States Fight? TN Vows Payback on New Yorkers After 9/11 Memorial Gun Arrest

Tennesseans have circled the wagons to protect one of their own arrested in the Big Apple for gun possession, and now New York motorists may want to keep a closer eye on their speedometers.Tennessee Vows Payback on New Yorkers After 9/11 Memorial Gun Arrest of Meredith Graves

In response to the arrest of 39-year old Meredith Graves for unlawful gun possession while visiting the newly opened 9/11 memorial, the Tennessee state legislature has taken action.

According to the New York Post, Tennessee’s state legislature has “declared civil war on New Yorkers“— at least when it comes to speeders in their state. State officials claim they may retaliate for the prosecution of a woman who was carrying an illegal pistol at the 9/11 Memorial.

A Knoxville-based legislator, who is also apparently a farmer by trade, is so upset over the Tennessee tourist’s gun arrest last month that he drew up legislation addressing it.

In response to the arrest of Meredith Graves, the Post says “his resolution condemns it as a grave miscarriage of justice— and reminds New Yorkers to “drive carefully” if we come visit.”

The Tennessee House resolution reads in part: “We remind the citizens of New York, especially those residing in New York City, to drive carefully through the great state of Tennessee, paying extra attention to our speed limits.” The resolution– which does not have the force of law even within the state of Tennessee, also requests the release of Meredith Graves, an outcome it claims common sense and sound judgment demand.

A registered nurse and fourth-year medical student, Graves face 3 1/2 years if convicted even though she was licensed to carry a concealed weapon in her home state of Tennessee. Before her arrest, Graves willingly surrendered her weapon to authorities thinking she was in compliance with the law.Tennessee Vows Payback on New Yorkers After 9/11 Memorial Gun Arrest of Meredith Graves

Many who believe in a strong 2nd amendment have been outraged by her arrest, and there are no signs yet that New York City authorities are considering dropping the charges.

The resolution appears largely an attempt to bring attention to the case facing Graves.

But when asked about any impact it would have back in Tennessee, the Tennessee measure’s sponsor, Rep. Frank Niceley, (R-Knoxville) told the Post: ”Well, I don’t know that the Highway Patrol would be any kinder or any harsher. But it’s something to think about.”

Resolution 585 should come up for a vote in Tennessee’s House of Representatives next week. If it passes, it will head to the Senate and then the governor’s desk.

Meanwhile, Graves is due back in court March 19th.

      I have a carry permit in Pa, I can’t take my gun to Ny, NJ, Ct, DE, MA, ME, RI and a few others around here.
      If Pa found me okay to carry a concealed weapon aka hand gun then why not the rest of these states?
      the 2nd amendment says I have the right to have a gun. last time I check the above states are still in america.

      The congress passed last year a bill to make a carry permit in one state good for all states what happened to that bill did haryy kill that also?

      If you call all your friends and let6 them know what New York is doing to all the states that passed carry permits and get them riled up. Call it a no fly list. If your are one of the rich fat cats and pay $1200.00 for a temp permit your carry permit from another state will be onered. If all tourisim stops and you hit the whole state it will force the NY hose to amend their law.The Republicians passed a law that would have made a carry permit legal in all states but our friend Dirty Harry over in the Senate killed it.

      If you were a member of the NRA you would know what states to avoid because your carry permit isn’t worth the paper your state put it on. Here on Oklahoma you have to pass a class before you get the permit 6 months lator. This is the second year myself and wife wanted to take our 3 older grand sons up thru DC, NY, Virgina, Conn, Phillie and Chicago but can’t carry in all those states. After Heller Decision, thought things would change. Many states will give a permit if you are wealthy enough. I usually spend about 10 grand but with the 3 grand sons probably would have cost 15 grand. I won’t be ripped off just because they want only the rich to be armed along with the felons.

