Texas Judge Sentences Honors Student Diane Tran to Jail for Missing School

A Texas judge threw an 11th-grade honors student in jail for repeatedly missing school in the hope that he could make an example of her.

Diane Tran, 17, works two jobs while taking dual-credit and advanced placement classes at Willis High School in Willis, Texas, KHOU-TV reported. Her parents divorced and moved away, leaving her to support an older brother at Texas A&M University and a baby sister who lives with relatives. She lives with the family of one of her employers, the owners of a wedding venue.

Tran told KHOU she doesn’t want to miss school, but is so exhausted sometimes that she can’t make it to her morning classes before attendance is taken. Other times she even ends up missing the day entirely.

“She goes from job to job, from school she stays up ’til 7 o’clock in the morning doing her homework,” Tran’s friend Devin Hill told the station.

Judge Lanny Moriarty warned Tran back in April not to miss any more school; when she missed again last week, he issued a summons and had her arrested in open court Wednesday. Tran was sentenced to a night in jail and ordered to pay a $100 fine.

“If you let one (truant student) run loose, what are you gonna’ do with the rest of ‘em? Let them go too?” Moriarty asked.

He admitted to KHOU after the fact that he didn‘t know the full circumstances of Tran’s situation. He said he might work to have the arrest removed from her record, where it would otherwise remain.

    As far as I’m concerned, if her grade point is above a B, she should be allowed to come and go at will. So much of class time is completely inane and a waste of time, if she can do the work on her own and learn the material, then leave her alone.

      You are exactly right.
      If my kids grades fall below a B they loose their weekends till it comes back up if below a C they are grounded till that comes up. However if they keep it B or above they don’t hear a peep out of me…including curfew.
      IMO if they are acting like responsible young people they should be treated as such.
      Also I was under the impression that if you are 16 or older you could drop out….how is it that this young lady was in violation of the law? 11th grade is above that age is it not?

      It all comes down to federal funding and warm bodies in seats. At ten absences, funding is cut. Grades don’t matter. My daughter had 11 absences in her 1st hour class, and she was told she couldn’t graduate. She also works to help with our tight money situation, often til 1am. The first hour class was art, which she had an A+ in. We had to go through two appeals before they agreed to let her graduate. She had B’s in all her other classes.

      ah but that is not the point. She is skipping valuable indoctrination time while she shows the world she can work two jobs maintain a great grade point average and take care of fellow siblings. We can’t let that get out now can we. She is an individual, self supporting, good grade getting, prove you can do it without government intervention person. Then the government gets involved and off to jail she goes. Why? Because we can’t have others thinking they can succeed with a lot of hard work and no government intervention. Why that just is not possible. Soon it won’t just be jail time. It will be off with their heads.

      I wasn’t thrown in jail, but in my junior year of high school I missed a lot of days of school because of illness but was maintaining A‘s and B’s in all of my classes and even stayed after school to make up time. I ended up getting sick towards the end of the year and missed a couple of more days and was forced to appeal so I could make up the time again the next semester. Even though I had all A’s and one B the entire semester, the county I lived in knocked off my credits earned for that semester and I ended up having to take an extra semester of high school (though I took an extra year to make up some classes I failed in my earlier for being lazy).

      They make examples of the kids who are having the most success to deter the kids who wouldn’t give a rats ass to begin with. It’s disgusting.

      I understand and agree with the Judge 100% regarding kids and keeping an eye one them…but I also think he’s lost his mind not applying a shred of common sense to this situation. Every case should be judged on it’s own merit. This girl should be commanded and held up as an example to the millions of useless delinquents out there. SHAME on that IDIOT judge !!!!!!!!!!!

      Judge issue an Arrest Warrant For the PARENTS for the abandonment of their Children. They need to be taken out behind the wood shed and taught you don’t shift your responsibility of YOUR children onto the shoulders of a 17 years old.

