Stunning Report: Chief Justice Roberts May Have Authored Both Obamacare Opinions

This weekend, CBS reported that Chief Justice John Roberts changed his mind and his vote before the final Obamacare decision was announced. While he initially sided with the conservatives, the report says, he eventually joined with the liberals on a technicality. Now, a report is out that seems to show just how involved he was with the conservatives before having allegedly switched.

The liberal outlet Salon.com has a story from law professor Paul Campos citing “a source within the court with direct knowledge of the drafting process.” That source makes a stunning claim: Roberts not only authored the majority opinion, but he also contributed to the dissent — a dissent he was drafting before switching his vote.

It should be noted that the CBS piece does directly deny this, saying that such reports are “inaccurate”:

The majority decisions were due on June 1, and the dissenters set about writing a response, due on June 15. The sources say they divided up parts of the opinion, with Kennedy and Scalia doing the bulk of the writing.

The two sources say suggestions that parts of the dissent were originally Roberts’ actual majority decision for the court are inaccurate, and that the dissent was a true joint effort.

The fact that the joint dissent doesn‘t mention Roberts’ majority was not a sign of sloppiness, the sources said, but instead was a signal the conservatives no longer wished to engage in debate with him.

The Salon report recognizes this, but still makes the charge:

Yet that, I am told by a source within the court with direct knowledge of the drafting process, is exactly what happened. My source insists that “most of the material in the first three quarters of the joint dissent was drafted in Chief Justice Roberts’ chambers in April and May.” Only the last portion of what eventually became the joint dissent was drafted without any participation by the chief justice.

This source insists that the claim that the joint dissent was drafted from scratch in June is flatly untrue. Furthermore, the source characterizes claims by Crawford’s sources that “the fact that the joint dissent doesn’t mention [sic] Roberts’ majority …  was a signal the conservatives no longer wished to engage in debate with him” as “pure propagandistic spin,” meant to explain away the awkward fact that while the first 46 pages of the joint dissent never even mention Roberts’ opinion for the court (this is surely the first time in the court’s history that a dissent has gone on for 13,000 words before getting around to mentioning that it is, in fact, dissenting), the last 19 pages do so repeatedly.

The explanation for this, according to the source, is very simple: Roberts’ chamber did much of the drafting of the former section, and none of the latter. In short, it appears Chief Justice Roberts ended up in large part authoring both the majority opinion and the dissent in National Federation of Independent Business v. Sebelius. This would seem to give a whole new meaning to the term “swing justice.”

For now, it’s only according to unnamed sources. But if true, it surely adds to the lore of one of the most stunning decisions — if not for its outcome than for how it was achieved — in Supreme Court history.

    This is Independence Day – yet I don’t feel so free – AND I see more of our
    “Indendence” slipping away faster and faster.

    People we have counted on (Judge Roberts) to be the solid rocks in upholding the
    Constitution have been proven to be TURN COATS on the People AND Constitution.
    Not a hopeful thing – it‘s what Obama has MADE HAPPEN and it’s what he WANTS US
    to feel, hopeless.

    Well, I’m down spirited but NOT HOPELESS!
    We’ve got to fight people – like we’ve never fought before. And, to those who feel a vote
    for Romney is a vote for the lesser of two evils – yeah, you’re right- but what will you do –
    vote for THE KNOWN EVIL? I don’t think so…

    Romney had better step up…and I realize Obama is waiting for Romney to
    announce ANY of his plans so that Obama can STEAL HIS IDEAS – then say,
    the people WANTED IT ( like Romney’s HC plan) but the difference was – it DIDN’T
    TAKE OVER EVERYTHING LIKE OBAMACARE.

      That was so well said. I might also add that the lifetime/longtime senators and representatives have to go. The people who are put up as nominees from both parties, that carry on the status quo. We need to get Constitutional respecting people in both houses. It is not the governments duty to run your life and give you things…It is surely American to give a hand up, not a hand out!!! We need to stop the entitlement mentality. Personally I think that it might already be too late, unless Romney suddenly turns into a true conservative…and actively turns the boat around…we shall lose the Republic. Obama is the biggest threat this nation has ever seen…and it‘s not because he’s black…it is the corruption in his heart, and his hatred for America. He surrounds himself with corrupt people, ie soros, ayers, wright, van jones,the mb in the white house and fbi…and the one true fact that can’t be denied is how much he despises the Republic…that it should be changed to what…marxist/communist? We need to come together and change the course he has set, all the progressives have set…we surround them…We need to take the stand that we will save America no matter what the cost. God help us, we need it.

