‘They Can’t Imprison All of Us’: Baptist College Vows to Resist Obamacare and Department of Justice

For the Obama administration, defending the Affordable Care Act, aka Obamacare, looks like it may be becoming a game of legal whack-a-mole. One mandate gets declared constitutional, only to have another potentially problematic one spring up.

In this case, the mandate that’s involved is the mandate that employers provide contraception coverage for their employees. That mandate, released long before the first decision declared Obamacare’s mandate legal as a tax, has sparked more than a little resistance from the Catholic Church. And now, it has a lawsuit pending from one small but tenacious Baptist liberal arts college. From Fox News’ Todd Starnes:

 The president of Louisiana College said his school’s lawsuit against ObamaCare will go forward and vowed to defy the law even if the courts rule in favor of the Obama administration.

“If the government continues to say that we have to do this, we will not do it,” President Joe Aguillard told Fox News. “There’s going to be, in my opinion, a constitutional crisis. We’re not going to do it.”

Louisiana College, affiliated with the Southern Baptist Convention, filed suit against the federal government in February. They believe the administration’s mandate that religious employers provide abortion-inducing drugs, sterilization and contraception is unconstitutional.[...]

Aguillard said even if the courts rule against the college, there is no way they will comply with the law.

“I guess President Obama will have to come down to Louisiana College with whatever means they want to stop us,” he said. “We are going to have, as we say in French, a tete-a-tete.”

Aguillard said the battle with the federal government has united the 106-year-old college.

“They can’t imprison all of us,” he said. “They can’t fight all of us. We are greater than the Dept. of Justice.”

Louisiana College is not the only school to have done this. The evangelical Wheaton College has joined a similar lawsuit.

So would an entire college refusing to comply with the Federal government be, as Aguillard suggests, a constitutional crisis? Probably not, largely because constitutional crises tend to involve particular branches of government taking each other on, rather than private entities taking the government on. However, it would be a law enforcement crisis, and would probably produce highly damaging optics for the government. We can only imagine the kind of lurid coverage one could get out of seeing random college administrators being shoved into vans. However, based on previous precedent, it would be more likely to force the administration to issue waivers for the contraception mandate, not retract it for everyone.

Still, it’s an encouraging story for those who support religious freedom in this country.

    The only real criminals in obama’s mind are Christians. Any Christian who votes for obama is voting for the oppression of our religion. He will go after Christians with every bit of power he has, to make an example. If he had an arena and some lions, he would enjoy the show.

      100% agreement. Nobama is going to declare martial law. Make no mistake about that. He will suspend the election,and he will open the way for sharia law here in our Country. Our only hope is that Yahweh God will intervene. I fear He has turned his face away from us. It is said a people get the government they deserve. Look around and it does look like with nobama we have gotten what we deserve. When good men and women do nothing good, and they have not, we wind up losing our Country to tyranny.

      It would seem that if Reagan could use Federal Transportation Funding to strong arm states into adopting the 21 year old drinking age, then any and all federal funding (student loans) should be removed for non-compliance. And if the recent Courts decision regarding withholding of Medicaid funding is unconstitutional than Reagan’s move was similarly unconstitutional. The Federal government using money to get foreign countries, states and local governments to comply with their policies, laws and regulations goes back a long time.

      Amen, Cosmic Dogma, Amen! I pray that I too will have the strength of the early martyrs when the b@st@rds come to take me off to the Colisseum. (I guess nowadays Christians will be taken off to the Super Dome and fed to the lions as part of the Half-time show!) I wish my Church, the Church of Jesus Christ of Latter-Day Saints, had as much backbone as the Baptists in this story. (I never thought that I would ever be saying that.) But my Church is so wimpy that we won’t even admit that all of the recent Church building fires (The count is now upwards five buildings!) were acts of arson by the shhh! –homosexuals– shhh! I am sure that our fearless leaders are just trying to avoid the “awful” consequences that would inevitably result if us backwards-@ss-farmers here in Utah ever caught wise to the fact that the LBGT community didn’t like us!

      Seriously, I don’t really know about what the Brethren are so worried if us lowlife-redneck-regular-white-guy-Mormons would do if we ever found out the TRUTH. I guess the LDS Church Leadership must be worried that we might BOYCOTT MUSICAL THEATER or some other such bigotted atrocity if we ever knew the TRUTH!!!

