Obama Admin Will Bypass Congress to Stop Young Illegals From Being Deported & Grant Work Permits

WASHINGTON (The Blaze/AP) – The Obama administration will stop deporting and begin granting work permits to younger illegal immigrants who came to the U.S. as children and have since led law-abiding lives. The election-year initiative addresses a top priority of an influential Latino electorate that has been vocal in its opposition to administration deportation policies.

The policy change, announced Friday by Homeland Security Secretary Janet Napolitano, will affect as many as 800,000 immigrants who have lived in fear of deportation. It also bypasses Congress and partially achieves the goals of the so-called DREAM Act, a long-sought but never enacted plan to establish a path toward citizenship for young people who came to the United States illegally but who have attended college or served in the military.

Napolitano announcement detailing the new policy comes one week before President Barack Obama plans to address the National Association of Latino Elected and Appointed Officials’ annual conference in Orlando, Fla. Republican presidential challenger Mitt Romney is scheduled to speak to the group on Thursday.

Obama planned to discuss the new policy Friday afternoon from the White House Rose Garden.

“We are a nation of laws and a nation of immigrants,” Napolitano said during a conference call with reporters Friday. “And as I said [earlier], with respect to these young people, deferred action – the decision announced today – is simply the right thing to do.”

Under the administration plan, illegal immigrants will be immune from deportation if they were brought to the United States before they turned 16 and are younger than 30, have been in the country for at least five continuous years, have no criminal history, graduated from a U.S. high school or earned a GED, or served in the military. They also can apply for a work permit that will be good for two years with no limits on how many times it can be renewed. The officials who described the plan spoke on the condition of anonymity to discuss it in advance of the official announcement.

The policy will not lead toward citizenship but will remove the threat of deportation and grant the ability to work legally, leaving eligible immigrants able to remain in the United States for extended periods.

While the AP claims that it tracks closely to a proposal offered by Republican Sen. Marco Rubio of Florida as an alternative to the DREAM Act, Rubio’s office released a statement this morning, separating itself from the plan. In it, he says:

“There is broad support for the idea that we should figure out a way to help kids who are undocumented through no fault of their own, but there is also broad consensus that it should be done in a way that does not encourage illegal immigration in the future. This is a difficult balance to strike, one that this new policy, imposed by executive order, will make harder to achieve in the long run.

Today’s announcement will be welcome news for many of these kids desperate for an answer, but it is a short term answer to a long term problem. And by once again ignoring the Constitution and going around Congress, this short term policy will make it harder to find a balanced and responsible long term one.”

“Many of these young people have already contributed to our country in significant ways,” Napolitano wrote in a memorandum describing the administration’s action. “Prosecutorial discretion, which is used in so many other areas, is especially justified here.”

The official Homeland Security press release announcing the plan quotes Napolitano as follows:

“Our nation’s immigration laws must be enforced in a firm and sensible manner. But they are not designed to be blindly enforced without consideration given to the individual circumstances of each case. Nor are they designed to remove productive young people to countries where they may not have lived or even speak the language. Discretion, which is used in so many other areas, is especially justified here.”

The extraordinary move comes in an election year in which the Hispanic vote could be critical in swing states like Colorado, Nevada and Florida. While Obama enjoys support from a majority of Hispanic voters, Latino enthusiasm for the president has been tempered by the slow economic recovery, his inability to win congressional support for a broad overhaul of immigration laws and by his administration’s aggressive deportation policy. Activists opposing his deportation policies last week mounted a hunger strike at an Obama campaign office in Denver, and other protests were planned for this weekend.

The change is likely to cause an outcry from congressional Republicans, who are sure to perceive Obama’s actions as an end run around them. Republicans already have complained that previous administration uses of prosecutorial discretion in deportations amount to back-door amnesty. Romney and many Republican lawmakers want tighter border security measures before considering changes in immigration law. Romney opposes offering legal status to illegal immigrants who attend college but has said he would do so for those who serve in the armed forces.

An NBC News/Wall Street Journal poll last month found Obama leading Romney among Hispanic voters 61 percent to 27 percent. But his administration’s deportation policies have come under fire, and Latino leaders have raised the subject in private meetings with the president. In 2011, Immigration and Customs Enforcement deported a record 396,906 people and is expected to deport about 400,000 this year.