      Also, I wouldn’t be surprised if obama started bombing Iran in sept or oct…just before election to garner the votes of the Jewish People…after showing his hatred to Israel for over 3 years…now, just in time for Novembers vote, the hypocrite will side with Israel…this marxist would do anything, say anything and give anything to retain power.       Happy 4th, Blazers! Well, it IS a somber day for us. Please realize that Roberts did what he did under extreme duress. As you all know, every family should have a code word in case they are in imminent danger, but are able to contact a loved one. Roberts can’t do that, but he did give his close friends and America a clue that he was being forced to change his position. That clue lies in how he wrote the majority opinion. Jurists and friends agree it is both sketchy and legally unsound, SO unlike Roberts who is an eloquent and brilliant man. That proves his HEART WAS NOT IN IT. If Roberts had truly held the liberal view, he would have reflected his belief and understanding in a studious, well-reasoned and compelling manner. Furthermore, he would have sided with the Obama crowd FROM THE START. It is absolutely ludicrous to think that a highly intelligent man like Roberts would suddenly become convinced that his original interpretation was wrong. That does not happen. The writing is on the wall, folks.

      Obama’s very presidency was at stake. He found a way to twist Roberts’ arm, and it had to involve not just Roberts’ own safety, but that of his family. Obama ACTIVELY promotes the killing of unborn babies at any stage of the pregnancy. Problematic people have mysteriously died. We don’t have proof, but you never do with commies until it is too late. Obama lacks empathy because of his upbringing. He is an evil man.

      Impeachment while it would be satisfying just won’t happen. You saw what the house democrats did with the Holder contempt vote. Having said that we each need to educate the average zombie that takes everything for granted about the country and freedom we are losing, the slippery slope has turned into a cliff. When you go to the store or gas station or where ever, educate the clerk that is checking you out about ONE issue. Ask them if they are registered, ask them if they know who the VP or Sec State is and ask them how they will vote. Lastly, ask them if they want to pay MORE taxes. Then tell them why voting for Obama is against their own interest. This takes about one minute. Some will blow you off, but it WILL make some of them think, MAYBE FOR THE FIRST TIME about their government.

      we should never expect the supreme court to be the defenders of the constitution. The supreme court is part of the government – do you think they will limit their own power? No, they will always seek to expand it.

      THE SUPREME COURT DID NOT DECLARE A SINGLE LAW UNCONSTITUTIONAL FROM 1937 TO 1997. That covers the new deal, great society, and all those other progressive time periods….

      The only solution is to elect ONLY constitutional representatives and repeal all unconstitutional laws. This will require a massive influx of constitutional candidates! We can start now. Replace Mitch McConnell with Jim Demint. Replace Jim Boehner with Justin Amash. REPLACE MITT ROMNEY WITH RAND PAUL. If we dont move now, we may never have another chance

      KRYPTO, SOY and others….so right. We have to get the truth out about what is at stake if we lose in the fall – so many still to reach. All Romney talks about is the economy b/c it‘s safe and they figure that’s all it takes. I don’t think so. They don’t get it either – about how this is not an ordinary Dem Admin., or ordinary period. It’s unprecedented and they are no less than Communist revolutionaries. But so many still don’t even know what those are and what dangers to THEM are if we go that route. And yes, we must win all the elections – and with patriotic, selfless Constitutionalists & replace the oldies. We’ve got a good start with the bunch we elected in 2010 but we must get many, many more and take the Senate. I have hopes of this and then they can keep Mitt leaning the direction we need and in check. Also pray re having the elections period. No doubt they will try to suspend by calling martial law/staged stunts, crisis. I pray that our military and anyone else that has authority and power are patriots that will find out in time and prepare, organize in case this happens in order to prevent and/or end it. We need Divine intervention folks.

