SWAT Video Captures Officers Firing 71 Times on Former Marine Questions of excessive force are once again being raised, this time in Tucson, Arizona after a SWAT team fired over 70 times at a 26-year-old former Marine during a drug raid that has yet to turn up any evidence against the now deceased soldier. Questions are also being raised after the SWAT team changed its story, first saying that Jose Guerena had fired on them, but later retracing that. A new report says Guerena’s gun was never fired and never taken off safety. And now, video from the team shows the deadly raid:


KGUN-TV explains what happened the morning of May 5:

As the SWAT team prepares to serve their search warrant on Jose Guerena’s home one of the first things they do is turn on their sirens. After eight seconds the siren is turned off and we hear the team announce their presence.

“Police, search warrant open the door,” an officer screams on the audio file.

Moments later the door is busted open. The video shows officers start entering the home when shots ring out for a full seven seconds nonstop. An officer is seen falling out of the doorway as the shooting stops.

The team backs out of the house, unknowing they had struck the suspect. They use their PA system to call out to anyone in the home.

“This is the Pima County Sheriff’s Department we need you to come to the front door with your hands up.”

Five minutes after SWAT arrives, evacuations of the neighborhood get underway. In the audio it’s clear the team begins to regroup.

“Everybody relax at this point. Whoever was up at the door, do a quick check of each other to make sure we‘re covered and we’re good. Make sure no one has got holes in them ok,” an officer said.

According to the Daily Mail, the officers originally claimed Guerena fired on them. But a police report later found that to be false:

A police investigation revealed that officers fired more than 70 shots.

Deputies said they opened fire after Guerena, 26, gestured at them with an AR-15, according to the report.

Some of the officers said they believed that Guerena fired on them, but the investigation showed that no shots were fired from the weapon and it was never taken off the safety position.

Police allege that the former Marine was involved in drug smuggling, robbery and human smuggling.

But a search of the home found nothing illegal. Officers found a handgun and body armour in the house.

The five SWAT team members remain on active duty. No criminal charges have been filed and no disciplinary action taken.

Mr Guerena’s wife, Vanessa, said she heard her husband moaning as he lay dying, his body struck by 22 of the bullets.

Ms Guerena told ABC News: ‘I saw his stomach, all the blood on the floor’.

She said her goal now is to ‘clear his good name’. Ms Guerena said their son Joel keeps asking about his deceased father, ‘Is he a bad guy?’

A lawyer for the SWAT team defended the officers’ actions, saying it’s clear that the team announced itself and gave the victim a chance to respond. When they saw a gun, they had to respond:

“In your opinion, is this now cut and dry once you see the video?” KGUN9 asked. “Yeah, you watch the video and clearly you hear sirens, you see them (SWAT) approach, you see them knock and announce several times. Clearly, anyone in the area will know police were there,” explained SWAT lawyer Mike Storie.

And, lots of them, SWAT admits to firing 71 shots in just seven seconds. After the shooting, the Pima County Sheriff‘s Department Lieutenant Michael O’Connor explained that number of shots, “They’re going to fire until the threat is over. (SWAT) fired in seven seconds.”

And, Storie told us there was a threat; a gun pointed right at them. The deputy to the right of the shielder, Storie said, saw it first, “The person above his right shoulder will be the first one who is looking down the hallway who will see the gun turning the corner and being raised towards them.”

      Before you slander this guy, read all the evidence. The guy was sleeping (midnight shift) and woke up to armed men in his house soon after his cousin was murdered by a hit squad in a similar fashion.       I think it was racially motivated. If this Marine were black this would never had happen. This would not have been allowed in Iraq or Afghanistan but in America its OK. We are really at war with our own Federal Government.

    This is awful especially for the wife and a now fatherless child. Hopefully the truth comes out but I am tired of the shoot 1st ask questions later policy on warrants these days. Prayers for the family, the officers involved and restoration of our 4th ammendment rights. Whatever happened to those flash grenades and smoke bombs they throw thru windows to dissorient people. Would have saved a life here

    That entire video, from the time they dismounted the vehicle to the time they fired 70+ shots through the front doorway, took less than a minute. How much time did they give this poor kid to answer the door in that time before they broke it down?

