Kelly Thomas, the CA homeless man who died after a police beating last year

Kelly Thomas, a 37-year-old homeless man who suffered from schizophrenia, is at the center of intense debate in Fullerton, California. It was last summer that The Blaze first reported about Thomas’ death, following an intense beating from local police officers. He was subsequently placed on life support following the incident and later passed away. Now, his family — and many in the community — are seeking justice.

The authorities responsible for Thomas’ harsh treatment are facing trial (for murder and manslaughter), as they continue to defend the actions they took. However, shocking new video evidence that showcases the horrific details of the encounter, frame-by-frame, could hamper their defense.

The officers purportedly first approached Thomas in the evening of July 5, 2011, after someone reported that a burglar was breaking into cars that were parked at the local bus station.

When cops approached Thomas and attempted to arrest him, they said he resisted. But as Gawker reported when the incident first occurred, Mark Turgeon, a witness to the police beating, claimed that Thomas wasn’t resisting.

“They kept beating him and Tasering him. I could hear zapping, and he wasn’t even moving,” Turgeon said. “He had one arm in front of him like this, he wasn’t resisting. And they kept telling him, ‘He’s resisting, quit resisting,’ and he wasn’t resisting.”

While initial clips of the incident only captured Kelly’s horrified screams, a newly-released video showcases the entire incident from start to finish. And it seems, at least according to what can be viewed, that Turgeon’s recap of the events is rooted in accuracy.

A startling, 33-minute video shows the officers approaching Kelly, beating him and then seemingly laying on top of him. Throughout the ordeal, he can be heard screaming “help me,” among other pleas. Additionally, more than once, he tells the officers that he cannot breathe (his death certificate rules his death a homicide and proclaims that he died from ”mechanical chest compression with blunt cranial-facial injuries sustained during physical altercation with law enforcement”).

Following the initial incident, the Fullerton Police Department claimed that two officers involved in the encounter had suffered broken noses — a statement that was later retracted. While the video does appear to show excessive force, it is somewhat grainy and Thomas’ actions — or inactions, for that matter — are not fully viewable. Still, the audio is just as horrendous — if not more so — than the video: you hear a man pleading for his life, the thumps of the police batons, and that zapping of the taser.

Here’s the original clip that was captured on a cellular phone that The Blaze shared last year. Kelly can be heard screaming and pleading for help. Witnesses can be overheard discussing their perspective on the police officers’ actions:

Out of the six officers who responded to and were involved in handling Kelly, only two have been charged. Officer Manuel Ramos has been slapped with second-degree murder and involuntary manslaughter charges and Corporal Jay Cicinelli has been given involuntary manslaughter and excessive force charges.

“We ran out of options so I got the end of my Taser and I probably … I just start smashing his face to hell,” Cicinelli is quoted as saying in a courtroom testimony provided by prosecutors. “He was on something. Cause the three of us couldn’t even control him.”

The officers are currently in pre-trial hearings, as the court attempts to determine if there is enough evidence to move forward with a trial.

    Murder? I don’t think so. Looks like a very clear case of resisting arrest and a failure of following simple orders. With a little bit of attitude thrown in for good measure. It’s sad he died but it was a direct result of his actions.

      Where in the escalation of force guidelines does it say “when you run out of taser, use the handle to crush the guy’s face”?
      Is the death penalty now to be applied to people who resist convoluted orders? The man had mental illness, the cops were aware of his condition as they knew him. No jury is going to let these guys off the hook.

      Well put, had he got on the ground, put his hand behind his back, relaxed (as he was told to do repeatedly when there were only 3 officers) he would be in cuffs and in the back of a police car unharmed. You are required to obey law enforcement regardless of your guilt or innocence. If you resist they have no recourse but to continue to FORCE your compliance. What else are the LEOs to do? Say sorry and let him up? Simply put, do not resist and you will not get beaten.

      We have all experienced situations where the police have been a little too into their authority and perceived power. They are servants of the people and are supposed to Protect and Serve. If they wanted to arrest the guy they should have done that. The escalation was caused by the heavy set officer and the without a clear communication that they were going to arrest the homeless man, he had ever right to walk away. The police need probably cause and a clear and state reason to stop you, hold you and certainly to inflict any kind of force. In most instances I have found individuals who joined the police were not the best and brightest and many are not motivated by Protect & Serve.

