Teen Faces Criminal Assault Charges for Shooting Spitwads in School

Andrew Mikel II, a freshman honor student and Junior ROTC cadet at Spotsylvania High School in Virginia, hopes to attend the U.S. Naval Academy after he graduates. But for now, the 14-year-old is at home, serving out a suspension sentence handed down from school administrators after he shot plastic “spitwads” at other students. Last December, Andrew was punished for using the hollow body of a ballpoint pen to blow small plastic pellets at three students during his lunch period.

At first, Andrew was slapped with a 10-day suspension, but the county school board later voted to extend his punishment, citing the school’s Student Code of Conduct no-tolerance policy that requires any student found with “any type of weapon, or object used to intimidate, threaten or harm others“ be ”expelled for a minimum of 365 days“ unless ”special circumstances exist.”

Andrew’s family claims the school is “criminalizing childish behavior” and the freshman is filing an appeal to be reinstated.

But the youngster’s problems could go well-beyond the schoolyard. The school district referred the “assault” case to the Spotsylania Sheriff’s Office which has charged Mikel with three separate misdemeanor criminal counts.

Andrew is now serving out a community service sentence and has been forced to enroll in substance abuse and anger management counseling to avoid further prosecution.

Is there a difference between a kid blowing spitwads at fellow students and a criminal charged with possession of a weapon and misdemeanor assault?

No, according to Spotsylvania Police Capt. Liz Scott. “Assault is assault is assault,” she told Fox News. “There were three victims that were involved in this, and I think the public needs to remember that,” she added.

The school’s assistant principal agrees. During a December 21 disciplinary hearing, Lisa Andruss said Mikel’s behavior indicated a disturbing trend because he was disciplined in junior high for shooting rubber bands. In addition, he was suspended in 8th grade for bringing a comb to school that resembled a pocket knife.

The school guidance department told Andrew that as a result of his tarnished record, he will no longer be considered as a viable candidate for the Naval Academy.

The whole situation has Mikel’s parents baffled. Andrew Mikel Sr., a former Navy Seabee and Marine officer, told Fox News that he’s been left “scratching my head at the whole thing.”

“One thing is he must attend substance abuse counseling – he’s never had a substance abuse issue in his life,” he said.

“Right from the get go the Assistant Principal Lisa Andruss said, ‘Come pick up your son, he’s being suspended for 10 days, we’re recommending expulsion, and we’re going to push this to the fullest extent of the law,” he continued. “When I arrived she showed me what amounts to a pee shooter: a plastic pen casing about four inches long and these little plastic balls that he’d had from a toy guy that he had years ago and found in his closet recently. This thing is harmless.”

Andrew admits his stunt was dumb and only did it because he “thought it would be cool.”

Since the school decided to expel him for the remainder of the school year, the family has enlisted legal help from The Rutherford Institute, a “civil liberties organization that provides free legal services to people whose constitutional and human rights have been threatened or violated.”

“What happened to Andrew Mikel is an example of how oppressive zero-tolerance policies have become,” John Whitehead, president of The Rutherford Institute says. “School officials have developed a very dangerous mindset that allows virtually no freedom for students, while at the same time criminalizing childish behavior.”

“My son did an infraction and he deserves a just punishment, but this is like cutting someone’s hand off for stealing a piece of cabbage,” Andrew’s father said. “If my son, instead of shooting a spitball, went up and punched a student right in the face he would only have gotten five days suspension and even if he‘d drawn blood the school resource officer said police still wouldn’t have gotten involved.” But since police and school officials are considering Mikel’s spitwad shooter as a “weapon,” the case has taken on a whole new meaning.

“It takes four state agencies to go after someone with a spitwad: It takes the sheriff’s department, the commonwealth attorney, the school board on various levels and the department of juvenile justice … what a fine use of taxpayer resources,” he added.

The Mikels plan to appeal their son’s disciplinary sentence next week and hope that his record will be cleared.

    I was just going to let the Blaze know about this! To late, I’m getting Old!