      Exactly, I generally tend to not point guns at SWAT officers because this exact thing will happen. When he was deployed and people were pointing guns at him he would have had to do the same thing.

      @Mahakala: That’s sheep-speak. Arming yourself in response to violent home invasion is precisely the right thing to do.

      They should had the exits covered and the perimeter secure. Why not start with a sheriff’s deputy knocking on the door and having an adult conversation before jumping straight to door-kicking and small arms? At best, this is a serious screw-up. Whomever was responsible for handling this operation needs their hides tacked to the wall.

      @conversationcanwork: Your alias is right on. This guy’s kids would still have a father if, instead of door-kicking, the police would have simply knocked on his door and asked to speak with him. Guerena was asleep when these guys decided to kick his door down. He worked nights. It is perfectly reasonable to expect someone to arm themselves after having their front door kicked in with little-to-no notice. I have read multiple stories on this and I don’t see any evidence the police involved made a meaningful effort to contact Guerena and identify themselves. The police initiated violence by forcibly entering Guerena’s home. We wouldn’t be having this conversation if they had simple secured the perimeter and peaceably established contact with Guerena.

      So, in other words, you’re basically saying that Jose Geurena should have just allowed the SWAT Team to break through his home and not defend himself from that violent, unjustifiable home invasion? Farlo MD is absolutely correct here, those are words of a sheep that you’re using. Even if Jose didn’t reach for his firearm, the outcome would be the same – a body dotted with bullet holes.

    The police did everything by the book. Moral of story. Don’t point a gun at the police doing a search warrant. Once the rifle was brought into play by the suspect, someone was going to die.

      do you really think it was that simple ? ..was he running a huge crackhouse that was an immeadiate threat ? ..look around at the neighborhood and time of day ? they were just looking ?there were no warrents ? Why didnt they pick him up during a traffic stop or when he walked out to get some milk ? Is this how it starts ? …..this is not a well run SWAT . May the lord have mercy on our Nation ….

      Well, it wasn’t going to be the police, since the Marine was actually trained on weapons use, use of force, target identification, etc. This was why the Marine’s rifle was still on safe.

      I agree, well said from mahakala, it seems as though the big shots in charge of this and other operations already have their minds made up. there protocal is set. what bothers me is why they can’t talk at someone. reason with the person for a few seconds. or minutes. who knows, maybe if those by the door didn’t start shooting the kid could have tossed a gernade at them? i don’t like seeing action like this going down. However the guy was no good if he was commiting these crimes. A former marine and human smuggling? that’s not good. that is not protecting citizens against all enemies foreign and domestic. He has issues or had issues. Now he has an issue that never will go away.

      You’re ASSUMING he pointed a gun at them. If you read the article, after an investigation, there was no AR-14 style weapon found, only a pistol and some body armor which anyone who has ever served in the military would own. This is nothing out of the ordinary. They didn’t find a gun on his person, either… just 22 bullet holes.

      The book is wrong. If someone breaks down your door, (LE or not), you have a right & a responsibility to defend your home. In your home, you have a right to point a firearm at anyone, at any time, should you feel the need. The fact that the Marine didn’t get any rounds off, proves the cops were wrong in firing. People, the police cannot just kick down doors & shoot “suspects” without being fired upon FIRST.

    My cousin is a member of the team involved in the raid. According to him, the suspect reahed for an assault rife and then the shots rang out…many of the shots were without aim, just shooting randomly into the house.

      Ok, I’ll try it this way.

      Conducting a breach requires commitment to purpose, what you see in this video is a lack of commitment.
      The entire element (the COPs) stall at the breach point and set themselves up as multiple targets this is known as the fatal funnel the dangerous area where the assaulter is silhouetted against his own entry point from the perspective of defenders inside the room.

