Supreme Court Justices ‘Blast’ EPA for Telling Idaho Couple They Can’t Build on ‘Protected Wetlands’

Several conservative members of the Supreme Court criticized the Environmental Protection Agency (EPA) on Monday for heavy-handed enforcement of rules affecting homeowners after the government told an Idaho couple they can’t challenge an order declaring their future home site a “protected wetlands.”

Justice Antonin Scalia assailed the “high-handedness” of the environmental agency when dealing with private property, and Justice Samuel Alito described some of the EPA’s actions as “outrageous,“ arguing that most people would say ”this kind of thing can’t happen in the United States.”

The EPA said that Mike and Chantell Sackett illegally filled in most of their 0.63-acre lot with dirt and rocks in preparation for building a home. The agency said the property is a wetlands that cannot be disturbed without a permit. The Sacketts had none.

The couple, who attended the Supreme Court arguments, said they had no reason to suspect there were wetlands on their property. They paid $23,000 for their property in 2005 and decided two years later to build a three-bedroom home. Workers spent three days filling in just under a half-acre of land.

Three EPA officials showed up, said they believed the land was wetlands, asked for a permit and told the workers to stop. Six months later, the EPA sent the order that triggered the court case. The Sacketts wanted to challenge that order, but lower courts have said that they cannot.

The EPA issues nearly 3,000 administrative compliance orders a year that call on alleged violators of environmental laws to stop what they‘re doing and repair the harm they’ve caused. Major business groups, homebuilders, road builders and agricultural interests all have joined the Sacketts in urging the court to make it easier to contest EPA compliance orders issued under several environmental laws.

Justice Anthony Kennedy wondered how far the Supreme Court should go in aSupreme Court Justices Blast EPA for Telling Idaho Couple They Can’t Build on ‘Protected Wetlands’ ruling, noting that government agencies often threaten citations when people don’t comply with the law. “Health inspectors go into restaurants all the time and say: ‘Unless you fix this, I’m going to give you a citation.’ Fire inspectors, the same thing,” he said.

The Sacketts’ lawyer, Damien M. Schiff, argued that they weren‘t trying to take away EPA’s power. Environmental groups say a purpose of the orders is to make it easier to negotiate a resolution without a protracted legal fight.

“Let EPA administer the act and issue compliance orders,” Schiff said. “But let’s also give homeowners a fair shake, too. Let them have their day in court to contest what the agency has done.”

Alito leveled some of the strongest criticism against the EPA, noting that the Sacketts had to wait until the EPA sued them to even challenge the idea that there were wetlands on their property.

“You think maybe there is a little drainage problem in part of your lot, so you start to build the house and then you get an order from the EPA which says: ‘You have filled in wetlands, so you can’t build your house; remove the fill, put in all kinds of plants; and now you have to let us on your premises whenever we want to,’” Alito said. “You have to turn over to us all sorts of documents, and for every day that you don’t do all this you are accumulating a potential fine of $75,000. And by the way, there is no way you can go to court to challenge our determination that this is a wetlands until such time as we choose to sue you.”

Chief Justice John Roberts said that because of the potential fines, few people are going to challenge the EPA’s determinations.

“Because of the administrative compliance order, you’re really never going to be put to the test, because most land owners aren’t going to say, ‘I’m going to risk the $37,000 a day,” Roberts said. “All EPA has to do is make whatever finding it wants, and realize that in 99 percent of the cases, it’s never going to be put to the test.”

The EPA’s normal procedure is to contact the homeowner before issuing a compliance order, Justice Department lawyer Malcolm Stewart said. A wetlands biologist has also confirmed to The Associated Press that he advised the Sacketts in May 2007 that their property was a wetlands and that there were wetlands on three sides of their land. The Sacketts say that in 2010, other wetlands consultants examined their land and concluded that the first one was wrong.

All we‘re saying is they can’t discharge fill, wait to see whether EPA notices, and then insist upon immediate judicial review if EPA notices and objects,” Stewart said.

