Teen Atheist Wins Big: School District Won’t Appeal Ruling to Take Down Prayer Banner

On Thursday night, a massive crowd gathered at Cranston High School West in Cranston, Rhode Island, to discuss the future of a controversial prayer mural that has captured headlines for months. While many came to protest a court ruling that found the banner to be unconstitutional, others praised the teen atheist who fought its presence. Last night’s meeting, which CBS News likened, at least at its start, to “a rabid shout fest,” ended with the Cranston School Committee voting 5-2 not an appeal the judge’s mandate that the mural be taken down.
As the Blaze has extensively reported, the case was brought against the school district by 16-year-old Jessica Ahlquist, an atheist who claimed she found the sign offensive. In January, U.S. District Court Judge Ronald Lagueux agreed with the young woman, which has sparked outrage, protests and frustration in the local community.
The district’s reasoning for not pursuing the case, it seems, has more to do with money than it does a disregard for religious liberty. We’ve reported about the extensive expenses associated with the case. Already, the battle has cost taxpayers $173,000 — and this was merely for the monies needed to defend against the lawsuit Ahlquist launched with the Rhode Island chapter of the American Civil Liberties Union (ACLU).
According to the school committee, the total cost if the district launched an appeal and it reached the Supreme Court could have come in at $500,000. In a time when budgets are diminishing and tough decisions need to be made, the financial needs of the district clearly took precedent.

“I’m really pleased with the decision,” Ahlquist, who was present at the event, said following the vote. “It’s obviously the decision I wanted the School Committee to make and I’m thrilled.”
In a press release issued following the vote, the American Humanist Association, an atheist and freethinking-led organization, praised the district’s choice not to continue the battle, while offering up accolades for Ahlquist.
“Given the strength of the ruling by U.S. District Court Judge Ronald R. Lagueux, it would have been tough for the school system to appeal,” Roy Speckhardt, executive director of the American Humanist Association, said. “We’re certainly glad that the committee decided to not waste any more time and money in pursuing one.”
“Jessica Ahlquist has stood up against her most vehement and vile critics with class and style,” he continued. “Her example shows how a fight should be undertaken in favor of protecting the freedoms we are guaranteed by our constitution. Everyone should offer a healthy measure of gratitude to her and her family.”

US Constitution, Bill of Rights, Amendment I, specifically the first part:
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof;
or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.
So here we have a naredowell who claims something that does not exist (freedom FROM religion instead of freedom OF religion) because there is no attempt here of “Congress making a law respecting establishment OF religion”, while that marxist POTUS violates the second part of the first part by “prohibiting the free exercise thereof” when it comes to the religious conscious of Catholics and other religious of a similar mind. We better all be Catholics now because our world has been turned upside down, inside out.

All while they can hang up a poster sized mural praising Allah during “World Culture” class teaching them the ideology behind the Muslim religion for 9 weeks (which recently occurred in a Jr. High around here). And many parents are so disengaged with the self-importance of their own lives to even notice. The liberals pick and choose whatever is convenient for their argument. Clearly the Founding Fathers had no intention of removing God from society; they simply wanted to keep from the government establishing its own religion. It will only get worse if BHO gets a 2nd term to overhaul the Supreme Court and the Appeals Courts further. Though it may already be past the point of no return.

Was she thinking about it day and night, unable to sleep, unable to focus on school work or worshiping her Satan? Doesn’t she realize she was out numbered and the only reason why she got her way is because of a judge that has a very weak grasp of the constitution? I’m sure out of all the students and staff that have passed through that school while the banner hung, there were a lot that disagreed with the banner but went about their business and NOT TRY TO RUIN IT FOR EVERYONE ELSE. What an ugly, UGLY little girl she is.

To explain on the freedom of/from comment because the public school system is funded (in part to some degree) by the federal government the christian prayer being posted in the school could be seen as the federal government “respecting an establishment of religion” in this case christianity. If you put up a prayer for one religion then you must either put one up for all religions or none at all.

