Supreme Court: ‘Obamacare’ Constitutional

The Supreme Court on Thursday ruled that President Obama’s landmark healthcare bill, including the controversial “individual mandate,” is constitutional by a 5-4 majority.
“The Court holds that the mandate violates the Commerce Clause, but that doesn’t matter [because] there are five votes for the mandate to be constitutional under the taxing power,” SCOTUS Blog reports. “The bottom line: the entire ACA [Affordable Care Act] is upheld, with the exception that the federal government‘s power to terminate states’ Medicaid funds is narrowly read.”
The court’s decision comes as a major defeat to those who have fought against the healthcare overhaul since before President Obama signed it into law in 2010. U.S. citizens are still legally required to purchase insurance via the federal government and the bill’s expansion of Medicaid, although now limited, still stands. This means roughly 30 million uninsured low-income Americans are still eligible for coverage through the bill’s expansion of the state-run entitlement program.
However, if it’s any consolation, the court also ruled that the Commerce Clause does not give the government the authority to compel Americans to purchase a product. So at least there‘s there’s that, right?
“I am disappointed with today’s Supreme Court decision because the Court has cleared the way for what looks like a very broad use of the tax power. But we can still be very thankful that the court has defended the contours of the Commerce Clause,” said Carrie Severino, chief counsel, Judicial Crisis Network.
Chief Justice Roberts was joined by Justices Elena Kagan, Ruth Bader Ginsburg, Stephen Breyer, and Sonia Sotomayor in upholding the mandate.
“Members of this Court are vested with the authority to interpret the law; we possess neither the expertise nor the prerogative to make policy judgments,” Roberts wrote in his opinion (page six).
“Those decisions are entrusted to our Nation’s elected leaders, who can be thrown out of office if the people disagree with them. It is not our job to protect the people from the consequences of their political choices [emphasis added],” he added.
Needless to say, Chief Justice Roberts’ opinion has shocked many people.
“Wow. So Kennedy voted with conservatives, Roberts with liberals. Umpire, indeed,” the Washington Post’s Ezra Klein tweeted.
In his dissent, Justice Kennedy said “In our view, the entire Act before us is invalid in its entirety.”
After hearing oral arguments on the constitutionality of the bill in March, the Supreme Court Justices focused on these four points:
- Whether the “individual” mandate is constitutional
- Whether SCOTUS has the authority to rule on a tax law even though it hasn’t come into effect
- If the individual mandate is overturned, will it be cut from the rest of the law as a separate entity or will other provisions fall with it?
- Whether the law’s Medicaid expansion is constitutional
Of the four points discussed, the Supreme Court ruled 5-4 that, as a tax, the individual mandate is constitutional. Under the Commerce Clause, it doesn’t work, but as a tax, it’s legitimate.
Several analysts predicted that if the court ruled against the mandate, it would have negative long-term consequences on the president’s legacy and would weigh heavily on his reelection bid.
It doesn’t seem that way now.
Chief Justice Roberts, whose vote saved “Obamacare,” announced the court’s decision at 10:07 EST.

Nobody should be too surprised at this ruling. The Supreme Court has been ruling unconstitutional acts as constitutional for decades. The horrible effects of the Bush family are vile and long lasting. As luck would have it, Mitt Romney has filled his team with dedicated Bushites. Since Obama is Bush on steroids and Clinton was no better… no matter the outcome in November, we will be looking at a seventh term for the dreaded Bush dynasty (ninth, if you count the mess George Senior made as VP for Reagan). My comments are taking too long to appear. I had posted another comment before the one addressed to you, saying exactly the same thing in re Roberts. I KNOW he was pushed against the wall, and a knife was held to his jugular. He’s the CHIEF Justice, for crying out loud.
I’m not giving up, but I am reminding you that the normal channels to effect change were officially made null and void today. We can‘t fight back if we don’t face reality. Our Restore America Plan has to factor in that monumental fact.