      Again by the video this is exactly what happened, this is common with untrained people who have no commitment to the elements of CQB.

      Surprise, speed and violence of action, Had this SWAT tm committed to the breach there is little doubt this man would still be alive, along with all the cops.

      @ RTLW: you took the words right of my mouth! I would add that, the number of shot fired is not at all unusual and for good reason: multiple officers are seeing the same threat and reacting at the same time. Example: if five officers see the same threat and engage, each firing 10 times, then 50 shots being fired. If only 50% of those shots hit their intended target, then you have a threat that has been hit 25 times, yet the public can’t seem to do the basic math on this and instead, cries excessive force. You NEVER shoot to wound, only kill. The supreme court has ruled that the deployment of SWAT in and of itself is considered use of deadly force. An operator (or any cop) isn’t going to wait around for the subject to point a gun at them. If the subject even has one in their hand, then it’s lights out for them. Lastly, let‘s not forget that it’s the investigators who obtained the warrant. It’s the job of SWAT to execute it. They are told who and what to look for and must rely on the accuracy and integrity of the investigators findings when executing the warrant. Nearly all drug related warrants are considered high-risk due to the high probability that the subject will have weapons. A nice polite knock at the door is not an option: speed, surprise and violence of action is SOP for this. They close ranks to cover guilty officers, If any good officers remain, they are intimidated by the others to remain silent. But, defend yourself or your family and kill one of these JBTs and you are charged with capitol murder of a police officer!

    Jose Guerena was set up. Some one want him dead. There needs to be a investigation into what he did in the Marine Corp and what type of operation he was on.There should be a major investigation into where the police got information for this raid. Something does smell right about this.

      Wonder about the sound bite at 16-19 seconds in of: bang, bang, bang, bang………before they broke in the door!! DO NOT like the no drugs, no evidence! Seems to me, if a former Marine had a gun in his hands at all he would certainly take the safety off…..otherwise why pick it up in the face of force??? Too much adrenaline??????????? When that first shot was fired, it was chain reaction…..Sad Outcome!

      Not a real brilliant plan, hope this ****** off all Marines. As a family member of 3 Marines, I can assure them. It can be compared to messing with a Grizzly Bear using a twig.       NM Section 30-2-7, Printed out and posted on my fence some time ago, a couple others wanted copies and they put it up on their fences… neighbourhood became a lot more quiet. Guess the local tuffs decided to play that loud bass someplace else and have not had any ‘problems’ since 2003, knock wood… Cops asked me about the poster one day at the local diner, told ‘em we were providing a public service. Never questioned about it again. They took note of my openly carried sidearm and that of the others in the diner that were also armed. An armed society is a most polite society.
      -AK, AZ, WY right to carry states, NM is open carry/Concealed carry w/permit. All the states need to adopt constitutional right to carry.
      -The FBI released its Preliminary Annual Uniform Crime Report for 2010, showing a decrease of 5.5 percent in the number of violent crimes brought to its attention in 2010 compared to the previous year.
      Why the decrease? Could it have something to do with the largest surge in firearms sales from late 2008 into 2010 in US history?!!? An est. 12 MILLION weapons were sold to citizens, 12,000,000…
      -The sheep are arming, why?!?
      -With 6 million unemployed to exhaust benefits this year, time to pay attention to your surroundings and the people around you.

      I think everyone is missing the point, swat showed up armed and ready to go, not a couple cops with a warrant. Probable cause didn’t lead them to my house, or to the little old lady down the street, the marine was wrapped up in something, or we wouldn’t even be reading the story.

      They could try this because you have an outstanding traffic ticket!

      They did this because he is a former marine and may have a firearm!

If the country had a population that was as self reliant and free as it used to be, criminal activity would be nothing compared to what it is now….because criminals would know their a.s.s would be shot or hung from the nearest tree if they tried and BS.       The more I look into this story, the more it makes me sick to my stomach. I have a relative in Tucson who owns a gun because of the home invasions. It’s must have been so frightening for the wife, who lost family to a home invasion, when she feared it was happening to them. Her husband was just trying to protect his family. The SWAT team made a horrible mistake.

