Senate Passes Food Safety Bill…Again

WASHINGTON (AP) — The Senate has passed a sweeping bill to make food safer, sending it to the House in the waning days of Congress.

This is the second time the Senate has passed the bill, which would give the government broad new powers to increase inspections of food processing facilities and force companies to recall tainted food. The chamber passed the bill for the first time three weeks ago, but it was caught in a constitutional snag when senators mistakenly included tax provisions that are by law supposed to originate in the House.

The version of the legislation passed by the Senate on Sunday is amended to avoid another such mishap.

The $1.4 billion bill would place stricter standards on imported foods and require larger producers to follow tougher rules for keeping food safe.

    To you folks making jokes….there ain’t nothing funny about this legislation. This bill has nothing to do with food safety. How many times are we going to are we going to look at the friendly, good intention title on a bill and go oh! Food Safety, well who’s not for that.

    This bill has absolutely nothing to do with food safety and has everything to do with putting small farmers and producers out of business in order to make way for Monsanto and others to control the food supply in the US

    Why does it cost 1.4 billion! I’m a health inspector in CA. I inspect food processing plants. Our program is funded by the health permits fees that processing plants pay for. NOT tax money. If the gov. wants more inspections our permit fee increases. So again Why 1.4 Billion??

      Elkmoon, the majority of the CDFA budget comes from the CA General Fund (Taxes) and the Federal Government (Taxes)…..NOT Fees. The CA CDFA budget, alone, is over 1/3 of a billion $$.

    We are stupid! We don’t know any better! Just ask the legislators that are passing this garbage. It doesn’t matter how badly the Dems lost in November. OB-1 has his agenda and the Progressive Socialists are going to do whatever it takes to push what he and George Soros wants. It’s hard to believe we have someone the likes of OB-1 in the “Peoples House” and there are no real attempts to get him out. Reporters like Krauthammer are already talking about a “second term” for this excuse of a leader. Let’s hope the Republicans will do what they promised to do. Let’s hope they can turn this country around! Let’s support their initiatives as much as we can!

    This is not the Food Safety Bill, it is the Food Control Bill. The Republicans have betrayed us, and the way this passed the Senate was both sneaky and underhanded. The only hope to stop it now is to call, email or fax your Representatives. The House will vote on it Tuesday. This is nothing short of a takeover of our food supply by the Federal Government, and I fear it will have terrible consequences for our farmers. It will also raise the price of our food. I am very afraid and sad for our country today.

      Well….if you work for the California Department of Food and Agriculture, FEES make up only 47% of your budget. 25% of your budget comes from the Federal government….as in ME. The rest comes from the California General Fund…..as in TAX MONEY. By the way….CAs budget ALONE is over 1/3 of a BILLION.

    Every single aspect of our way of life is under attack. We are watching the planned systematic destruction of our country by the ruling elite. They see it. Unless you have a 10 year supply of MREs in the shed, or you’ve sunk the equity in your house into food insurance, this is one of the good jobs a national government is supposed to do.

      Did you know that in bulk grains one difference between feed for livestock and food meant for human use are fewer mouse turds per ton. The point is this food has already been inspected by government inspectors and you can”t get rid of all the mouse turds in the world.

    The Federal Government keeps assuming power it does not have, and the States keep letting them take it. Is there no end to this audacity?
    Senators should be elected by State Houses, not directly. The States have lost their voice in D.C.
    There is no one left to stand up for actual Federalism and States’ rights. Big Agribiz and Big Government in cohoots. Just like Big Govt and Big — u name it: Labor, Auto, Banks, Stock Traders, and now “Big Food”.
    Both of the Senators from my supposedly ‘red’ state of GA are for this. Shame on them! Sens. Chambliss and Isaakson are good ‘ol boys in the pocket of Big Agra, I guess. I thought Georgia was Conservative? Doesn’t look like smaller govt to me, Senators.

    I can‘t but believe that this could all be part of the big gov’s scheme to control every aspect of our lives, vis a vie Michele O’s “big fat kids” mission to dictate what restaurants can sell.
    When it comes to food regulation the government has a terrible record: they imposed a “low fat” philosophy and granted subsidies to the high fructose corn sweetener industry resulting in an influx of diabetes, heart disease and obesity the like of which the world has, heretofore, never witnessed; they disparaged much healthier natural fats and both pushed and subsidized the hydrogenated vegetable oil (and margarine) industry. Result? Hundreds of thousands unnecessarily die.
    As John Stossel would say, “Give me a break!!!”

