Texas Could Soon Abolish Transgender MarriagesAUSTIN, Texas (AP) — Two years after Texas become one of the last states to allow transgendered people to use proof of their sex change to get a marriage license, Republican lawmakers are trying to roll back the clock.

Advocates for the transgendered say a proposal to bar transgendered people from getting married smacks of discrimination and would put their legally-granted marriages in danger of being nullified if challenged in court.

One of the Republican sponsors of the legislation said he’s simply trying to clean up the 2009 law in a state that bans same-sex marriage under the Constitution.

“The Texas Constitution,” Sen. Tommy Williams said, “clearly defines marriage between one man and one woman.”

The legislation by Williams, of Houston, and Rep. Lois Kolkhorst, of Brenham, would prohibit county and district clerks from using a court order recognizing a sex change as documentation to get married, effectively requiring the state to recognize a 1999 state appeals court decision that said in cases of marriage, gender is assigned at birth and sticks with a person throughout their life even if they have a sex change.

Most states allow transgendered people to get married using a court order that also allows them to change their driver’s license, experts said. Some advocates for the transgendered say the Texas proposal would not only prevent future transgendered marriages but also open up the possibility that any current marriage could be nullified.

“It appears the goal is to try to enshrine a really horrifying ruling and making it law in the state of Texas,” said John Nechman, a Houston attorney whose law firm does work for the gay, lesbian, bisexual and transgendered community.

Gov. Rick Perry’s spokesman Mark Miner said the governor never intended to allow transgendered people to get married. He said the three-word sex change provision was sneaked through on a larger piece of legislation Perry signed two years ago regarding marriage licensing rules for county and district clerks. Perry, a Republican, supports efforts to “clarify the unintended consequences” of that law, Miner said.

“The governor has always believed and advocated that marriage is between a man and a woman,” Miner said.

Williams said he understands that some people’s gender cannot easily be determined when they are born and they later have an operation that could change the originally assigned gender.

“It is an emotional issue,” Williams said. “I can appreciate that.”

But when asked about claims of discrimination, Williams insisted his goal is to simplify marriage licensing for clerks who are trying to balance the 2009 law with the 1999 Texas appeals court ruling.

“They shouldn’t have to resolve these issues,” Williams said. “We have confused them.”

Williams’ legislation has cleared a committee vote and now awaits approval by the full Senate, which is predominantly Republican. The version in the GOP-dominated House has not yet been given a hearing.

Some advocates for the transgendered say that even if the legislation is passed, transgendered people could still get marriage licenses using other state and federally-issued documents such as a drivers’ license or passport. But without the weight of a court order officially recognizing their gender reassignment, they worry any legal challenge, such as a divorce or estate dispute, would nullify the marriage.

“We want to be recognized as people. We want to have the same rights as all of you,” Lisa Scheps of the Transgender Education Network of Texas said at a March hearing on Williams’ bill. No one testified in favor of the legislation.

Kolkhorst, who authored the 2009 law that allowed the sex change documentation to be used in getting marriage licenses, did not respond to messages left at her office seeking comment on why she now wants to take it out.

The 2009 law originally was filed without the sex change document provision, but House records show Kolkhorst put it in as part of a lengthy amendment in the last month of the session. The changed legislation passed the House and Senate and Perry signed it into law a month later.

“It would be terrible for Texas, now that it finally caught up with the rest of the country, to take a step back,” said Shannon Minter, an attorney for the national Transgender Law and Policy Institute. He said most states allow marriages for people who have undergone sex reassignment surgery.

Nikki Araguz was at the Capitol last week to lobby against the legislation. Her husband, a volunteer firefighter, was killed in the line of duty in July 2010 and she is being sued by her dead husband’s family over control of his $600,000 estate.

Araguz had a final sex change operation in October 2008, two months after they were married, and says her husband knew and supported her. His family argues the marriage should be voided because Araguz was born a man and same-sex marriage is not legal in Texas. A hearing is scheduled for May 13.

“This is crazy. I feel like this is a personal attack on me,” Araguz told The Associated Press. “If this bill is passed, it essentially means women like myself who have had reconstructive surgery will not be allowed to marry their heterosexual partner.”

      It IS a medical condition and there is treatment for it. There is clear evidence on MRI scans and in genetic studies, and the treatment given to people who need it is close to 100% effective in followup. This ‘condition’ exists everywhere in the animal world were you find the two-sex dichotomy, due to the way that sexual differentiation occurs.

      All the BS’ing done by know-nothings on this site makes you all look like a bunch of ignorant rubes.