      This is very sad…Remember that “Patriot” Act and the extensions just passed, well, this is related…

      Yes, any law enforcement was suppose to notify the individual/household a search and or seizure warrant is being enforced. If the door is not opened and suspect is inside knowingly not abiding to such warrants, law enforcement can use a forceable entry. 

      Due to the Progression in the mindset of Government and people, all law breakers are pretty much considered terrorists. Thus the reason SWAT is sent to execute the warrant. 

      This is what happens when you give Government to much power. Government uses it on you. 

      Supreme court case King vs Kentucky (8-1 ruling) is the case which curtailed the 4th amendment allowing law enforcement to break into any house, warrant or not, based on reasonable cause of entry. If a law enforcement officer smells drugs, hears scurrying, etc they can break in. In a similar case of Indiana Supreme Court, the State Court ruled in favor as well, siting the Peoples ability to sue Government agencies would lesson officers to break in unless really needed…BS

      We have lost a lot of our Liberty and it continues slowly everyday..QUIT voting Progressives (left or right) into office…Wake up!

      Would love to have evidence of what the officers saw inside the house. My guess is that they had a history that included “Ex-Marine”, “drug smuggler”, and “human trafficker”. They had to be on edge approaching the house. If the Marine was holding the weapon when they broke the door in it could take less than a second to be fired upon. The officers’ state of mind has to come into effect.

      Over-reaction, but I can completely see why it might happen. You don’t answer the door to the police while holding an assault rifle. That assumes, of course, that the report is factual; they did already fudge the part about shots being fired.

      I’m kinda surprised to see the hate against police here. I guess I expected to see people be supportive. Maybe it was the “former marine” label. If the title said “accused drug smuggler armed with assault rifle” I feel the reactions would be completely the opposite.

      Really? Why not? It’s not their house. They do not have a right to enter the house until they have served the warrant. Breaking the down in and then serving the warrant is the norm now. The fact they found absolutely no evidence of any criminal activity just means they haven’t had a chance to plant evidence and cover their mistakes.

      Police are humans. Frail, corruptible, just like the rest of us, and the founders knew that and wrote certain rules for them not to break called the Constitution and Amendments.

      Stupid, idiot, lazy Americans give the police way too much power to invade their lives at the whim of the police. All so the regular citizen can go on being lazy and feel safe, even though he is never truly safe. Wake up people. See wrong doing when its staring you in the face and don’t make excuses for it.

      Another success story for the “War on Drugs.” This is out of control.. Here in Portlandia the Police are feared.. They have a reputation for shooting first and asking questions, well, never.. They’ve killed several times, unarmed, and in some instances, non threatening, citizens, and are yet to be held accountable.. One victim, a 16 year old, drunk, standing in front of his parents home, armed with a 3 inch pocketknife.. He walked toward the front door of his home after police shouted for him to get down, and they killed him.. His Mother had called the po-po‘s to come calm him down saying he’d been drinking and was beligerent.. They calmed him way down.. His poor Mother was on the news saying, “He just needed help. Why’d they have to kill him?” Good question..

      There is something hinky about this story. First there were drugs, then there were none. First there was human smuggling, then there was none.       No justification for this crap in any way shape or form. Personally I think those SWAT teams go in hoping for a chance to do combat.

      2 things: Am I the only one that listened to the sound track and just as the siren goes off and the door knocking begins, there is a faint voice saying “bang bang bang bang” that could only have come from the man wearing the camera or someone very close to him?

      2nd thing: They shoot until they know the threat is over, fired 71 times and only hit the target 22 times? Where did the rest of the rounds go? Who else in the house was threatened with bodily harm or death due this reckless gang banging? The inside of any modern home has no resistance to a rifle bullet at all, you can shoot right through any drywall, even multiple layers of drywall, including some stud as well. It is a miracle that no one else was killed.