How ’bout the Senate instead decides to send all tainted food to your state….so that your ‘local’ inspectors can sort through a half billion contaminated eggs.

      As I understand it, this bill does NOT cover eggs and meat, the two most commonly contaminated products. If people cook their eggs and meat properly, problem solved! We don’t need this bill. It is just a mandate for the Government to be able to harass our farmers. The wording in the bill allows the FDA to shut down a facility if they even suspect there is a problem. I don’t believe the Tester amendment will protect our small farms and organic farms. Call your Representative today and tell them to stop this monstrosity.

    let’s see….a half a billion eggs affected with salmonella, romaine lettuce delivered to 23 states, a half million pounds of e. coli flavored hamburger, to name just a small fraction of the incidences of food contamination within the last 12 months.

    And you folks think this is a about a government take over of your vegetable garden? HAR!

    Our food supply is a national security issue…in addition the the single largest component of our non-durable goods economy. But hey, don’t let common sense or reason stand between you and a good conspiracy theory!

      You can not make the world safe with more government, they already inspect most of the food. As we import more food from China etc, do you really think you can hire enough inspectors and pay for them. Food will become more costly and not any safer.

      This bill creates a MINIMUM of 20 THOUSAND overpaid, unneeded federal bureaucrats to create a brand new, indecipherable mountain of red tape. There is no upper limit in the Bill, of course. All card carrying union members.

      This bill allows unelected bureaucrats to pick winners and losers in a huge area of business. It’s called a protection racket. Unionize, or else. Support these campaigns, or else. etc, etc…

      Monsanto and its #2 shareholder Soros will make an obscene amount of money, a percentage of which will flow back to The Party, of course. Yaaaay, croney capitalism, what a rush, duuude!

      Of course you love this bill.

      So…the food issues you used as examples all involve some big food company. Ironic when you consider they are the food producers that are currently inspected most. Now with this grab of power that is supported by the likes of Kraft etc the inspections are going to increase. Ask yourself why any company would willingly lobby to endure more Federal Inspectors. The answer lies in the largest threat to those large comapnies in my opinion is the much smaller regional farms that are infact going back to the “old 40 acres and a mule” model and end users are supporting that. Now with an exememtion of a miniscule $500,000 of sales and three years of records and all the other crap the samll farm will have to deal with, which producer do you think will survive this bill?

      KRMH you are so right. farm raise seafood coming from China. 25 is tested. Of the 2 5 98% is contaminated wityh lead, mercury and other heavy metals industrial pollutants. It is not the domestic food supply we need to worry about it is the growing number of imports. Why are we importing Chinese fish and exporting our own to China???? Some one pointed out all the contaminated food that has been found recently. First it was found and second it was immediately recalled. In almost every case the producer had been cited for violations that were never corrected.

      `(a) In General- No entity engaged in the manufacture, processing, packing, transporting, distribution, reception, holding, or importation of food may discharge an employee or otherwise discriminate against an employee with respect to compensation, terms, conditions, or privileges of employment because the employee, whether at the employee‘s initiative or in the ordinary course of the employee’s duties (or any person acting pursuant to a request of the employee)–
      `(1) provided, caused to be provided, or is about to provide or cause to be provided to the employer, the Federal Government, or the attorney general of a State information relating to any violation of, or any act or omission the employee reasonably believes to be a violation of any provision of this Act or any order, rule, regulation, standard, or ban under this Act, or any order, rule, regulation, standard, or ban under this Act;
      This is the start of a FARM LABOR UNION. Sound familiar?

    We already have a safe food supply in this country. The government cannot check on every food source produced in this country without hiring thousands of inspectors to do this. We do not have the funds to hire more government workers and pay for more red tape. The repubs that support this need to be gone in the next election cycle. This whole new law is about control period!

      Patriot there is already a mecanism for this. It is called not buying their product. Did you keep on buying green onions after grocery X was found to have contaminated onions? No you quit buying them all together. That is incentiive for them to insure they are as safe as it is cost effective to make it. What you have to look out for is they will use this as an excuse to irradiate foods in the name of safety. I am not too sure that language in this bill does not already authorize this.

      This bill contains Barriers to entry for new businesses, increases the cost of smaller businesses and contains the framework for making food a controlled substance. Your f will cost you much more if it is available.

