Taking Liberties: WI Pet Ordinance Forces Homeowners to Choose — Your Pet or Your House

Wasau Wisconsin Pet Ordinance Limits Number of Pets Homeowners Can Keep | James and Melissa Lecker

In a push many see as a gross infringement on one’s personal liberties, a small Wisconsin town is forcing homeowners who keep more than the town’s “permitted” allotment of pets a choice: Give up your animals, or give up your house.

This is the dilemma currently being faced by one couple — James and Melissa Lecker — who, unbeknownst to them, moved to Wausau with four dogs.

For Melissa, there was no “choice.”

“These dogs are our family. They’re like our children,” she said.

In Wausau, homeowners are not permitted to have more than three cats, gerbils and rabbits or two dogs.

Melissa told Fox News she was in disbelief when a police officer showed up to her door to inform her that she was subject to a $100 per day fine for being over her dog “limit.”

“I had never heard of anything like that,” she said.

“They told us that the ordinance clearly states they [City council] cannot work with us… that it’s either two dogs or that you have to move, as you can’t have four dogs here.”

Meanwhile, the town’s officials said their hands are tied as the “ordinance doesn’t allow for variance.”

According to Fox, Jeff Gold, a municipal attorney from New Jersey, said the law makes sense when it comes to dogs:

“They smell. They bark. They have excrement,” said Gold.

“You’re not punishing [the Leckers], he explains. “You’re regulating society.”

No one from Wausau, including Mayor James Tipple returned reporters calls for comment.

Melissa says she has put her house on the market and is prepared to take a $15,000 loss in order to keep her dogs.

“I hope we can work something out,” she told Fox. “But they are just being so mean. My dogs didn’t bother anyone.”

    These abuses of government are not just isolated incidents. It is rampant from one end of the country to the other. Some areas are worse than others but as a whole there is not one place that has not been touched by some form of governmental abuse. It has become so widespread and carried upon the wings of political correctness that I do not believe there is any civil way to stop it. I truly believe that a huge percentage of the American people are tired of turning the other cheek. They are tired of being forced to be tolerant of what they know is sick perversion. They are tired of trying to get along while their rights and their dignity are yanked right out from under them. What I believe is, that being tired is going to turn to anger. Anger will turn to action. When this happens on a large scale, and it has to we’re past the point, the people responsible for such liberty stealing laws and regulations will find themselves taking a long drop on the end of a short piece of rope. There are still proud loyal Americans that know what freedom means and more importantly what it means when it is lost. These Americans have been pushed to the brink. I do not see any way that a resolution will be reached that is not reached through violence. I am not advocating violence, I am pointing out a scenario of events that I believe are in our near future.

      You said it well. I am a Marine Corps veteran and I have never committed a violent act against anyone, but even I see how vile and destructive our gov’t and its executives have become. I cannot pass a cop on the street without muttering how I really think about them and their enforcement of unconstitutional and ignorant laws. And the younger crowd who have served our military are more likely to see it this way. I have already run across alot of men my age who are not going to slip quietly into subservience to the federal gov’t so that we can pay off the debts of generations before us. To be quite truthful, Ron Paul being named President was about the last hope I had for my nation. Unlike Michelle, I have always been proud of my country, until I started to look at what people were really doing in D.C. and how they are rotting this nation from the inside out.

      Homeland Defense is militarizing them complete with military uniforms for swat teams etc and the Patriot Act and a slew of other acts allows police legally to ignore the Constitution and treat all citzens like they are the enemy.

      AND, do NOT forget that police beong to UNIONS. The WI police kicked out the TEA PARTY and refused to let them spend the night – made them buy permits, etc – BUT when the teachers and other public unions went on strike, THE WI POLICE – LOOKED THE OTHER WAY – and allowed their union buddies to CAMP OUT FOR MONTHS at the capital and TRASH/DAMAGE the building which taxpayers had to pay for.

      The police are no longer the neighborhood cop. They are now thugs – you do not Trust who will arrest you if you video them, etc.

      There is an underlying hatered I have that was not there 5 years ago for the police. When a small community like mine has a frigging SWAT team, I knowthe Police State has become too big. I get pi@@ed off when I see them sitting to catch speeders instead of doing real police work. They are a tax collection arm of the Government now. Total crap!

      People and their ‘beloved pets’ should leave Wisconsin. Relocate to a state that WILL NOT INFRINGE ON YOU or YOUR PETS RIGHTS!

