Senate Passes Food Bill

WASHINGTON (AP) — The Senate passed legislation Tuesday to make food safer in the wake of deadly E. coli and salmonella outbreaks, potentially giving the government broad new powers to increase inspections of food processing facilities and force companies to recall tainted food.

The $1.4 billion bill, which would also place stricter standards on imported foods, passed the Senate 73-25. Supporters say passage is critical after widespread outbreaks in peanuts, eggs and produce.

Those outbreaks have exposed a lack of resources and authority at the FDA as the embattled agency struggled to contain and trace the contaminated products. The agency rarely inspects many food facilities and farms, visiting some every decade or so and others not at all.

The bill would emphasize prevention so the agency could try to stop outbreaks before they begin. Farmers and food processors would have to tell the Food and Drug Administration how they are working to keep their food safe at different stages of production.

Despite wide bipartisan support and backing from many major food companies, the legislation stalled as it came under fire from advocates of buying locally produced food and operators of small farms, who said it would could bankrupt some small businesses. Senators eventually agreed to exempt some of those operations from costly food safety plans required of bigger companies, rankling food safety advocates and larger growers but gaining support from farm-state senators.

Senate sponsors further softened the bill’s impact on the food industry — including eliminating some fees processors would have to pay and reducing the number of required inspections — to gain votes in the Senate and to make the bill more palatable in the House. Members of both parties voiced concern about the legislation’s impact on small farms and businesses when a different version of the bill passed that chamber in 2009.

The bill’s prospects are unclear since there is little time during the brief lame-duck congressional session for the House and Senate to reconcile different versions. Iowa Sen. Tom Harkin, the sponsor of the Senate legislation, said he has agreement from some members in the House to pass the Senate bill, which would send the legislation straight to President Barack Obama’s desk.

Senators rejected several unrelated amendments to the bill, including an amendment to place a moratorium on earmarks, or pet projects in lawmakers’ states and districts, and one to repeal an arcane tax provision that helps pay for President Barack Obama’s new health care law. Supporters said the amendments would have killed the bill’s chances in the House.

The Senate legislation would:

—Allow the FDA to order a recall of tainted foods. Currently the agency can only negotiate with businesses to order voluntary recalls;

—Require larger food processors and manufacturers to register with the Food and Drug Administration and create detailed food safety plans;

—Require the FDA to create new produce safety regulations for producers of the highest-risk fruits and vegetables;

—Establish stricter standards for the safety of imported food;

—Increase inspections of domestic and foreign food facilities, directing the most resources to those operations with the highest risk profiles.

The bill would not apply to meat, poultry or processed eggs, which are regulated by the Agriculture Department. Those foods have long been subject to much more rigorous inspections and oversight than FDA-regulated foods.

The federal Centers for Disease Control has estimated that tens of millions of Americans are sickened and thousands die from foodborne illnesses each year.

    This will mean bread lines like many of us remember from the USSR. Bye Bye specialty and ethnic food stores. Bio-engineered fruit and veggie only, monsanto is pleased they love GMO’s. Prepare to grow/hunt for your own food… and be prepared to be prosecuted for it.

      Ghost of Jefferson offers a good one as well. Heirloom seeds allows you to buy only the seeds that you know you will eat (my family does not like beets for instance). However, I am not sure if Heirloom packages its seeds in a way that you can store them for a long period of time and still remain viable. One of the things I like about Emergency Seed bank is that they come in a virtually indestructible container that you can bury on your property and use when really need to. Safe from the government in cases of martial law- etc.

      Good point about the packaging. If one is so inclined, buy mylar bags and 5.5 gallon buckets. Store the seeds in the mylar with some dessicants thrown in, iron it up, throw it in the bucket, seal the bucket, and now you‘re ready for storage in any ol’ place you want. :)

    Well, I don’t think exempting small farms from meeting standards actually protects us from bad food.
    If you aren’t meeting the standards set to be safe then your farm should go under.
    I do like the killing of imported foods business . The new regs will shoot the cost thru the roof, or stop importing certain items all together
    I know of a person who imports tropical drinks in those individual containers. His foreign farm and processing plant doesn’t get tested at all.

      Small farms are not the problem, food storage and preparation are. If food is handled properly as it is on small farms and cooked correctly there is very little occurance of illness. Big brother is just trying to find more stuff to use to control the unwashed masses.

      People in Colorado, this is horrible for you! Other food producing states as well. How many people did you grow up with who are no longer farmers? How many wells are we going to watch be shut down right under people’s land? If our state representatives will not lead the charge to recall these dangerous senators than we must. We cannot wait until 2012, 2014, or 2016. The states must stand up for themselves. How many more industries can we allow to be run from Washington, D.C.?

