Dems & Media Imply Romney May Have Committed a Felony    But Whats the Full Story?Talking points are becoming more personal, campaign rhetoric is heating up, and political operatives are pulling out the big guns. But what do you expect when we’re only a few months away from Election Day?

Of course things are going to get ugly!

The Obama campaign, for example, has accused former Massachusetts Gov. Mitt Romney of being an “outsourcer-in-chief” and the Romney campaign has responded by calling the president a “liar.”

But let’s focus on this whole “outsourcer-in-chief” thing because (as we had great fun watching the other night) the president’s supporters are hell-bent on making this a major campaign issue.

Now, it’s important to note that the “outsourcer” accusation has already been debunked by Factcheck.org and The Washington Post.

Romney stepped down from managing Bain in 1999 to do the Salt Lake City Olympics. From there, he went on to become Governor of Massachusetts. The outsourcing that the Obama campaign blames Romney for occurred after he had finished managing the company.

If he wasn’t managing Bain, he wasn’t outsourcing. So this shouldn’t be a talking point, right? Well, remember when we said the president’s supporters are hell-bent on making this an issue? Yeah, we meant that.

The Boston Globe, a paper that has mostly ignored Massachusetts senatorial candidate Elizabeth Warren’s laugh-out-loud “fauxcohantas” problem, has uncovered documents that, they say, suggest Romney may have actively managed Bain after ‘99.

“Government documents filed by Mitt Romney and Bain Capital say Romney remained chief executive and chairman of the firm three years beyond the date he said he ceded control, even creating five new investment partnerships during that time,” Callum Borchers and Christopher Rowland report for the Boston Globe.

“Also, a Massachusetts financial disclosure form Romney filed in 2003 states that he still owned 100 percent of Bain Capital in 2002. And Romney’s state financial disclosure forms indicate he earned at least $100,000 as a Bain ‘executive’ in 2001 and 2002, separate from investment earnings,” the report adds, implying that that Romney could have made managerial decisions during Bain’s outsourcing period.

If the Globe can prove this, then the Obama campaign can really go after Romney for “betting against America”! But do the SEC documents prove he was actively managing the company?

“You can’t say statements filed with the SEC are meaningless. This is a fact in an SEC filing,” former SEC commissioner Roberta S. Karmel told the Globe reporters.

“It doesn’t make a whole lot of sense to say he was technically in charge on paper but he had nothing to do with Bain’s operations,” she added. “Was he getting paid? He’s the sole stockholder. Are you telling me he owned the company but had no say in its investments?”

Okay, so let‘s pretend the Globe and other news outlets are correct when they say Romney was involved in Bain’s day-to-day functions after February 1999. What then? Well, as Factcheck.org points out, he’d be guilty of a federal felony for having certified otherwise on federal financial disclosure forms.

“If someone invested with Bain Capital because they believed Mitt Romney was a great fund manager, and it turns out he wasn’t really doing anything, that could be considered a misrepresentation to the investor,’’ Karmel said.

Obama deputy campaign manager Stephanie Cutter was more blunt in her assessment.

Either Romney was “misrepresenting his position” at Bain to the SEC, “which is a felony,“ or he was ”misrepresenting his position at Bain to the American people,” she said during a conference call Thursday morning.

“If that’s the case, if he was lying to the American people, that’s a real character and trust issue,” she added.

Not so fast. As it turns out, documents recently obtained by Fortune show that, if anything, the Globe article is simply a poorly researched hit piece.

First, “offering documents for a Bain Capital Fund circulating in June 2000, as well as a fund in 2001,” do no list Romney as being among the “key investment professionals,” the Washington Post’s Fact Checker [again!] notes.

Simply put, the “contemporaneous Bain documents show that Romney was indeed telling the truth about no longer having operational input at Bain — which, one should note, is different from no longer having legal or financial ties to the firm,” Fortune adds.

Second, Romney never said he cleaned out his desk, shook the Bain dust from his feet, and never, ever looked back. He said he no longer called the shots after he stepped down in ‘99. The only thing the Globe’s recently-uncovered documents prove is that he still had ties to a company he helped build.

Third, there’s this statement and explanation from Bain Capital itself:

Mitt Romney left Bain Capital in February 1999 to run the Olympics and has had absolutely no involvement with the management or investment activities of the firm or with any of its portfolio companies since the day of his departure.

Due to the sudden nature of Mr. Romney’s departure, he remained the sole stockholder for a time while formal ownership was being documented and transferred to the group of partners who took over management of the firm in 1999.

Accordingly, Mr. Romney was reported in various capacities on SEC filings during this period.

Fourth, there’s this rebuttal from Factcheck.org [via POLITICO]:

We see little new in the Globe piece. So far nobody has shown that Romney was actually managing Bain (even part-time) during his time at the Olympics, or that he was anything but a passive, absentee owner during that time, as both Romney and Bain have long said.

… in our considered judgment, nothing in the Globe story directly contradicts Romney’s statements — which he has certified as true under pain of federal prosecution — that he “has not had any active role” with Bain or “been involved in the operations’ of Bain since then.”

Lastly, and here’s the kicker, the two Globe reporters fail to mention that the former SEC commissioner they cite as an authority on the subject also happens to be a regular contributor to Democrats.

Seems like a pretty important detail, doesn’t it?

Final thought: Did these reporters really think no one would challenge their article? Considering that we live in an age of instant communication and high-tech research tools, figuring out whether someone (let alone a man running for president) has committed a felony by lying to the SEC isn’t going to be that difficult. Indeed, as of this writing, the Globe’s entire report has been thoroughly debunked and their narrative has been shot to pieces.

