(Updated) That Wasn’t a Raccoon: Couple Shoots Female Intruder Initially Thought to be Animal

Shot Fired: Boulder Couple Hears Animal Outside Window That Turns Out to Be Female Intruder

When you hear a noise outside your window, it’s often safe to assume it is a nocturnal animal of some sort. That’s what a Boulder, Colo., couple initially thought, until the thing entered their bedroom.

The Denver CBS affiliate reports that the wife realized the intruder was not a raccoon when their bedroom door opened in the wee hours of Wednesday morning. They yelled and warned for the intruder to leave. When the person continued toward them, the husband fired a shot.

When the lights were flipped on, it revealed a woman unknown to them. The woman was hit in the thigh and taken to the hospital.

Police are investigating who the woman is and why she entered the home in the first place.

Interestingly, the Denver Post reports a nearby couple saying they have had a similar experience with a female intruder before, who they believed was intoxicated at the time but non-violent:

College Avenue neighbors Fanta Watson and Sergi Gomis said they had similar experiences when they lived near 11th Street and Baseline Road, when they didn’t lock their doors at night. One night they heard a loud noise in their living room, and when Gomis went downstairs to investigate, he said, he encountered a confused young woman who believed she was in her own home.

“This woman was dressed very nicely and she said, ‘We go way, way back. Why are you throwing me out?’” Gomis recalled. “She was really upset about it.”

According to the Post, it is yet to be determined if Colorado’s Make My Day Law will even need to be applied in this case:

Under Colorado’s Make My Day law, homeowners are allowed to use deadly force if a person enters their residence uninvited and either has committed a crime other than trespassing in the residence or intends to. Homeowners are also within their rights to use deadly force if they reasonably believe a trespassing person intends to use any measure of physical force on any occupant of the home, under the law.

Residents protected by the law are immune to criminal prosecution as well as civil liability, according to Boulder County District Attorney Stan Garnett.

Authorities are also still determining if any charges will need to be filed.

UPDATE:

The intruder is not believed to be a drunk college student who might have just stumbled into the wrong house and was too intoxicated to realize it or respond. The Denver Westword blog has more:

The featured players in a Boulder “Make My Day” shooting could hardly be more unlikely: Zoey Ripple, CU student and ultra-perky food blogger, and the pair of Timothy Justice and Doreen Orion, whose saga of traveling the country for a year in a “glorified tin can” is told in the book Queen of the Road.

Justice won’t be charged. But Ripple, who was ultra-drunk at the time of the incident, isn’t out of the woods yet.

Ripple, a CU student listed on the university’s website as majoring in speech, language and hearing sciences, is hardly a notorious scofflaw. The Camera discovered that she’d pleaded guilty to shoplifting in Broomfield in 2010, but her record was cleared after she successfully completed a deferred sentence. Her LinkedIn profile lists her as “Food and Beverage Intern Manager” at Columbine Country Club, and she’s also blogged about food for the website Bite Into Boulder. Her most recent review, a June 2011 analysis of Khow Thai, features lines like “Thai food is one of my absolute top favorite foods” and “So BEWARE, those who cannot handle the heat, stray from the items on the menu with chili peppers by their name!”

The presumption at this point is that Ripple was simply so out of it that she mistakenly wandered into the wrong house and was unable to respond to Justice before he sent a chunk of lead in her direction. But in a prepared statement shared by the Camera, Boulder District Attorney Stan Garnett also offered compassion to Orion, whose online bio describes her background as a psychiatrist and appearances on Good Morning America and the Discovery Channel, and Justice.

      What I want to know is if the couple didn’t know her, it probably means she is not a neighbor, how did she get there? If she is so drunk that she doesn’t know what house she is in, did she drive there? I say throw the book at her, before she kills someone

      This is exactly how it should go down.
      Someone enters your home you point a weapon at them and tell them to leave.
      One step more and they get shot in the Leg.
      One step after that and it becomes time to empty a clip into the center of mass.