However, critics argue these type of regulations, and the tangled mess of paperwork that accompanies them, are unwarranted, unfair and have been enacted with no real authority.

And while judicial activism has become a recent topic of discussion due to the GOP primaries, the question of federal authority in these areas has also been brought to the forefront of a national debate.

Why? Because much like Justices Scalia, Roberts and Alito, many Americans believe departments such as the EPA have been acting well outside the boundaries of their authority. Speaking of which, who gave them authority?

    The EPA “declared” the land to be wetlands, but it was not wetlands before that point. The couple should sue the federal government proactively, because the federal government, the EPA, CREATED the wetlands, which devalued their property substantially.

    We need to be a LOT more proactive, folks. How about a consortium. We pay hundreds of thousands of people (who have already declared bankruptcy due to barney Frank’s “free houses” program), a thousand dollars each to fill in wetlands, created hundreds of thousands of cases, “swamp” the EPA in their own legal morass.

    The EPA needs to be disbanded and dissolved and not replaced. So too the DE and the FDA.

      totally agree we need to get the epa out of here closed regulations overturned. the acreage neighboring mine is now declared wetlands….the property previously worth over 3 million dollars is not worth the cost of paying property taxes on. why is it wetlands? never was before until the county put in new drainage for a road nearby draining all of the water onto the highly coveted 40 acres thereby turning it into a swamp for the last year now it is wetlands and the owners are out 3 million dollars. cannot be developed, logged nothing. we need to get rid of these jerks

      Imagine that — the EPA saying WE don’t have a right to due process!

      The Supreme Court Will Side With The EPA, Its not going to side with these people. This is the same Supreme Court the ruled that CO2 is a pollutant and ordered the EPA to continue regulating it.

      If you want to contest the EPA’s order, how about “It’s my property and I can do with it what ever I d@mn well please, thank you.” If you can’t, then it’s not your property, the government just lets you think it is.

      Yes! We need to do away with the EPA, The Dept of Education, The Dept of Energy, and many other Federal ran agencies that are INFESTED with PROGRESSIVES!!!!
      I live on a lake here in MO that has about 1800 homes and a PRIVATE lake that was built in the late 60′s. Our Board of Directors,in which I am a part of, recently purchased some land near the lake that would be used for transporting mud to that would be dredged out of the “Man Made Lake” that has become very shallow due to siltation deposits from near by farms that comes down the DITCHES into the lake. The EPA came by and shut us down because we are in violation of disturbing the “WETLANDS” which amounts to a DITCH. We can’t even dredge out the lake to remove the silt due to these IDIOTs!!!!! They have absolutely NO COMMON SENSE what so ever. It’s time to step up America and get rid of these agencies that think they can do whatever they want without any recourse from the property owners and residents.

After research it was EASILY seen that Paul is THE ONLY candidate who can start turning this Country back toward the Constitution. First the FED will go. Next the Department of (special) Education known as public education. The EPA will go next. Following that will, or even at the same time that worthless ABORTION known as the Patriot Act.

      Don’t be surprised if Paul wins the presidency to see the 16th and 17 amendments abolished.

      This is all part of the UN’s Agenda 21 policy to remove owners from being able to build on land they purchased in the wilderness of the Western States first and then other areas of the country. And those people that were appointed by this Administration were part of the movements to put these regulations in place at the UN. You think this is bad just wait when all the new Dust Regulations for farmers kick in and the CDL requirement to operate farm equipment just like over the road trucking industry with log books and special licenses. These idiots are extremists in our Gov‘t agencies and we can’t do a damb thing except hope that we win this next election and get these idiots out…and then reform these agencies to use common sense.

      There isn‘t a day that goes by that I’m not proud to be an Idahoan. Just a couple months ago the Feds were after another guy up in Northern Idaho for killing a Grizzly Bear that was trying to eat his children. What have we come to America? We can’t build on our own land? The Federal Government is way too intrusive and its time we stand up and reclaim our country!! I am a 10th Generation American. My fore-fathers dug Freedom for this whole continent, and know I have to witness it all go down the toilet,…. its sad. The Federal Government is so big know that if we don’t beat Obama in 2012 just buy a piece of land in the mountains, get a 5th wheel with camo netting and a great generator and sit back and watch the world crumble around us!       The EPA has too much power. They determine how much ethanol goes into our gasoline. They are trying to increase it to 15% reducing our mileage even more. They are choking U.S. down in many other ways. Abolish the EPA. period.