      This was murder. suppose you father was an East German Stasi, and you must be one of these frustrated cops, with no self control looking for a reason to beat someone. The cop was clearly antagonizing the guy, who was of limited mental faculties. Besides each of the cops where twice this mans size, they could have waited for back up and put him in hand cuffs and taken him in.

      The population used to look at police as someone that would protect them, but now the population look at the police more and more as the Stasi, someone that will harass them, and now they want to confiscate our guns and leave it up to these brutes?       One tensing up with each blow and in extreme pain will react. Thats not resistence, thats bio reactions one cannot control. Refusing to put your hands behind your back or lying prone and still would be resisting, but if your down and their beating you of course your going to flail about in defensive movements to cover your face and head. These cops should be charged with a hate crime because the victim is White and they are now the Hispanic majority now in the police force. But not one mention of such a thing because there is no White justice watch group to bring these matters to the forefront of our society. Roles are entirely reversed these days and people of color have now been given control over us even though they are still in the minority. This was done out of White guilt and appeasment….is it working? I don’t think so. Race based politics never does.

      Resisting arrest? Listen to what the officer says to him at 15:25. “See my fist, it’s getting ready to f you up”. The subject then says, “Start punching dude”. Then the beating starts.

      The Attorney General disagrees with you. He has charged the firs officer with 2nd murder and the 2nd officer with manslaughter. The first cop knew the man and understood he had mental problems. He had problems understanding what he was saying. The victim was threaten by the first cop and the other cops did not know officer Ramos illegally threaten the man. The cop kept giving conflicting orders. He was looking for a fight from the beginning. He told him previous he was gonna kick his ass, and the guy said, go ahead and do it.       Why not ALL SIX?! The security video, although the quality of it isn’t that great, WITHOUT A DOUBT, showed that ALL SIX officers took part in mercilessly beating Kelly to a pulp!
      That said, I’m satisfied that Manuel Ramos and Jay Cicinelli, those two officers that ultimately caused Kelly’s death through the use of their subsequent assaults and severely excessive use of the Taser, are being charged with manslaughter and use of excessive force. I’m having a feeling that even the highest-skilled defense lawyer will find it almost impossible trying to justify their use of police brutality, as the police officer that was with him before reinforcements appeared was the one that initiated the scuffle. If the security video isn’t enough to put Manuel and Jay on trial, I don’t know what it will take to hold these two officers accountable for their bestial actions.

      It amazes me reading the posts here that LEO has the right to do whatever it takes, from the language used by this cop, threatening someone that is only being investigated, that cop has no right to talk to anyone like that, he was so unprofessional, I could even believe I was listening to a cop.

      My family owns and operates a cattle ranch. If I can flank a 300+ lbs bull calf with nothing more then one leg lassoed I think 2-3 police officers with tazers can cuff a man. The only thing I could think of while I watched this video was how if a bystander tried to step in and even just ask “WHAT ARE YOU DOING” or “STOP!” that bystander would have gotten more of the same. It‘s said to think I spent 6years in the Marines thinking I was defending American’s freedoms only to witness something like this happen on our own soil.

      As for this entire encounter, why did the police stop him? Why was the fat officer (only way I can really distinguish him) threatening to beat him with his fists? At no time did this homeless man act out in agression. He stood up after being struck by the fat officer. He then tried to walk away. Walking away does not constitute being hit with ASP battons.

      As for all of you claiming non compliance, I take it you’ve never been tazed before. When you are being shocked you can not move. All your muscles contract. Saying a man is resisting while being tazed is like saying someone having a seizure is resisting and being non compliant.

      He was fighting for his life. Those cops should be tried for murder! Its is a clear case of unnessary force! He was unable to breath, and with 4 huge/fat cops on his chest, its no wonder! Then for one of the cops to continually beat in Kelly’s face with his flash light was beyond rediculous! MURDER!!! Plain and simple! I come from a family of law enforcement, and I‘m sure that they wouldn’t condone this either! Shame on them!

      Really? At 15:20 he follows the officers command to put his hands on his knees. At 15:22 the officer says, “now, see my fist? It’s getting ready to **** you up.” That cop is a punk and coward for saying something like that. He has a gun, night stick, taser, pepper spray and training in hand-to-hand fighting. Of course, Thomas should bear some responsibility, but that cop was looking for a fight it seems.

      I’m assuming you and MacPappy are referring to the Constitutional powers of Congress in Article I, Section 8 of the Constitution?

