Sen. Coburn Repudiates Chief Justice: Did Not Enforce the Constitution Today, Is On The Wrong Side In Ruling

Conservatives across the country were appalled when they learned on Thursday that Chief Justice John Roberts voted to uphold the constitutionality of the Affordable Care Act.

“Members of this Court are vested with the authority to interpret the law; we possess neither the expertise nor the prerogative to make policy judgments,” Roberts wrote in his opinion (page six).

“Those decisions are entrusted to our Nation’s elected leaders, who can be thrown out of office if the people disagree with them. It is not our job to protect the people from the consequences of their political choices [emphasis added],” he added.

Among those who believe Justice Roberts failed in his duty to defend the constitution is Sen. Tom Coburn (R-OK), one of the foremost critics of the president’s healthcare overhaul. In an exclusive interview with The Blaze, Sen. Coburn had some harsh words for the chief justice.

“Do you think that the Chief Justice fell on the right side in this argument?” The Blaze asked

“No, I don’t,” the senator responded.

“It is the Supreme Court’s obligation and duty to enforce the constitution so that when the Congress gets outside of the enumerated powers, that they slap them back,” he added, implying that by voting to uphold the controversial “individual mandate,” Justice Roberts had failed in his duty.

“What I would tell you is that you can’t find anywhere in reading the constitution, the Declaration of Independence, or the Federalist Papers, any intent that was ever thought about that the federal government would be putting forth this type of legislation and this type of control over everybody’s life,” he added, explaining that the mandate includes a “fine” and “not a tax.”

“You no longer, in this country, have the right to decide that you won’t buy health insurance,” the senator continued, “and I think the Chief Justice came down on the wrong side of this.”

      According to Article III, section 1, “The Judges, both of the Supreme and inferior Courts, shall hold their offices during good Behaviour…” That’s it. No mention of censure or impeachment. Does the Obamacare opinion reflect either the Constitution or the wisdom of the founders as presented in the Federalist Papers? No, it does not. Doesn’t sound like good “Behaviour” to me, so I think a certain five justices need to be called onto the carpet. Barring that, we have the Declaration of Independence: “But when a long train of abuses and usurpations, pursuing invariably the the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new safeguards for their security.” Now, we can do this in either of two ways: first, vote out any and all Presidential and Congressional representatives who support this nonsense come November, or second, the 1776 approach. Time to choose.

    Justice Robert’s vote theory…

    After Justice Roberts (just) voted against the Arizona immigration law I came up with a theory;

    He has a Skeleton in his closet that is VERY big and the Democrats found out about it. They presented (blackmailed) it to him before the immigration vote as a test to see if he would comply. If he didn’t comply by voting with them on the Az immigration bill they would have made it public before the vote today and he might not have even been able to vote today.

    And you saw how he voted today…..

    Doctors, hospitals, pharaceutical companies, are all profiteering off the working poor. However great their eduction and their work, they deserve less, certainly enough less that we could afford health care without losing our freedom. The Poll Tax was repealed. The Obamacare tax against the young and against the working poor is much worse. If you could not pay the poll tax, you could have elected not to vote. If you cannot afford the health care tax because of your rent and your food expenses, you actually have to leave the country. How can the Poll Tax be repealed, yet the Supreme Court upholds a tax ten times worse, where you have to give up not just voting, but permanently give up your citizenship and leave the country? Worse Supreme Court decision ever, perhaps even worthy of Fascist Italy. Vote the Fascist Democrats out!

      In defense of GWB – he nominated Roberts with the trust of a non-partisan judge, neither right nor left. As in many other matters, he was deceived. Anyone else he would have nominated could have done the same, back stabbing crap. We can go all the way back to the Demorats and Robert Bork. If Bork was on the court, this may not have happened.

    Look….the SCOTUS decision stinks, it’s a gut punch to conservatives, libertarians and independents who believe in limited government, fiscal discipline and lower taxation. But Roberts may have handed Romney and the GOP a victory in November whether intentionally or not. Roberts in his brief put it back to “we the people” to deal with the consquences of our political decisions.

    Mercifully, the democrats can never try the commerce clause again in their attempts to create socialized medicine in this country.

    Let Obama and the democrats crow over this Phyrric victory of theirs because once the party hats are off and the hangover sets in…they have to start explaining the biggest single tax hike in US history and it’s not just on those making $250K a year, it‘s on EVERYONE who doesnt’ comply with Obama’s edict. No more “it’s not a tax per se”…it‘s a tax PERIOD because if it’s not a tax it’s unconstitutional. Romney and the GOP superpacs can now bludgeon Obama relentlessly for the next 5 months over this Obamatax and what can Obama do? Tell us it’s not a tax? His own words will be repeated over and over while Obamatax is paraded for all to see. The image of the huge tax and profligate spender liberal just got made bigger and clearer.
