Soldier Accused in Afghan Shooting Rampage Charged With 17 Counts of Premeditated Murder

KABUL, Afghanistan (AP) — U.S. Army Staff Sgt. Robert Bales was charged on Friday with 17 counts of premeditated murder, a capital offense that could lead to the death penalty in the massacre of Afghan civilians, the U.S. military said.

The 38-year-old soldier is accused of walking off a U.S. military base with his 9mm pistol and M-4 rifle, which was outfitted with a grenade launcher, before dawn on March 11, killing nine Afghan children and eight adults and burning some of the bodies. It was the worst allegation of civilian killings by an American and has severely strained U.S.-Afghan ties at a critical time in the decade-old war.

It’s unclear what prompted the killings, but the case has drawn new attention to the debate over mental health care for the troops, who have experienced record suicide rates and high incidences of post-traumatic stress and brain injuries during repeated deployments in Iraq and Afghanistan.

Six other Afghans – a man, a woman and four children – were wounded in Panjwai district of Kandahar province, the spiritual birthplace of the Taliban. Bales also was charged with six counts of attempted murder and six counts of assault in those cases, according to Col. Gary Kolb, a spokesman for U.S. forces in Afghanistan who disclosed information from the charging document.

Bales, a father of two from Lake Tapps, Washington, was officially informed of the 29 charges just before noon local time at the U.S. military prison at Fort Leavenworth, Kansas, where he is confined.

His civilian attorney, John Henry Browne, said Friday that he believes the government will have a hard time proving its case and that his client’s mental state will be an important issue. Bales was on his fourth tour of duty, having served three tours in Iraq, where he suffered head and foot injuries.

The decision to charge him with premeditated murder suggests that prosecutors plan to argue that he consciously conceived the killings. A military legal official for U.S. forces in Afghanistan who spoke on condition of anonymity to discuss the case, noted that premeditated murder is not something that has to have been contemplated for a long time.

The maximum punishment for a premeditated murder conviction is death, dishonorable discharge from the armed forces, reduction to the lowest enlisted grade and total forfeiture of pay and allowances, Kolb said. The mandatory minimum sentence is life imprisonment with the chance of parole.

Legal experts have said the death penalty would be unlikely in the case. The military hasn’t executed a service member since 1961 when an Army ammunition handler was hanged for raping an 11-year-old girl in Austria. None of the six men currently on death row at Fort Leavenworth was convicted for atrocities against foreign civilians.

The charging document did not provide details about the killings, leaving the timeline unclear. The dead bodies were found in Balandi and Alkozai villages – one north and one south of the base.

Members of the Afghan delegation investigating the killings said one Afghan guard working from midnight to 2 a.m. saw a U.S. soldier return to the base around 1:30 a.m. Another Afghan soldier who replaced the first and worked until 4 a.m. said he saw a U.S. soldier leaving the base at 2:30 a.m. It’s unknown whether the Afghan guards saw the same U.S. soldier. If the gunman acted alone, information from the Afghan guards would suggest that he returned to base in between the shooting sprees.

It also is not known whether the suspect used grenades, Kolb said. The grenade launcher attachment is added to the standard issue M-4 rifle for some soldiers but not all, he said. Bales was assigned to provide force protection at the base.

The pre-dawn shooting spree has further frayed ties between U.S. troops and President Hamid Karzai as the two nations are negotiating agreements for America’s military footprint in Afghanistan after most international combat forces withdraw by the end of 2014. After the shootings, Karzai reiterated his demand that foreign troops leave posts near Afghan villages and pull back to larger bases.

The killings also have fueled anti-American sentiment in a country where violent protests raged for nearly a week last month after Muslim holy books and other Islamic texts ended up in a garbage burn pit at a U.S. base.

“By the laws of Islam, the soldier should be hanged,” Dost Mohammad, a shopkeeper in Kandahar, the provincial capital, said Friday. “While other countries’ laws say that this individual should be given a life sentence, from our point of view and that of other Muslims, this guy should be hanged.”

Afghan officials and villagers maintain that 16 civilians were killed. The U.S. military never announced a death toll, but said Friday that investigators had collected enough evidence to charge Bales with killing 17 civilians.