      You are the owners of the pets and that makes them YOUR PROPERTY. You as taxpayers should NEVER have to part with your beloved pets. Their family!

      I will die for my pets! God Bless the young woman and her family of pets. May God surround her with His loving arms and protect her from pure evil!

      Our pets belong to us. We the ‘tax payer’ should never have to part with our Beloved Babies. Pet’s are family too.

      I agree fully. If it was me and even if I was willing to give up all the dogs, I would move away from that commie town that is a disgrace to America. I don’t care what excuse they give, they do not have the right to tell people how many pets they can have just as long as they are able to keep a clean situation. I can see them doing that with people that have 30 cats or something like that when they are unable to keep up with keeping things clean.

      I have no problem with people having multiple pets IF they take care of them and they keep them reasonably quite, the problem is most people don’t, in my neighborhood, they leave their dogs out 24 hours a day, and never even attempt to keep them quite, the one next door barks all the time, every time someone walks by, every time a car or delivery truck go by, when people walk in the railroad tracks, (and there is a large wall in between) I have a dog, but he is inside most of the time, when he does make excessive noise, I keep him quite

      There should be warnings about this law on road signs right along with the “Welcome to” signs. This law should have be printed out in the newspaper in the real estate section. This law should be printed on the real estate papers a prospective buyer signs when bidding on a house. This is a rotten law made by rotten people. The citizens should protest.

      My town, Bakersfield, CA also has a pet ordnance. Your allowed 3 dogs. I see both sides of the issue, a free people’s right on private property vs government laws and regulations to reduce noise or whatever. I dont know. I know my neighbors allow their 2 dogs to bark all night, howl until the dogs get tired and stomp through the wood pile while I am trying to sleep… and how much that upsets me. I am glad they dont have 4. By the time the cops get there, if they get there, the dogs are quite.

      The local government has the right to make the laws fit for that community and government is set up so that if you dont like the laws you can petition your grievance, elect someone who will change the law, or run for office so you yourself can try to change the law.

      Laws are (supposed to be) set up for the common good, not the good of an individual. Is it good for the community? Maybe. Is it good that they cannot put in a factory next door to me? Yes. Is it good that a cattle feed lot or dairy cannot be built next door to me?. Yes. Zoning regs have their place. Is the dog limit reasonable? Maybe, maybe not.

      I remember reading that one of the founding fathers, Thomas Jefferson, I think, said that the tree of liberty needs to be refreshed from time to time with the blood of tyrants and patriots. My apologies if I didn’t get it right word for word, and I invite anyone who does have it word for word to correct me, as I would like to keep the quote on record for myself. Anyway, I’m rambling here, what I want to say is that there’s still time to react without violence, but it will take each and every member of any town that has over-reaching laws like this to get off their collective duffs and get involved in what government is doing. Quit waiting for someone else to save you, and go down to city hall, and make your opinions known! If the sitting government won‘t respond to the community’s wishes, then they need to go. Same thing that we need to do with all of our Congress members who voted in that stupid law about not being able to protest in “restricted” areas. All but 3 of them approved it.

      Pet owners brought this on themselves. Dogs are always tearing up my garbage bags, there is always crap on my yard, but i don’t own one. Sit outside on a “quiet night and count how many dogs are in your neighborhood.

      Libtardian, I guess that I have a real beef with your comments for several reasons. Number one it sounds like you hate dogs. You say that you don‘t but it’s pretty obvious that you hate everything about them from their animal hair, to their behavior, to their smell, etc. Second, as one person commented, don’t lump everybody into the same category as your terrible neighbors. I am a pet owner and I don‘t allow my dog to go to the bathroom on ANYBODY’s lawn. I take him to a dog park or at least a dog friendly park and I always clean up after my dog. I follow leash laws, get my dog licensed, and get him annual shots. Third, it is very hateful to say that if you think of your dog as your child then you are pathetic or sad. Some people cannot have children whether it be for physical reasons or whatever. An animal is a great companion and has been proven to help people out who are recovering from addictions or great loss.

      The issue with this ordinance is that there is no leniency. There is no permit that you can get like in some cities or states that allows the couple to keep their dog. And honestly this law just shouldn’t exist. If I own my home, I should be allowed to paint it whatever color I want to, build a shed or a fence wherever I want to, install an electrical outlet, or own whatever kind and whatever number of animals I want to because it is my home.