      @ DISHEVEL WRONG. You can wind up very dead with that mind set. In this situation, if you tell a person to stop and they continue towards you, you place two to center mass. If that doesn’t stop them one to the ocular cavity. At 20 feet, it only takes one and a half seconds for a perp to be on you. Shooting to wound or a warning shot is the surest way to lose the fight. You decide – do you want to be the victor or the victim? These people were very lucky in the fact the intrusion was not a home invasion.

      They should have there guns taken away and put in jail. This woman wasn‘t hurting them and I didn’t see in the article where they warned her 3 times and fired a warning shot. This is what police have to do! In NYC, Chicago, Washing DC and Phillie they would already be in jail and charged with attemted murder.

      Just like every other story written by the Denver Post its an editorial in disguise. This one is against the castle laws and they use a non-sequitur of a harmless women that at one time entered someone else’s home which may or may not have ever happened to make it seem as if the victims in this story took extreme action that was unwarranted. Reporting like this is the reason the Rocky Mountain News is gone.
      The Post will soon follow in its footsteps.

      Nice setup by the post with the tease story released first and the blaze readers like me taking the bait. Then Doh! what do you know the post updates the story a few hours later and their speculation was right on the money. Well duh I guess we just need to go ahead and take away ever homeowners right to defend themselves inside their house in the middle of the night. They are so clever.

      You are SOOO correct. These folks should have waited until the UNKNOWN INTRUDER was at their bedside with the muzzle of their own gun next to their temple. She‘s lucky that he didn’t shoot to kill.
      But I’ll tell you what. You give me your address and I‘ll make sure you get nightly visits from all kinds of ’folks’ wandering into your house refusing to ID themselves and you can use your telepathic skills to see what their real intentions are. We‘ll just see how fast you determine it’s time to get a gun for the protection of you and your family.
      But wait! you’re a lib, right? Well shucks, my bad.       @Dishevel I see your logic but I have to strongly disagree. Firstly: There are no warning shots or “shoot to Injure” this is flawed logic that will get you killed in this situation. If a terrorist is in your home and is a threat (meaning they do not leave after a verbal) you have an obligation to subdue that terrorist until they are nolonger a threat. google ballistics of any home defense caliber 9mm, .38/.357, .40, .45, .223/5.56 etc and have fun. But please realize that a bullet passing through tissue will leave the reciever with a relativly small hole that may not stop a threat with 1 bullet.
      Secondly: With the mindset to “Wound” the terrorist, you are left open to civil if not criminal prosecution putting you both in jail because the jury will find that by “shooting to wound” you were not in “immediate” grave danger.
      I am not advocating that we all shoot to kill for the sake of. A human life is precious. However the moment a terrorist breaks into someone’s home and becomes a threat, the terrorist’s life is deemed less valuable than that of the rightful occupants.
      On a lesser note: Most every semi-auto firearm uses a MAGAZINE to store ammunition not clips.

      @Turkey…You’re an idiot. I hope that you are never in that situation but, I summize to believe you would assume the fetal position in a corner for the 20min+ for the police to arrive and if the terrorist finds you first, I pray the police don’t find you in a corner, lying in a pool of exc

    ~~~ What a stupid law. So if the trespasser has not committed a crime other than trespassing, you have to be able to read the trespassers mind in order to justifiably use deadly force. ~~~

      No brainer, of course they should be allowed to take action against an intruder who is INSIDE their home. However, not even a remote comparison to the Zimmerman – Martin situation. One where Zimmerman an adult followed, confronted, fought with, shot and killed a KID.