      So you have a judge that was found guilty of ethics violations punishing a young lady for working two jobs and missing a couple of classes while maintaining an honors grade point average. So is the example he’s making here having more to do with this young lady trying to make a life for herself and her family instead of going on welfare and relying on government assistance?

      I couldn’t disagree more.

      When you teach people that they are exempt from the rules because of they are better than other people, you foster the same mentality that is running our country into the crapper.

      I’ve benefited from rules like that in my life. I was smarter than everyone else, but I didn’t do the work. Guess what…being smart only gets you so far in life. Sooner or later you have to do the work and follow the same rules everyone else does.

      No one is so special that the rules don’t apply to them.

      Oh, as for the story…

      You have to learn in life when to ask for help. I still struggle with that one, and I bet she is learning it the hard way. She is putting more on her shoulders than she should be doing. Her older brother…what is he doing?

      With your train of thought is why our kids have run amuck. She needs parental guidance, she‘s 17 and shouldn’t be on her own. Judge should find her parents, no matter what state thei in and pop them in jail

      Good people that have the ability should help this young lady. Other good people should find her parents and throw them in jail. Further good people should DEMAND that the judge step down.

      Again, IF THE STORY IS COMPLETELY ACCURATE.

      I wouldnt have normally said that but I am not truly sure what stories to trust or not now adays. Glenn I hope you checked this.

      IF, IF ,IF, IF the story checks out the judge has no buisness being a judge making decisions that affect peoples lives forever without knowing everything that there is to know. I CALL THAT LAZY.A judge should have HONOR. If this story is real and 100% truthfull this judge has NO HONOR nor does he care nor does he have any common sense. He needs to be permanently stricken from the bar and ALL of his cases need to be reviewed. IF THE STORY IT TOTALLY ACCURATE.

      Walkabout, the difference is not genetic. It’s because Asian countries place a higher value on education than the US. Teachers, both in general and in advanced education are currently being demonized by the right, who are doing their best to reduce government support for education, while other countries throw their economic weight behind education as an investment in the future of their country. The right in this country say teachers make too much, they are indoctrinating our children with the theory of evolution, and not teaching enough religion.

      The US used to lead the world in the education of its own, but now education is viewed as area to cut costs to offset tax breaks for the rich. It‘s a sad direction we’re taking. Too bad so many in these country don’t associate education with American exceptionalism. I guess when we fall far enough behind other countries the stigma of getting an education will be become, instead, something we value as a country.

      @TOTO – You are absolutely correct. If the young woman is keeping her grades up, and we have to assume she is since she an honor student (although the article did not specify), it should not matter. Quite frankly for many very intelligent and hard working students, their time is better spent independently studying. Another commenter further down nailed it though when they said the school loses funding if they do not have warm bodies in the seats, and that’s really what the schools care about. This young woman seems motivated and smart. She should homeschool herself. If that is not possible I’m sure there are other homeschooling parents in the area that would be willing to take her into their home classrooms. Public school is not where this hard working young woman needs to be. I hope she is able to get the record erased and wish her all the best.

      The abilities of this young woman are heroic. Her selflessness towards her family through hard work and dedication to maintain very good grades should be commended. She is a success story, not a criminal.
      If under the law there was room to mitigate this charge away, it should have been sought out. I do not approve of activist judges. I would hope that this law will be changed if indeed, the judge’s interpretation of the law is correct.

      I was reading these comments out loud, mostly the ones about missing the indoctrination, to my almost 13 year old. He said that‘s probably why she’s doing so great, missing that indoctrination.

      Asians may put more emphasis on education than America, but they also actually educate their children. That’s why they do better. Our government has been so interested in indoctrination into the left that they leave out the education, the reading, writing and arithmetic. I graduated in 1982 and didn’t see it so much. My highschool was on a college campus, and we were taught harder stuff than the regular school. I had a friend leave getting C’s from my school, and ended up with A’s from the public school. My husband has adopted sisters that are 20 years younger, and they watched movies in class. My son, during the last week of his school, has learned almost nothing. They’ve been watching movies all week, too. He reads books that have so much Spanish it has to have a Spanish Dictionary in the front so you can look up the meanings. Even his science teacher (conservative, wonder how he got in there) says their curriculum is very left leaning.