      I can remember when many of us said we would rather vote for the dog catcher rather than this so called “brilliant” community organizer who was blatant in Fundamentally Changing We Americans. Now have we changed? Yes, we have. No one trusts anyone, well we all know now how he did it pretending to be our savior (of sorts). As always there are two choices to put in office. I for one have not changed my mind since Joe the Plumber was made a scapegoat for simply asking a potential president a question. I can NEVER recall an American citizen treated like that. EVER.       Mitt is a proven liar and he is going down in flames. So either he has lied to the SEC or he lied to the American people.

      He was listed as the sole stockholder, chairman of the board, chief executive officer, and president for 3 years after he claims to have left (which Bain claims was part time). Sounds like a certain Mormon’s nose is growing. Of course if Romney followed his father’s example and released more than 1 year of tax returns he could clear this up, unless he is hiding something.

      All of you have the freedom at this point in time to vote for anyone you want. It is a federal law that nobody, even state governments and parties, can tell you who to or not to vote for. You should make your vote based on the information at hand in order to put the most honest, Constitutionally sound candidate into the office of POTUS. Since we all know that Obama is definately not that, we have to look at Romney and Paul and decide, who is most electable? I say Paul as I know from information received, that Paul supporters are not going to vote for Romney because of the felony election fraud perpetrated along with violation of federal law by state GOP. I know that a lot of Democrats would vote for Paul from information received, and I know they will not vote for Romney, they will hold their nose for Obama (sounds familiar doesn’t it Republicans?). I know from information received that the youth, who helped to get Obama elected, will not vote for Romney, but would vote for Paul.
      I will make an informed decision and will not vote for Romney, but for Paul , if I have to write his name in, and I will try to get as many people as I can to do the same.

      @WestCoastPatriot I just cannot close it out after reading your other comment which really is an education in itself–about how you have “information received twice” about voters for Paul so I apologize. Mr. Paul is living in my state but he is from Pennsylvania so he probably read the Constitution up close and personal.and poor old me I only have my pocket Constitution from Freedom Works. Still as you say (thank you for that info) we do have the freedom to vote for who (or is it whom) we wish and every vote will have to count to beat Obama. Do you honestly believe that Paul has a snowballs chance in hell? Nope, sorry. By the way no rancor here but I have that freedom to state my opinion and when you write in your vote and all the other info you received do as well bear in mind you have just voted for Obama. I don’t hold it against you. By the way and beside the point but I do like Rand Paul. I hope Romney chooses Rubio the R&R suits me and maybe many voters to cancel your choice.     Our President has out sourced our lives with the horrible healthcare bill as it is as such. He says some people must pay insurance for those that do not want to, The AJ has also out sourced our lives saying their are some that do not have to prove citizenship to vote but we who are honest citizens must show ID’s sometimes on a daily bases. There has always been help for those that have had no control over their health problems and their is always transportation for those that need to get somewhere to vote. .. Vote as if your livelihood depend on it because it does in November.

      Exactly. In my lifetime this country has passed the unbelief test of all time. Never would I have ever dreamed that this is what my children and their’s would have to deal with or I think I would possibly have not had children but then again our forebearers faced hard times really hard and I can look back and feel for them. How awful it must have been. No matter the accusations on Romney he could be replaced. The difference is I doubt Obama could or we‘d have a choice again but and here’s the rub—if I believe in God and providence and I do then all I have to do is remember Ramses.Or Ahab and Jezebel.     The Obama campaign is becoming more and more desperate daily. Yesterday evening it was that Romney intentionally went to be booed at the NAALCP so he could sew up the “racist voting block”, now his surrogates in the media accuse him of being a felon without so much as a single stitch of evidence. In fact, the evidence goes against them. I want to make it clear I’m not a Romney supporter, but this is liable plain and simple. I think malice would be provable in court. He should sue the paper and these two “reporters” personally in Federal court.

    Mitt Romney might have managed a company illegally in 1990 — but it’s just FINE for Obama to have NO Birth Certificate – No Congressional Approval to go to war – No basis for 90% of the appointments – Bypasses the constitution regularly – and Obamacare didn‘t originate in the House therefor it’s not legal – but that only affects EVERYBODY — shall I go on?

You think that if a person says something bad about Republicans, they are automatically liberal. That is called being closed minded. I have been a Republican all my life (36 years), but I have also seen my party crumble into a more leftist ideology and since I am Conservative, I now consider myself a Conservative Libertarian (kinda like Reagan). So get off you holier than though leftist Republican mindset.

What the hell does that mean in the context of this argument? On any given day I would never be holier than thou, if I were I would not be a Christian. Who has to discipline herself constantly. I have criticised many Republicans including my Senator Kaye Bailey Hutchinson pro choice Lindsey Graham John McCain who I did not vote for but Sarah Palin I did I can name many but some I like Darrell Issa and the new kids on the block. Also I consider myself a Ronald Reagan supporter as well. That is why I voted for him. Duh! Smaller government and I wish it were like it used to be—It ain’t but the subject is if you have not noticed about Romney and it is clear whether you like it or not that it is a two party system. My candidate I supported in the primaries didn’t cut it with the people and I had a 2nd choice and neither was my governor but now I wish it had been. We have Romney and Obama. Do I take offense when the only candidates that will count on the ballot are those two and one is being “accused”? Yep. You and I are on the same page but it just is not going to be Ron Paul. R&R I hope