Report Post »If this was a victory for the Constitution then I would be supporting it. But it isn’t. It is a clear violation of the First Amendment – abridging the free practice of religion. And don’t even bother starting with the “establishment clause” until you can tell me how a small municipal school district hanging a generic banner that does not single out any single religious belief somehow rises to the level of Congress establishing a government religion.
It is patently ridiculous.
If she wants to extoll the virtues of her faith, then she is free to do so. If she asked to have a similar banner somewhere else extolling good sportmanship (ironic, given her utter lack) from an Atheist perspective I would have supported her 100% because that is the free excercise of religion. As Americans we are free to express ourselves. But WE ARE NOT free to tear down others’ banners and silence those we disagree with.
This is no different from the Taliban destroying the Afghan Buddhas. It is religious intolerance. And we are better than that.

That’s actually not a bad idea. With a few modifications of course. But I’d be amenable to some sort of compromise in an effort to satisfy all concerned. As long as one side doesn’t feel it is more RIGHTEOUS than the other, I’m fine with it. Personally, I could care less about some stupid prayer banner. It’s not the banner that I would object to. It’s the insistence by the right that THIS IS THE WAY IT IS NO MATTER WHAT, mentality. You guys think that your rights are being taken away, they’re not. If Christians propagate their values, it is an “establishment clause” violation, but if Secular Humanists propagate their values, then it’s not. These atheists, humanists, don’t believe in God, so that means they think Christians are foolish in believing in God because there isn’t one according to their belief. Ok fine, if there isn’t a God than according to their own construct, that means both religious values and atheist values are both man made. If that’s true, then what makes one value better than the other, since both values are man made? So therefore why do atheistic values get the preferential treatment in our policy making rather than religious ones… as Selwyn Duke has argued.
What people value are always inherent in the laws that we legislate. But Humanistic values always prevail, why is that? For example, the humanists value a woman’s right to choose to kill innocent life because they value promiscuity without consequence or responsibility. Yet at the same time they value a death row inmate’s right to life when he has murdered people. Ok fine, but why do their values win and get put into law at the end of the day?

Kids can go across the street to pray before school, after school, or during lunch periods where going off campus is permitted. The football teams that want to pray before a game, can pray off school property, out of their uniforms, before going to the school and dressing out. manger scenes can be placed out front, not on school property. This clearly will separate the church from the state. What are they going to do next, say the church cannot buy property within so many feet from a school? It’s always about the right of the atheist, what about the rights of the non-atheists? Do they not count any more?

Posted on February 17, 2012 at 1:22pmin no way whatsoever does this decision prevent students from praying or holding the particular beliefs that they may hold. what this decision DOES do is separate church and state, since this is a public school and therefore directly connected to the gov’t, it has no right to promote one religious ideology over the other (especially since there are students who do not hold the same beliefs). No one is saying you can’t believe in your religion or pray while you are at school. Instead, they are saying you cannot force your religion on others by promoting its prayers, etc on government property. get a grip and quit whining every time you don’t get exactly what you want.

I, personally, wish to see TRUE freedom come. One of the best ways to do this, is to take “Marriage” out of the tax code, and out of the law books. Next, we need to send school funding back to the localities. While I personally insist that the Federal government DOES have a role in education… the way it functions now simply impinges on freedom and progress in the educational field.

It was requested that the “Heavenly Father” and “Amen” be removed so that the prayer could be re-named a school creed. That request was denied. The school brought this on themselves.

You are correct – all of these things would be completely legal. In fact, students can have bible study clubs at school, they can pray at school, they can participate in religious observances at school or take religious holidays. All of the christian students could print the text of this banner on 8 1/2“ x 11” paper and tape it to their binders.
Provided the school does not appear to endorse this activity, it is protected by the 1st amendment.

I think these people just want to feel that they’re better than others. You must respect their beliefs, but that could give a crap about yours… After all, the belief that there is no God, is still just a belief. I see these activist Atheists as selfish and self-centred.
And, honestly, I am still trying to find a law that says having a prayer on the wall is illegal. When Thomas Jefferson wrote about the separation on church and state to the Baptists, it had no legal authority, and it was a warning of the opposite reason the quote is used today.
Liberals have a convoluted and twisted idea of history, and it makes me sick. Especially when I know they’re the ones teaching our children at school.