      This lady is a Nurse and trying to become a Physician. This arrest and if she goes to jail will put paid to becoming a physician. I would suggest that people take vacations elsewhere and avoid spending any money in NY. You would be more than welcome in Florida and Texas and no one would take your gun if you have a license to carry

If I did own a gun, though, and decided to vacation in NY (not a chance in Hell that would ever happen), I’d spend five minutes looking up the gun laws in NY, since I’m smart enough to understand that not all states respect the 2nd Amendment like Texas. This lady needs to accept responsibility for not informing herself and TN needs to get over it.

      Seems to me that’s a good natured back and forth. It’ll be resolved amicably. And whole lot of people will realize that states, in the good old Constitutional way, have the right to to create and enforce their own laws. And realize that you shouldn‘t assume that something that’s legal in your own state in legal in another. States rights, the Tea Party ideal. Why is anyone complaining? Do want, in this case, a Federal law instead of allowing states to make their own decisions?

I know NYPD and they don’t care for this crap. Common sense saves a lot of time and money.       As a upstate NYer I am ashamed of my states ignorance of 2nd Amendment rights. The only people in our state that are comfortable owning guns are criminals and the police. In my experience, legal gun owners are made to feel like criminals for even applying for a permit or obtaining a hunting rifle.

      I visit Tennessee often and have thought of moving there. However, two wrongs don’t make a right. I have nothing to do with the crazy liberal politics of this state and try very hard to change it. NY is past the tipping point and I now am just looking for a safe exist. Warning to TN don’t go down the same path, with the same PC policies that got NY into this mess.

      TN is acting stupid. If TN wanted to act like this, they should have waited til her court date was past. She probably would have gotten off anyway. TN Gov could have contacted NY Judge on her behalf, if he wanted to do something. We are dealing with Libs folks! I don’t like gun control of any kind, however, we have it to some degree. Each state is different. We all know that, wheter we like it or not, especially licensed conceal carry gun owners, which she was. A RESPONSIBLE gun owner knows the law in a State before he goes. Period. It’s on her, not NY.

      This is a Slippery slope. Although I agree that If you have a license to conceal carry legally in one state, you would think, it should be OK in all other states? The problem is:
      We do not want our government governing each state, each state is responsible for itself as it is supposed to be. If they use this as a way to over ride individual states rights, then THEY will surely IMPOSE a lot more unfavorable laws, rules, mandates etc. on us.
      The only thing for now for all conceal carry individuals is to get educated with the state you maybe thinking of visiting and check their local laws. There are books out there to help with this. Get the most recent publication. If you feel that your personal safety is at risk in the visiting state, you may want to reconsider other means of personal protect for yourself. Pepper spray, taser etc.
      I personally will be emailing to all the NY state representatives my disapproval in this case.

Yep, you can get a gun permit still pretty easy up hear, thats why we are refered to by the down staters as rednecks and uneducated, which is far from the truth.       @ Littlebigman, the second amendment to the U.S. Constitution does not give you the right to carry a gun. It is the NATURAL RIGHT of self defense that allows you to carry whatever weapon you deem necessary to ensure your own safety and the safety of those around you. Far too many people get confused about this. Even if an amendment to the Constitution was ever signed that nullified the 2nd, your right to carry a weapon would not disappear.

      Also, the 2nd amendment never mentions firearms. It says arms. Arms means any weapon. You should take note that the battle of Lexington was fought after the British took control of all of the city’s cannons and munitions. The men who fought the American Revolutionary War knew what they had a right to possess and why. We need to remember that.

      Since when should a law abiding citizen need a license to exercise an INDIVIDUAL right? No state may create laws that strip you of your rights based on state residency. All states must recognize that they have no authority to do this.

      It’s about time that states take action against socialist northeastern. First of all, I don’t know why anyone in their right mind would ever want to go to NYC, although not all of NY is bad, I would never spend a dime in there. Shame of it is there are good people there who have no voice. Had Ms. Graves been a thug robbing people in the city, the gun charge would have been thrown out already, but because she is law abiding, and a believer in the 2nd amendment, they will throw the book at her.