A December poll by the Pew Hispanic Center showed that 59 percent of Latinos disapproved of the president’s handling of deportations.

The changes come a year after the administration announced plans to focus on deporting serious criminals, immigrants who pose threats to public safety and national security, and serious immigration law violators.

One of the officials said the latest policy change is just another step in the administration’s evolving approach to immigration.

Under the plan, immigrants whose deportation cases are pending in immigration court will have to prove their eligibility for a reprieve to ICE, which will begin dealing with such cases in 60 days. Any immigrant who already has a deportation order and those who never have been encountered by immigration authorities will deal with the U.S. Citizenship and Immigration Services.

The exact details of how the program will work, including how much immigrants will have to pay to apply and what proof they will need, still are being worked out.

In making it harder to deport, the Obama administration is in essence employing the same eligibility requirements spelled out in the proposed DREAM Act.

The administration officials stopped short of calling the change an administrative DREAM Act – the name is an acronym for Development, Relief and Education for Alien Minors – but the qualifications meet those laid out in a 2010 version that failed in the Senate after passing in the House. They said the DREAM Act, in some form, and comprehensive overhaul of the immigration system remained an administration priority.

Illegal immigrant children won’t be eligible to apply for the deportation waiver until they turn 16, but the officials said younger children won’t be deported either.

Last year, Napolitano announced plans to review about 300,000 pending deportation cases and indefinitely suspend those that didn’t meet department priorities. So far, Immigration and Customs Enforcement has reviewed more than 232,000 cases and decided to stop working on about 20,000. About 4,000 of those 20,000 have opted to keep fighting in court to stay in the United States legally. For the people who opted to close their cases, work permits are not guaranteed.

      There is hope. Look at what happened in Wisconsin last week. The unions and Democrats stuffed ballot boxes. They voted dead, nonexistent, illegal and God only knows what else and Scott Walker still won. He not obnly won but it wasn’t a close call either. Why do you think they were so upset by it? Did the Republicans fight fire with fire? I don’t know. Did the Republicans just outmaneuver the Dem thugs? I don’t know. The implication is that it can be done. Democrats never win elections honestly. They haven’t in years. The current president is the recipient of vast voter fraud and he knows it. We know it. Everyone knows it. Illegal elections and voter fraud are so a part of the Democratic platform that they joke about it. This is nothing new. If the Republicans are indeed fighting fire with fire, it is a win win situation. Dems can’t say anything without an investigation and that would inevitably reveal thier own ubiquitous fraud. Mr Holder may try to impede this but he has no credibility at all. He is a joke. No one in this country trusts him.

      The blacks won’t vote for a Republican. They just can’t. It is so ingrained in them from birth. There is no love lost between blacks and Hispanics. Blacks look upon them as interlopers on their freebies that massa Sam gives them. Plus the Hispanics will actually work. I think that is why so many were“deported”. It was a ruse to placate the blacks. I am thinking this will backfire on him.

His narcissistic behaviour will never allow him to accept being wrong, and his total lack of any morality means all is fair game.

      He wants his dictatorship, the transformation of the nation into a progressive socialist nation and the complete control of all; failing that he will destroy everything.

      Do not be suprised with a sudden executive order today or tommorow being signed and making the illegals not only have work permits; they will have instant, retroactive citizenship, enabling them to vote legally.

      Before Nov, unless God deems otherwise, we will have a civil war or a dictatorship on our hands.

      The president chooses to ignore the law and make an edict in order to secure more votes at a time when his support is beginning to abandon ship. I would think throwing the law under the bus in order to try to get re elected would fall under failure to honor his oath of office. He is grasping at any straw, in order to shift the tide that his failures have started.

      I applied for a job at a Latino computer shop last year. The owner and one worker spoke English; the rest did not. My resume wasn’t looked at and I was offered a job. I asked to hang up for the day first to see if I would fit in. I walked around, observed and spoke with the one worker who spoke English and had been working in the US for several years.

