Shocking: Reid Rewrites Senate Rules By Using Obscure Legislative Maneuver

In a stunning development Thursday evening, Senate Majority Leader Harry Reid D-Nev., resurrected an arcane legislative procedure to change the Senate rules, making it harder for the minority party — in this case Republicans — to force procedural votes on controversial amendments after the chamber has voted to move to final passage of a bill.

Reid’s initiative passed by a vote of 51-48 and left key Republicans irate.

According to The Washington Examiner, the catalyst for Reid’s move came on Tuesday when Senate Minority Leader Mitch McConnell, R-Ky., tried to force a vote on President Obama’s jobs bill by offering them as amendments to the China currency bill.

The Examiner explains:

Tonight, McConnell made what’s called a “motion to suspend the rules,” to allow a vote on the amendments. Such motions are almost always defeated, because they require a two-thirds majority to pass. But they’re another way for the minority party to force uncomfortable votes. Even though the minority party doesn’t get a direct vote on the amendment, how somebody votes on the motion becomes a sort of proxy for such a vote. In this case, for instance, if Democrats had voted down a motion for a vote on Obama’s jobs bill, it would have put them in an awkward spot.

Though it’s been the standing practice of the Senate to allow such motions by the minority, tonight Reid broke with precedent and ruled McConnell’s motion out of order, and was ultimately backed up by Democrats.

So, the end result is that by a simple majority vote, Reid was able to effectively rewrite Senate rules making it even harder than it already is for the minority party to force votes on any amendments. Should Republicans retake the Senate next year, it’s something that could come back to haunt Democrats in a major way.

The Examiner makes certain to note, however, that Reid’s move on Thursday is different than a similar sounding measure dubbed the “nuclear option,” which is used to end filibusters:

While triggering the “nuclear option” requires a Majority Leader to use the same sort of strategic maneuvers as Reid just did, tonight’s move had to do with the amendment process, not filibusters.

      From what I‘m reading it’s quite possible a mojority of Nevada didn’t vote for him. SEIU has the contract to service voting machines in your state, and many didn’t have the vote come out the way the voter wanted it to.

      Joe McCarthy tried to warn us. They were infiltrating from within. Once they were inside they moved up the ladder and hired their compatriots. He only warned about government infiltration, but it was happening in our news rooms, our schools, Hollywood, and all other places where there is public influence. Now with such a higher percentage of our youth going to college, where second generation far leftists are the norm doing the ‘educating’, is it any wonder that the voting public has no idea what Our Country is all about, and vote the likes of Reed and Pelosi (in New Jersey, sadly, we have Lautenberg and Menendez)? This was a well thought out long time play of the Progressives of the 20s and 30s and I’m afraid of what is upon us. If we are not overthrown from within before 2012 (martial law would keep Obama, I’m afraid) this election cycle seems to be our last hope, but there seems to be too few ‘real’ candidates. If we are able to survive, home schooling seems to be a must as a starting point to turn things around!

      If what Reid used was an ‘obscure’ maneuver, then he obviously wasn‘t ’re-writing’ the Senate rules. He was using an ‘obscure’ Senate rule – which obviously hadn’t been used for some time and was just gathering dust. Poor McConnell! By the way, wasn’t it the Republicans who decided that there MUST be a 60 vote majority (filibuster proof) before ANYTHING could be debated. The ‘filibuster’ was an obscure rule until 2006 when the Democrats took the majority. Now the Republicans claim it is the NORM!

I did see some idiot up there saying that Reid had been there a long time..obviously either a union guy or someone who was clueless about politics..but a friend of mine watched the elections there. he said the woman running against Reid was actually way ahead of him until the “lights went out.” Then when the lights came back on…Reid was ahead… isn’t that just astonishing? Someone else told me that Reid had a smug look on his face like he was very confident of winning.. and of course.. Reid being a Union guy… well.. we all know how honest Union thugs are.. and we all know how honest Liberals are. The Party of Satan.

      Some republicans voted for this too… actually I can‘t find the list but on Levin’s show last night he named 12, I believe that voted in Reid’s favor.. Course, the usuals like Snow and Collins of Maine voted with the dirty dems but that isn’t surprising at all.. I believe Jeff Sessions voted in favor and that IS surprising.. The only thing is, I don‘t want to hear CRAP when it’s used against them after the Repubs take back the senate..You watch Reid will be crying when it is used against him.. the child is unstable..

    Whether we like it or not, the Constitution only cares whether 50+1 votes are cast for a bill, or any other vote, to pass the Senate.

    The filibuster and other “super”-majority tactics are just tricks to make it harder to get things done.

    I am all for an end to these tricks. Let the process work as our founders intended.

      You’re wrong Doug. Look up why we have a 3/5ths and a 2/3rds requirements in the Senate. Certain things need a 2/3rds majority…. like changing the Constitution. A simple 50 + 1 would be wrong in some situations.