      This is government run amok.

      What bothers me most is that in my lifetime Swat has gone from being
      called in, for hostage/violent situations, to being the NORM for serving an arrest warrant.

      They could have simply surrounded the house, and loudspeaker and telephone ordered him to surrender. IF he then chooses not to comply, then go greenlight on his butt.
      even if he was guilty flushed “evidence” can be retrieved.
      Robbery stuff would be in and around, and well human trafficing evidence would be as well.
      There was no need.
      Given his military training, they are following Big Sis’s assessment that ex-military are a grave threat
      to the US. which is utter BS leftist propaganda.
      This guy was going no where, it SHOULD have been orchestrated differently.

      One of the team is fiddling with the vehicles door and sets off the alarm. Was the warrant for the house or the car? I am pretty sure that part of the element of surprise does not include leaving your sirens off, sneaking to a residence and then setting off a car alarm while the other team members are not aware of your actions.

      What would you do?
      You are sitting at home and your car alarm goes off, people come to your door and you do not know if these are real or fake officers. Do you grab a gun or welcome them in.
      After living in AZ it is common for smugglers to find houses of those that are not home and hold many, many people in them. They will take them by force also.

      Same thing as muslims and muslim EXTREMISTS. If the normal muslims wished to distinguish themselves from that institution, they would take a stronger stance against the atrocities of that institution in order to drive out the extremists, or they would distance themselves from that institution in order to preserve their own integrity.

      but…
      IF the police were chasing a CRIMINAL outside of Guerena’s home, it would sound exactly the same – sirens, police shouting, etc. If they were announcing a warrant to the neighboring apartment, it would sound exactly the same. If the CRIMINAL were breaking in your front door to get away from the police, it would sound exactly the same.
      What I would like to know is…
      DID THE POLICE SAY HIS NAME so he knew they were there for him???
      If not, he could have very possibly have simply been defending his home.
      He DID put his family in a closet, as anyone would.

      What I do know is, we do not have all the information.

      Why only NOW do they have a video? This happened two weeks ago. Something stinks to high heaven here. And this is the same sherrif that allowed the congresswoman to be shot. Decorated Marine shot down in his own home in front of his family, with no evidence of criminal activity, and nobody has even lost their job over this? This country is quickly becoming very much like Nazi Germany, or any other run of the mill police state.

      You stupid idiot! This Marine veteran was sound asleep when his wife told him that there was a man outside pointing a gun at her! He took up that rifle not knowing who was about to come into his house or why and I’m willing to bet the reason that he never fired a shot and his weapon was on safe was because he heard the siren, recognized the tactics, and recognized the all black swat uniforms and wasn’t going to shoot anyone! The members of this swat team that entered this MAN’s home and MURDERED him need to be executed by the state. I wouldn’t feel safe with any person like that in my society.

      BTW, I am a 26 year old Marine Veteran who owns guns and has a family. I would probably have done the exact same thing in that situation. Now that I know what will happen though, I will shoot first and refuse to ask questions regarding ANYONE who enters my home without my EXPRESS PERMISSION. I will not be shot dead in my own home as my wife listens to the bullets rip through me and ricochet off the walls of my home.

We saw what the Union Thug police did in Madison, Wisconsin; they attacted TEA demonstrators and helped the Union Tugs create $7.5 million in damage to the State House. The police are no longer on our side.

      Just so every one knows – This guy was just sleeping after getting home from a graveyard shift when his wife woke him up saying some one was pointing a gun at her through the window. He reacted by grabbing his gun and heading towards the door when they busted it open and shot him… He most likely thought it was a home invasion since they are not uncommon in Arizona, especially in Tuscon. I’ve heard a few first hand stories of these home invasions, and knowing how bad they can be, this guy reacted in the right way – He would have needed an assault riffle to stop them and protect his wife and kid… I’ve also personally had the Az swat team show up at 5 in the morning with one of these warrants for some one who did not live at the house anymore- they woke me up and came in the house with guns drawn before I could even put my shorts on – I had no idea who they were or what was going on. and we were all lucky I did not have a gun.