      I asked him if this was a 1099 job. “What’s that?” It’s kind of like a W2. “What’s that?” OK…. I continued observing and this is what I saw;

      The cash register was the owners front pocket, the hand written client receipts (sometimes just masking tape with a name and #) were trashed when a computer was picked up. no taxes were charged, every part installed into a computer or laptop “had” to be used, as workers finished a computer they wrote down what they did on a piece of paper, every computer got an illegal copy of Windows 7 and Office 2007 installed, stolen laptops would have the password removed while the client waited, laptops, computers and cameras would be purchased for cash without checking any ID and put out for sale, near the end of the day each worker would go to the “boss” with his piece of paper and they would haggle over the pay and then be paid in cash. I turned down the job.

      If this is what is happening with people who are trying to become citizens legally…

      …I wonder what the illegals are doing? Most likely the same thing.

      I don’t think they will trust the Government to keep their word. Most are working already without paying taxes. Why pick up a work permit and expose yourself to a lying Government?

      Clearly, this is all about votes by a desperate president and his arrogant Administration; and it will not stand. We do not live under a dictatorship!

      As for the story, HOW THE {}}#%^* does a president pass a law without Congress? Executive schmexecutive he still cannot create laws. I have said it many times and have written my Rep, my Senator, and the Speaker to censure Oblameus and keep him from abusing the Executive Order anymore, but I can only suppose they are not listening or don’t care when I get no response.
      At least they only have two years-long enough to make their vote count, which was the whole reason.

      I predict this will lose Democrat votes for Obama. I know people who are not the least bit conservative, who do not like the fact that our country is being overrun, and who say, “I want my country back.” Heck, this may even lose him Black votes. As a group, the only time Blacks and Hispanics get along is when they are ganging up to vote for some scheme that extorts more money from Crackers/Gringos. And, it is often Blacks who are competing with illegals for the jobs at the lower end of the scale. I think this is a bonehead move.

I would cll on all immigration authority to enforce the laws on the book or face termination of their jobs and possible criminal charges.

      I was also thinking of the unemployed blacks age 16 to 30. When they find out their Shining Leader is handing out work permits to illegals when they don’t even have a job do you think they will bother voting?

      This will make it even harder for Obama‘s and Holder’s “people” to find work.

      If Local businesses had to rely on local labor, they would hire more blacks & whites. They would take people with high school diplomas, GEDs & non graduates and further educate them. Companies dropped apprenticeship programs which were vocational training for non college bound workers. Many people who attended in house apprenticeship programs went on to enter management, college or stayed in house as skilled workers. But that was all dropped after Amnesty #1.

      Obama is anti-black. Romney will get more than 10% of the black vote. It will be proof that Obama miscalculated.

      Ever see the film Full Metal Jacket? There’s a scene during which the military journalists are directed to not use the phrase “search and destroy” and instead write “sweep and clear.” This is a game of semantics and Obama has already provided Romney (and other future politicians an out): All Romney has to say is his stance is “evolving.” That’s not flip-flopping in weasel-speak… it’s a politician being able to play to the masses as the winds change.

It had nothing to do with any law or bill; a bureaucrat just decided to rule and restrict by policy. You don’t need laws (other than as tokens) when you can make the rules up as you go along and call “Mulligan!” when you feel like it.

      Bush & McCain were stopped from pushing forward an amnesty bill. That is success.

      Did anyone here of a border fence being built first? That is the reason why it failed. They wouldn’t promise a timetable to say that amnesty would ONLY be granted upon the fences completion. If they would have done that, they could have passed a bill.

      Without a “secure” border but a good fence, then any amnesty bill is an “in your face”, because we can, arrogant act by Congress, big business, and the left.

      TARP was passed in panic on a “relatively short time span” before opposition could be mobilized over a long enough time. We would have been better of bailing out the people with mortgages. It would not have been fair at all, but the crisis would be over. it would have even been better to let AIG & some others fail. Bankers would not have been so cavalier about caving into to political pressure and making bad loans. As it is we are still in extend & pretend. We are in our 3rd year of stress.

      Both Bush & McCain showed the limits of economic knowledge. Especially McCain who sat on the finance committee. Obama is too arrogant to admit any shortcomings & he has many.