      Oh great seeing eyeball … to say the “right’ is trying to ruin the educational system is really not even close. We currently spend way more per child in our liberal government school system then any nation on the planet …. what do we have to show for it ….we are around 17th in the world, with high school kids in class with their pants down walkin aroundlike penguins.( I know, I work with them) The ‘right” want’s to CUT the stupidity not the education.
      Give me 2 years, no government and the complete coperation of every school; teaching creation/ Genesis and the book of Proverbs (and the theory of evolution will still be discussed), (I play fair), and I would give you everything I own ( currently living under a bridge), if there is not a measurable difference in grades and attitude. In fact you could take me out and shoot me! (just give me a chance to have my will made). Of course, parents are partly responsible, but guess which educational system they come from!

      This is about keeping the gravy train for government going and nothing more the school does not get full tuition for the student if they are not there enough, the school intern tells law enforcement, and then a judge is responsible for making sure the school gets its money. At no point should one be confused about the welfare of the kid, the parents responsibility or anything besides the money. A government of the government for the government by the government God bless America!!!!

      In the 1st article she mentioned that the Rep. was a Democrat.
      The 2nd article Madeline failed to mention that the elected official was a Republican.
      If you read the comments here most people are wondering why government is doing the things they do. I’m just pointing out it’s coming from both parties. What the 1st article mentioned here was about is irrelevant to the question of why Madeline chose not to include the party affiliation of this Judge.

      She has two jobs and two-more to support. She barely has time to eat and get to her next job or school. BUT what about her “older-brother”…Why isn’t he at a part-time job, also. If He is so “strapped-for-cash” why is he not on some form of scholorship to un-burden his only other working sister?? Many of my friends went to college/univ on their own dime. their parents could afford to “help” but each brother/sister(etc…) went to work including college and owed much-less comming out. Their parents were “out of the loop” entirely…they even used the “dorms” or small appartment near school and work. Some even didn’t have cars to support…bicycle, pubic-trans, or walking-fast.

      the rules, the rules do you hear me the rules. This is a judge that is a total AS# no common sense but totally prepared to make this gal bend to the rules of the zero tolerance police for non-conformity.
      Total garbage this judge needs to be removed from the bench. If this gal chooses not to get and education that‘s her business not anyone else’s. So sorry, the Constitution does not say an education is mandatory for all citizens. So back off.

      I suspect the school, being staffed primarily by liberal administrators, didn’t consider, her scholastic performance because they probably graduate students based on attendance not performance.

      What a sad comment on educators that they have zero tolerance for this exemplary self sufficient young lady.

      She should be hired by the school as a motivational speaker to replace a deadbeat principle.

This judge, whether Republican or Democrat made a really really stupid decision and it had nothing to do with his political affiliation. Could you please feign outrage at something more important?       I guess I need to be clear. In one story it was Germane to the story what the Political Party affiliation of the person was. In the other Story about the Judge the Political Affiliation if any was not Germane to the Story. Hope that fully answers your question.

      An elected politician, city, county, state, or federal, is by definition, political. A judge, by definition, is ‘supposed’ to be apolitical. Therefore, as stated earlier, the judges political affiliation is not, nor should be, ‘germaine’ to the story.

      Unless, of course, I missed something. Perhaps you could point where political persuasion makes the difference in this young womans story.

      This child is making the best of a horrible situation, instead of putting her in Jail, the court should be looking for ways to help her and her family until she graduates. The fact that she is maintaining good grades without dropping out is commendable. This judge is wrong, the decision should be appealed.