U.S. officials are working with Afghan officials to compensate relatives of the victims, money that likely would be disbursed to the eldest male of the family. Eleven of those who died were from one family.

Bales’ lawyer, who is based in the state of Washington, has said that his client remembers very little or nothing from the time the military believes he went on the rampage.

Browne told CBS’ “This Morning” on Friday that his client’s memory problems predate the shooting spree. Browne said Bales had earlier suffered a “serious” concussion that was not treated “for a variety of reasons,” which Browne did not explain.

Browne said he thinks the U.S. government will have difficulty proving its case against Bales because “there is no crime scene” and a lack of important physical evidence like fingerprints.

Two military defense attorneys also have been assigned to his case.

Browne has said that he wants to visit Afghanistan.

U.S. military officials said they would do what they can to protect Bales’ legal team in the event of such a visit but warned the shootings have heightened tension between U.S. troops and villagers in the area, and decisions about where the legal team could safely travel would have to be on a case-by-case basis at the time of any visit.

The charges launch what is likely to be a lengthy legal process.

Bales was assigned to the 2nd Battalion, 3rd Infantry Regiment of the 3rd Stryker Brigade Combat Team, of the 2nd Infantry Division, which is based at Joint Base Lewis-McChord in Washington. The U.S. Forces-Afghanistan has sent the charges to a special court-martial convening authority, the 17th Fires Brigade, an artillery unit based in Fort Lewis, Washington.

Lewis-McChord spokesman Lt. Col. Gary Dangerfield said Friday that officials at that base will have the legal responsibility of trying and managing the case against Bales, but it was not clear where the proceedings will actually take place, noting that Fort Leavenworth has the most updated security.

The commanding officer of that brigade has several options ranging from taking no action to ordering an Article 32 investigation, which is comparable to a preliminary hearing or grand jury process in U.S. civilian courts.

During the investigation, the defense will have an opportunity to see evidence and cross-examine government witnesses. An investigating officer will issue a report at the end of the probe in which he can recommend a court-martial; and add, delete or modify the charges. A mental assessment for Bales also is expected to be ordered.

He could be charged with other offenses later, according to the legal official. On Friday, a senior U.S. defense official said Bales was drinking in the hours before the attack on Afghan villagers, violating a U.S. military order banning alcohol in war zones.

      Just got here–T’anks. I also echo your sentiments. Sgt.Bales is charged with shooting 17 Afghani and attempting to kill several others. in a oseas workplace incident. Major Malik Hasan murdered 14 (life in the womb does count) and attempted to murder more than 30 others. at Ft.Hood. When our first ANTI-American President starts defending America-and Americans against his bloody freaking Muslim Brothers Then-and not until then– will I consider him an American President.Bush was the Last American President.

I’d say the military who MADE that decision and 0 who never encourages people to join the military, but instead turns on them, who should be held accountable. He keeps engaging and spreading our military thin while reducing pay, benefits, etc, not only putting them in danger themselves, but all around them. MOST people can only take so much. Had he come home and killed 17 of his family it wouldn’t have made news, much less put him up for a possible death penalty.
      What a SAD nation we have become. The “Throw the bums out” moniker has never been more applicable than now for this nation to survive.

    This guy had 3 tours, a serious head injury and foot injury. I heard a new report that he was told he would not be sent on another tour, then they sent him to Afg. where your allies you are training shoot you in the head. This guy should have never been sent on another tour like they told him. He was emotionally unfit for another tour and obviously someone in the military thought this because they told him he would not go on another tour. Now, it is a terrible thing that happened, but they need to look up the person that changed the order from not another tour to send him to Afgh. That is where this whole thing went off the tracks in the first place. I think the Obama and his buds would have like it better if he would have killed himself instead. We need to get out of afganistan all together, they are not worth the money, American blood and ruined lives. You can not make a silk purse out of a sow’s ear.

    As a military wife, mother, aunt & sister, I’m having a really hard time with this. My heart breaks for this soldier’s wife. My heart breaks for our military & their families. I’m having a hard time with sympathy for the victims & their families. God help me (& everyone else). I don’t understand my own feelings. Perhaps it is a complete lack of trust & faith in the honesty of our enemy. I’m also bothered by the fact that Staff Sgt. Bales doesn’t remember killing any women or children. He admitted to the murders. By his own admission, he is guilty. Justice, in whatever form is deemed proper, must be served. So be it.