      The article says he “Gestured” an AR-15 rifle… okay just what the hell does THAT mean?
      If I were to bet money, i would say that he probably had it in his lap, (for whatever reason). The police bust down the door, they see the rifle in his lap, Guerena flinches, twitches or even blinks and some amped up SWAT guy shoots, then everyone else starts shooting.

      THen again the police let the sirens go for several seconds so as to announce their presence… so why did he have a rifle in the police are obviously right outside?

      I dunno….It’s all FUBAR. A lot of things are not adding up with this story. Bottom line, this did NOT go according to plan for the Dept and now they are scrambling to clean their hands… and in the process just making a bigger mess.

      You guys are only up in arms because this man was an ex marine. If he was not ever a soldier you would be totally cool with it, probably even praising the swat team for removing a dangerous criminal. Get over yourselves, this is no a police state. This man was accused of breaking the law. Obviously they had some reason to call SWAT in on him, they don’t just do that for the fun of it. And when SWAT comes in your house, you get down. Because they don’t play around. If they feel they are threatened they take you down. Same thing that they do (or should do) in the army. If a soldier feels like someone is trying to hurt them, they WILL shoot first, and ask questions later.

      In my home, I’m perfectly within my rights to answer the door with any damned thing in my hands I please.

      If the police have a search warrant, there’s no reason I should retain my weapon while they search my home. This was a clear over reaction.

      If this former marine has a criminal history that includes violence, that might mitigate the situation. If not, it doesn’t matter what the suspicion is, he’s INNOCENT UNTIL PROVEN GUILTY.

Why do the Police storm houses like this to present Search Warrants. There are kids in these houses. They could knock on the door POLITELY to see if anyone comes to it at first in civilian clothes. Covered by a sniper!! Many times during these raids only a bag of weed is found. The Police have a tough job and face evil for sure. But this type of storming the compund sets up violence.       Dude, neighbors 4 doors down from me had US Marshalls break down their door last summer because they received a “tip” that they were running drugs out of their house. Luckily when the Mashalls saw my friends wife huddled in the kitchen with her 3 & 5 year old daughters they scaled WAY back. turns out it was all just a big “misunderstanding”.

      So don’t be so fast to say “They were there with good reason!” Yes they could have been. OR they could have been there on a “tip”. And No, if this was just some joe-shmoe non-marine guy I would still be tweaked about it because the cops opened fire FIRST, the victim never fired a shot and even had his weapon on safe. THEN they cops give conflicting stories… yeah there’s something amiss period.

      how easy would it be to do that.. set off someones car alarm, you know they are going to grab protection and be on high alert… you know they are going to have a gun pointed at you if they have one, they said AR-15, there wasn’t one. there was a handgun, was it even registered to him? probably not, probably was a ‘drop gun’.

      Another important fact is that SWAT is taught how to disarm and immobilize it’s targets… one of them could have easily shot him in the arm or leg. plus which one said “put the gun down and your hands in the air” ? none of them. not one of them even said “he’s got a gun”, it was, bust the door down, move in, unload weapon. straight up murder.

      I wonder if the swat members that entered had helmet cams? I wonder how it is they can do this and get away with it, and yet when Border Agents shoot known drug traffickers on the border as they try to run from authority, why it is they put border agents in jail? So what if the guy had been in the shower, would that little bit of time they gave him be enough to dry off, throw on pants and come to the door? I don’t think so. What if he had on head-phones listening to loud music, and he finally turned down the volume, would that have been enough time? I think it comes down to the arrogance of a police state, harassing it’s own citizens more so than known criminals coming across the border.

      This makes me utterly sick to my stomach. These guys had body armor, head to toe, all the experience in the world, and they felt that just seeing a gun gives them the opportunity to empty their magazines into one man, armed with a single pistol?
      And on top of that, NO EVIDENCE HAS BEEN FOUND??

