See the Letter the DOJ Sent to Florida Demanding It Stop Purging Non-Citizens from Voter Rolls

On Thursday, the Department of Justice (DOJ) demanded the state of Florida stop its efforts to purge non-citizens from its voting rolls. A letter sent to Florida Secretary of State Ken Detzner alleges the process violates the 1965 Voting Rights Act and the 1993 National Voter Registration Act.

The major charge of the letter reads:

Talking Points Memo (TPM) breaks it down:

The Justice Department sent a letter to Florida Secretary of State Ken Detzner Thursday evening demanding the state cease purging its voting rolls because the process it is using has not been cleared under the Voting Rights Act, TPM has learned.

DOJ also said that Florida’s voter roll purge violated the National Voter Registration Act, which stipulates that voter roll maintenance should have ceased 90 days before an election, which given Florida’s August 14 primary, meant May 16.

The Miami Herald further explains that “Under the Voting Rights Act, Florida needs federal approval before it makes changes to voting because five Florida counties – Monroe, Hillsborough, Collier, Hardee and Hendry – had minority-voting troubles decades ago.” It also notes what has been done so far:

So far, Florida has flagged 2,700 potential noncitizen voters and sent the list to county elections supervisors, who have found the data and methodology to be flawed and problematic. The list of potential noncitizen voters – many of whom have turned out to be lawful citizens and voters – disproportionately hits minorities, especially Hispanics.

About 58 percent of those flagged as potential noncitizens are Hispanics, Florida’s largest ethnic immigrant population, a Miami Herald analysis found. Hispanics make up 13 percent of the overall 11.3 million active registered voters.

Independent voters and Democrats are the most likely to face being purged from the rolls. Republicans and non-Hispanic whites are the least likely.

“We are firmly committed to doing the right thing and preventing ineligible voters from being able to cast a ballot,” said Chris Cate, spokesman for Secretary of State Ken Detzner, responded to the Herald.

      It’s not Washington D.C. job to protect the citizens of Florida from voter fraud within it soveriegn domain. Any attempts by the DOJ to stop the Florida legislation from protecting it voting process integrity will precieved as an unconstitutional act of aggression. And will be adressed as such.

      I live here in Florida and trust me the Purge is already done speaking for an inside view…It is easier to use the provisional ballot in cases of dispute then to have votes cast by non eligible voters unhindered…It is a done deal before Holder can say “oh Snap” The Tens of Thousands are already identified and gone

      Once again the DOJ steps into a mess and all Florida is trying to do is clean up its registration lists of Eligable and Uneligable registered voters! I guess the DOJ needs those Uneligable Voters to sway the Vote! The DOJ probably has people with those names ready to vote in the Election. Then when they show up, they would be turned away. Instead of making it easier to vote, the DOJ is making it harder and waisting money! obama is worthless POS, and his admin all needs to be put on an Island in Antartica and left there!…. That would solve everything. They wouldn’t have to worry about Global Warming, and they can all raise their taxes until they have NO money. As far as Food, Good Luck!….

      What’s wrong with what ENCINOM said? I don;t want illegals voting either, but the article said the following,

      So they weren’t all illegals. As long as the citizens retain their right to vote and gets their vote counted and the illegals are purged, I have no problem. If there are citizens (Repubs or Dems) that do not have their votes counted, then THAT WOULD BE UNCONSTITUTIONAL. It is actually D.C.’s business to make sure voters retain their Constitutional rights. States cannot mess with that.

      Although I firmly dis-agree with our President on the majority of issues and I truly hope we elect a new President come November I have to make one comment. I would rather thousands of cases of voter fraud than to have one US Citizen stopped from voting. Unfortunately, I would have to agree with the DOJ. Florida has to share it’s vetting process and get it approved as to not make a mistake and cause an American Citizen to lose their voting right. I know that the red-tape involved is amazingly slow, but they should have started the process several years ago.

      My Gosh, from past experience, why would we expect the DOJ to want anything that’s legal? How do you expect them to stay in office if they have to do things legally?
      Wonder what would happen if I refuse to show my drivers license when asked? Wonder what would happen if I travel without a passport? Could I get back in the Country or would I have to go via Mexico?
      As my family passes on, I’ll just start voting for them, would that work? Maybe I’ll try it.

      I don’t care if they vote republican, if they are not legal citizens, they CAN’T vote. By saying they have to go through the courts, mean holding up everything until after the election. I know a woman from Columbia, legal citizen, who hates illegals. She came here the right way. She helps me translate my blogs into Spanish. The ones here illegally are generally conservative, it’s just that they fall for what the Democrats say. And trust me, they don’t give any more care to brown than they do black. Remember, this is the party that not a single one voted FOR blacks to have the right to vote.