      Ever since I was a kid, my favorite characters in the Bible were always Daniel, Shadrach, Meshach, and Abednego. About 8 years ago, I started reading about the Von Trapps (the Sound of Music family), fearing that we were headed in that direction. A couple of years ago, I read Foxe’s Book of Martyrs, fearing that we could go beyond the Von Trapps to 1st century style martyrdom.

      While I still hope to leave this world via the Rapture, the possibility seems there that I may end up being killed by people controlled by the forces of darkness because of my belief in the Lord. All I hope for is if that time comes, I’ll be able to stand strong and not deny the Lord. I also hope that if it does happen, that perhaps someone would be moved to repent as a result. That’s what happened in the first centuries of Christianity. I remember in one case, the Romans would watch the Christians die with just peacefulness, that many converted on the spot to Christianity, and they volunteered to join their brothers and sisters on the arena floor, becoming martyrs themselves.

      Also, who decides what is “sin”? Your denomination might view something as “sin”, whereas another one doesn’t. Who is right? Who is wrong? Surely both sides can’t be right, but it is entirely possible that both sides are wrong.

      You take your personal walk with your savior, and try to force it on others and make it the law of the land.

      Your faith is no longer focused around your own salvation, but stopping others from living the life they want and then reaping the perceived punishment in the afterlife.

      You don’t want religious freedom, you want religious oppression over the people you disagree with.

    A Bunch of pastors showed up and blocked The doors when the state of Texas 1st tried to shut down Lester Roloff’s school for young girls and boys. State backed off for a while. one of they main reason’s the civil rights movement won was because it costing the cities and states to much money to house the people they arrest. Had them housed in a football stadium’s because they ran out of room in the jails.

      I’m not being disrespectful, but understand me here. When you use gov’t to make me participate in your system, because YOU THINK I have too much, or I need to SHARE more, or whatever, you are STEALING. Just because a majority of people decide something is OK, doesn’t mean it is. In this case, a majority DID NOT decide that. But even if they had it doesn’t matter. It is immoral to steal, no matter how justified you believe your cause. Especially when you are doing it in the name of “taking care of me.” My money is the result of my work. NO ONE ELSE’S, MINE. So by taking my money with force, against my will is either stealing or slavery. I don’t approve of any of this. I’m not being represented. The organized minority, constantly presented as a majority is running all over my God given (not gov’t given) supposedly gov’t protected right to keep what I busted my ass for in the name of taking care of the people. If every dollar I earn has 20% seized, whether for healthcare or Socialist security, then I am by definition at least a 20% slave to those receiving the benefit. Slavery is hardly charity. Just because you don‘t like how much someone has doesn’t make it right or moral. And using the might of gov‘t to take my money to give to old or infermed doesn’t make YOU charitable.

      Your statement that they are worse off is often an incorrect assumption. Besides where is it written that those who do what is right exist to support those who do not. The Bible admonishes one to avoid becoming a legal surety for others. Being compelled to give away one’s resources of time and money so others have more time to have children while they watch cable TV and talk on their “free” cell phones is oppressive. Why should we change and loose when they don’t have to?

      This small Baptist College will band with Catholic Churches, Other Baptist, Evangelicals etc. That will be a lot of people refusing to follow Obama’s mandate. Should be an interesting fall. Frankly, I believe they are doing the right thing and I support them.

    A drug that induces an abortion can not be prescribed by a doctor because no such drugs exist.

    There are old wives tales and different folk medicine procedures for inducing abortions but theyt are not a part of the medical services as covered under the Affordable Health Care Act.

    To suggest such a drug exists invalidates your entire argument.

    There is not a mandate that employers provide contraceptive services to their employees.

    You have made this up.
    They are protesting an imaginary concept.

    The rules implementing the Affordable Health Care Act state that a health care policy sold on the exchange must include contraceptive care. That’s it. Big Deal. It’s included in most policies sold now so this is not even a change. It is nothing new.

      No way can they arrest us all. Whats is the percentage of police officers in a town, any town. They are a miniscule group compared to all the people. If the churches support the colleges, then you are talking about a ton of people. Also, they don’t have the jail space (they have already filled them up by not executing people for capital crimes).

      If SCOTUS rules that the government CAN rule over religious freedom, I think you will be seeing a lot more trouble from that than Obamacare.