    I‘m more intrigued by Aguzo’s husband….what kind of man that is “hetero” wants a woman that used to be a man? That is some seriously screwed up logic…pretty sick and twisted person if you ask me. I personally don’t care what these freaks do, so long as it doesn’t impact me, my state, or my country on a financial or personal level.       You seem to think that people just want to change their sex at the drop of a hat. These folks feel as though they are trapped in the wrong body, they do not choose to be that way. You may very well live by, work with, or (gasp) have dated someone that used to be of the opposite sex and you would have no idea! With the advancements in technology these people do NOT look like transsexuals. Transsexuals, FYI enjoy dressing up as the opposite sex, but they are not necessarily gay. Gay people do not want to dress up as the opposite sex, nor do they want to be of the opposite sex. I’m as conservative as they come, but I feel that one should educate themselves on things they are unware or don’t understand otherwise you just sound like a redneck idiot.

    Ok here‘s the definitions for people who don’t understand all the term.

    Transgender is a huge catch-all category invented by the gay lobby to contain as many ‘strange’ behaviors as possible. It encompasses everyone from a crossdressing fetishist to the baby born intersex who was cut up by doctors at birth. There are drag queens, full time crossdressers, ‘genderqueer’, and all sorts of other things that get slapped with the same label. And the whole thing is complete BS.

    Yes, there are people born with intersex conditions and related biological phenomena. That does not give the gay lobby the right to use them for their own purpose, or to mischaracterize them as gay, or to wheedle their way into laws that were meant to help people who were suffering from bio conditions. And the whole purpose of creating this nonsense of “transgender” was to blur everything together so that it could be exploited politically.

    This business of thinking that bio-intersex conditions are the same as some guy who puts on his wifes dress once in awhile is absolutely insane.

    And the commenters here who just want to stir the pot and say stupid things do this site no favors. The staff of the Blaze is allowing leftist trolls and other troublemakers to make a laughingstock of this site and their work. It reflects very poorly on the people here and no, not all publicity is good publicity. More than one internet venture has been ruined by fear to moderate ‘free speech’ in the name of ratings.

    I enjoy the stories on this site for the most part. But if this sort of mob mentality is what things are going to be, then this site serves no purpose except to generate some small amount of ad revenue for the owners. If people simply want to gang up on those who are perceived as different and talk smack all day, then nothing good is going to come of this. You are just feeding into the leftist strategy of creating strife and destroying the remaining civility and dignity of this country.

    Beck got my attention with his examination of the root causes of our political issues. If this site is his only legacy, he has thrown away every bit of good he may have ever done.

      I agree and in my earlier statement I was not addressing biological maladies. People can suffer all sorts of anomalies and should be treated with compassion be it cancer, birth-defects or a chromosonal disorder. But that is a far cry from people who proclaim they are a woman locked in a man’s body!!! That is an metal disease and can be treated with proper (not religious!!) therapy.

    GOD did not say that one set of guidelines was for first CHRISTIANS, with later generations to follow different standards because “we would progress so much.” Actually, HE knew and knows that mankind does not change. We are sinners and without HIS GRACE and JESUS’ death for us on that cross so long ago on our behalf, we would be lost forever. The first century CHRISTIANS and the CHRISTIANS of today follow the same GOD and HIS same guidelines.

    Homosexuality is an abomination to GOD. Always has been. Always will be.

    Okay, first, Really? This is what we have to waste our time and money on right now? I hardly think there are enough “transgendered” marriages going on that this really should be an issue at all. First of all, posters here seem to be confusing transgendered with gay people or transexuals. Gay people will certianly NOT be banigng down the door trying to get a sex change operation in order to get married. Transgendered are people who have actually changed their sex from male to female or vise versa. I hardly think this really needs to take any more time or resources that should be used to deal with REAL issues…..

      Some people think that letting two consenting adults get married would somehow destroy the constitution of marriage. These are also the same people who think that America’s foundation is the family unit. Therefore letting two loving consenting adults marry would hurt America’s foundation. Also, because America was built on “Christian” values, and the bible doesn’t necessarily look fondly on alternative lifestyles, then it would hurt America in this way as well. But things change in 240ish years and some people reject change.

      What this does is to reverse the idiocy of legally recognizing a man as actually being a woman when he has undergone a “sex change” operation, and the same in cases of women. The legal fiction that surguries actually CHANGE a person’s sex is just that, a fiction. The biology reamins that same. This law affirms that such fictions have no bearing upon the legal requirements for marriage, between a real man and a real woman, regardless of how they may have outwardly altered their appearance or pretended to behave.

      Texas recognizes that a marriage is the fundamental unit to procreate children and since gays and gender switchers cannot do so, having them marry is a mockery of the most important institution in the world.
      A person’s gender is defined by their DNA. It’s that pesky Y chromosome thing. Mutilating the body and wearing a dress will not change that.
      In all other areas of life, when the mind and body disagree, we strongly encourage the mind to win out. If a man came to a psychiatrist proclaiming he was a horse and left with a prescription for a saddle, the doctor would surely be loose his license to practice medicine. So why do we accept that a person is of a gender in opposition to every living cell in their body? That is insanity!!

      These delusions are treatable just as homosexuality is treatable. Homosexuality arises when the pre-60 month child failed to adequately bond with the same sex parent, leaving a longing for male identification. Along comes puberty and the adolescent’s fascination with the same sex is translated into libidinous desire. If the child would have fully bonded with the same sex parent then at puberty, the adolescent would emulate the same sex parent and follow that‘s parent’s love for the opposite sex. Now maybe you understand why a proper family structure of a male and female does matter.