      I’ve had a similar situation with a lot I now live on with my local county. They denied a building permit for 3 years on the premise of potentially high groundwater, and aquifer recharge issues in California, as well as vernal pools (seasonal) in the area. I was fortunate enough to hire a good hydrogeologist and defeat the statists in my county. Happily Living on my 50 acres today in the country, with about $75k lost in legal/development issues that will never be recovered. Thanks Government!

      I guess it’s the price you pay for peace and quiet these days.

      Reminds me of the story of the guy in Florida who bought a vacant lot that had been used as a tire dump. He hired people to clean it out, and was stopped by the EPA and fined because water had collected in the tired and formed a “wetland ecosystem,” including a stream that formed when it rained due to the damming of the tires.       Prepare folks, we have lost. It is now a matter of just how bad it is going to be. When Citizens have to travel 3000 miles and spend untold thousands of $$$ to defend their RIGHT to build on PRIVATE PROPERTY, we have lost.

      Abolish the FED, the EPA, the DOE, the Department of Ed, Commerce and shrink this NATIONAL government back to a Federal one. Defend us, build roads, and leave it to the states for the rest. It will never happen but we can dream.

      Wasn’t the EPA was invented to stop environmental pollution at the corporate level, and those that cross state lines, just like the FBI was created to combat organized and interstate crime? But these alphabet agencies have long been targeting individuals. Don’t we have EPAs at the state level to deal with individual matters? No wonder Washington is so dysfunctional and bankrupt! DC needs to let the States handle their own affairs and butt out.

      It’s Agenda 21. They want everyone in cities (called urban centers) and the majority of the land, mostly coastal and wetlands) to go back to it’s natural state. Look up the percentage of population that lives in coastal regions. They also don’t want rural communities, because I suppose they could be free thinking out there by themselves.

      I don’t think the entire EPA should be disbanned . I do think that they should be used as an advisory agency for Congress. Much like the ATF,DOE,DOE,FDA,DOA the EPA is an Unconstitutional agency that can levy taxations and regulations without the people’s consent. These are departments of political appointees but in place by a single person not voted into office by the people. In short they remove the people’s voice and destroy a GOVERNMENT OF THE PEOPLE BY THE PEOPLE AND FOR THE PEOPLE.

      This happens all of the time. I built my house here in FLA 12 years ago legally and even got a wetlands report from palm beach county stating that the lot was not “wetlands” but 10 years later got a letter from the EPA demanding 10k for building on “wetlands” or they could bulldoze my house. Their mistake was going after too many of us at the sametime and our County Commissioners backed us up and it quietly went away but if I was singled out like these folks I don’t know what I would have done.

      You seem pretty sure that there were no wetlands at the property. Did you visit the site. Take a few things into consideration here that lead me to believe there might have been wetlands present. This property was on of the last to be developed in thhis area and why did they need to haul in all of that soil and rock to construct the building foundation. The permit process is pretty simple if you follow procedures. Sounds like they might have screwed up here.

      In our case the wetlands were created by the county positioning a drainage pipe to empty on our land. We were not around at the time, nor were the wetlands regulations in place. By the time we were ready to build, it was too late to call the county into account. The resulting streams had fanned out, and we were not allowed to re-create streams to control the flow– supposedly all in the name of pure water. Who cares that all water from our small plot of land feeds into miles and miles and MILES of wetlands– making however it traverses our land totally insignificant.

      By the way, there is LOTS of money involved in wetlands projects….