      Case law does not legally trump the Constitution. PERIOD!
      15th Amendment :
      “Section 1. The right of CITIZENS of the United States to vote shall not be denied or abridged by the United States or by any State on account of race, color, or previous condition of servitude.
      Section 2. The CONGRESS shall have power to enforce this article by appropriate legislation.”

      According to that Amendment, Voters MUST be a legal Citizen!

      So DOJ You can take your letter, fold it until it has the most sharp pointy edges possible & insert it into your Communist…
      Americans are coming to take you out of power as you do not have ANY constitutional right to GOVERN the voting process in a way that violates the constitutional requirement that any person who votes in a presidential election is REQUIRED to be an American Citizen. Also 15th Amendment gives CONGRESS the right to arbitrate that, NOT the DOJ!

      The DOJ is under the control & regulation of the CONGRESS, not the other way around.

      BS!! IF I went to vote and “couldn’t” and knew I was a CITIZEN, I would cast a ballot that would be held until I could prove I was a Citizen. You can do that in every state. It’s called a PROVISIONAL (or Conditional) ballot.
      THIS INTIMIDATION method of the DOJ should be ENOUGH to get every person in the USA that values freedom off their sofas and out there helping to insure our States, our Voter Rights were not tampered with by this corrupt-appearing/one-sided DOJ ! Don’t take this lying down FLORIDA.

      Raise hell about this. The DOJ has no business tampering with the individual States. From every angle, from every side these wolves are coming after AMERICA !! Brent Bozell (Media Research Center) made an excellent point: IF the MEDIA can stonewall on the 43 Catholic Lawsuits against this govt. They could also not be reporting on the JEWS being rounded up (as happened in 1939 Germany). So now we have a President who can kill Americans legally by drone; a Media who refuses to print or televise the REAL NEWS; and a DOJ who thinks it can dictate to States trying to clear ineligible people off their voting rolls. DUH. Think it’s time to pay attention?

      How is preventing citizens, including a WWII decorated veteran, born in Brooklyn, from voting protecting the Republic?

      The Govenor should be arrested for violating the rights of his citizens when he compiled a list to steal an election and deny citizens basic rights.

      There is no reference in the article stating that they are eliminating anyone from the rolls yet. They are creating a list of potential problems and sending this to local officials to dig further. The idea that the office that is responsible to assure that the election is on the up and up should not be news. Every official should be required to do this with due process.
      It would appear that the Federal Government under BHO is working to turn this country into a 3rd world country with a tin pot dictator. EVERY thing is upside down. People are convicted before the trial, the measure of the success is how many people are on food stamps, illegal aliens are treated as citizens at large with more rights than a person who is here legally, and so many other examples I could rant forever.
      We have 157 days to the election. We must rid ourselves of these invaders for the sake of our families, our country and our God.

      You are partially correct (for a change). The governor should protect the citizens of the state! He should implement picture voter ID cards to citizens like many states are trying to do. However, the DOJ is trying to stop that also. They know that the only way Obama can win is with illegal votes.

    So… because the majority of illegal immigrants are of a single ethnicity (Latino/Hispanic) we cannot keep them from voting? I don’t get this B.S. It is FLORIDA! I’m not sure that there are many Canadians smuggling themselves across the border and all the way to Florida. But, I’m fairly certain that alot of Mexicans and south americans cross the border to get to the southern states where construction is always going on thanks to hurricanes, flooding, tornadoes, and economic expansion (unlike in California).

      Lawyer here. Your comment is correct, but your point is mistaken. Here, the DOJ is not trying to get the state to enforce the Act; the DOJ itself is enforcing the Act against the state. The case you cited does not address that issue.

      Thanks for great comments! My smile for this morning. Did you hear that Ben Afleck et al are holding fund raisers for the 1/32 Cherokee in MA? Reese Witherspoon included?? Really?? I wonder why these otherwise talented, seemingly intelligent people have NO logic! When Warren says incredibly dumb things like : “Rich people need to share their wealth because they became Rich using the schools and roads that we ALL paid for.” People need to respond: “Oh, right. Then why isn’t EVERYONE RICH?” …she can’t answer the obvious follow-up question. She’s already proven herself to be a liar; a person who has no respect for other cultures; totally illogical…so why would anyone want to vote her in? She is the poster-child for being unqualified to represent other people. We not only need to make sure our voter registration rolls are purged from phonies; we need that in Congress and the Senate. I think Americans have learned that there is never a time when we can not pay attention. Our country is too Precious to be ignored.