      I have a Conceal and Carry in AR, one of the best states on the planet for gun rights, everyone is packing and crime reflects it. Crime rate here has dropped every year since it was passed at the state level.

    I hope this sets up a Supreme Court challenge so we can get the 2nd amendment enforced in all 50 states. If this is challenged, they will probably drop the charges so it won’t result in another situation like Heller v/ DC I wish the Supreme court would have clarified the 2nd amendment ruling to all states.

      You need to do some reading of the Constitution bud, States rights don’t include the right to super cede the US Constitution….Was kinda part of that deal of becoming a state…In case your don’t want to…here ya go, as I’ve seen you say this a few times now….

      Article VI Section 2

      This Constitution, and the Laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land; and the judges in every state shall be bound thereby, anything in the constitution or laws of any state to the contrary notwithstanding.

      States can’t take away your 2nd Amendment anymore than your first or any of the others….And as of a few years ago, the Supreme court decided that the second amendment applies to the individual, not just a “militia” as the progressive loons would like you to believe…

      Show me where the Second Amendment says only hunters or target shooters, or only the good ‘law-abiding’ people have the right to keep and bear arms.
      Then show me where it says this is a state’s rights issue. Go ahead- I dare you. Just like TN wants to make threats to New Yorkers over an infringment of a resident’s rights, yet will allow illegal roadblocks and searches of vehicles and persons on their roadways.
      Sounds to me as though TN will only enforce the rights they want.

      In fact when the the Constitution and Bill of Rights were first written, they limited ONLY the powers of the federal government, Not the states. In other words, before the nationalization of the Bill of Rights, New York could have outlawed guns and been totally within their authority as a state.

      This is evident in cases like Barron V. Mayor of Baltimore (1833), where the U.S. Supreme Court denied Barron his 5th amendment rights not to be “deprived . . . of property without due process of law“ and to receive ”just compensation” for property taken for public use–even though Baltimore ruined the value of Barron’s wharf. Not only was the decision unanimous, but Justice Marshall said in his ruling that “These amendments contain no expression indicating an intention to apply them to the State governments. This court cannot so apply them.”

      Then there was a War Between the States and a 14th amendment which provided a new basis to make the Bill of Rights binding on the states because of those phrases “No State shall make . . . nor shall any state deprive . . .etc.” One by one the Supreme Court has reinterpreted the previous amendments in light of the 14th and ruled that they are now binding on the states. The 2nd amendment, however, has yet to be nationalized like the rest of them as states are currently allowed to make their own gun laws (for the most part). And in all likelihood the 2nd amendment never will be nationalized.

      Actually, this goes beyond the Constitution. The founding principle behind the Bill of Rights is found in the Declaration of Independence: “We hold these truths to be self evident, that all men are created equal, that they are endowed by our Creator with certain unalienable rights, that among these are Life, Liberty and the pursuit of Happiness…”

      Note the words ‘AMONG THESE’. We have a Divine Right to not only our Life, but the protection of it. It‘s not a ’law’ in the Constitution, it’s a God-given or natural.

      The Bill of Rights wasn’t written by politicians granting us certain things, it was demanded by THE PEOPLE to ensure the federal government knew what it couldn’t legislate away from us.

      Many States Like New York and New Jersey Has Technically Repealed The Second Amendment.

      Now you cannot purchase CO2 cartridges or even BBs in the State of New Jersey. The US Supreme Court promised it would look at all the anti-gun laws in the cities, towns and states. The 14th Amendment states that everyone is a citizen of the United States not the State they live in so why can States control the Bill of Rights and the Law of the Land?

      Boycotting NY because of their position on gun control would not cause NY to change their laws. I believe strongly in the 2nd amendment, and have a concealed carry permit, but tourism and gun control are unrelated issues.

      To boycott NY for this (or any other) reason would only be effective if the boycott were nationwide, and if people who would normally vacation in NY went elsewhere. For those who NEVER go to NY but say they will boycott NY, makes NO difference in NY’s economy or their gun control laws.