      If that’s the case, then you’re absolutely right. The police officers are so severely blinded by their lust for luxurious pensions and authoritative power that even the “good” police officers don’t understand that are literally violating the Constitution by simply being in the local police force. I think once people start to understand that the Constitution forbids the establishing of local police forces, we might be able to finally address the problems of the ever-expanding police state.

      No. Article 1 section 8 is the enumeration of the “Powers of Congress”. It limits congress from appropriating money for armies for longer than two years. That is being violated, but it’s being violated by the federal government as we are not constitutionally allowed to maintain a permanent military force. They get around it by appropriating funds for the military every two years, which is an obvious end run around the constitution.

      Local police forces however are not created by congress they are created by the states and local governments. The purpose of the congressional limitation in the constitution was to prevent the federal government from using a military to create an authoritarian regime. There is no constitutional limitation on states or local governments from creating enforcement agencies to enforce their laws.

      There are a lot of reasonable arguments to be made about the validity and extent to which police forces are used, but that simply isn’t one of them.

      Just look at all the cops standing around after this guy is cuffed, there’s no real leadership in this country, and no one thinking about this guy’s suffering and urgent medical needs, he was still innocent till proven guilty in a court of law. Police have become more inhuman then human in the world, because of lack of accountability and our justice system being run for profit, and employment of 1 million+ attorneys and 3-4 million para-legals. Their future children will reap what they sew, what comes around goes around. I hope that cop gets what he deserves in prison.

      Believe Me, if I am ever nearby when the police do this to ANYONE without a WEAPON in their hands, I will try to protect the innocent man who remains innocent until proven guilty. FYI: As a matter of law, YOU DO NOT HAVE TO OBEY POLICE COMMANDS. They are just citizens who most likely you have never met before. Treat them like you would a stray dog. Never trust the badge is real. They are counting on you to make the first move. So, if you haven’t done anything wrong, just walk away. You do not have to engage them in a conversation. If there is probable cause for them to arrest you, they will. Otherwise, you are a FREE AMERICAN until killed by a gang of overpaid, chaos-creators who normally only show up after a crime. These “officers” were clearly looking to provoke this sad nut-case into a situation that would allow them to legally beat him to their hearts content. His pitiful attempt to flee was all they needed to assault him so brutally that he later died. His screams were heart-rending to most of us and the scene was one of pure horror.
      If that baton twirling thug wasn’t enough to register on your radar, I guess this reply won’t either but most of us knew exactly what the killer was planning. Just for giggles though, can you provide us with any departments guidance that instructs its officers to beat someone in the face hard and often enough to induce a coma as a matter of police policy? I’ll wait for you to look that one up.

I believe this the case here. If this was an 80 year old woman or man resisting arrest because of dimentia would the police officers kept on beating until the person was near death?       You are desperately wrong. Ramos and Cicinelli had every right for necessary use of force to get Thomas to comply. Meaning when he failed to roll to his stomach and place his hands behind his back, they would have been justified in forcibly doing just that…rolling him over and bringing his hands behind his back to cuff him. Instead they chose to beat him into submission, resulting in his death. Now the Defense Attorney is attempting to make a case that it was the paramedics who cause the actual death of Thomas.

      resisting ? resisting you say ? you must be one of the sadistic cops like them then, the poor man was fighting for his life, he was being beaten to death, I know I would be fighting back too. he was pleading for them to stop because he couldnt breathe, give me a break. it is so apparent that these thugs were out for nothing more than to cause as much harm to this man as they could. this didnt have to happen, they had pleanty of time to cuff him while he was sitting on the curb, or to cuff him when he still had his back pack on. this was nothing more than harrassment and deliberate mayham, you could see that comming when the other officer brought the gloves for the first officer to put on, “ just in case ” what exactally does that mean, this guy was totally harmless. so what if he wasnt all together in the head , he wasnt threatining anyone. Oh how easy it is to lie when the man cannot defend himself.. those offending officers should all do some jail time of their own and never be allowed to walk with honor again. shame on the Fulerton police dept for not fireing these men immediately after seeing the video..

      All right, it seems that I’ve made an error featuring Article I, Section 8 within my earlier statement, thanks for pointing that out.
      However, with all due respect, you’re sadly mistaken within your argument in which you mentioned that “there’s no Constitutional limitation on states or local governments from creating enforcement agencies,” as Article I, Section 10 forbids states from establishing standing armies (in which the Police fits this description):

      “No State shall, without the consent of Congress…keep Troops, or Ships of War in time of Peace…”

      Hence, aside from the Article I, Section 8 error, this IS a resonable argument.