      The EPA along with the Department of Education, the Department of Energy and several others need to be disbanded.If their function is needed, it can be done at the state level. They have caused more problems than they have solved and are filled with overpaid bureaucrats who never had a real job, kinda like Obama, who like wise never had a real job, except when he was a soda jerk. Still a jerk, and that is a complement. Certainly neither has the mentality nor capability of running a McDonald’s burger joint let alone the country.       The EPA does NOT CARE if there are thousands of challenges. They have unlimited funds available from the American taxpayer. This would just give them an argument to say they are overloaded,and so they HAVE to levy fines etc for non-compliance. THEY well know,as the article says, they can put anyone into bankruptcy,IF they get challenged. These b’crats are EVIL!

Ron says what he will do (there are checks & balances) and many people are SCARED but look at the CON-JOB of the current administration that fooled people into voting for the con-job. This country has gone off the rails and still many voters are hesitating about going back to the constitution and THE FEAR OF THE UNKNOWN? Yes, it would be strange and that makes many people uncomfortable. Maybe it IS TIME to vote for Ron Paul and get A JOLT OF REALITY and really WAKE-UP this nation’s deep sleep.       I think the President will override the Supreme Court on this one. They are forgetting that his executive order trumps abunch of old folks. He had pretty well stopped all mining – drilling for oil or anything that causes Global warming. This must be good because it would otherwize create about 1.3 million jobs.

      yeah yeah…i know…Ron Paul is the second coming of Christ and will save us all…yeah yeah.. okay.. get over yourselves…but lets look at REALITY…

      1 – assume Ron Paul does get elected…
      2 – assume he actually does what he says…which is hard to know because as many figure out…it is easy to promise when you aren’t making the decision and it is all hypothetical with no political, financial, or social ramifications.
      3 – lets look at what will happen…

      A – Congress will flip him the bird and continue to pass budgets ( not that they have done that since Pelosi and Reed took over), pass Omnibus spending bills, pass Appropriation bills… Oh all loaded with earmarks and pork by the way..just like Ron Paul loved to put in as well…
      Why..why won’t Paul be able to stop this… EASY.. The Constitution gives the HOUSE the power of the purse… ONLY the House can initiate ANY government spending. The President is only commanded to deliver a budget to Congress but Congress can use it or throw it out and make their own…the Constitution SAYS SO!!
      for all you diehards that believe Paul would be the ONLY guy to follow the Constitution, he would HAVE to follow along…his only fight would be a VETO which Congress could override and would after the first protracted government shutdown that resulted in no pay for the military (which Ron Paul probably would like) and no pay for Social Security and Medicare

      next after Paul was elected…

      B – the Supreme Court would still be able to override anything that Paul tried to do outside of Congress and since the Court is split right now.. 4-4 with one RINO swing vote in Kennedy…don’t bet on them siding with Paul.
      C – even if Paul could start the process to repeal the 16th and 17th Amendments (which can only be done with another amendment), Congress could KILL the process since 2/3 of ALL Congress is needed to create an Amendment and 3/4 of all State’s must ratify the Amendment and right now neither 2/3 of Congress nor 3/4 of State legislatures believe what Ron Paul believes…

      Now does that mean that Ron Paul should not try.. NO…absolutely not…he would be the President and I and everyone else should at least take him at his word the he believes this is necessary to save the country. The President MUST do what he believes is best for the country.
      Just like Reagan did when he tried to abolish some agencies like the DOEd. Congress fought him off and won and nothing changed. GW Bush tried several times to privatize at least a portion of Social Security and Congress fought him off and won and nothing changed.

      What Paul people don‘t seem to get is that the President CAN’T CHANGE SQUAT without at least one chamber of Congress agreeing with him.

      When the government begins telling me what I can and cannot do on my property (an it is not a community allotment), then it’s time to put your money where your mouth is.