This is a death panel decision-period. I am both disgusted and outraged at that traitor John Roberts for siding with the other liberal justices at allowing the federal government to dictate to us-something that our Founders had tried to ensure against happening. This will be the largest tax increase in our histort-contributing to our downfall of our individual freedoms. As the bill is enacted, more evidence will be brought to light that this allows government intrusion into our every day lives. Mark this date down as the day America died.

No; Roberts has nasty skeleton in his closet, they found it and held it over his head. That’s why he voted progressive twice in one week. I spent yesterday listening to the March 27, 2012 SCOTUS debates and Roberts was against Onamacare. Now he’s for it. Ron Paul can‘t tell SCOTUS what to do and he definitely won’t do anything to protect us against the Muslim Brotherhood and Sharia Law.

You really are clueless. Let me give you a real quick run down. The vast majority of Docs do not take medicaid. Be my guest and call around and ask some in your area. My group does not take medicaid. It will be cheaper for business to not pay for health but to pay the fine. You will be kicked off your current plan and be forced onto an exchange or medicaid. The exchanges are being set up to use medicaid or medicare guidelines. Good luck finding a primary care provider. I will cut/fire staff in order to close the gap for the money I loose by not taking on these new patients.
Our clinic has medical students that rotate through. So far this year, not a single student was going into primary care. Again, good luck finding a primary care provider.

This is only a “victory” for Obama in that the repeal would have been a major loss. By winning he keeps the same position… he doesn’t gain any ground. He blatantly lied about the individual mandate by saying it wasn’t a tax.
As for the rest of the hyperbole, no, I do not think millions of jobs will suddenly close up shop because of this. Remember, Obamacare has continued all during this case; it’s never stopped. Nothing is different today from yesterday; Obamacare is still the law. If a business didn’t close down when it first passed, there’s no reason for them to do so now.
That said, it‘s still a terrible freakin’ law, and I agree with the dissenting voice: this shouldn’t be Constitutional. It is, but it shouldn’t be. Bah.

So now the government can tell us all to eat salads and brown rice, basically rabbit food and drink water other wise “No health care for you”? Better yet how soon will a panel be formed to determine who gets what health care..you need a liver? you drank alcohol most of your life, and your 55..no transplant for you! Grandma needs a knee…what is her worth to society, what can she do to repay society for it…be a Walmart greeter? This election was about the Constitution. I know everybody thinks it was about the economy or the middle east but it wasn’t. This go around we had a chance to get back to the Constitution but we voted in accordance with the talking heads. The establishment knows where America stands now.
We don’t want our Constitution any longer. We want a mastermind to fix everything. Romney is just as big government as Obama. He may not be marxist and he may be a good businessman but he is still BIG GOVERNMENT.
His speach the other day talking about Obama doing this and Obama doing that was replaced with I‘m going to do this and I’m going to do that.
Bush was another example of BIG GOVERNMENT.
We didn’t cry un-Constitutional when he signed the Patriot act. Is that due to the “R” next to his name instead of a “D”?

I agree with just about everything you are saying. The only problem is that Ron Paul doesn‘t have a snowball’s chance in he11 of winning. The fact is that Romney and his money machine WILL be on the ballot. If RP goes 4th party (Gary Johnson is already 3rd party) Obama will win.
And I just can’t take another 4 years of Obama. I’ve only had one 10 month long (contract) job since BHO won in Nov 2008. I have 2 companies that are (were) considering hiring me. They were waiting on the result of SCOTUS today. I don’t expect to hear back from them now.

My suspicion is that many were counting on the SCOTUS to defeat Obamacare and now they see they’re only option being the removal of Obama from office. Not only the base but the fence sitters will now galvanize to Romney. My gut tells me the Tea Parties will get a lot more active as I’ve already been getting phone calls for donations.
Meanwhile…Obama now has to explain one of..if not the biggest..tax hikes in the nation’s history. He can’t say “per se” anymore. He can‘t deny it’s a tax anymore. Roberts handed Obama a steaming pile of sh#t to doubletalk his way through.
Time after time Obama told the nation that anyone earning under $250K would not see their taxes go up “one dime”. Well…it appears anyone not paying federal taxes and/or not covered by insurance just saw their taxes go up today. Now to you and me…we knew this was the case already..but now Obama can‘t deny he’s raised taxes on anyone earning under $250K.
Roberts (whether consciously or not) has put Obama and the democrats against a wall.

