Texting Woman Who Walked Into Fountain Criticizes Mall Security

Cathy Cruz Marrero has received a lot of unwanted attention after a security camera caught the Pennsylvania woman tumbling into a decorative fountain. Marrero says she was deep in concentration writing a text message when she plunged into the water at the Berkshire Mall where she works. We told you about her story in this post yesterday.

“I saw the water coming at me, I could see the pennies and nickels at the bottom of the fountain and then I was in it,” Marrero, 49, told the Reading Eagle.

The video evidence of Marrero’s momentary brain lapse was posted to YouTube and has received traffic from more than 1.6 million viewers so far.

All laughing aside, Marrero says she’s mortified by the incident and gets uncomfortable when talking about it.

“My issue is I don‘t think security was professional because they didn’t send anyone to check on me until 20 minutes later and I had already left,” she said Wednesday. “Instead of laughing, they should have said, ‘Is she OK?’ and been down there right away to check on me,” she said.

Since her accident, Marrero has recruited an attorney, James M. Polyak, to “conduct an investigation into what happened.”

“We are troubled by the fact that anyone at the Berkshire Mall responsible for releasing this video would find humor in an employee injured on the premises,” Polyak said. “We intend to hold the appropriate persons responsible. No one from that security office came to her aid in a timely manner.”

Marrero also says that texting and walking is “dangerous,” adding that she never texts while driving. “It’s funny, but you need to see the serious side of it,” she said. “What if it was a senior citizen? Would it be funny then?” She also warns that she could have hit her head, “especially if the fountain was empty, which it sometimes is for cleaning,” she added.

Marrero’s husband, Walter, says he offered to jump in the fountain himself to try to make her feel better. “I wanted to do that, stand up and say, ‘Hey, she‘s Fountain Girl and now I’m the Fountain Guy’ if it would make her feel better,” he said.

To add insult to injury, Marrero says the phone she dropped in the fountain worked after her fall, but was stolen over the weekend while she was at work. When she asked for video to see who left the store with her phone, security denied her request.

“It’s been a bad week,” she said.

Her parting advice: “Do not text and walk.”

      How about a federal law banning decorative fountains in malls. Remember that one can drown in 18 inches of water if impaired enough. Does texting while walking constitute impairment or just plain stupidity?

    Cmon lady, you were a walking, texting moron, through no one elses fault. Just roll with it and go dry off. Have you learned anything about texting and walking through this incident? Hint: if you can‘t walk and chew gum at the same time you probably shouldn’t be texting and walking at the same time. I will give you credit though, your bumble made me laugh for a few minutes while I watched the video 3 times, and a good laugh is important during these times of heated rhetoric and vitriole, changing a free republic to a psuedo-socialist state is tough work.

    That’s right…How dare they place that water fountain right in front of her!? Is this woman for real? If she was injured she sured fooled me> I never saw someone rebound that quickly in all my life after a fall like that. She didn’t even seem to break stride. Over she went, she bounced back up, make sure she went back down to retrieve her phone and then bolted! I am sure that she was embarrassed because you can’t hide the fact that you are soaking wet when you return to work after falling into the fountain. I felt sorry for her until I heard about her idiocy. Instead of threatening litigation because she was embarrassed maybe she should learn to laugh at herself and submit the video to AFV.

    A couple questions come to my mind over this article. First, did Ms. Marrero contact the lawyer or did the lawyer contact her? Second, seeing in the video that she immediately got to her feet and walked away, what grounds would the security drones have to think she had been injured? Hmmm, that brings up another question: what makes her think that she is so important that security is watching her at all?
    I wager that if she had lain in the water for more than a few seconds, or acted confused or injured, security and other people walking in the mall would have been right there to see if she was alright. And people wonder why it keeps getting more expensive to do business today.

      actually I think a man was cleaning in the area and he did ask her if she was ok, or at least he went over to her and she appears to indicate she is fine ….and then she left the building.

      How were they suspose to know that she worked in the mail. Is it stamped on her some place.

      Just a couple of things that came to my mind. However, the suing does not surprise me at all. Its the new get rich pass time these days. Better than the lotto.

      Hmm good idea. They should put up a sign WITH HER PICTURE saying “Caution, stupid woman fell into fountain while texting on 1/18/2011.”(or whatever the date)
      Maybe set up a small display and play the video on permanent loop instead of the picture. That should make everyone happy.

    Figures that she would sue for her own stupidity. Security could “see” that she was all right (not injured) because she got up and walked away, and “dear” if an elderly person would have been walking and texting and fell in, security would have been there if they didn’t get up, but it’s very unlikely that an elderly person would be texting in the first place – not many elderly persons ever text.

      This sounds like a job for…wait for it…..our one and only regulatory Czar, Cass Sunstein! People should be heavily fined and charged with a misdemeanor…walking while texting. Depending on the speed of the walker minimum punishment will be confiscation of all texting and walking equipment for 6 months….followed by 1 to 2 yeasr probation.

      and seriously how many seniors text? If they do, 90% of them can’t text and walk. Fox reported this morning that she is also under litigation for identity theft. While unrelated it demonstrates a pattern of less than desirable behavior.

      FYI – stupid is a dominate trait. Look around if you need proof.

      Yes security should have responded, but she did get up and walk away? And go over to a window.

      She is no better than a drunk falling down – reckless endangerment to herself and others.
      Get these idiots off the streets and out of the malls before they injury an innocent party.
      Maybe the malls should be padded for these people who text and walk.

      Reminds me of the guy who put his Motor Home on cruise control and went to make a sandwich. He sued the manufacturer for not putting on warning labels. He thought the Motorhome would drive itself while in cruise control….We are surrounded by idiots!

      Well she has gone from someone who had my sympathy to a money grubbing joke. People asked her if she needed help and she didn’t ask for any. What difference does it make who those people were, strangers or mall security? It didn’t become an issue until the lawyer got hold of her and, conveniently, her phone was stolen.       The doofus who fell in a fountain while texting in the Berkshire Mall has stepped forward. Her name is Cathy Cruz Marrero and she is so mortified and humiliated that she just had to grant an interview to a reporter at the local newspaper and have her picture taken, which the newspaper will then sell to you or emblazon it on a coffee mug. In fact, Cathy is so shaken that she already is all lawyered up and ready to sue the asses off the people who mocked her on the security tape and posted it on YouTube.

      Aside from this liberal development…
      the reason things like this happen is because of right-brain vs left-brain.
      When texting you are using the opposite side of your brain as opposed to alertness and awareness of surroundings and motor skills. To explain another way, I can play guitar and sing, but cannot play guitar and hold a conversation or talk, as the two activities are using opposite sides of the brain.
      THIS is why you cannot text and drive, and why you are setting yourself up for an accident.
      the information doesn’t pass between the two hemispheres very well, I am surprised some scientist hasn’t demonstrated this, it is not new, they have known the two sides are responsible for different actions and attributes for a while.

You fell down no fault but your own. No wonder Government thinks we are so stupid, they have to put silly labels on everything so we will be advised in advance not to be so stupid. I am sure the directions and safety precautions that come with the phone no doubt state “Do not text and walk at the same time as injury may result from running into objects, getting hit by a car, fallling down stairs etc and making a damn fool out of yourself.

      All joking aside, it sounds to me that she may have a case. YES she was stupid and negligent by not paying attention to what she was doing, but that doesn’t excuse security from doing their job to help her. I DO NOT think she is entitled money, but heads should roll (metaphically there, BECKISNUTS) in the security office of that mall.