      Another big problem I have is with our Judges. NO JUDGE SHOULD HAVE A LIFETIME APPOINTMENT. Where did this come from anyways? THE PROGRESSIVES. Judges should NEVER be appointed. They should be ELECTED BY THE PEOPLE, the same as the President. The idea that a President has that much power over the people, is mind boggling to me.       EPA is the worst and most destructive and numerous out-of-control rogue federal agencies.
      Agencies derive their power from Congress as delegated authority.
      Congress can delegate powers only to the extent that they are among the enumerated powers of the U.S. Constitution.
      Because the Constitutional powers to designate private property as “wetland” does not exist, Congress has no authority to delegate that non-existent power to an unelected and unaccountable federal agency of bureaucrats.
      Congress needs to revoke the charter of the EPA and dissolve the agency, or severely reign them in and exercise the requisite oversight to prevent these types of fiasco from happening.
      Our next Congress and Administration should exist to correct problems such as the EPA, and if their vision is too timid, they should be the last to get our vote or support.
      We The People are going to have to FORCE these changes on Congresses and Administrations that have become way too comfortable with the status quo.

      Let me state upfront that I am not a tree hugger.

      While I understand the popular opinion against these ruling, without the EPA and rulings like this, flooding or drying up streams or others properties would be rampant and all of our streams would be full of chemicals or silted in. Endangered species habitats would be destroyed and no one would be the wiser.

      You should never buy a property before you know what’s there. Think of it like buried utilities. Just because you buy a property without knowing they are there does not give you the right to dig them up and put a house there. It affects your your neighbors and it’s protected under certain laws for good reason. You pay to have the utilities discovered before buying the property. The same should be true in this case for wetlands.

      These people bought this land being ignorant of EPA regulations, but ignorance and money spent does not grant them immunity from the law. I am a civil engineer and realize how painful and sometimes ridiculous these regulations can be with new construction, but I also can objectively see the benefit of the regulations having also seen what it looks like without them.

      Often, if you fill out the appropriate permits and offer an equal amount of created wetland area, the EPA will allow the construction. It does cost money, but I think that is ‘stupid tax’ paid when you do not do your due diligence before purchasing new land and make premature construction plans.

      What astonishes me at how many of you don’t understand what it is that is causing all of the problems that we are witnessing in America. The Agenda 21 Plan is behind everything and the EPA is the top dog. If we don’t understand the true problem, then we are defenseless to stop the problem.       As much as I like many things that Ron Paul stands for, there are several areas that I disagree with him on. I, too, would like to see the EPA, Ed. Dept., HHS, etc. disbanded, I think his foreign policy views are childish (ignorant of reality) and many of his domestic policy views too simplistic. Regardless of my views, Ron Paul will NEVER be president of this country. It’s just not going to happen folks! Sorry, but he is the most un-electable of the candidates. And the sooner you Ron Paul supporters come to reality and get on the bandwagon of a candidate that can actually beat Obama, there better. I think it’s going to come down to Romney and Santorum, maybe Gingrich. But I can’t stand Gingrich (too much of a Washington crony), and while I like Santorum, it looks like Romney has the momentum. Forget about Ron Paul. Is he doing this country good by bringing his issues to the forefront of our minds? Yes, but he’s not going to be president.

      So, when the EPA was first introduced no one thought too much about it. The only people complaining were the corporations, who most felt were just complaining because of their need to pollute the environment. We now see the EPA is the model of the progressives new government. How do you get around the Constitution, simple form agencies to implement restriction instead of laws.
      Every agency that creates restrictions that are not over seen by an elected official should be considered unconstitutional. Restrictions of freedoms guaranteed by the constitution are illegal.

      But yet we have the EPA, FEMA, Home Land Security and the TSA who can create new regulations on a daily basis without representation of the people. Just think of it, our forefathers were upset because of taxes and fought a war because of lack of representation, but we continue to allow the government to form these agencies to control more of our rights than our fore fathers ever would have allowed to be taken away.

      We have allowed the progressive socialist to steal our freedoms with regulations.

They want to get people in the Western States off of our private property because we are hard to control. The EPA has destroyed ranchers for river work 5-7 years after the fact.       A good reading of the 5th Amendment’s takings clause would do fine for that purpose. But, ummmm . . . that isn’t the current reading of the 5th Amendment in Supreme Court caselaw. The taking has to be all (or close to all) of the use of the property.

