Shock Vid: Autistic Boy Beaten By Bus Driver and Aide

In Bedford County, Virginia, a school bus driver and an aide are being named in a shocking $20 million lawsuit that claims the two abused Timothy Kilpatrick, a young autistic boy, back in 2009.
The women, Alice Davis Holland (the bus driver) and Mary Alice Evans (a special education bus aide) were convicted of assault and battery following the incident, but it seems new problems for the two former district employees are on the horizon.
According to allegations, the Holland and Evans had repeatedly physically abused the then 11-year-old boy. Ryan Edwards, a spokesperson for Bedford County Schools, says that neither of the women have been employed by the district since September of 2009. And WSLS.com has more about the legal penalty they faced for the allegations waged against them:
Holland, of Bedford County, was sentenced to one month of active jail time and another 11 months of suspended time. Evans, of Bedford, received two months of active jail time and 10 months of a suspected sentence.
Interestingly, while the two were charged with misdemeanor assault, a prosecutor dropped a separate felony child abuse charge. Now, the child’s family is taking action of their own.
Allegations and convictions are one thing, but video footage is another. Lawyers for the boy’s father, Thomas Kilpatrick, were apparently able to secure a disturbing bus video through Freedom of Information Act requests. In it, the driver or her assistant can be seen hitting the child with a fly swatter, while at other times choking, kicking and beating him with their bare hands.

In the 2009 clip, young Timothy, who is now 14 years old and whose autism is so severe that he can barely speak, seems to be crying out. At times, be moves his arms and legs, seemingly trying to stop the women from touching him. In this particular incident, the child was strapped to his seat with a double harness, which didn’t allow for much movement.
While the boy’s father claims that he attempted to let authorities know about the abuse well before it was discovered, he claims they didn’t listen. The Times Dispatch reports:
Kilpatrick, though, said he had brought concerns to school officials nearly a year earlier after his son started showing signs of injuries and fears about riding the bus. Tapes of incidents during that time could not be located, according to the suit.
The father said Wednesday during a phone interview that he was unable to get school personnel to respond to concerns that his son was being harmed when he first reported in November 2008 that Timothy was coming home with bruises and scratch marks on his arms and face.
The lawsuit being launched by the Kilpatrick family names, as defendants, the Bedford County School Board, the two women on the bus, and Sara Staton — the director of special service for the school district.
In the complaint, the family alleges that Timothy was denied equal access to and enjoyment of the transportation system. Of course, the fact that their son was forced to fear physical and psychological threats to his well-being when riding the bus is also mentioned.

With that sad, had I witnessed this I would have put on the cloak of violence from my anger and whipped the living dog snot of these people all the way up until the cops showed up, my kid or not. Kill them no, but instill in them you do not harm innocent children. I would gladly serve my time and pay my fine for defending innocents is worth every penny.

Whether he was upset about something that happened before he got on the bus or after we dont know. When an autistic child is upset, depending on the severity of their autism, they act out physically or verbally to try to express that frustration. It can be very intimidating if you are not accustomed to seeing that. That being said, anyone who is supposedly a “special education aide” should know, that the more upset and angry you get towards the autistic child, the more agitated and demonstative they become. Again, the response usually corresponds with the severity of their autism. Clearly, watching this tape, the boy’s response to a MAJORITY of the beating he was taking was rather tame. Not only did he remain relatively calm as the bus driver was tying him down and after he took a punch to the head by the aide, he sat there and took a good beating until he started to defend himself. Arguement, you were either watching another video, putting your comment up here to cause a stir to have a good laugh, or maybe you are just that insensitively stupid. You are the kind of person that makes it possible for “wild animals” like those two to beat up a kid like that.

Posted on October 7, 2011 at 1:15pmA lot of you people are ignoring the video that shows the boy violently reaching out troward her as she leans away from him. It would help if the video were not edited. I see abuse here, but not proof of malicious abuse or intentional criminal activity. I see two poorly trained women struggling to deal with a boy, who is not small, that is capable of violence. the fact that she is sitting by him with a fly swatter shows that she is preparred to use it as a means of discipline to control him.
Not knowing the facts about how the boy normally behaves, and not being able to see all the video I am not so quick to condemn these women as some here do. It can be very frustrating, and sometimes frightening, dealing with a severly mentally disabled child who is still physically strong. That they are not up to the task and choose poor methods is clear. I do not find the case so clear beyond that.
Glenn said that the woman was crushing the boy on the other side. That is not what I saw. I saw no sign that his space was becoming cramped. It looked like she was sitting slightly ahead of him. I imagine there is more room on those busses that normal ones. I mention this fact just to point out that the scene of abuse leads some to leap to conclusions that magnify what they are actually seeing. We don’t know all the facts.
I’m sure just being reluctant to leap to conclusions some will see as a moral failing in itself. I could care less for the opinions of such people.