      I would agree that marriage is one of the most important institutions in the world; it is based on affection and trust, and it rears the future generation of thoughful, capable Americans to be the best they can be. What I don’t understand, though, is why transgenders are making a mockery of marriage more than..anyone else is. The divorce rate in America is 50%; Larry King has been married eight times; Kelsey Grammar ended his marriage over the phone; infidelity is still considered a generally redeemable offense. It is astonishing to me that THESE examples aren’t the reason a mockery is being made of marriage. It seems to me, personally, like in a world where trust and love is as rare as it is that we as a society should recognize the value of every powerful, lasting relationship that we can find.

      You can have children outside of marriage. Two married people can opt out of having kids. Barren women and sterile men can marry. Marriage doesn’t promote babies- fertile sex does.

      If two men love each other and want to proclaim that publicly and legally, let them. It’s no more or less problematic than straight marriages. Same process, same tax breaks, same health benefits. The only possible complaint is that YOU don’t like homosexuals. And that, I’m afraid, is your own failing.

      If you were truly compassionate the way Jesus would want, then you would happily attend a marriage ceremony for two consenting adults no matter WHO they were. Love is a wonderful, amazing thing. Any two people who find their ideal partner- regardless of gender, sexual orientation or anything else- should be honored.

      All this hatred and disgust really makes the religious seem petty and cruel at best, and considering the general political and governmental views of this board, hypocritical. You don’t want big government, except when you do. Taxpayer dollars are going to limit freedom, but you’re all for it this time.

      No we won’t. We still allow in-state tuition and state sponsored scholarships for illegal aliens. We SHOULD write stricter laws cracking down on illegal use of state welfare as well. But we won’t. Because people like Julian Castro (mayor of San Antonio) and is piece-of-garbage mother (she insulted the Alamo and said it was “racist”) would start a riot.

      As far as peoples’ sex goes, it is determined at birth- that is it. 200 years from now, when an anthropologist looks at your skeleton (if the world hasn’t descended into Mad Max times) the anthropologist will be able to tell what sex you are/were from birth. Not whatever pervy mutilations you enacted upon yourself. If they find any soft tissue, it will also be in your chromosomes.

I’d like to know if these same sex marriages or transgender marriages are done in China, the middle east, India, and other countries, or are Europe and the United States the only ones going done this path of destruction.

      Unbelievable! When Jesus walked the earth, He didn’t eat with the people who thought they were all that because He knew they could not receive because of their judgment. He ate with those that needed Him and were open to His Word. You may want to check what side you are on if you are judging others because of a medical condition that there is no real medical treatment for as of yet. Instead of condem them and judge them, why don’t you get down on your knees and pray for them and yourselves that God will reveal Himself to you and the love He has called us to live by.

      Amen! Unfortunately this thread of posters is the average sampling of cruel and hurtful responses that is common on this “news” site. It is very apparent to me that most of these people have never known anyone who had true biological gender confusion. I‘m curious how one of these individuals would explain to a human being that they don’t deserve the institution of marriage because they were born with insignificant and unusable male genitalia and then grew breasts when they hit puberty forcing them to choose the gender that they felt was appropriate for their life. I’ll wager if this comment is even noticed that someone will have some sort of sarcastic cruelty filled response on why this citizen of the United States should be denied their right to marry.

      Here‘s something for y’all to think about. I‘m sure we all agree that it’s obvious that men and women think differently. Turns out, there’s even a scientific explanation of that, as doctors have identified different structures in male vs female brains that cause them to work differently. When it comes to so called “transgender” people, it turns out that a few of the people that say they feel like they‘re a man stuck in a woman’s body, or vice versa, actually do have the brain structures to support it. Often they’re different in other ways too (like hormonal imbalances, etc). Some even have BOTH sets of chromosomes (i.e. two X and one Y). It’s pretty clear that there are some people that have some kind of birth defect with respect to gender. This should come as no surprise, since there are birth defects that happen in just about every other part of the body. How should the law apply to these kinds of people? Do we still only care about what’s in their pants? Do we go by their brain structure? I don’t have the answer – just something to think about.

      Funny, the law firm defending the Defense of Marriage Act has withdrawn from the case, but the Blaze fails to report it. Instead, they focus on the TX news, which is speculative and less important. If the SCOTUS overturns DOMA based upon Equal Protection guarantees, then it will not matter what TX does since the federal laws will trump the state rules. Amazing that the Blaze omitted such an important piece of news…

      @LoveNot: Medical condition? Try psychological. Indulging in unrealistic fantasies is not good therapy. Mutilation, however sterile and precise, in noway alters their sex. Xx/xy is strait-forward.
      Granted, a 1/million exception occurs, THEY deserve the exceptional considerations–Which are detracted from by the unrealistic masses.