    I’m sorry that these folks are having to undergo this blatant abuse at the hands of big government bureaucrats. But there is a very big potential bright spot, if this case is decieded before Obmney care is it will have to potential to illustrate the consequence of bureaucratic over reach and abuse inherent with large government in general.
    Additionally, this article illustrates the very reason I’m for a specific constitutionally minded candidate in 2012, if Obama and his socialist buraceracies allow us an election that is.

    Dont get me wrong. I think the EPA started out with a virtuous purpose but these things either need to be declared prior to the sale of any land in very plain English (and I do mean English) or the EPA should have to offer to buy these lands back at current market value if they decide to reclassify any land. I think we need an EPA and it should be a strong one, but we need to break them up and start over! I wonder how much money they have made over the years by this? And I wonder where that money actually went

      I think you have it wrong. The EPA was sold under the scam of a good cause. It was meant for exactly what this article is displaying: depriving private citizens of their rights through a back door that, until now, has effectively kept their destruction of the constitution out of the hands of the courts.

      The EPA is a scam that has done absolutely nothing positive. Show me ONE positive thing this gestapo has produced. Just one….?

    The administration needs to be replaced, but in all the debates the Repubs are killing each other and giving Obama talking points for the general election, The Republicans are being handled by the Left wing press, The press is not looking for solutions and plans from the candidates, they are looking for “gotcha moments”. Conservative voters have to coilese to one candidate and focus on Obama.
    I mean which candidate will roll back all of these regulations, and which candidate will let them slide?

      Oh, I know why, that would mean that progressive liberal socialists could only speak when they have facts. The world would be a much quieter place, ah peace at last.
      For starters here are a few facts to digest, the term “Palistine ” comes from the word “philistine”, meaning gentile or Greek foreigner. In other words the “philistine people were like not even Arab, but likely Caucasian mediteranians. But since no “philistines” actually remain in that location, the world will never know. Secondly, the “Islamists ” want Israel to concede land, but both Egypt and Jordan also seized land the UN had “gifted” to the make believe state of Palistine. Where is your outcry that these two countries also return the seized land areas, WBTW are by far greater in area than what Isreal seized .
      Lastly, if I were lobbing rocks at your house, would you give me what I wanted hoping I’d stop lobbing rocks? If so, here come a few rocks, and I want your deed!

      Under what standards and measures does the EPA operate. What is used to determine if a wet lands is a wet lands. Under what law other than imminent domain can the government come in and tell you what you have to do with your lands. Remember this couple wasn’t dumping toxic waste. They were simply filling in their land in order to build a home. They weren’t filling in the land with 55 gallon drums of acetone. Does the EPA have the ability to determine what is a wetland? If so, why was this not done sooner. If it wasn’t important enough to do before why is it so important now?

      The EPA should not have direct authority as it does. Federal should have impact on state enforcement, not individuals or corporations. The way it SHOULD work, is that laws are made at the Federal level for the benefit of the U.S. and then the states enforce those laws. Look at it this way, there is not a federal police officer that stops speeders, or a federal officer who cites a restaurant for having a dirty floor. Do I believe that a company or person who dump’s poison upstream where my kids play on the river that comes through my property should be held accountable – yes, however, we have laws already in place for that – at very least manslaughter, possible murder if they where warned. Just like the restaurant that put my kid in the hospital, I would expect exiting laws to protect my child (i.e. the ability to pursue life, liberty, and the pursuit of happiness).

    This is one of the things that everyone sort of “laughs off” until it happens to them – when they get a letter saying the government has decided you live in a flood zone, and now need to buy flood insurance, or (as happened to me) after I bought a house near (not on) a lake, I was advised by a lawyer that my land was re-zoned and that I could not disturb the land (build anything) – the government didn’t feel compelled to share their plans or even tell us our property had been re-zoned.

    As Justice Alito said “that this kind of thing can’t happen in the United States” – but it does. Every Day.

      Everything is being done in secrecy. They are overwhelming the system, making new rules and leaving it up to the courts. We are being taken over internationaly and this is everything that you thought could never happen is going to happen. This is fundamental transformation we were promised.