      Turn it into a revenue generating bill, not a spending bill…
      Don’t do anything but say, “if some ‘outbreak’ happens and is traced back to whatever source, that source will pay fines, pay all related medical expenses, if any death, $5 mill to the surviving family per incident, $5 mill to the government for each person affected, and an over-all fine of $500 mill per incident.”
      Just think, over the past year, that would have generated over a billion for our ailing government…
      And would be a stronger incentive to make sure our food is “clean”…

      Well the simplest way to stop it is don’t FUND it.. I understand the need for safe food HOWEVER.. maybe if they passed bills that were state friendly instead of having our food travel interstate we would get better QUALITY and SAFER foods.. As it is the FDA can‘t find a bunch of bad jalapeno’s from Mexico before destroying acres of TOMATOES grown in the U.S.A.. We already have good laws in place in this country it‘s OTHER countries who are the BIGGEST offenders and this bill will NOT allow our inspectors to inspect growers located in OTHER countries it’s a SMOKE SCREEN.. I am not even sure it doesn’t allow for inspections of backyard gardens.. whatever isn’t exempted in a bill is automatically included.. which would also give the FDA power as to what is grown..

      Where is this in the constitution? We already have the safest food supply in the history of the world. In all truth this is beacuse of the free market system, not in spite of it. Put out a bad product, between lawsuits and the word getting out, you are quickly out of business.

      Well, sir, you can only have lawsuits if it is suspected you broke a law. If there are no laws regarding the standard for food products there can be no lawsuits and the consumer will have no legal recourse…

      Why does it cost money to increase food inspection? Maybe because you need to hire more food inspectors. And who is going to create these new standards? Do you think they will do it for free?

      You all cry about the free market system and how great the invisible hand is, but it seems very few of you have any idea what actually goes into a consumer based economy.

      and LOOK at the cost//new gov jobs: (a) In General- There are authorized to be appropriated to carry out the activities of the Center for Food Safety and Applied Nutrition, the Center for Veterinary Medicine, and related field activities in the Office of Regulatory Affairs of the Food and Drug Administration–
      (1) $825,000,000 for fiscal year 2010; and
      (2) such sums as may be necessary for fiscal years 2011 through 2014.
      (b) Increased Number of Field Staff-
      (1) IN GENERAL- To carry out the activities of the Center for Food Safety and Applied Nutrition, the Center for Veterinary Medicine, and related field activities of the Office of Regulatory Affairs of the Food and Drug Administration, the Secretary of Health and Human Services shall increase the field staff of such Centers and Office with a goal of not fewer than–
      (A) 3,800 staff members in fiscal year 2010;
      (B) 4,000 staff members in fiscal year 2011;
      (C) 4,200 staff members in fiscal year 2012;
      (D) 4,600 staff members in fiscal year 2013; and
      (E) 5,000 staff members in fiscal year 2014.
      (2) FIELD STAFF FOR FOOD DEFENSE- The goal under paragraph (1) shall include an increase of 150 employees by fiscal year 2011 to–
      (A) provide additional detection of and response to food defense threats; and
      (B) detect, track, and remove smuggled food (as defined in section 310) from commerce.

      Right there.

      You are apparently confused…whether intentionally or not only you can say. A “free market system” and a “consumer-based economy” are two different things. Typically, a “consumer-based economy”, as defined by the current example in the US, requires that much that defines a free market system and which creates competition & growth be abandoned in favor of government regulation and control in order to function.

      Mary Lou and Independent this would never have passed if the states had any say in Gov’t. That is why I say repeatedly we need to repeal the 17th Amendment and give the states back their power through the Senate. What we are seeing today is tyranny by the majority. The very reason the Founding Fathers felt it necessary for the states to have a direct say in Gov’t. Today the Senate is just like the House. It represents voters and not the states. This is what makes corruption possible on a large scale in the Senate. Just think of the bills that would not have passed if the states had any say. SSA, Medicare., Medicade, Food Stamps, Welfare, Obamacare, Stimulus, Tarp. This was the reason for the 17th amendment. To remove the states power and soverignty.

      Progressives want to starve us by making food more expensive and expropriating family farms and food processors! In “developing” countries, food is a major expense like your rent. In America, not. Am I alone, or is the food in America already safe? I’ve never got sick buying from a food vendor in America.

      This bill legislates what you can grow on your own land. You can now be arrested and jailed for giving your neighbor vegetables you grow in your own back yard. one more freedom lost in 2010.
      So how long till we revolt? We have become a nation of cowards unworthy of the freedom paid for in blood by our forefathers.