      Not remembering anything the next morning (or claiming not to remember) is hardly a justification for killing civilians and even children. Any drunk driver who‘s ever killed someone probably wouldn’t remember much the next day either. But that amnesia, real or faked, won’t bring back any of the slain innocents, will it?

    I recently read that the Army had him [previously wounded in the head] jacked-up on psychotropic drugs prior to pushing him out the door for his fourth tour of combat duty. WTF! Remember that psychotropic drugs were involved in the Columbine High School massacre? Remind me why we’re still in Afghanistan? I’ll tell you. They want to use it like a aircraft carrier; to launch strikes in the up coming war with Iran/Pakistan and others. Sounds like a trigger for WW III to me. Oh by the way, did you hear the the folks at Homeland Security have low morale? (sad face). If I were required to betray the Constitution, my oath, my friends, my family, my ancesters and the trust of the American People on a daily basis, I would probably have such low morale and lack of moral self-esteem that I’d quit. I would then work for the cause of restoring the Constutional principles our country was founded on and speak out boldly agaist this tyranny that our NWO/Globalist/Facist Puppet Masters are perpatraiting not only against U.S. but all of humanity as well.       I hope I never have the misfortune of being deployed to Afghanistan…incidents of Afghan “allies” shooting at my brothers in arms is not anything new unfortunately.
      Back in 07 I was told of an incident (by an eyewitness) where a Afghan policeman whipped out his side-arm and started shooting a U.S. soldier in the back…thankfully his body armor stopped an entire family of 9×19 pistol rounds from leaving as much as a bruise. Oh, the afghan cop was in turn shot and killed himself.

    First off, I would not trust what any Afghan soldier stated. They are highly unreliable with their information and really do not want us there. Secondly, Sgt. Bales never should have been told to go for a 4th tour of duty over there. He had suffered a traumatic head injury and also had lost a portion of his foot. Where were his commanding officers intelligence in sending him over AGAIN. Our men and women are asked too much for the sake of a country that does not want us there and after we finally leave, it will all go back to as it was.
    Sgt. Bales is in desperate need of mental care and mental rest and many years of love and TLC.
    Oh and why as not the psychiatrist from Ft. Hood even gone to trial yet? It has been over two years and he killed over 15 people and wounded over 25. Just wondering

    We can’t wait til obama is rotting in Leavenworth.. if we can catch him before he flees to one of his communist/muslim safehouses overseas that our American tax dollar $Trillions bought for him. it’d be great to watch obama go thru a High Treason trial and walk that last perp walk to do the Saddam Dangle, we’d bring popcorn and lawnchairs to watch that on a jumbotron at Leavenworth.

      I’m amazed that anyone can think Bales killing 17 civilians (including 9 children) or Hatley killing 4 Iraqi detainees can be considered “their job” without being certifiably insane.

      Bales should never walk as a free man again, but odds are he needs mental care, not prison, for the rest of his days. I only wish he could have gotten it before he went on a rampage and murdered children.

    After reading the headlines today about the US soldier who shot up Afghanistan civilians, I couldn’t help noticing an irony.  There is all this clamor to try this guy quickly and execute him, never mind his having suffered a traumatic brain injury.  Yet this Major Hasan, who shot up Fort Hood while screaming Allah akbar, still hasn’t stood trial, and they are still debating whether he was insane, even with the clear evidence regarding his motive: slay as many infidels as possible.  So we have a guy in a war zone who cracks, and he must be executed immediately.  But this Muslim psychiatrist who was stateside in a nice safe office all day murders 13, wounds 29 of our own guys, and they try to argue the poor lad suffered post-traumatic stress syndrome, from listening to real soldiers who had actual battle experience. 
     
    Two and a half years later, they still haven’t tried the murderous Muslim.

    I don’t trust the Muslim villagers to tell the truth. I don’ trust the Muslim soldiers to tell the truth. I don’t trust this CinC to tell the truth. Hell, I don’t trust some of the top military brass to tell the truth.

    I hope John H. Browne is a bulldog at getting the truth and won’t allow what is expedient to be the answer. If Sgt. Bales is found guilty he should pay with proper punishment. I will not condemn him yet.