    What ELSE does the bill say? I’ll bet there is language that puts the smallest of food producers, i.e. the home gardener under the auspices of the FDA, should they want to go that low, which they will when the treason plays out, the dollar is worthless, and the NWO rolls out the new world currency. I‘ll bet this lays the groundwork for squashing the eventual ’black market’ of home grown food. I’ll look it up myself, but maybe there is a patriot out there who already knows the answer to this question.

      Some people think that they can have a garden, and no one will find out, but think of that one snotty neighbor who will blackmail you for your best tomatoes or they will tell; or the liberal neighbor that hates you because you don’t think like they do. I have one, and she causes a lot of trouble for me.
      There’s always one in the mix. I’m not being paranoid, I‘m just trying to figure a way to grow vegetables so a person can’t see them over the fence.

      They have just convinced me that it might be profitable now to open a few of my acres to growing produce for the local farmers market. Tell me I can’t, I will open up a few MORE acres, as well. Fress green beans, tomatoes, cucumbers, etc. for sale here next summer. come get some!!

    What I can‘t figure out is why they don’t try the existing laws first, which already do a good portion of this anyway. This is what happens when you don’t learn how to read under the no child left behind, maybe we need to start a no Senator Left Behind program that teaches them how to read a bill before they vote on it!

      VERY Dangerous……take control of all food. The take over last week of the land in Alaska was not for the Polar bears…it was government take over of the land that has our oil and gas. They almost have total control of our natural energy resources now. This is a take over of not only our food supply, but our ability to produce our own food.

      I believe that most food borne illnesses are caused by unsafe preparation of foods and improper storage not the food itself. This is all a bunch of crap. I wonder how many people get sick outside of cities in rural areas where people actually get to eat real fresh, organic foods.

Fanny and Freddy and most anything the government touches to become bankrupt or just another black hole down which our tax dollars disappear.

      One of the net effects of this bill will be that the companies which produce and handle the food will have to charge higher prices for their produce. YOU will be the one paying the price at the supermarket. YOU pay while the bigwig Senators who voted for this eat subsidized meals at the Capital dining facility. These clowns don’t care one whit about the common people, only their re-election and padding their own nests. I wonder how many campaign contributions were provided by Con – Agra, Archer Daniels Midland (ADM) and other food giants in order to gain passage of this bill. They, the food giants, will gain while the small companies will slowly go out of business one by one.

      Obviously the message that Americans sent to Washington this last election didn’t sink in! So the answer follows!

    Not like there is much use in trying to convince either of the two corrupt career CA Senators to not pass more onerous regulations. Too bad the redistricting reform won’t affect them either.

      Yup, I am from NJ and it was a waste of my time to call Menendez and Lautenburg… but I did it anyway….again! I feel like I am in a “real cheesey” 1980′s movie about how the USA was defeated. Is there any way I can change the channel or walk out of the theater? Please God, make it go away… I just want to enjoy my family and life again! Good thing I work with a guy from the Ukraine… he saw this coming some time ago and told me how to prepare. However, even though I am doing all the right things it does not seem like enough… especially is the big, bad government simply walks in and takes away all I have saved and worked hard to put aside!

      Didn’t matter … I tried to call my Senators .. they closed their offices .. at least turned off the phones … could only leave a message … I had sent emails earlier in the week … the canned response I got was that he was going to do what he wanted and that was that. We need to throw more of the bums out .. is it 2012 yet!

      I pray that we make to that point and date. I fear for the Republic and am losing hope in this system of corrupt politicians, corrupt judges and officials. I pray daily that all the destruction that has been done is reversible and soon. I do not know how much more this nation can support before it completely crumbles.

We need to instill this type of national pride in our youth once again. True, we Americans share in this world; but we are NOT by any means “Global Citizens”. America IS “qualitatively different from other world nations”; but America is slowly losing her exceptionalism. We need all the little (now old) “Hulkamaniacs” to rise up and give a “Hogan leg-drop” to all this globalization nonsense. I guess it’s sort of ironic that Hulk Hogan eventually ended up representing the NWO. (I know this; and I am not a wrestling nut by any stretch of the imagination.)

      In all seriousness, we need to go mainstream with these ideas. I understand that rallies can be expensive; but they don’t necessarily have to be. Restoring Honor on 8/28 was great; but patriots (like Glenn) need to organize similar events (in spirit, not grandeur) at least once a month. We can’t allow “them” to ignore us; we simply do not have the time.

      Can’t stock up on perishables and this will affect alot of those. I wonder what this little piece of work will do to food prices.
      I cut my finger on a staple yesterday, why oh why won’t the government pass a law to protect us from staplers? Oh and my feet were cold this morning, we definitely need a law to protect us from cold feet in November.
      No point in expecting any common sense when it comes to food preparation when the government can make a law to protect us from EVERYTHING.