    So this kid gets suspended, and the 4 year old who cant make good decisions yet; brings a knife and is still in school! WTF? Where is this Sh_t Hole World going too? We need our Heads Examined for putting up with this! I keep thinking it can’t possibly get any worse, than its like it does, and its ten time worse than what I thought! Oh heres just one more story that will make your day! Let the Govt. know that your boss is doing a Sh_ty Job and the Union wants to give you a raise! Let the Govt. Know, so they can send it to the Dept of Justice/American Bar Ass. WTF? Do you ever worry, your neighbors are watching you? Or are we in Communist Country, and our Govt. know what were doing even when we take a Bath? So when I said, I give up and things can’t get any worse it just did again!

      SHOWTIME – When you provided the list (updated from MY SACRED HONOR original list), I was compiling the same type of list. Going back, looking at the type of posts. I love who ever came up with the Wall of Stupid, or was it Wall of Shame – Any hoots, it’s one thing if the folks on that list provide some decent facts, to where we can bounce our thoughts, experience, education, etc. back and forth, and it be constructive. But, the majority of the time, the folks on this list spout off an opinion (that’s ok – first ammendment) but, don’t want to back it up with any facts. Or like with ENICOM, I always ask what he/she would do or decide for that situation (story) and he/she never replies with any thing legit response.     This is rediculous. The principal and admins should loose their jobs. this would amoutn to a detention or 2 in my dat (im 34) this 0 tolerance is the biggest joke. you are going to destroy a kid who has a real promising future for something Im sure we all did. The bigger question is why are people not out in front of that school every day with signs protesting? We need to quit assuming that some online yelling is going to do anything. we need to hit the street and have toes admins faces on every conservative blog.

    This is exactly what our enemies and terrorists wanted us to do and how to react. If we lose common sense and remain politically correct, we are spawning future generations that can not or will not defend our country from real threats.

    Zero tolerance policy SHOULD include INTENT and some common sense would go a long way.

    There is something wrong with this kid that he repeatably displays this kind of behavior. He should be evaluated for mental health issues. First it was rubber bands, then a comb that looked like a pocketknife, and now plastic pellets shot at other kids. This isn’t just childish behavior, but something gone wrong in his head.

      Nothings wrong with him he is just a kid kids tend to do stupid things. Hell in science class I was the only one willing to dissect the fetal pig in my group. After cutting it I decided to basically play with it made people in my group gag but they thought it was funny. However some turd in another group was watching mine and reported me to the principle and i got suspended for making what we where doing fun for my group members.

The entire scene in Animal House will now have to be banned from schools because of the violence and weapons being used during the scene.

    You have got to be kidding me. I say arrest Lisa Andrus for malicious foolishness and abuse of this student. She should then loose her job for making such rediculous theats. This kid could be suspended for a couple of days and then be given a warning if he repeats this. If shooting rubberbands and spitwads can keep a kid out of the academy, or have him expelled from school. then we might as well give up – There will be no boys left to serve this country. No wonder our boys explode with rage. We might as well have them wearing pink tu tus and toe shoes, with politically correct binders on their balls.

    this is getting so retarded…..they are having trouble getting adults to let them tell us how to live our lives so they go after the kids…………when i was in school i did the same thing….got paddled on walkway in fron of other classes and did not even think of doing it again…now 62 years old and still don’t do spit balls………but do have my carry

      How I miss my “Leave it to Beaver” days back in the 50s and 60s when we would play Cowboys and Indians, right in the school yard during recess and we even used squirt guns. Can you imagine? Lethal squirt gun weapons! My entire small town school would have been in prison if it were today.

      Lately I can hardly believe what I read, or see on television: I feel like I’m in some sort of a Twilight Zone.

      Honestly, if I didn’t have Christ in my life, I’m not sure if I could cope with all this.