      Obviously, you have never owned a great dog. My dog, Lady Samantha of the Valley (Sammy) is my personal protector, home and business security, companion, and most of all, she is my best friend.     This is a common practice in every city I‘ved lived in and is there to stop the folks that don’t even clean up after their first dog from getting more. It also protects against the nuts with 175 cats. Animal feces attracts rats and other undesireables that affect your neighbors as well. I don’t care what anyone says; no one picks up the poop everyday! Before anyone jumps on me, I’m the proud owner of 3 very well-cared for Irish Setters . 3 dogs is my cities limit. If people want more move to a rural area.

      We have similar rules in our HOA contract. They are clearly stated, and people are advised to carefully read all rules before signing to buy a home here. If a person doesn’t want to abide by the rules, they are not forced to buy the home since there are many other areas without such rules. In our subdivision, 4 pets dogs, cats, or any combination is the limit.

      I’m with you, Bikerr. There are enough laws to take care of the issues caused by having too many pets. Some people should not be allowed to have any. Some can handle many more than 2. It‘s a stupid law that only restricts the freedoms of responsible people and does nothing to deter those who can’t handle the responsibility of one.

      Agreed, it is a common practice among cities in this nation including the conservative area that I live in and for the most part, I understand the need for it. Around here, a kennel license is easily available as long as the owner has no felony, animal citation, and the immediate neighbors are fine with the extra dog(s). A kennel license must not be available to this family. What a shame.

    She had the dogs in advance and should have checked. I can understand the ordinance but if an owner can prove there are no concerns of excessive noise, smell, and well taken care of, there should be some waivers or variance. It‘s the owners in the past that have abused animals and didn’t take care or allowed for the excessive noise when close to neighbors. Upfront the story sounds kind strict on regulations but in this case she had the dogs before moving and should of checked to be sure the ordinance wasn’t a problem. I say the owner has to take some responsibility too.

      I can see it IF someone was BREEDING dogs or cats and selling them from their home – using their pets for income – and they had numerous dogs and cats just to increase the number of litters to sell –

      OR Kept all their dogs and cats OUTSIDE where they are bored and bark – because they are not considered a part of the family

      but these people kept their 4 dogs INSIDE with them and love them like family and I am guessing that all 4 dogs are neutered spayed so she is not using them as income.

      I would move also.

      Anyone with common sense. If you check out the area for schools, shopping and other amenities, why wouldn’t you check on any pet laws, especially since you have 4 pets. Personally, I think this is too many pets and I bet she is going to have a hard time selling that dog smelly home. They might not smell the stink, but people who plan to buy will. I am pretty sure they don’t bathe their dogs either.

      If you want more than two dogs, buy a house out in the country.

      This ordinance does nothing to help people. Obviously, it is causing trouble for people. And it makes it all the harder to find places for all the homeless animals to go. I have more animals in my home than that ordinance would allow. All but one of them were either taken off the streets or out of places where they were not being cared for properly. They are better companions than almost anyone else that I know. If you’ve never been loved by a cat or dog, then I feel sorry for you. BTW, for those of you who think I’ll be out there begging for food for my animals when things get tough, I stockpile food for them, too. I’m doing my part to keep the economy going, and buying for my animals plays a big role in that.

    The longer I live around people, the more I prefer dogs. I’d prefer to see an ordinance prohibiting a single obnoxious a-hole human being from living in any house within town limits. The choices for such a violation should be limited to “leave town or be put down.”

      Thank you. We have always been a decent family and since 2002 have had four schnauzers. Two died this last year from old age and illness, so I am down to two. I clean my yard constantley, and immediately go outside to investigate barking and bring them in if they are being silly. Our whole family is the same way, we want to be good dog neighbors, big or little dogs. Owners should be judged if they take care of their animals and are good neighbors. It is not about numbers, it’s about care and good neighborship.

      Well put, SPIRITED ! Those of us who have pets that are like family, tend to them the same way we do to ourselves. Including flushing the toilet — using a sandwich bag turned inside out, we pick up our pets’ feces, then flush it down the toilet. Tell me the difference between that and taking care of your child’s dirty behind and dirty diaper?

      Remember the story about shopping carts at grocery stores? Seems they have human crap deposits on them from babies. Very filthy. Ban kids under 18 from the stores. That’s what government does best.

    Regulating society? I hope the homeowners fight this with everything they have! This is getting ridiculous! As long as they take care of them and don’t bother anyone why do they care? They don’t just government trying to be in people business even more!