Official recognition of any religion on public property is specifically addressed by the establishment clause of the First Amendment. Every standing precedent in United States case law supports these two Constitutional truths. The school board learned an expensive lesson, and the young lady certainly understands the Constitutional limitatations the Bill of Rights places on all governments better than most adults. This isn’t law school stuff, it’s junior high civics. Civil rights issues can never be decided by majority or even plurality opinions, for these truths are self-evident. Good thing too, for most Americans DON’T own a firearm.

As time went on, the same principle began to complain about problems in the school, including theft by students, to which Mr. Colson responded “perhaps you should put a sign up that says ‘Thou shalt not steal’”.

If schools would start teaching students about the differences in religious cultures and beliefs and encourage tolerance through understanding , maybe there wouldn’t be such a divide and folks could relax a little bit. But the insistence of the Christian Right to accept it’s doctrine as being the only true faith is what causes these problems in the first place. Arrogance is not holy, it’s assholey.

It is simply about the government being prohibited by the people from ‘establishing’ religion. The Washington Monument is an Obelisk, representative of the Egyptian culture and religion, and signified worshiping the Sun. The Columns which are so prominent in many Government buildings were those same ones used in Greek and Roman culture to uphold their Temples honoring their sky gods. The word Capitol has its origin in Roman religion and mythology wherein the planet Jupiter was honored and worshiped as the King of the gods, thus the main central point of a State. They teach their kids to worship invisible beings who sometimes take human form but were not concieved through intercourse. They teach their kids that this invisible being knows and sees all so they better be good, and that kids that are not good will be eternally tortured by another invisible being. But as long as they are good and eat their vegatables they will defy the laws of biology and defy human mortality. They actually believe that they will be invisible beings one day as well. They have a club of some kind and they meet once a week and sing to the flying invisibility. At first I thought they were on LSD or methamphetamines but they swear they are not. I can’t see the flying invisibility even though my neighbors swear that I can. It’s not there, and I told them so. Then they told me I should leave the country because I don’t sing to invisible man-spirits.

Researching the case law leaves no doubt at all.
The framers could have chosen language that simply prohibited government from choosing sides, but it’s obvious to anyone trained in logic, rhetoric or jurisprudence that the most nuetral arbiter is one who not only doesn’t have a “dog in the fight”, but who is also disconnected from the fight in every way. It’s why we have the greatest degree of religious liberty and latitutde any nation has ever enjoyed. Hanging any sort of religious symbol on public property diminishes that liberty. The American churches of the 18th century insisted this liberty be protected by eliminating government from matters of faith. The were afraid government might favor a religion other than their own. You should be afraid of that too. You are, I assume, Christian, and your worship is protected by the free exercise clause, we are, collectively, not Christian, and are restricted from making laws concerning faith by the establishment clause. The First Amendment is undoubtedly the most influential sentence ever written in the English language. It has done more for believers than every sermon stacked on end. Believers are looking the proverbial gift horse in the mouth.

Let’s see some of the insults already lobbed, and you tell me your take:
“Whore”: Used twice. Definition is that she sells her body for sex.
A comment that was deleted called her a “snatch” and said “may she die and rot in hell.”
My personal feeling? The banner harmed no one. Yes, it was an obvious endorsement of religion (it’s the school prayer; there’s no doubt the school endorsed it. They took it to court to fight its removal). The courts ruled that it breached the establishment clause; the girl was right. And since then, she has received death threats and insults from hundreds, if not thousands, of people. Heck, the article’s been up for, what, half an hour? And already someone here has called for her to die. Others have said she’ll go to hell for her actions. Before the day is out, do you think we’ll see more?
The reaction was extreme for such an act. Do I think she’s a busybody? Sure. It was a banner; many people will say “it hurt no one.” But if it was so unimportant, why are we seeing calls for her to die? Why are people calling her a “whore” or a “snatch”?