      Also stock up on heritage seeds and a greenhouse so you can harvest seeds. Monsanto’s hybrid seeds can destroy heritage seeds if they are anywhere near them. They have already “regulated” that run-off water belongs to the government and we shouldn’t hamper it running into the water tables.

      How about instead of the Nanny State of “we will protect you from dangerous food” we instead have people INFORM THEMSELVES about proper food preparation. There is very little danger from food that is prepared properly. Heck run a government funded ad campaign about it. I would much rather fund that than fund the price hikes on food that this will bring.

      Admittedly, there are foods that are hard to prepare in a way that ensures safety (peanut butter, for example), however, there is no need for a blanket law for all foods other than “meat and eggs.” Under current law, unprepared foods (such as peanut butter), are required to be subjected to microbial testing before it can be released for public sale. Only minor adjustments to this law can ensure public safety.

      The peanut butter outbreak a few years ago was due to the manufacturer of the peanut butter using a microbiology lab that was using unproven methods to test for bacteria contamination. A simple adjustment to current law could make it so that those manufacturers would need to use labs that meet an accreditation requirement. In other words, the methods a lab uses would need to prove accuracy. Simple fix. No widespread new regulations.

      This is going to put many small producers out of business, and the larger ones will be exempt from many of the same rules and regulations. Ever wonder why nutritional supplements, pharmaceuticals, and even medical equipment prices have gone through the roof over the last couple decades? Because of stringent and mostly useless FDA regulations. Your food prices are going to skyrocket in the same way very soon. Glen has talked about inflation, but that will pale in comparison to what the FDA is about to do to your grocery bill.

      For all intents and purposes, the govt just took control of all food in the country. By adjusting the supply of various foods “due to concerns for the safety of ……….. the following foods will be in short supply until the safety of ………. can be assured”, prices and consumption levels can be regulated. Look for shortages of red meat, sweet foods, salty foods, fatty processed foods and anything Mrs. Obama thinks is bad for us. Look for de facto “Prohibition” since the president has gone around Congress for just about everything else. I doubt there will be any shortage of fruits and vegetables unless the current administration is mad at the people for something and perhaps a bit of hungar will bring them (us) back in line. The tea party people are going to lose a lot of weight.

      They control medicine, housing, education and now the food supply. Welcome to 1984 twenty-six years late.

      Read an article where people will be plundering for food within 3 days of a crisis and KILLING for food within a week. DO NOT depend on anyone else to provide………especially the government.

      You can always begin with beans and rice and work out from there. Make sure it is stored properly.

      Robinva.. ya know about 3 years ago I got laid off.. and we had bought a small house with a large yard a few years before that but working left little time for a very big garden.. well I started buying non-hybrid seeds growing and saving the seeds from my own plants.. I got really good at it and with my mothers help (she was raised on a farm) and the internet I learned not just to grow my own food, but to can or freeze it. I had at the time NO idea why I suddenly became so interested in growing everything myself.. but it’s been paying off so far in better tasting food and it seems it will pay off even more in the future.. Wish I would have asked her about raising goats they are good for milk and butter from what she said..

      I support anyone’s right to grow any food they want for themselves. If I catch someone growing food in a way that violates regulation, I will absolutely not say a damn thing to the authorities.

      You’re supposed to use the courts to punish the guilty, and we are innocent until proven otherwise. Regulations violate our right to a fair trial, punishing us as if guilty before being taken to court.

      The American public is fully aware that the system referred to as CODEX Alimentarius, is one designed to remove the right of the people to grow, harvest and consume the foods of their choice, for no other reason than to benefit the financiers of the global organization known as CODEX, and to implement a global takeover of the food production and supply for the benefit of those same financiers; multi-national corporations.

      For the last ten years, I have raised MY OWN vegetables, fruit, and meat products – for me and mine. I’m not in the business to sell the stuff. I just enjoy keeping household costs down and know my products are without additives. I know that it will NOT go well if some government scab comes to my door and tells me I can’t produce my own food. Not that I will stop doing so, but it will get into the headlines regarding my own ‘defenses.’

      So lets see…. they have: health care, insurance industry, car manufacturing, energy, finance industry, control/monitoring of personal finance, education, nutrition (watch out for that child nutrition bill coming up), “adult formation of children” in health care act, transportation, pharmeceuticals, and now they have taken over agricuture. Oh, I forgot, they’ve given the military over to the UN (Nato). And they’ve destoryed the dollar. They own most of the mortgages in the country. And they will be restricting travel by using body scanners everywhere. opps…almost forgot they also control the media. Did I forget anything? Yes, the International Building Codes Council will control everything about zoning…building and owning homes so no one will be able to own a home and if they do, they won’t be able to renovate it. I’m sure there is something else…oh, yea… the internet, radio and television.