      It is not illegal to follow someone (and a 911 dispatcher is a glorified secretary so they have no authority). It is not known if Zimmerman touched Martin. He says he didn’t and no evidence has come forward to prove that he did. In America you are inocent until PROVEN guilty. I know you commies would like to change that. You were not there, no one knows who made physical contact. The person who made PHYSICAL contact is the one who broke the law. ANd if Martin made PHYSICAL contact with Zimmerman (I don’t care what he was doing or even if he called his momma a name), than under the law Zimmerman is justified in using whatever force he needs to, to defend his person from an assult. Quit trying to spin that case into something it isn’t

At no point did I say Zimmerman was guilty, but you are completely incorrect that a self appointed neighborhood watch whimp has the authority to follow and confront a private citizen walking down the street. There is no indication that Martin initiated any confrontation, so yes logic would tell you that Zimmerman initiated contact. And the next time you come down from the Mountain, take the time to learn what battery means. Zimmerman is not within his rights to confront, question or undertake threatening action. You also cannot claim stand your ground in a situation you initiated unless your LIFE is truly threatened. All we know to this point is a 28 yr. old adult who outweighed a 17 year old KID by 70 lbs initiated something and when the KID started kicking his ass, he shot him. Yes let’s wait for the verdict. But of course if it doesn’t fit you narrow minded narrative, the jury will of course be commies.

      @JROOK just a few things to clear up your post, 1) Z was not self appointed, im not sure why everyone thinks and keeps saying that, the community appointed him. 2) even if Z confronted M first, once Z was on the receiving end of a beating, deadly force is fully justified under floridia law, ask a lawyer or look it up yourself.

      @Samps The record indicates he self appointed himself that night as he wasn’t scheduled. And yes you are correct that you can utilize deadly force if the individual goes behind defending themselves. Which of course is at best a judgement call and would require witnesses who can speak about the entire confrontation not just the point at which they heard screams. While some outlets have tried to depict Zimmerman as having serious injuries, I’m not sure a “broken” nose (looked more like a bloody nose) and a few superficial scraps on the head would cross the threshold of excessive response by Martin. The difficulty of course is the only one who knows what transpired between the time Zimmerman left his car and approached Martin and shooting him. I personally think the 2nd. degree murder charge is either a gift in that it can’t be proven and may lead to an acquittal, or an attempt to push for a plea bargain. Zimmerman may be sacrificed to protect a wider review of the SUG law. Hard to tell.

      If you had bothered to read the police and corner report, you would have noticed that the “kid” as you called him was over 150 pounds. Throughout history, that person would be a fighter on the front lines. Learn your history and apply common sense before you post as it appears that you are a person that listens but does not hear, a person that looks but does not see, and does not realize that it’s easy to grow old but difficult to grow up.

    They will investigate forever. This is The Republic Of Boulder Colorado. Progressive police force used to investigating burning couches at fraternity houses. A Gun in the county and especially one that is loaded will be punished if not in court it will be punished in the court of public opinion.

      You didn’t read the sentence right. they haven’t determined that the “make my day” law even Needs to be used. Which means they aren’t expected to file any charges, but if they need to they can invoke the “make my day” rule.

      In other words they will not be prosecuted in either case

      She will most likely sue the owners of the home for every penny they have and win. Most cops tell you that if you have in intruder, shoot to kill, not wound. Many criminals have won lawsuits because they were injured breaking into a home.

      The law in Illinois, not Chicago, is if they break into your home and enter your bedroom then you have the right to use deadly force to defend yourself. The act of entering your bedroom by itself is justification. You are not required to give any type of warning and it doesn’t matter if they threaten you or have a visible weapon.

    I bet she stops pulling the drunk home invader act now. A bullet through your thigh might have that effect. But seriously, she is lucky that she didn’t do that in my home. I wouldn’t have aimed for or hit her thigh. I’ve got years of training that tells me two in the chest and one in the head all the time. You don’t fire a gun with the intent to wound. You fire it with the intent to kill and you do it.

    Why did the camera focus on the address? Absurd!. Just going to be problematic for home owner/gun owner.

    I’ll bet this woman goes into these homes all the time, steals a little and leaves. When she is caught she “acts” drunk. She is stealing stuff the people won’t miss or think they misplaced / lost.
