State Worker Fired for Receiving Email That Used Trayvon Martin to Impugn Dead Police Officer

We‘ve all had that moment where the Spam filter doesn’t work and some offensive, irrelevant or shocking email manages to make its way into our inbox. In the case of one state worker from California, forwarding an email like that to a friend out of disgust has cost him his job.
Background: In November of last year, Police Officer Jim Capoot of Vallejo, California, was shot and killed trying to stop a bank robbery. At the time, ABC News 10 did this report on the incident:
Well, evidently at least one state worker didn’t feel badly that a defender of their community had been killed. In fact, based on the email that state worker Steve Johanson received from a colleague, they appear to have thought it was a good thing. The email contained a disgusting image (reproduced below) which evinced utter lack of respect not just for Capoot’s memory, but for a certain other person who died under tragic circumstances:
Disgusted, Johanson forwarded the email to a friend, who reposted it on his blog with an appropriately disgusted reaction. The state’s reaction, however, will make you disgusted. From CBS 13 Sacramento:
Johanson knew Capoot well. He couldn’t believe a colleague at work would ever send this to him.
“The person who sent it to me knew I knew Jim and worked with Jim. It was not a big secret what my former job was,” he said.
This former cop forwarded the email to another ex-cop friend who posted it in disgust on his blog. Then, the state suspended Steve and fired him Thursday for improper use of work email.
It’s a decision he’s fighting and may sue over.
He lost his friend, and now his job. But he’s gaining support from strangers as his story and the picture spread on the Internet.

UPDATE: Steve Johanson himself has contacted the Blaze to provide information regarding his situation. We have copied the most comprehensive explanation below:
The altered photo emerged shortly after the racially charged Martin case came to light in the national media, and was captioned, “Would it make people feel any different if we put this face on a dead pig?”
On the receiving end of the email was Capoot’s former law enforcement colleague, California Employment Department employee Steve Johanson. Johanson, who is white, said the offending email was sent to him by a black coworker on a state-owned computer.
Expressing grief and anger, Johanson shared the email with an associate who runs a pro-law enforcement website called “Big City Cops,” which posted the image on its Facebook page. Johanson said he was seeking advice on how to respond to the email, and it wasn’t his intention for the image to be posted. Facebook has since removed the controversial photo, deeming that it violated the social media website’s content policies.
To be fair, this latter point implies that the employee involved was not punished, when he was. The employee, whose name has been listed by two Facebook postings, was (as indicated above) suspended. Some reports claim that the employee in question had a history of sending around racially inflammatory images to his white coworkers. The Blaze has yet to discover news reports corroborating this account, though if it is true, then it makes Mr. Johanson’s case doubly problematic. Again, from Mr. Johanson’s link:
EDD spokesman Patrick Joyce also declined to comment on the case, citing personnel confidentiality rules. However, a source familiar with the investigation said the employee who originally sent the email to Johanson and two other employees has been placed on suspension.
Yet the reasoning behind Mr. Johanson’s firing is, as readers will see, still highly troubling:
Garcia said Johanson told him last week that he was being terminated because he violated the state’s email policy by sending Garcia the image.
“I believe his only mistake was not going to management in the first place,” Garcia said. “But he was afraid of retaliation. I don’t think he thought the initial reaction would get the attention it got.”
It seems to us that blowing the whistle on a colleague who may have had a history of sending this sort of information around should be rewarded, since that sort of history should never have been allowed to accumulate in the first place.

And the traces of weed in Trayvon’s system was so small, they concluded it could have been from months ago. How many teens and adults don’t smoke pot. I wasn’t certain because you used a period instead of a question mark. As a matter of fact, I’d like to be able to go to a concert where I can be spared the pot smoke, there are those of us that are allergic to pot, and might actually like to be able to smoke tobacco too, but that isn’t allowed in any venue in the state of Colorado. You have some serious problems with perception or were born yesterday. Occasionally, there are some racist posters, most I suspect are “Trolls” (liberals posing as racists to give conservatives a bad name). But most of the posters here are judicious, conservatives who are aware of the liberal b.s. spewed from the mainstream media outlets.
While no one person except Zimmerman knows EXACTLY what happened that night, the facts which are slowly disseminated from the police, the discovery process, and the m.s.m. make the profile of what was first reported by every m.s.m., Fox news, and even Glenn Beck what the people on this blog call “Suspicious.” As a law enforcement officer who investigates criminal matters, I know that the prosecutors I work for would not prosecute Zimmerman because it appears he acted out of self defense – his lacerations to the back of his head, bullet trajectory, and eye witness accounts indicate this.
I believe that the bloggers on this site just want a FAIR trial for Zimmerman, and fear that by having black antagonists, domestic terrorist organizations (aka The New Black Panthers), and the m.s.m. portray Trayvon Martin as some sweet “choir boy” who was shot in cold blood by a racist zealot, Zimmerman is not going to get a fair trial and is already convicted. Very few 17 year old males are “sweet, ” and Trayvon certainly was not, and most likely was a “thug!”

For instance, in this guys case, it was probably just a normal email from either another State Employee or from someone on the outside of State Employment. If you sent an email to a State Employee right now from your Yahoo account there is no filter for that. Filtering is not fallible.. His mistake was forwarding it. Even tho it isn’t a firing offense. If it was 1000′s of employees a day would get fired. Something more to this story.

PS- Treyvon was a punk and they are using 5 year old pictures of a kid that is not and was not the kid at the time Treyvon assaulted Zimmerman, from the blind side because Zimmerman was told to stay at his truck- which he did! How do we know it was a blind side assault? Because Zimmerman was at his truck, and if he saw it coming he would have shown his gun and the confrontation would have ended right there- no one hurt!

Like it or not if the computer is owned by the government or the company you work for, you do not have freedom of speech or any privacy rights when you use it. It’s not yours, and if you do it when you are supposed to be working they can also hold you accountable for it. Save private type emails for your private computer and on your private time.

After that didn’t work, they tried to say that I had written it on State time. Which was also untrue. I knew their tactics beforehand and I advise all to do the same when trying to get information out that detrimentally affects their agendas.

The best picture I ever saw was of a thirty year old drug dealer who had been convicted of drugs and robbery offenses throughout his adult life, who shot at police and was killed during return fire. The picture a local NYC paper posted was the perpetrator in his 7th grade class picture. Probably the last year he had attended school. Seriously though…it really gives the public the impression that a little boy was killed. Just like the Martin photo above….that photo shows a 12-13 year old. Other photos of the 6 foot plus Martin tell a different story.

More so since one person in the email was known to the reciever. Where not talking about some fool forwarding some stupid joke. This man had a wroking knowledge of one subject in the email.

I’m an intern for a Federal Agency. I’ve received the IA training, and as a state employee I know for a fact he received it as well. When an email of this nature is received, the response is to not resend it, or even open it… but report receiving it. Forwarding it to someone else, and then having it put up on a blog, is blatantly inappropriate workplace behavior.

Posted on June 4, 2012 at 7:42pmI’m an IT employee for the State of Calif. While he SHOULD have gotten training it’s not a fact that he did. You would be surprised how many people get access to their Departments Network and not get training. Besides the guy did mess up by forwarding the email so technically he can be admonished. But, fired? Don’t think so. This type of thing happens EVERY day and OFTEN. Even from Management types. I have access to this type of information and believe me it is prevalent and especially among supervisors on up. It’s a which hunt to get this guy. It’s not a termination type offense. At the most it’s a letter of instruction or letter of reprimand. Just so you know I’m not lying about my job. For all you Calif state employees you know what a AISA or in my case a SISA is. :) that’s me…More to this story for sure.