They harass, bully, and, in this case, kill citizens. They run around helping the local and state government tax its citizens by writing tickets for laws they don’t understand themselves.       Where does it say I have to obey the misguided commands of some law enforcement officer if I’m not guilty of anything??? Please! By doing so, it makes me guilty before I’m convicted. That is just wrong. LE has way to much power, and we the people need to take it back. What they did to this guy was just wrong, and all of them need to be punished for both their actions and inaction. Looking at the video, it seems he got a bit out of hand after they tried to confine him. What if they simply escorted him to the squad car? Did they even try that option? I know if there were several guys on me, I would try to push them off me just so I could breathe, and would try to keep my hands in front of my face to keep it from becoming part of the concrete. I think LEO’s need to go back to the old way of arresting suspects, and only put someone on the ground who needs it, and try to just ask someone to turn around and cuff ‘em first. Use as I was taught in the military about escalation of force, and only using that force which is necessary. These guys went right to one of the higher steps in the escalation ladder instead of giving this guy the option. Cowards the lot of ‘em. I hope their consciences are pricked and they repent of their horrific actions.

Well they’re getting ready to **** you up.” Officer Ramos was at his wit’s end with the punk. Night after night of dealing with that dirt bag. And when that punk got to his feet, and then when the punk took off running, intent on escape…that must have been the breaking point in Ramos’ mind. But frustration does not excuse the use of excessive force and gross negligence or involuntary manslaughter. If Officer Ramos is found guilty of 2nd degree murder, then that will send a very clear message to all the thugs, punks, transients, vagrants, and violent, disturbed mental patients that the streets of America belong to them…

      Wow. Seriously? Did you watch the same video I did? Have you ever been to any kind of crisis intervention training or any training dealing with people with mental illness? I have and this is NOT how you deal with mentally ill people. Not to mention, the primary officer CLEARLY threatens the man while he is doing NOTHING to “resist” and that’s not the only thing that goes on. Mr. Thomas’ physical reactions do not appear resistant but reactive to being ASSAULTED! Not to mention, they do not teach you in Taser training to beat someone with the Taser. There were at least 5 officers ON TOP of this guy telling him to get on his stomach…..if you watched the WHOLE video, you can see his feet are pointed to the ground and he was already on his stomach. They had him pinned and you can tell he is not fighting them but simply trying to BREATHE. This is crap and there is no excuse for this at all and these officers deserve what they get. They give all of LE a black eye, not just themselves and their agency.

      These officers were all of them in the wrong. And I believe that we as Americans have the right and the duty when we see something like this happening to step up and say stop. Slow down take a breath and consider what you are doing.
      When we stand back and do nothing then we are contributing to the situation. I’m not saying get physically involved but verbally with respect and let them know that it is being filmed and recorded.
      With cell phones today what is being filmed can be uploaded at the same time. It is our responsibility to respect but also to hold our public servants responsible.

      He suffered from schizophrenia, do you know what that means? Kelly was disabled, and as such, should have been treated with the same compassion as someone with a physical disability, since people with mental disabilities are treated with contempt, as was the case here.
      Kelly was an inconvenience to them and therefore, disposable. If you think for a moment that the outcome would have been any different if Kelly would have played dead instead of being scared and fighting for his life, then you’re not living in the real world . These cops that killed him are now living in the real world in that they can’t simply cover up a murder like they would have liked. They are going to have to pay for their actions.

But just like Hope and Change is true one must know who is being protected and served and what are we hoping for and what/how is it going to change.

    The police haven’t changed since the Sheriff of Nottingham. They serve their “lords”, be they cities, counties, states or the Federal establishment. I believe there is much more of this kind of stuff that goes on every day, but we never hear about it. If you think these mooks give a crap about the citizens then I feel very sorry for you.

      I had not only one officer respond to my home the day after someone complained about me flying a foam RC model airplane in a vacant park but another officer as well. They could not cite the exact code I was in violation of but I agreed to not fly there anymore because I could see we were going to come to an impasse where they needed to resolve the matter so they could say to the complaining party its been dealt with. We do live in the police state, don’t think so? Just realize or count up all the laws you must comply with on a daily basis or you will be arrested. Start with your county taxes that failure to pay can get the sheriff to your door and have you evicted from your own home.