    These brave men and women have been fighting far too long. WWII was less than four years. This conflict similar to Vietnam has been going on for a decade. That’s the only thing in common with Vietnam, and in some ways Afghanistan and Iraq have been worse, because it is the same people fighting for TEN years. Very few people did enough tours in Nam to equal what Bales has done. Our soldiers need a break.     Thank you for your immeasurable sacrifices, your losses we can’t even comprehend even though many of us come from from families steeped in military honor over 240 years of this nation. We appreciate your service and honor. NOW……

    go down to the CO and tell him GOOD FREAKING BYE to this freak parade. I’m freaking done. I’m not defending this momo filled decadent hellbent nation anymore. Period. Let everyone fend for themselves, since half the people in this country need to be reminded that freedom isn’t free and the bill has come due. Let em try it.

    Then start drafting all these imaginary Rambo Gays and lefties who love wars but don‘t like them when it’s not furthering THEIR cause, and let them bleed for about a month is all it would take for them to be slaughtered on the battlefield by the bloodthirsty mo hating Muzz while trying to hump a muzz like Obama’s ****** huggging Momma did such a great job of chasing that all over the world her adult life. Sick woman. Today he would have been aborted in first trimester..

    That’s how I feel today. I wouldn’t fight for HALF this nation, and they‘re gonna meet us down the road anyhow the road they’re traveling, so I’ll deal with them personally at that point as will my Neighborhood militia, and be glad to do it I might add..

    He should be charged with 17 counts. He should also be given a PTSD screening, and the care one should get after 4 tours and two purple hearts. Neocons better wake the hell up too on the toll that these multiple deployments to a craphole with no freaking mission objective are doing to our countries finest. In order to prove premeditated murder, would it not have to be proven that Bales planned each one of these killings – would it not have to be proven that he had targeted each of these individuals specifically, rather than randomly? Murder yes. Premeditated murder – doubtful.

      “Premedite means to decide to kill before taking action. A murder is premeditated if the killer decides to kill before actually killing.”

      Just from a random law website. Basically it means that you‘ve armed yourself before hand and have a pretty good idea of what you’re doing (ie, going house to house and killing every person there). Ie, not spur-of-the-moment; you know you’re going to kill.

      Seems it fits, as he shot these people no matter how they responded.

    I expect Liz Cheney to file a Friend of the Defendant motion on behalf of the neoconservative chicken hawks who were so adamant in sending this brave soldier into Combat four times in 7 years. His family will always remember that kind gesture when their husband and father is engulfed by the machinery of the uniform code of military justice quagmire.

    I pray they will be able to keep his retirement benefits, his personal effects, and coffin drape flag. But they will probably give him a DD before the firing squad.

      Yes…God bless him. He snapped. Too many tours. Too many deaths of friends. Too long away from home. Too long in an army whose government is not supportive of it’s members. Too long in a war that has rules that help the enemy. Too many personal wounds, mental and physical. Anyone would break down in that situation.

      Your priorities are bizarre. You’ll fight tooth-and-nail to prevent someone from aborting a child with severe birth defects who will live a short, painful life, yet you blindly defend the act which killed nine ALREADY LIVING CHILDREN. The DoD has now spent $500 thousand on surgery enabling him to walk normally, and they have detained him in the brig in Rota, Spain where he is nursing back his health using a Mediterranean detoxification diet with a daily massage and Olive soap defoliation regime.

      NO trail till JUNE 2012, not quite 3 years after it happened. And our wonderful Attorney General Eric Holder will not call it an act of terror, it’s just a work place shooting….even though the MUSLIM PIGF&$KER shouted “ALLAHU AKBAR” before he began his rampage. He targeted just soldiers, he had shot off over 214 rounds of ammo and have 177 rounds unfired with a gun that he bought in July of that year. He had links to AL-AWLAKI and went to the same Mosque at the same time that 2 of the 9/11 hijackers were there… coincidence, maybe… there were numerous warning signs of this MUSLIM PIG….
      What he did was an act of treason against America…He took an oathe when he enlisted into the service to protect and defend…..AND ON TOP OF IT THIS MUSLIM ******* IS STILL GETTING PAID……