      Unfortunately, that is not the law in Texas. I think most states have some sort of truancy law. How serious they are about enforcing it is another story. Here in Texas funding, that buys equipment, supplies, technology and pays the (pitiful) salaries of teachers come from that funding. It’s especially hard on poor districts and we have many poor districts. Truancy among some minority populations hurts, too. If a minority population is small then you don’t have to have much truancy to raise a red flag and wave it in the face of the the state.

      As for the legal age to drop out, it varies I suppose, by state, but in Texas you cannot not “officially” drop out until you’re 18th birthday.

      I got slammed on Huffington Post, but I was in public education in Texas for 30 plus years and I’ve heard all the hard luck stories. There is more to this than meets the eye…on both sides perhaps, but we aren’t getting all the facts. This girl should neither be supporting a younger sibling or an older one. The younger one is with relatives and they took on the burden so they should be the ones supporting her, not her teenaged sister. As for the one at Texas A&M, he/she should be supporting himselfherself and to foist that responsibility on this girl is abuse, IMO. With that being said, is that the REAL story? Or is it her story to get her neck out of the noose for attendance? I’m telling you something is fishy. And if the judge didn’t know all the facts he should

      This is outragous .. if she is not flunking out and working hard .. it should not matter if she shows up all the time .. perhaps a corresponse school would be a better fit .. sounds like she is a fine young woman working hard for herself AND others.

      Yep, this is not justice. The education system is going into ashes to raise as a phoenix into something new, a paradigm shift once and for all. This student should be allowed a packet course or small group night school to not interfere with her productive lifestyle. So what does our system do? The exact opposite and punishes. If I am not mistaken this is someone covering their reputation. It’s never about the genuine student and it never is. This needs to change.

    Calm down, folks. Did you catch the last sentence? One wrong opinion does not override everything this judge has done. You’re rushing to judgment in a similar way as the left did with Trayvon. Do you have all the facts? Do you know this man’s character?

    You may want to reserve the judgment until you have more facts. It‘s possible that the overloaded court system didn’t allow the JP to actually know her entire history.

      The Judge probably sees more of these cases than he should and the girl likely didn’t fully comprehend the implications to volunteer the information. We just don’t know the whole story. Whether from the pressure the media is putting on it or by merely his own ethical standards, I’m guessing he will work to remove the arrest from her record.

      Again, it is prudent to wait for more facts. Or are we all now “drive-by media?

      Tran no doubt has a sad story and didn’t deserve jail time. This was her second time before the judge. As per the last sentence, the judge didn’t know her story. For the number of truancy violations he has likely seen, it would likely take a lot of time to understand every single truants story. In all likelihood, the judge was too severe in this case. So, he deserves condemnation and removal from the bench post-haste. Regardless of whatever good he may have ever done we, in internetland, have determined his possible mistake should cost him his career. Off with his head!

However, that isn’t how the system is currently set-up or the young lady would never have been before the JP. The government has far too much over-reach and involvement in our daily lives. This judge should not be made the example of all things wrong with our government anymore. If he is exposed as being unusually harsh throughout his career, then fine. But if this is an unusual occurrence, then I am quite sure he will make it right for Ms. Tran. Either way, we do not have all the facts from this story.

    42 USC 1971 – Sec. 1971. Voting rights

    (b) Intimidation, threats, or coercion No person, whether acting under color of law or otherwise, shall intimidate, threaten, coerce, or attempt to intimidate, threaten, or coerce any other person for the purpose of interfering with the right of such other person to vote or to vote as he may choose, or of causing such other person to vote for, or not to vote for, any candidate for the office of President, Vice President, presidential elector, Member of the Senate, or Member of the House of Representatives, Delegates or Commissioners from the Territories or possessions, at any general, special, or primary election held solely or in part for the purpose of selecting or electing any such candidate.

    This means that delegates cannot be bound to vote for any candidate for the nomination for President, Vice President, etc….