      For what it’s worth, living here in Washington State, where we have concealed carry and I understand we respect at least some other states concealed carry licenses, I have one policy that I keep:

      If I see a broken down motorist on the side of the road that needs help, I pass them by if they have license plates from Enemy States (enemies of the Constitution), such as California, New York, New Jersey, Massachusettes (hell, any of the Eastern states!). If they need help, call the Feds or go without. Shouldn’t be much of a problem though, I’m sure one of their transplanted commie Kalipornia immigrants will stop and help.

      No No No keep the Feds out of the concealed carry permit. We all want smaller government but yet I see people all the time wanting a Federal Permit to carry concealed. Are you nuts? I don’t want the feds having anything to do with concealed carry permits. Keep it at the state level. Know the state you are visiting and whether or not they have concealed carry and what their laws are. And by all means avoid the communist states of Illinois, California, and New York.

      ITA with your post. Initially I thought it was a wonderful idea but after speaking with some long time gun owners, they brought up the same concerns. We don’t want the Fed involved- they can use the legislative power it to enforce greater gun control/bans.

      I wish the best for those who carried in NYC- I’m behind them.

      And I think the best thing is for all of us CCW holders to read and know the laws of the states we choose to visit.

      Sherman’s tactics are the only reason the north won. The battles in the north were spectator events. The locals would actually go out and watch the battles from the sidelines because the southern gentlemen didnt believe in attacking the civilians. If the south had followed a scorched earth policy it would have been over with really fast. I actually thought about that this past week and thought that would be a good policy for the south to follow this time. One thing you should consider is that back then all the production was in the north. There is a lot manufacturing going on in Tennessee and here in Texas now. Outside of detroit what is the north making now? Texas and lousiana have the majority of the nations oil refineries and pipe gasoline up north. There is an off valve on the southern side.

      Since Tn has I-40, I-81 and I-75 frequently used by New Yokers I would advise they do not exceed the speed limit. I can assure you there will be no lowering of the clocked speed to save you bucks. Thank your draconian gov’t and you anti gun laws.       This is a different situation the scenario you lay out 200+ years ago…

      Regardless of his generally idiotic behavior, he is right on this…The law is unconstitutional in the fullest degree and if she had done this in protest to the law than your argument and mention scenario applies…She was not, she was ignorant of the law, and got arrested for breaking it. Wrong or not, it’s still the law and will be applied and enforced by the agency responsible to do so….As other laws like Obama-care are being…

      Hopefully this will institute a court challenge to the law and further the 2nd amendment across the country. If we can bring down the NYC law, others will crumble…

      Please don’t insult me in a veiled manner either….We have encinom/monicne, Rose-ellen, and others to do that…

      I live in upstate NY also and we are chomping at the bit to get the @$#% out of this state. We moved here 10 years ago and have since realized what a huge mistake it was. The area is beautiful, the people are wonderful but the politicians, taxes and regulations are idiotic. Once we decide what FREE state to settle in and get our house sold, we are out of here with no plans to ever set foot in the state again. Once we leave, NY can fall into the ocean as far as I am concerned.

      I left New York many years ago and moved to New Jersey—-just as bad. Left New Jersey about 20 years ago and I am a happy gun owner and carry a concealed permit here in Florida. I could never live in the northeast again where only the police and bad guys carry guns.

    The city and the state have an obligation to provide travelers a work around option to protect them from crime traps like the speed traps that have been found to be unlawful. This is wrong and should be challenged in the courts. Lib’s in NY are out of control just like Obama they think they can make any law or proclamation to force us into obedience like a good socialist population should act. Here is a great example: If you ever watch the Discover Channel program “Gold Rush”, in a recent episode, 2 of the 3 gold claims were shut down by the federal government for “mine safety violations”. One of the claims had been in operation for over 20 years without an inspection or accident as it had been run by the owner, a 91 year old gold miner. The federal government knows whats best for the claim owners, right? The closures cost the miners their livelihoods. All because of a federal regulation. You can’t fight it, it is like talking to a bag of rocks.
