Tax Official Threatens to Shut Down Kids Pumpkin Stand For Lacking Proper Permit

LEWISTON, Idaho (The Blaze/AP) — An Idaho family that operates a roadside pumpkin stand is scared out of its gourd after a state tax collector showed up and tried to squash the business.

The Lewiston Tribune reports the Idaho State Tax Commission has called for the closure of a family’s pumpkin stand in Lewiston, a mill city along the Snake and Clearwater rivers.

Dan and Kami Charais told the newspaper that a Tax Commission employee informed them the stand was in violation of laws and had to shut its doors.

The couple says their 4- and 6-year-old children had been carving out a niche for themselves in the local jack-o-lantern market — to raise money for school sports, they say.

A Tax Commission representative told the newspaper that even goods sold at roadside stands are taxable and that the stand did not have a proper permit.

A similar event occurred in Portland, OR in August. 7-year-old Julie Murphy’s Lemonade stand was shut down by food inspectors at a local art fair for also lacking proper permits. The county later apologized.

    Can anyone say “oppressive regime” if not, start practicing or vote ‘em out, NOW, and 2012 and impeach ALL of those you can at all levels, this started by the progressives at the local level, so beware you are not safe just because the focus is on the national level and there seems to be change coming. You will need to be vigilant about watching your city councils, county, state, yeh, all of them.

    Small people with big power. Folks like this tax official disgust me.

    Last year, on a Sunday afternoon I put my garbage cans out at the curb. Apparently I put them out a bit too early. Shortly afterwards a county car rolled up to my property and slapped a warning notice on my door for this serious infraction. I was surprised inasmuch as these county employees don’t work on the weekends. Found out later that the county employee lived in my neighborhood and to justify using her county vehicle on the weekend, to take her elderly mother to the grocery store, she would hand out warning notices around the neighborhood for any trivial thing she could find.

    What a parasite!

    I have friends here in SoCal that have a large truck farm and roadside stand. They informed me that the State came to them and told them they need to ‘inquire as to how far people come to buy from them. If they travel more than 50 miles, they need to be taxed‘ under some obscure ’tourist’ tax.

    ….yeah, right. I will ask questions like that.

    What is this society coming to? Another tax and sociaital revolution is what we need – NOW!

      we need to take a STRONG AMERICAN stand and tell these “officials” to get the hell away from our families, our kids, and our gardens/farm stands/ lemonade stands. we MUST take a stand and SAVE OUR “STANDS”. … obama is grabbing every aspect of American free trade right down to your garden in your backyard, and he is empowering his greedy little minions to try to inflate their egos and wallets by shutting US down.

      we just heard we will be hit by a tax if we sell anyone, even our nextdoor neighbor, anything over $600. from our house, garage sale, etc… WHAT?!

    Hear is the problem. We give these lawyers our vote, they write these laws that are ream of paper long, no one reads them, then they are law and the minions filter out and enforce them.

    Look out babysitters the IRS just hired workers.

    Look at your phone bill you are still being taxed for the installation of the telegraph wires, are they still there?

    This country needs a hard reset to get back to what the founders had in mind!

    I under stand that they need a permit,i don‘t agree with it’ but is the way the pumpkin rolls,{boy that sounds yummy!} all of this is not about the kids craving pumpkins,that’s great that they are trying to raise money for whatever it may be, and it is wonderful that they are being taught to work.{ most parents don‘t teach they’re kids the meaning of work, so i congratulate them for teaching responsibility. now with that said, the tax man was just doing his job,{ even if we don’t agree with him} but that is why we have laws.so don’t blame anyone but the parents for not getting the permits. because with out laws we would be a nation of misfits. so god bless those kids, give them an {e} for effort.and i hope they sellout of pumpkins.just get a permit. i hope to be eating pumpkin roll very soon.