      I am sick & tired of f_cking _ss politicians who get law degrees (juris doctorates) but are economically illiterate.

Give them work visas and give them a path to legality would be the best way. Of course, enforcing the border lines should be done at the same time so we do not end up here again.

Stop paying taxes into a broken system work as independent contractores like the illegals do and they don’t pay taxes but reap on the taxes you paid.       I have some sympathy for the children,but I have 2 problems. First this will encourage additional illegal border crossings. Second there is no contiguous border fence from California to San Diego that is as effective as the fence along the San Diego border area.

      If we had an effective border fence like the one by Sand Diego I could be for this. But when will a elected f_ckercrat ever going to do that?

      Janet Napolitano is not. She lies all day, everyday. Some areas of Texas are getting a more effective fence. At the dame time the Obama administration has given up or purposely chosen to not extend the fence to Arizona & New Mexico.

Thirdly: if a child wants to stay in America, brought in by Illegals, as long as their grades are over C+ and they aren’t on the public dole, they can stay, but they have to compete for college and pay for it like everyone else does.       I do not blame the children of criminals for their parents’ deeds. I would not think any caring society would. That is tantamount to blacks blaming all whites for their past enslavement, or Jewish people blaming all Germans for the abominations of a few of them.

      Sure, the cycle should get broken, but you don’t punish the innocent person for the sins of the guilty no matter what. You punish the parents.

      What do you do with a person who was brought here by their parents when they were 7 years old? Do you just deport them and toss them into a country foreign to them not caring if they live or die, or do you imprison them in one of our wonderful prisons where we have allowed gangs to run them instead of actually punishing and rehabilitating (when possible) prisoners?

    The executive branch via Home Land Security has no authority to grant Work Permits to illegal aliens as it has just done. Congress has this authority. This is fascism. The Issue is not the program – it is the fact that congress and state representatives have been made irrelevant and American is now controlled solely by the executive branch.

    It is highly likely the GOP will not stop this as they have the authority to do but will try and gain political support by allowing it to stand. They will trade our constitutional republic for temporary political gain.

      Although there are millions of illegal immigrants in the U.S. this will place the ones that came here legally, on the suspect list. Obeying the law is not acceptable anymore. People will question anyone that claims to be a U.S. citizen. This only grants 3% of the people a pardon at the expense of the 97% that earned it. So sad!!!

      It‘s just another gimmick from a man who puts his own political aspirations above the nation’s well being. Leaked national security details. Leaked operational details of the Bin Laden killing. Billions of taxpayer dollars to failed “green energy” boondoggles backed by Obama’s bundlers.
      This is just another example of Obama kicking every stone and shaking every bush for every loose democrat vote in the nation because he’s lost the independents.
      This will backfire on Obama..again. His campaign has been unable to find it’s footing right out of the gate (ok…in reality he‘s never stopped campaigning but the for sake of this discussion I’ll use his “official” campaign start). He can’t run on empty promises and lofty rhetorc as he did in 2008..he‘s got a record now and it’s a lousy one.
      This will be seen as nothing more than a gimmick..Obama is in trouble.

      WHY would you do this when:

      1. Mexicans will flood over the borders now
      2. We American citizens dont have jobs (they do NOT care)
      3. Many worked hard to come here legally

      The question is if they were illegal, why did they go to our public schools and some go on to college? They and those who brought them have already taken from a system that they were never paying into (Fed taxes). And now we are to give them amnesty? Again why are we broke?

      Hey, does anyone here think the this weeks Time magazine was a coincidence or do you maybe think they already had a heads up on this announcement?
      That’s what I thought–been in the works for a very long time and yep, another leak. Well, at least no ones life and/or freedom was taken and we didn’t become a traitor to an ally—unless that includes all legal American citizens.
      I say if they want to play this game then let em. Now congress needs to enforce all other aspects of illegal immigration full force and head on. Deport these ‘kids’ family when they apply, they’re fair game, any illegal kids in schools prior to graduation–deport them and their family. local law enforcement send any and all illegals to ice even the ones that haven’t committed a felony. Boarder patrol–beef up and get harsh.