      They had to know he was suffering from PTSS, and the best strategy would be to arrest him at a “normal” traffic stop where they could better control his weapon, if he had it on him. THEN go search his home. This sounds more to me like a cowboy operation and a completely disgusting last of professionalism from these COWARDS.

      I find it amazing: we live in a system whereby the Court orders California prisons to release 37,000 inmates because of over-crowding of which I just know some of them had more serious crimes than this Marine, swat shot to death, and to make the prisoner release in California even more dire, a reported computer glitch (yeah right) caused California to release a probable 450 violent criminals. Then I ask: what in the heck is this swat doing?

      The weapon being on safe tells this old marine that he did not intend to fire, and therefore was not pointing the weapon at SWAT. Vets flip the switch as they bring up the weapon, as this fulfills two safety rules…keep the weapon on safe until you intend to fire…and never point a weapon at something you do not intend to shoot. If this is true, and I firmly believe it is…they shot a man simply for holding a weapon in his own home, if he was even holding it.

      This is the bottom line, regardless of your opinions of whether this was the right or wrong actions, AFTER they kicked in the door.
      We have a 4th amendment, well, we HAD a 4th amendment, and it wasn’t followed in this situation. In fact, State Supremem Courts around the country, including very recently in my state of Indiana, have made that amendment null and void. It was put there for a reason by our Founders, because this behavior was EXACTLY what they were experiencing under Brittish rule: Warrently harrassment of the citizenry. If we don’t stand now against our court system, which on the surface seems impenetrable, we will all be bound slaves to the government. As I understand it, anyone who has a case against a judge OR a member of the Executive can file impeachment charges with your Distict Attorney, or maybe the State DA, not sure where you have to go, but it doesn’t have to start in the US Senate. If you have a greivence, you personally can file for hearings.
      Look it up, I’m not real clear on the legality of this. I’m sure we can all find a Constitutional lawyer that can clear it up.

      8 seconds… Really! Give a man a chance to see who is really there before you BREAK his door down and threaten his family. My STUPID state recently said that police can legally enter a house without a search warrant. Let me think. They knock… I get off the couch… see several men outside… grab my gun… AT LEAST 10 seconds pass. Give a man a chance to call 911 to verify the warrant. How ’bout that! There are so many cases of people impersonating officers… I always verify identities.

      First off i wasnt there! Second the marine didnt open the door it was busted down. Third if i hear sirens outside and am worried about my family or myself being as i am disabled you bet your ass im grabing my rifle. Fourth I lean towards the side that says they excuted a hero who defends my freedom and theirs. I would just like to say where is the evidence that this man was all the things they say he was. Lastly it sounds like they got their story mixed up from the begining, I smell cover up. (hey joe you saw him pionting the rifle at us right hint hint, yeah sam i saw , you all saw the rifle pionted at us right, oh sure boss) thats an easy story to stick by to aviod charges.
      Sorry but i cant agree that the police are the good guys and havnt for a while..

      I have my doubts that he was even holding it, let alone pointing it at them. Investigation revealed that he never fired a shot, and that he never even switched the safety off. Why camp out by the door with a gun with the safety on? Doesn’t make any sense.

      1. Pima Co Sheriffs Dept, not the feds.
      2. This was not a tragedy. Jose Guerena made a conscious choice to engage the deputies with gunfire. This was a successful raid as no Deputies were hurt.
      3. The Deputies had a search warrant, blew the sirens, announced their presence, and demanded entry.
      4. Jose Guerena had enough time that he told his wife and kid to get into a closet, then grab his rifle and advance on deputies.
      5. Once the deputies saw their lives in imminent danger, they fired until the threat was put down. Suppress the threat by “overwhelming firepower” and “violence of action”. Thats what they do.
      6. Jose Guerena was given every opportunity before being shot to surrender and obey lawful orders and he chose to grab a rifle.
      7. Nobody tried to cover this up, the story changed when FACTS became apparent, the investigation unfolded. They admit Jose Guerena did not fire.
      8. This was no Ruby Ridge. This