      Agreed, this stinks, the kid seems like he is on a great path, and this comes up? We just had a case in Denver where a girl, in ROTC, forgot to unpack some practice rifle in her car, there was a surprise inspection/search at school, she told the school the rifles were in there from the ROTC practice, the community had to preasure the schoolboard to not expel her. It seems the good kids are being targeted and we coddle the @#$#@wipes. If Johnny is caught dealing drugs, we have to give him a second, third, forth chance and grants to go to college. For the straight A student that shows any speck of Christianity or Patriotism, kill their career. Our founders would weep.

      Glad I graduated in 1973. This is what Progressivism does in our public schools, I always hear them scream for help when some one shoots up a school from outside. But when they have locked up all those that could actually help them. They will be sitting next to them in jail when their masters turn on them.

      Aw, c’mon!!! You’re putting me on!!! What kid hasn’t thrown a spitball in school?! I suppose rubber bands are lethal weapons? I’ve killed flies with rubber bands.

      Make the kid write 500 times, “I must not propel spit objects in school.” Or, make him turn in a five-page theme paper on why he must not do whatever he did again. The kid’s a kid!

      I hope the judge LAUGHS at the charge, tells the school officials that they are being mentally abusive, and gives the kid to a sentence of turning in a theme at the next session of court! (That’s what my son was given when he wrecked his car. There were five other boys in court for the same thing, and the judge fined themn $100 each. They had on tee shirts and jeans. My son had on a suit and tie. The next session of court came. We were finally sitting in an empty courtroom except for us. The judge asked why we were there, and my son stood and said he was turning in his paper the judge had requested. The judge smiled at him and asked him to step forward. Timmy had on his suit and tie again, too. The judge took the paper, thanked him, and told us to have a good day.)

      What’s particularly amazing is the fact that they are using history books that have been re-written to fit the progressive agenda and didn’t demand that the publisher replace them with accurate books immediately, but they can go to all the trouble of prosecuting this child to the extent of the law. As for his appointment to Annapolis, I would hope, if this is the last breech of school rules, that they would look at this for what it is – immature, but ridiculous, all the way down to the sheriff’s involvement. Straighten up, Andrew!

      I guess if shooting spitwads and rubber bands is a crime,,,,,I should have been handed a ‘life-sentence’. While I now do not condone shooting spitwads,,,it’s one of those things done in school. No doubt the hypocrits in charge there have done the same thing.

      It never ceases to amaze me how people can loose their common sense.

      Nobody that I know would have been able to attend college if this was the case at my school. Our society is becoming so soft and politically correct. The kid should get a detention and a slap on the wrist. The administrators should be fired for wasting the counties time and money with a case this meaningless. Yet again, they are doing what school administrators do best…

      This young man does not fit the new model for service academies anyhow. The current model is for pacified politically correct soft warriors. We need warriors that can empathize with our enemy for the greater good of non-aggressive pacification. Gone are the days of destroying the enemy. Our soldiers will be the new politically correct martyrs of tomorrow where winning the war is not important: We lost the war, but we did so in a politically correct, compassionate and sensitive fashion.

      Hey, ya want to put sombodys eye out! Hahahahaha This whole thing is getting hilarious in the schools. Although, they may have a point. Our parents and grandparents did the same thing and look what happened to them. They became so violent that they kicked the Germans and Japanese all the way back to thier countries, and then some. Then they built a country so great that it had to be Progressivised over several generations until King Obama became available to finish the job. Remember that the “Greatest Generation shot spit wads, drank booze, smoked cigarettes and carried guns (not toy ones or “finger guns”), but also had the courage to stop bagging groceries and save the world. Insanity abounds!!!!!!!!!!!!!!!!

      I can’t believe this kind of insanity is possible in America anywhere. When I was in government grade school we took bic pens apart and shot actual spit wads at each other all the time. Although unsanitary, completely harmless. His were significantly more sanitary than ours. We would have gotten life in prison for the stunts we used to do in todays wussy climate. If this wasn’t so sad it would be funny as hell! Our society is completely lost I fear. I usually don’t like law suits, but in this case I hope this kid sues the school, sheriffs dept., the state and fed govt. for big bucks and all infractions removed from his record.