By doing so -and by further complicating the states’ medicaid obligations -he’s made a bad situation worse legislatively, and handed Obama a steaming pile of dogsh#t to spin for the next five months. But of course Roberts was careful to include that his decision wasn’t reflective of the “wisdom” of the law..just the constitutionality of it. Well of course..once it was moved to a different area all of a sudden it was “constitutional”.

That means as of next year, my son will no longer be getting his surgery to treat a medical condition because I will no longer be able to AFFORD IT! In ‘14 my employer will be dropping insurance because it’s cheaper to pay the penalty than to offer what the government says they must. So my family will get in this pool of crap plans that cover much more than we need, so insurance will be less AFFORDABLE for my family. HOW DOES THAT HELP ME?? Answer: IT DOES NOT. The doctor could provide a lifesaving operation, for say, a Car or half of your coin collection.
I think that 2/3s of the Doctors leaving the profession is a good thing. They can still use their talents to freelance and still be very wealthy.
We MUST eliminate the Middleman (i.e. socialists, facists, marxists, global elite, control freaks and the like.)
It is time to buck the establishment until we can replace these criminals with real representatives of the people.

I canceled my insurance when this bill passed. And I found out something amazing…by putting what I paid to premiums in a savings account and paying cash for services, I pay WAY less for health care. Most providers offer cash payer discounts (usually 1/3 of the cost of what the insured pay). When I had health insurance, I had premiums, deductables, and copays and I ended up paying more. Now that I pay cash, I have an interest baring savings for health emergencies and control of my health decisions and I will not let the government take that from me.

You absolutely nailed it. Obama won his mandate, and now has to face the rest of election season listening to soundbites of him eating his own words.
IF it had been turned over today, it would have been a huge blow to his campaign. As is, they avoided the nuke… but are still going to have to deal with the fallout. I still don’t care for Romney, but I must admit I’ll look forward to seeing Obama squirm every time someone presses him on his new “tax.”

What I believe he was saying to us is there are consequences to elections and it’s not up to them to fix our mistakes. If we don‘t want to deal with this kind of nonsense in the future then we’d better send in a better crop of people to respresent us.

1st-CJ Roberts clearly lays out Gov cannot force you to buy anything. That rules a Federal mandate unConstitutional, as it should be, and finally squash the attempt to expand upon the commerce clause in the future.
2nd-CJ Roberts properly defines the “penalty” for what it is, a tax. Each and every one of us have deducted our house, medical expense, a child birth, etc from our taxes. In doing so, we pay less in taxes than those who did NOT do whatever it was we deducted. That same principle applies here. If you choose NOT to buy healthcare, you pay a tax. If you buy healthcare you *deduct* that tax, paying less.
3rd-By properly ruling, he brought forth the reality to each and every one of us that Obamacare is a great big tax, that Congress can tax how they want according to 16th amendment and that it is our RESPONSIBILITY to elect Reps/Sen who will not tax us to death, if we do not want it. That both parties have been doing this same thing for YEARS.
I think ObamaCare stinks. It’s horrendous but CJ Roberts was appointed to rule according to law and that is what he did. Obama did not want to call it a TAX, why? Because we’d reject it even more. Judicial activism would be to declare it as something it isn’t, CJ Roberts did his job by calling it what it is, a TAX. Let’s do ours…

If we want to kneecap this tyranny in the making, we need to draft a constitutional amendment. Something along the lines of “There shall be no law or tax that compels, by non-criminal means, behavior that is otherwise protected from criminal prosecution.” I’m sure we need to have a lawyer or 100 refine it to remove any outs for the government, but the alternative is… horrifying, and apparently more and more necessary.
I’m agnostic, but I‘m praying to whatever got that may exist that we don’t need to resort to the true last-ditch of liberty, and for the strength of character to do the right thing, if we do.