I also have an autistic child, if the people on the bus did this to him they would be dead no matter who got there first me or my husband got there first. Beat him to within an inch of his life and he still won’t get it. Negative re-enforcement only works on those who can relate their actions with the negative results. This is ignorance and cruelty nothing more. This is unacceptable to me and I believe in spankings, but only when they are applied to children who will gain something from them. Use the right tool for the job and beatings are never the right tool. If their patience level had reached the breaking point they should have asked to be re-assigned. Wonder if their union will be defending them?

Hats off to your caring. As a Children‘s Club teacher for an autistic child who’d nearly overcome it by the time I was trained to work with him, I know of the patience this requires. Thanks for hanging in there Dad, too many don’t.
My 11 yr old grandson has all the symptoms of mild form of autism, but the nearest specialist is 70 miles away his pediatrician convinced my daughter it‘d be the same medicine so he’s just being treated for ADHD. When she was nearly at her rope’s end last year Grandpa, Uncle and I took him 3-4days a week to live in the country, after his expelling she decided to computer home school the , him & twin sis, she sometimes helps a friend one day a weekso it was set up for evening classes and we keep them overnight!
An autistic 11 yr old boy can be a REAL CHALLENGE, with so many variables God alone gives patience, but NO WAY ON EARTH does that kind of behavior get excused. Restraint yes, but the boy was restrained, THIS IS VIOLENCE! JAILTIME!

If you were dealing with a non-autistic child, this may sound great, BUT, an autistic child must learn Normal. My grandson has asked us to define words which the average 2 yr old will pick up the meaning of. Most concern emotions, or behavior and reactions. The thought that someone (usually older sis) did something 2 him 2 weeks ago, means she’s out to harm him, and we must get him to talk it through until he understands this was 1 incident, and something she usually was only reacting to. They don’t usually understand that reactions to them do not mean someone would want to destroy them and they need to strike first. I’ve found the tv shows he watches have to be monitored because when he was young, he truly believed all the aliens were coming for him. Now he’s dealing with whether or not there really are ghosts and goblins. We go through this each year and I can see improvement. In his old school a teachers report pointed out he was upset because she walked in and asked them to be seated when the normal day they did pledges first. Reaction. Shoe off foot, on top of head!

Autistic kids brains short circuit between thought and communication and it becomes very frustrating for them. My brother usually took it out on his own body, scratching or hitting himself. It was so very frustrating because in the 50′s he was considered retarded, period. There’s a real person in there trying so hard to get out. We finally were able to teach him sign language. It changed his whole world. Every child is different. It takes all your resourses to help bring them out.

What these two women did was inexcusable and they need to be fired, exposed and arrested, but you are going to have to step up as a dad and be a little more observant.
Now you need to let your kid know that you are here for him and ride the bus with him. Let him know that he is safe.

I pray that true justice reigns upon them and others like them…. and for those who have not yet been caught, I pray they do! These things make me so angry! Anyone who beats someone that can not defend themselves should experience the feeling themselves, and if they have already ( as a child etc… ) then they should get it again 10fold to remember the experience, because obviously if they are doing it, they must have forgotten! There is too much emotion and anger controling the comments on this thread (so what is new?). But I think a more sober look at this video might lead to a more complex interpretation that would make us hesitate to call for such absolute condemnation. Refraining from absolutely condemning the women does not mean you have to tolerate their abusive actions. It IS possible to take mediating positions between Hitler and Mother Theresa.

Why on earth would you put him back on the bus if he had cuts and things and refused to get on? I don’t get it. I would have demanded to see the tapes and find out what was happening. I am not saying that what these woman did was correct, as I think that they should be locked up for it, but as parents we need to listen to our children and look into things deeper even if they are inconvenient with your own life.

Those two women should never be allowed to work with or near children again for life. Pretty sad that the prosecutor dropped the felony charge,those women should be in prison.

Posted on October 7, 2011 at 11:02amI am so glad they got video. My autistic and Down Syndrome son was abused at a Montesorri school by just about every teacher there. I got an “anonymous” tip that I later discovered was one of the teachers who was against the abuse, but didn’t want to lose her job. He showed no fear of going, but he lost all eye contact. When he knows someone doesn’t like him, he tries harder to get them to like him. I also had a public school teacher mentally abuse him.

My younger brother is mildly autistic and I would protect him growing up, even to the point of taking the punches myself when I couldnt fight back. It‘s horrible how people think they can take advantage of someone who often can’t fight back either because of physical limitiations or mentle ones.
