when it came to criminals, he knew they were capable of anything.

Posted on April 29, 2011 at 12:02amHe has played it smart indeed, the fact though, is it should be easy enough to determine with a medical testing if he can actually hear or speak. I would like to know more of this story; from the title of it, I had hoped it would have been one of those ‘dumb crooks’ moments where he would have been in court and when asked if he was deaf and mute say “Yes your honor.”

I understand that, the danger is fairly obvious if there ever comes legislation to start testing all people accused of a crime. I just wonder though, why it took so long for anyone to figure it out. Is there more to this story than given in the article?
I have a friend of mine who is totally deaf and mute, he can read lips, sign to a degree and is able to write very well. Also he is extremely smart and educated. So, yes I could see how someone may be able to fool a group of people for a long time, yet somehow something still is missing from the story.

Report Post »I love when people get off because of “insanity” or they’re not “mentally capable” of standing trial. What ever happened to “equal justice?” Punishment should fit the crime, end of story.