      I am assuming that most people here posted before watching the video that shows deputies blasting a siren, yelling SEARCH WARRANT, OPEN THE DOOR, the deputy knocking 3 times on the door. I cant believe that sooo many of you truly hate the police that put their lives on the line everyday to keep you safe, to ensure a civil society, and keep order. To my Marine brothers, Yes he was a Marine. That doesnt mean that he was not a bad guy. Many gangs have joined the Army and the Corps to gain military training. This guy apparently did not give the legal system a chance to decide if he was guilty or innocent, he took things into his own hands, decided his own fate. Swat was sent due to intelligence they had received through investigation, due to the violent and severe nature of the crimes he was suspected of. Say a prayer for a fallen Marine if you must, but what if he was the violent home invader/drug dealer that he was being accused of.       What I don’t get is that if the warrant was for drugs and human trafficking, why is the local Sheriff the lead agency? Aren’t the crimes federal, especially the human trafficking? Something’s not right here. Someone’s trying to keep their hands clean on this one and giving the dirty work to someone else. I haven’t seen anyone elese mention this. Maybe someone could enlighten me on this one.

      @chirodoc007 Would love to have evidence of what the officers saw inside the house. My guess is that they had a history that included “Ex-Marine”, “drug smuggler”, and “human trafficker”.

      The stories I read went a little something like this. Undercover police were casing the neighborhood in unmarked car “someon” called in a license plate check and that made them suspicious because they were by that persons house, they got a warrant to search this and 4 other homes. Background on the Marine. It was around 9 9:30 am and he was in bed fast asleep after working 3rd shift at a copper mine, his wife said she spotted armed men outside house and because a couple of close family members died the year before in a home invasion became scared and woke her husband (a 2 tour combat veteran) in a panic. Now I look at this story and have these questions 1. If you are sound asleep with the air conditioning on and someone is hollering and knocking would it be reasonable that the marine did not realize that it was swat? 2. From the time the door bust open and the shots begin did these officers given this man enough time to realize that they were police serving a search warrant? and 3. Why has the story changed three times. Also it took about an hour for the police let EMT’s go to the man. Yes he had body armor but many of the troops had to by their own armor to have the best protection in combat. If they were watching this guy why didn’t they catch him coming or goin

      I also heard that the other 4 house that were searched also had nothing found so what was this probable cause that was used to obtain these warrants? The police also lied in their initial statements that the body was not visible from doorway so they were scared to go in to see if man was still armed and alive yet when pictures of crime scene were veiwed you can clearly see from the doorway where his body was laying. The sherrif was quick to release their first version of events yet when stories started to not jibe with the facts he scolded even questioning the situation and then sealed all the details from the public. (This sheriff is no stranger to controversy he is the one who quickly blamed the tea party and sara palin for gabby gifford’s shooting with no proof)

      Sinista mace (continued)… In my state, as in others, it si illegal to defend your own life against a deadly threat. I do carry, my two Glock .40′s, with a ccw. Better to be tried by 12 than carried by six. Im sure we both agree on that.

      I‘m not saying that the police don’t serve a valuable function to society. What I’m saying is increasingly they exist for revenue enhancement, and their brutality is killing us. As an institution, they’re also overstepping every bounds that is put in place by the constitution. That doesn’t make me a sick individual.       Sinista, Thanks for replying to the questions, I didnt think you would but it better helps to understand where your coming from in your points of view. I too am a constitutionalist and see the violations of the 1st, 2nd, fourth, fifth, 10th and fourteenth amendments happening almost daily and I am mad as hell. I am a firearms dealer and wish I knoew more of the directed energy weapons you speak of, might be rather interesting. Well good luck and one last thing. I have a problem with it too. When we call other name regardless of the reason, we loose our credibility. Both you and I alike. Try to lighten up. Peace.