      I agree with almost all of your post. But you lost me with how we can “replace” said politicians 1 for 1. The way I read it, you mean do this today which I’m not sure how that would be possible. You could certainly call for Demint to take over the minority leadership position but that is an internal affair. Same with the Speaker of the House. And as for replacing Romney with Rand, I just don’t see how that is possible and I doubt Rand would do it if it was possible. Rand, if all go’s well, will make an excellent candidate in a future Presidential election.
      And sadly Jim Demint will not be running again for his senate seat in 2016. He is my Senator and neighbor and he is not a lawyer which makes him even more special. He is not perfect though as none are. He has repeatedly said he will not run for President and I take him at his word.
      I do not share the opinion that this election is for the ballgame. I do understand the urgency but we have to think strategically as elections will come every 2 years. I see Romney as a stop gap measure. In other words we can get by with him while we CONTINUOUSLY prepare better candidates for the future. This is what we should have been doing all along but we lost sight of the responsibility we have as citizens to preserve freedom. I can see a future where we all thank President Obama for re-awakening the spirit of freedom in this country. Our problems will not go away in just 1 election. This is a non-stop train!

    It’s not only Roberts but the entire court who are traitors to the constitution. Roberts could have been stopped by the other Justices but they also choose the easy way out. I hate to think that there was money under the table on this but what else am I led to believe when this bunch of little gods do as they have done. The SCOTUS is no better than the Senate when it comes to politics and both are in the back pockets of the Buffet and Soros gang. America must have another revolution and abolish both the SCOTUS and Senate or simply sink into communism. No other way out now.

    He has epilepsy and is medicated for it. His judgement is affected by both the brain defect and the medication used to treat it. That is a scientific fact. This mentally challenged person has done great damage to the court and this country. I only care about him to the extent that he needs to be relieved of his seat and put on a modest pension immediately.
    A way must be found to remove justices not competent to render decisions. This freak Roberts is a prime example.

    We may never know whjy Roberts changed his mind and could conjecture on it forever. One thing that is coming out is that the administration was given information abot how the court was ruling well before the release of the decision. We need to focus on that as it could mean the administration may be involved in tampering with the court.

      Roberts’ brain is afflicted with epilepsy. He has to be medicated to keep from spending his time on the floor in convulsions. He is not capable of exercising sound judgement. He is in there for life by the way. Remember the “judge” who was on the court with a feeding tube? This has to change.

      Does anyone have any doubts that comrade obama either bribed or threatened the members of the court that he did not appoint to arrive at this decision! It is sad that Roberts was so weak that he gave in to this but who knows what he was told. At any rate Roberts is a traitor and has been very insturmental in the final destruction of our constitution and our country. History, (if we continue to keep it) will show this.

I don’t think people are seeing the BIG PICTURE and the more the MOB seems to scream “Crucify Him” the more I say they are wrong. I have carried the thought forward : What if Roberts had voted against Obamacare… Then instead of MOTIVATED GOP we’d be hiding under our desks to avoid being hit with the multiple HATE missiles lobbed by spoil-brat Libs. They could still force States to do things by blackmailing them (threats to remove current medicare funding for example) … ROBERTS didn’t lock anything in IRON…he told us: Don’t expect the Courts to get you out of the mess YOU got YOURSELVES into by electing the politicians you have elected. THE VERDICT is STILL OUT as far as I am concerned. I think he did us a great favor. He acknowledged that black-mailing states was NOT Constitutional.
      Some sob-sister columnists are making a lot of $$ with their half-baked theories about his Epilepsy and his changed opinion(s)… brings up Shakespeare’s Thou Doest Protest Too Much…. so I agree,

      Spot on. Kagan and Sotomayor are Obama apparatchiks. I was very concerned during the whole deliberation process, because I knew this was going to happen if Kennedy sided with the conservative justices (which he did, and Obama was informed). I just didn’t know who the victim would be.

    Roberts is in over his head. It matters not why he did what he did, either indirectly (media opinion) or directly (threats or payoffs) what matters is that he did it. He is as unstable as water. He dared to violate the Constitution for whatever reason, it is his job to protect the Constitution. I would like to think those guys in DC would roll up their sleeves and work hard to repeal this socialist law. But, since when does this really happen. Obama has done allot to be impeached over, they have yet to try and impeach him. So my guess, this law will not be repealed, but they will do allot of bellyaching over it. It seems that they all have their own agendas in DC, and it is not protecting the Constitution and the citizens.