    Usually if you look cross eyed at a cop he thinks you’re resisting and about to assault him.
    There‘s good cops and bad cops and unfortunately he ran into some bad ones and they won’t be convicted.

      I live in the area that this happened.
      These particular cops are horrible. What happened here was murder.
      “See these fists, they are getting ready to **** you up.”
      That was a quote from this officer before he murdered Kelly Thomas.
      He should face the death penalty. Every officer that witnessed this and did nothing to stop this murder should be summarily fired.
      They are not supposed to stand around and watch as a threat is made then carried out.

      @Reconmarine.Never had any run ins with the law other than speeding tickets.I have eyes.I have ears.Im not an occupier.Or,a weed smokerIf you’re to blind to see the whole “legal” process is corrupt from cop to court,you should re-enlist so you can do as ordered ,and not have to worry about thinking for yourself.Or you can become a cop…all that military training is just perfect for killing their victims…er I mean, protecting the public.Of course not all are bad.But the benefit of the doubt is no longer given to them.I will always assume they will find 5 different charges for me if I don’t smile,kiss their ass and pretend to sound grateful that they were born.Check YouTube or google police corruption.

      I am not sure everyone understands that the very police organization, local police force as stated is in fact illegal. There is no justification for “local police forces” in the Constitution. Back in the day, when I was young and foolish, the County Sheriff was the only law you ever saw. A sheriff and his deputies are the only law enforcement mandated by the Constitution. The County sheriff is more powerfull in his office than a Governor is in his. Why have we allowed the forming of local police forces?
      Why do we allow them to be funded?

      I support the cops but this was disgusting and revolting. Look at the blood pool in the video in the end. This was not sanctioned. I hope these past officers get the death penalty. The officer was giving conflicting commands, using verbal foul language and escalating the issue. He was over abusive and the cause. The twirling of the baton in the earlier video clearly show he was in to beat heads. Also, note in the video when they go towards the bush early on . they have his left arm behind his back and his body pushing down on his right arm while they are screaming for him to move his arm. He cant. It was pinned down and they kept beating hi. also, the over used the taser. This was truly disgusting and if the DA of that county is not prosecuting the officers himself/herself then something is wrong

    Adding to my earlier comment, Thomas was given a command by the cop, and he did NOT comply, he also resisted when they had him on the ground.Two wrongs dont make a right in this case. Had Thomas complied with what the cop told him to do,he might be alive today,had Fullerton PD NOT hired a a cop, who to me sounded like he could barely speak english,and who possibly need more training, and more physical training,this may not have happened…..

      First of all, I am for the rule of law and making sure that citizens are safegaurded against dangerous people. I am usually very happy with the police and appreciate the hard job they do. On the other hand, I agree with Dishevel, I too noticed that the cop kept telling him to do different things, not really being very clear, and then threatening him by saying “see my fist, I am going to F___ you up!” He then starts to get rough with the guy pushing him around as he is already on the ground. It is like he wanted the guy to resist so he could beat him. Did anyone else notice at the very begining this same cop had his nightstick out when he was just talking to him?
      Now, the guy was not listening to instructions.
      He did try to run away.
      He did resist at first.
      He probably kept “resisting” especially as he could not breathe, which should be obvious to anyone who has had a couple of fat guys sit/kneel/stand on their back.
      The guy seemed to have stolen some items from somewhere, he had someone else mail in his backpack. For this and making the cops mad as they had to deal with him alot he lost his life.
      I decided a long time ago that when you see a cop coming at you, if he looks angry, you better just lay down and put your hands out in a non-threatening way.
      The only other option is to use deadly force from the start if you are not going to comply as the cops certainly will.

      Okay I have offended Obama supporters… the point was these are cops who public sector union members who acted as thugs with clear intent to harm this man.. they showed no remorse. Something is motivating them to act as if they have impunity when it comes individual civil rights… Someone in their department is giving them signals to the effect that they can beat the crap out of citizens for no reason..       Taking the video was the most anyone did for this victim. Trying to do anything less than pulling your own weapon and making the officers stop beating the man would be suicide. And who wants to pull down on several trained gun hands? No, the problem has to be handled at City Hall, and thank goodness for the videographer.

    Let justice be done in this case across the board; if found guilty they need to serve the maximum sentence availible under the law. Watch for the radicals to use this trial as a motivator for instigation of rioting and violence in the near future regardless of the officers being found innocent or guilty.