As a Christian, I feel obligated to point out when others are misusing the name of Christ. I believe the correct term is fundamentalist. I have no problem with Conservative Christians, nor Christianity in general (as I’m a Christian myself); having a deep faith can truly make a good impact on your life. But when that faith makes you strike out at others with different ideas, you’ve become a fundamentalist. It’s the Christian who bombs abortion clinics or sends death threats to teenage atheists. It’s the Muslim who kills his family members for honor or justifies thinking of women as property. It’s the Jew who spits on “immodestly dressed” little girls or demands death to all the Arabs in Israeli lands.
Religion can be a wonderful force, but it can also be used to back up vile behavior. I know Christ wouldn’t condone or encourage these kinds of threats; so why do some Christians feel it’s “right” to make them? Her eternal soul is her own matter, and I’ll also pray she finds faith in Christ during her life. I disagree with her atheism, but I would never call her a whore and then say she deserves the abuse she’s getting (threats, mockery, hatred online and in town from complete strangers). She was correct in saying there was a violation of the establishment clause, and the courts agreed. Public schools should not endorse ANY religion, which is what happened here.

And you’re an endless amusement! Here’s the funny thing. This girl was offended by the banner and wanted it taken down. Being offended is not grounds to go to court… but breaking an amendment of the Constitution is. So when you say things like “they want to take down the Constitution,” I have to shake my head at you, because the Constitution was being breached before.
Did the banner hurt anyone? No. Was it still unconstitutional? According to the courts upon which our laws are judged, yes.

I’m not manchurian.candidate, but I’d like to point out this flaw in thinking. You are arguing that laws are “more valid” after time has gone by. That’s a pretty flimsy position to take. Some states still have adultery laws on the books… but when was the last time someone was charged? (Actually, I seem to recall there was an issue about this with the show “Sister Wives,” so maybe that’s a bad example).
A law, ordinance, or public display can stand for decades without complaint; but if someone does take it to court, the courts decide if they are violating the Constitution. If something’s lasted for years, it doesn’t mean it IS Constitutional; it just means no one’s cared enough to complain yet. You can steal cable for years; doesn‘t mean it’s not a crime when you’re finally caught.

As for the slavery issue, you’re mixing up your arguments. You are no claiming I said the Constitution explicitly guaranteed slavery. That’s false. What I did say was it was deemed a state’s right issue (as per the 10th amendment, where powers not granted to the federal government are held by the states). Not until the passage of the 13th amendment was slavery declared unconstitutional, because until then it was simply considered allowable under the 10th amendment. States could allow or not allow slavery as they pleased.
I think you’re getting mixed up by changing your argument, not by my response to it.

Uh… I guess you missed the part where I said the States could decide whatever they wanted with slavery as per the 10th amendment. Slave states decided they were property, the courts agreed. And as I said, I felt the decision was wrong; they could have (and should have) ruled that they were people with all the rights allowed to any free man. But once the courts had ruled slavery was constitutionally valid, it stood until an amendment overturned it.

An Associates is a trophy for participating at best. A TRADE however will land you a job that Master degree people are getting for pay in Public institutions and usually, if you are a good business owner, its security is just as good if not better than working for public entities. College is a joke. Unless you like to get your hands dirty however, college, is at the moment, a necessary evil.

Thirty years ago a high school diploma could land you a job with better pay than public workers and 20 years before most adults had or decided to drop out of school before the equivalent of 8th grade and work. Why because the pay was good! And school didn’t enhance it. Who was getting paid better? Hint: It’s not the college kids of today.
I remember CBS one night asking an auditorium of people what their education level was. ONE person had an associated, almost everyone had the Bachelors, 5 had their Masters and no one was there with a high school diploma or a Doctorate which sent a clear message. Get your dang Masters, find work and then haul butt to get your Doctorate. It was sad to see and discouraging for we all know the cost every student has to make in order to reach that goal.

College is whatever you make of it. There’s not much demand for those with an art degree, but there’s a huge demand for those with medical, math, or hard science degrees. A business degree is also not a bad idea, especially for someone setting up their own business (learning how to do your own accounting, taking law classes, understanding incorporation, etc… all valuable).
College is like life. If you plan it out and know what you want to get out of it, you’ll go far. If you putz around and goof off, you’ll get very little out of it.

Second, you mention this great agrarian communal society the puritans lived in…They almost died many times because those that worked could not produce enough food to support those who did not work.. They would put all of the food the community would grow in one place and would allow all in the community to go and get what they needed but it wasn’t enough. THEY ALMOST STARVED TO DEATH…SOME DID! They gave up on that dumb experiment pretty quickly. Hey, give me one good example in the entire history of the world where Socialism, Marxism or Communism has worked to the benefit of the PEOPLE.