This is not the first time government has forced citizens to buy insurance.How many here are old enough to remember back when we were forced to buy mandatory auto insurance.Yes boys and girls,there was once a time in this country when people drove the highways and byways without any mandatory liability insurance.Of course the mentality was different then.But was it different because of,or in spite of,the fact that people weren’t forced to buy insurance.Today you can’t drive a new car off the lot without first purchasing auto insurance.
These big government types are very patient,they’ll implement something small,like mandatory auto insurance,then once everyone becomes conditioned to it,bring out Obamacare.Not many years from now the next generations will look back,much like everyone does today about auto insurance,being conditioned to Obamacare,and wonder how people ever lived without it.

However, EVERY AMERICAN CITIZEN has to purchase insurance or you have to pay a tax. So you are wrong in saying that this is the same thing.

As we all know Congress is not subjected to this law. This means Congress is not representing us because what they have violated the constitution by passing this law in the first place. Have you ever read the Obamacare law? The entire thing? Until you have, you are only following the Party Line. I have read the entire thing, and it is scary.
It is not just health care. It determines who can get federal financial aid and determines what they can study if they do qualify (so much for freedom of education). It allows the government to access your accounts and remove money for any reason at any time (so much for freedom of income). If you are too poor to qualify for health insurance, it will penalize you with taxation to push you further into poverty.
So, what happens when the amount of health care costs, food stamps, and financial aid becomes more than the amount the government takes in taxes? What will we do then? We can’t borrow any more money. Printing more money doesn‘t fix it as we don’t have anything to base the money on. What happens?

The court did not strike down previous court rulings dealing with contract. This court ruling is incomplete (which is a surprise) that will force a contradiction in law (google rulings force contract signing). It IS illegal to force a person or company to SIGN a contract. So thus, this law requires the individual to be taxed if they do not enter into a contract with a private entity. Explain yourself out of that one.

This ruling now requires a contract under duress which is over a century old law. Will be interesting that they just opened themselves up to contract duress issues.

This will destroy the country…all healthcare from an employer will now be dropped….companies will pay the “tax” instead of providing care…people will pay the “tax” and then get sick, get insurance since no pre-existing are allowed, then drop it right after….the government will be stuck with a $1 Trillion deficit every year this holds…on top of the $1.3 Trillion deficit already running…this will bankrupt the US in under 5 years….

This is a very mixed victory for the left. The “mandate” has been upheld for the very reason the administration claimed it was not: a tax.

Poll after poll has shown that if you simply ask people if they support “Obamacare” many oppose it, because most of them don’t even know what it means; it’s become just a Conservative catchphrase for something evil, like Socialism and Communism. When people were told what the bill actually was (expanding healthcare to those who can’t afford it, people with preexisting conditions being allowed to buy insurance, etc), the numbers flipped, with a majority supporting it. Just goes to show you: the most effective tool of Conservatives is ignorance.

In contradicting the “Preezy’s” oft-repeated statement that “this bill won’t raise taxes” by declaring that the so-called “buyer mandate” is actually a tax and thus Constitutional, Chief Justice Roberts has very possibly subtly destroyed MR. Obama chances for re-election.
Remember how MR. O swore up and down there would be no new taxes? Well, shucky darn and lo and behold – all of a sudden it IS a new tax ( perhaps several new taxes ). Who’d a thunk it?
Now if I were O’s opponent in the upcoming election I might just keep this little tidbit of information in the forefront of all my campaign speeches and political media advertisements, along with any other bothersome little details of the provisions of the bill that would adversely affect the average tax-paying American.
Any bets on how Independents and Democrats are going to react to this new tax come election time?
That sucking sound you hear is just the Democrat Party imploding under the weight of their lies and corruption.