    Rule 38 adheres to this Federal Law. There WILL be over 1144 Paul supporters as delegates at the convention and they will ALL vote for Paul on the first round. Federal law trumps any state law.

    Ron Paul 2012!

      Our system was set up so that an underdog could be victorious over a rich candidate that can buy the vote, and do not think votes are not being bought. Some people do not belong in places where decisions should be made. They have no sense of justice and rely on politicians to lead them, when most of these are dumb as dirt.

    The people who put this girl in jail belongs there themselves. They could have found better ways to ease her burden. She is an honor student, or so it says. They should stay out of her business if they nothing to contribute to her cause. She is doing her job. She may not need to be in school so they can plan their pink slime lunches.     So let me get this straight. Here we have a smart, hard working, responsible girl who want’s to do the right thing but only has 24 hours in a day to do it all in. She is working to take care of her siblings while maintaining honor level grades. Yet she is late to class or misses a few classes and this clown of a judge sends her to jail and fines her? Let me guess, in this same school district there are probably multiple “students” who are members of gangs, frequently go weeks at a time without showing up to school, have failing grades, and have run-in’s with the law on a fairly frequent basis. These “students” however instead of getting jail time and a fine get welfare money, food stamps, government paid cell phones, free health care, and free legal council for every time they get caught committing a crime. No jail time, no fines just benefits. Yes, this country is upside down.

    This judge needs to be fired.

    Home school. My kids did it and were top of their classes in college. Especially this young lady, who obviously needs an award for her persistence and dedication. You have my support.     This judge needs to go to jai. People of Texas get him out of his position. We are living in difficult times and this girl is doing the best she can. Get the judge out and send him to jail for missuse of his powers.     He found out after the fact her reason for missing classes? Did it not occur to you to ask her beforehand why she missed school? Sometimes I wonder about our judges and their ability to critically think.

    Grant you she should not miss school, but I am a little vague why the parents were allowed to move away. At 17 she is a minor and a younger sibling living elsewhere – that is abandonment. They should be arrested?

    Um… I’m not familiar with Texa law on this matter, but don’t most states go after the parent(s) and/or custodian(s)? Judges can’t just make up law as they see fit. Yes, I read the parents moved away. So who is the adult here (other than the honor student)? Was the girl emancipated? Details are lacking…

Did mom & dad choose what car they take to move away and to “heck” with the “other-MINOR-stuff”? A “baby-sister” living with relatives? Guess this could be called the “new-norm”. Saw a clip about the gal that was investigating a school and most class rooms were empty of students, however, there was an early morning class that was “filled-to-the-brim“ because students ”loved the subject & this class“ and after this ”one” class was over…THEY WENT HOME!!! Strange things are happening and it just gets more unbelievable each day & each news report. My heart goes out to ALL of the youth in America. Sad.

I say conservative because she is giving all she has to make sure her brother and sister are taken care of, while trying to stay in school. the fact she is on the honor roll shows that she isn’t just blowing off school. There use to be such a thing called a hardship clause, where kids were expected to stay home and help out on the farm in times of need.       In this case it does. He ran on a conservative platform, the dictrict is ardently conservative, you can‘t win unless you’re anti-abortion etc etc. Sorry to burst your view of reality, but this guy is yours, you can’t blame liberals for this one. Own it!

    This judge is a moron and should be kicked off the bench, out the courthouse doors…and then beaten to a pulp.

    Damn cowards who can do whatever they want…kicking the crap out of them is the only justice you’ll ever get.

      Lets keep the violence out of this. However, was this just a one-time bad call by the judge or is this a pattern. If the latter, then getting him off the bench should suffice.

      You’re right of course. It just gets my blood boiling when dealing with judges and others in the same position of authority. There is literally nothing you can do to them while they are in office. They can issue warrants, summons all day long for whatever reason they want with no oversight. Try to fight them and they’ll have you arrested for contempt, held without bail as often as they want, for as long as they want.