    How much assault can our country take before it collapses? If and when this country collapses it will happen so fast, we will blink and look at one another and say what just happened, then the dead wood in DC will do what they have always done, protect their own interests at our expense. In the end, we will be their slaves and they will be our masters. The first step in solving a problem is correctly defining the problem, sometimes it is painful to do that.

      In re Roberts, I have pondered what I would do if I had to choose between the destiny of my nation and the life of my children or grandchildren. To be honest, I don’t know the answer to that. I know if I had to choose between denying Jesus and watching as my children were skinned alive, as some Christians have in totalitarian states, I would cling to the Lord to find the strength to endure the horror of watching them being tortured. But this… I honestly don’t know. I don’t think he was given the option to resign.

On the 236th anniversary of our country I can’t tell you how sad it makes me to read these kinds of comments.

      “Anti-American”, “Enemy”, and “a vote for anyone but Romney”….sheesh! Follow your road to serfdom. Romney will find a way to get you there, as did Reagan, Bush I and Bush II, the other R’s from recent times and along with Clinton and Obama. I will not be along for the trip. I pray that you prosper in, and enjoy your servitude. I prefer to resist. Peace.

      Don’t think most folks here (at the moment) are fans of the PAULBOT (my way or the highway) approach to teamwork and consensus building. With or without you, we CAN and WILL take back this country and its Constitution. And yes, right now it looks like we’re going to put our collective energy and resources behind Romney and as many solid conservatives as we can vote-in come November.       Republicans and democrats will set a record in 2012 for lowest vote totals (as a % of population). Either Gary Johnson will get 20% of the vote or a record amount of people will refuse to vote on election day. This is an indictment of the two party system and if you want to see the fruits – look at the last 200 years governance in this country

      I don’t have your crystal ball but I will be surprised if Johnson gets over 10%. Half of his vote will come from the drug legalization crowd. Not to downplay his impact, he could play the spoiler for Romney in swings like Colorado. Conservatives are energized and WILL descend on the polls in mass. Hope you’re right about a low DEM turnout.

      formulate the bill. When Roberts was pressured to ask Kagan to recuse herself he said stop trying to tamper with MY COURT.
      Also his Az. immigration decision leaving that state w/o a southern boarder. Leaving open the largest pathway of the Mexican Drug Cartells.

      It really is not important why he pulled a Benedict Arnold & fled to the island of Malta,
      but he did.

      That’s more complicated. Only Scalia and Thomas dissented IN PART. However, the most controversial provision — the one Barack wanted to strike down — WAS upheld.     I stil say the employer mandate is a larger issue than the individual mandate. How can it be constitutional to require an employer to pay for an employee’s health care? If your employee were a slave than it might behoove you to care for his health, but slavery has been abolished. Now we are only enslaved by our government !

    This decision by the Supreme Court has been dessiminated, analyzed and criticized. While some are trying to shoot the messengers, there are still questions that must be resolved. The Catholic Church is challenging Obamacare on many issues.
    Justices do participate in public forums discussing the legal reasoning of past cases. In fact, Justice Roberts responded to questions of a group of students about Obama’s perceived insult to the Court.
    I read that the state of Florida alone has 1.9 million uninsured—legal or not? Like our immigration policies, Obamacare is not affordable, workable, or enforceable.

      As of last Thursday, it is the law of the land. There is only one way to change that and additional appeals to SCOTUS would constitute insanity. Monies spent on lawsuits by Catholics should be directed to ensuring that the 64% +/- that voted for POTUS Obama in 2008 do something different this time. There are 68 million Catholics that make up about 22% of the population in the US. You might even discover just why the Catholics became so liberal even at the highest levels and fix that too. Forget the lawsuits. About the same % of Jews voted for POTUS as well.

    But let me ask you a question, has anyone ever thought about the shape the economy would be in if Roberts joined with the dissenters and defeated Obamacare?
    Well, right away businesses would hire; the economy would be humming along very nicely through the election.
    Romney would not get the credit; OBAMA would and he would be re-elected.

    Take a longer view on this; stop bashing Roberts; he simply allowed the voters to decide on Obamacare not him. That’s a good thing. No the rabid Democrats in Congress, not the Obama, nor the SCOTUS should decide Obamacare; we the voters should and we will on 11/6/12!