      If the proceeds are all going to charity, there should be no requirement for a permit. If it truly was the children who were doing the work and keeping the money, then again no permit should be needed because the last time I checked minors don’t have the right to vote on who to put in office or what bond measure their taxes will be used for. Because children have no say in how government is run and they are supposed to receive all of their necessities from mom and dad, who do pay taxes, they should not have to pay taxes in any amount until the age of 18..err 21… I forgot, you can be labeled as a dependant now until you’re 26. So I say no taxes until the age of 26, thanks Obama – Pelosi – Reid.

      the last time I got a permit – it cost me $15 for parking lot (office only open Mon-Thurs) and 4 hours waiting for my number to be called to pay the $35 permit fee which was good for only 1 day – the botanical society plant sale (which funds free plants for our parks) was rained out so we had to reschedule for the next weekend – and I just said “forget about it” on the permit and we rolled illegal. If you think that is tough – you ought to see how much driving around the city is required to open an internet business – takes 3 days and a lawyer and a notary four times because each office needs their forms notorized.. No info on website about what is required – just major run around. Guess my city just does not want us to help with the parks or for us to have new business in our town..

      The point here is that the government (in this case, local city gov.) has once again taken itself waaay too seriously. One of the principles of our original form of government was to keep it small and responsive to the people…These “local tax nazi” stories always pop up every year and normally the problem is resolved by an apology from the “tax nazi’ and life goes on as usual…This is the way government mistakes are supposed to be handled. No biggie! The REAL problems are at the State level and ABOVE where the the government is more protected from their own mistakes and power is more concentrated…this story is more silly than relevant right now!

      The IRS-KGB is able to wield almost unlimited power with no accountability to anyone anymore. They will do anything to keep power, as with the lemonade stand first and now the pumpkin stand as well.       This is absurd ! Come to Los Angeles, get a taco cart, ice cream cart, sell food out of an ice chest in front of 7 Eleven, add on to your house with no permit, live 8 people in a one bedroom apartment, get free health care, go to plan parent hood and get a abortion on medical. it is absolutely absurd that American citizens are being discriminated against when people from other countries just come walking across our border,fly in on planes, float over in boats and our government just turns a blind eye.

      Come to America, get a free education,free health care and then send your under the table wages back home. this is great economics, give it away here, send it over to another country ! can you say government funded by your tax dollars, redistribution of the American dollar.

      These kids need to contact GOOGLE on how to legally use the system. Google Inc cut its taxes by $3.1 billion in the last three years using a technique that moves most of its foreign profits through Ireland and the Netherlands to Bermuda.       I would bet there is a bit more to the story. I live in Idaho and people sale crap on the road all the time. My bet is the tax guy had something against the people. I wonder what kind of person you would have to be to shut down something like this. Hopefully Otter will put a stop to it. I doubt it though, my experience in the Republicrat party reviled to me how spineless they all are. They will only act if they know the news paper wont attack them for it.

      compliance officer stopped by while the children were at school. She had seen activity at the home over the last few days and wanted to discuss their permitting process.

      the tax commission employee was doing her job. simply stopped to educate these people. never threatened to shut it down. the parents went to the paper crying about it.
      sorry to disagree folks but its the law. these parents are teaching their kids that if they dont like the rules they just complain about it and people will feel sorry for them and they will get their picture in the paper. i think its bullcrap that the tribune put it on the front page. the media controls your emotions instead of your common sense yet again

      They have already closed down lemonade stands, stopped bake sales, door-to-door candy sales (yoohoo, Michelle is that you?) and yard sales unless you get a temporary permit, tag all items, and apply sales tax. In Georgia, they even fined a man who had a garden and gave his excess vegtables away free of charge. Here in Missouri, they want to add a sales tax when you sell your home. They are always thinking of new ways and they get more and more invasive. A friend of mine posited that under Ocare with its provision about BMI, it is a step for a new tax for oxygen consumption. Sounds ridiculous, but……

      That has already happened…. Just the government CONTROLLING OUR LIVES, as you know, THEY know what’s best for us. We‘re just too stupid to think for ourselves and they have to take care of us because we can’t.

      Time to get out the pitchforks and torches if you ask me. TIME TO TAKE OUR COUNTRY BACK!

      That old Beatles song still rings true today, perhaps more than ever.

      Now, on top of everything else, the death tax is coming back, and new taxes are being added: the health insurance tax, the no health insurance tax, the garage sales tax, the barter tax, (those first 4 all being part of the Health Care Law), the carbon tax (by EPA decree), and other assorted taxes we don’t even know about yet (based on new powers granted assorted executive branch agencies and the IRS).