      Hey Doug in Seattle, if what you call for were sincere in you, the Senate would not be a mirror of the house and Senators would be elected by the state legislatures – just as our founders intended and before progressives changed how they were elected.

      Ironically, it was Democrats who sought to hold minorities and working whites in the south in a vice forever – until Republicans united working whites with Blacks as President Reagan suggested we do and together, one state at a time, we elected REPUBLICAN Govs. and Legislatures – finally ending Democrat lock-in and the true source of hatred in the south.

      Being an Alabamian, a Veteran, and a small business owner, I can tell you first hand, I watched it happen and today we have a chance to let merit and our work speak for us – rather than being muted by Democrats.

I’m from Illinois, our State Legislature got a visit from good ole Dicky Durbin when they were in process of setting up recalling future Governors. He didn’t want language included for Senators. Imagine, our Senate representatives being accountable to us?

      This isn’t cheating, it’s breaking with tradition but working within the strict confines of the rules.

      As noted in the excerpt above, this will come back and bite Dingy Harry & Co. when they lose control of the Senate… Remember, there are a lot more Democratic Senators up for re-election next year (2012), so chances are good they will lose enough seats to lose control of the Senate.

    This deals with 2 items of Obama’s, “The American Jobs Act”. First, this Act raises revenues and the US Constitution says under;

    “Article. I. Section. 7. Clause 1: All Bills for raising Revenue shall originate in the House of Representatives; but the Senate may propose or concur with Amendments as on other Bills.” How can a Bill from the White House (that isn’t a Bill yet) be acted upon by the House if it includes raising revenues? And how can the Senate (under Harry Reid) bring this non-Bill to the floor of the Senate, like he did today, without going through the House first? http://www.house.gov/house/Constitution/Constitution.html

    Second; On page 133 of President Obama’s “The American Job Act”, Sec.376. states;

    “Abrogation of State Immunity- A State shall not be immune under the 11th Amendment to the
    Constitution from a suit brought in a Federal court of competent jurisdiction for a violation of this Act.

    A State’s receipt or use of Federal financial assistance for any program or activity of a State shall constitute a waiver of sovereign immunity, under the 11th Amendment to the Constitution or otherwise, to a suit brought by an employee or applicant of that program or activity under this Act for a remedy authorized under Section 375(c) of this Act.”

    How can the White House submit a non-Bill, or any Bill, to the House or Senate that over-rides the 11th Amendment of the US Constitution?

      Good points on both. I don’t think they can submit it to the house based on the 11th ammendment. If they do, however, I’m sure it will get killed in the house. I think…..hell, I don’t know, this gets so confusing, but, if reid knows all these dirty little tricks, I’m sure the republicans know of something that can stop it. At least I hope they do.

      How can the White House submit a non-Bill, or any Bill, to the House or Senate that over-rides the 11th Amendment of the US Constitution?

    Harry Reid should be in prison for all he has done to this country.
    But Conservatives MUST wake up to the fact that the left has not rested in 80 years of trying to take over the government and they have done and will do whatever it takes to succeed…legally or illegally.
    Conservatives have been far too complacent and too respectful of the left. Admirable, yes, but ineffective when your opponent will stop at nothing to acheive its goal.
    I pray it is not too late to take back what we have lost and boot the bastards out completely. But with Reid’s move today and all the booby traps hidden in the bills they forced down our throats, who knows if we even have a chance left?

      We the people voted ourselves into this mess. We the people sat on our hands when our local school district accepted federal money in favor of controlling the curriculum being taught to local schools.

      As a reward rural America is shrinking at 1% per year. As a result rural America is hiring fewer teachers and the yet the teachers haven’t figured out that if the curriculum grows the town they teach in, its job security for them.

      Three high school history teachers in my area could not identify when the African-Americans begin voting Democratic. The had no clue the reason for the shift.

      We the people need to send a few “education experts” back home.

      Can‘t help but FLASHBACK to the last time the repub’s TOOK the senate 50-49 /1 independent!Hillary talked them into proving they weren’t “Just Like” the democraps by power sharing on all committees, then dingy harry got a jump rope, and “jumpin jim” regaled them with his skill. Since the independent caucased with the dem’s the power sharing disappeared totally. NEVER UNDERESTIMATE THE REPUB SENATORS ABILITY TO MESS IT UP!!!! In this case, they expected dh to actually follow established precedent!       Moron’s believe everything told them by the lsm. Reading people realize that everything they don’t hear from the lsm forms a pattern and that pattern right now looks and smells a whole lot like a “pole cat”. (As my father used to call them.) The so called jobs bill has nothing about jobs in it. It should be named Save My Job bill. Wonder if Plouffe has a new resume made up for BO yet?