      To take the longer view would qualify you as ignorant, and not knowing you I can’t do that. The longer view is that the Constitution MUST be upheld regardless of consequences. What just took place is a travesty, formed a new type of tax, rendered the commerce clause useless, revealed the power of marginalizing the SCOTUS in public. I’d take the Constitution if it meant POTUS being re-elected any day. Although I think it would have added to his woes and saved the country trillions…

      Okay, I’ll take the long view here. What has happened is the Supreme court has just decided that it is constitutional for the federal government to tell it’s individual citizens what they must do, or they will face a steep tax for failure to do it. The Declaration of Independence, signed by our congress 236 years ago today, states WE hold these truths to be self evident, that all men are created equal, and all are endowed by their creator with certain unalienable rights, that among these are the life, liberty, and the pursuit of happiness. That to secure these rights, governments are instituted among men, DERIVING THEIR JUST POWERS FROM THE CONSENT OF THE GOVERNED. So, in truth, this ruling turns that statement on it’s head. Now, the government has the authority to tell those that they govern, those who are supposed to give their consent, what they must or must not do. That is the long term view as I see it. And because this is the supreme courts ruling, the only way to overturn the implications of this ruling is to amend the constitution banning such powers from the federal government.
      You seem to be thinking more in the short term, thinking that we can strike down Obamacare with the next election. The only problem with your line of thinking that they still retain that power to tax us in order to force us to do something.

    Roberts hasn’t destroyed himself simply revealed himself as a progressive. He voted the way he did because he believes what he voted for and believes its within the constitution. The problem we have with our system of Government as it relates to the Supreme Court is that they are unelected lifers even if they lie about who they are to corrupt politicians to get on the Court. I say based on the level of corruption on both sides we should amend the Constitution and put term limits on these Judges because they are nothing more than Politicians at this point anyway.

      What is wrong with a decent family man, good father, good husband who has made his own fortune by hard work; who gave his inheritance to the church he belongs to ? A man I first remember ‘meeting’ when the Salt Lake Olympics were going down the tube and the Reputation of the USA along with it? He single-handedly turned these Olympics around and then ran for Gov.of Massachusetts and won in the toughest election they’d ever had; a lone Republican in a notoriously Democrat state.
      Romney, with his sons and their families and many grandchildren felt the need to run for President just as many of us feel the need to stand up for him and our precious America… we are all watching OUTSIDERS come in from ???(we don’t know where) and rip apart (daily it seems) every value, every truth, every thing that has made America great.
      The MSM and the WICKED Obama people (and yes, WICKED is the best word for them, they are EVIL beyond belief = WICKED) have been LYING about ROMNEY’S background, his record, his hopes for America and his ABILITY to Beat OBAMA. I watched carefully during the debate when I was not supporting him (at first) and was impressed by his Steady, Mature, Well-Reasoned response.       He could be impeached .. but I don’t know if that includes a medical reason … but I would put this in the Treason catagory and that is impeachable .. if he allowed to be swayed by outside forces (and it looks pretty clear he did) and voted against the Constitiution … and We the People … then I would try.

      Convenient co-incidences are usually red flags. It just so happened that Roberts was at the center of two anti-Constitutional decisions in close proximity? Obama’s path continues to be cleared. The Senate will not stand up to him; The Congress will not stand up to him; The Supreme Court will not stand up to him. The last line. The people must stand up to him in November.     Listen well people: ObamaTax is now the established law of the land according to the five activist justices of the SCOTUS who supported it.

    What matters NOW is the fight to make sure it is overturned in the new administration when Obama is defeated. This is a golden opportunity for the conservatives; they need to get out and explain in simple terms the economic impact this law will now have on families, towns, communities, and their home states, in addition to the nation as a whole.

    Say to the people: This is what it will cost you in taxation; and we need to repeal it, the only way we can is to overturn it with a conservative majority.

    People are worried with the economy most of all; and that needs to be a portion of the campaigns focus. THAT is why Obama and the leftists are growing more and more desperate, along with the growing insanity of Obama they are saying and doing stuff to counter the conservatives by hook and crook.

    THIS is OUR TIME.
    THIS is OUR PLACE.
    THIS is OUR FINEST HOUR.
